Hatta yaln\u0131zca alelade ve s\u0131radan bir hak de\u011fil, Anayasal d\u00fczeyde kabul edilmi\u015f olan ve temel hak ve h\u00fcrriyetler kapsam\u0131nda yer alan \u00e7ok \u00f6nemli bir hakt\u0131r.<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc hakk\u0131, 1982 Anayasas\u0131n\u0131n (AY) Temel Hak ve \u00d6devler ba\u015fl\u0131kl\u0131 ikinci k\u0131sm\u0131n\u0131n Ki\u015finin Haklar\u0131 ve \u00d6devleri ba\u015fl\u0131kl\u0131 ikinci b\u00f6l\u00fcm\u00fcnde yer alan 34. madde ile d\u00fczenleme alan\u0131 bulmaktad\u0131r. Madde, Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131 ba\u015fl\u0131\u011f\u0131 ile kar\u015f\u0131m\u0131za \u00e7\u0131kmakta ve toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenlenmesinin do\u011frudan temel bir hak oldu\u011funu ifade etmektedir.<\/p>\n<p>2. Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fc, Kimlere Tan\u0131nmakta ve Bu Hakk\u0131n Kapsam\u0131na Kimler Girmektedir?<\/p>\n<p>a. Kural<\/p>\n<p>Anayasal d\u00fczenleme incelendi\u011finde; madde metninin ilk olarak \u201cherkes\u201d s\u00f6zc\u00fc\u011f\u00fcyle ba\u015flad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu ifade de, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme temel hak ve h\u00fcrriyetinin kapsam\u0131na herkesin girdi\u011fini g\u00f6stermektedir. Bu ifadeden de anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere; toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenlenmesi, yaln\u0131zca vatanda\u015flara tan\u0131nan bir hak olmay\u0131p T\u00fcrk vatanda\u015f\u0131 olmayan bir kimse de bu haktan faydalanabilmektedir. \u00d6rne\u011fin, T\u00fcrk vatanda\u015f\u0131 olmayan T\u00fcrk soylu kimse veya di\u011fer yabanc\u0131 uyruklu kimse ya da vatans\u0131z kimse gibi..<\/p>\n<p>Ancak bu a\u00e7\u0131klama, yabanc\u0131lar bak\u0131m\u0131ndan izin sistemine engel de\u011fildir. Zira 2911 say\u0131l\u0131 kanunla vatanda\u015f olmayanlar bu kimseler y\u00f6n\u00fcnden izin sisteminin kabul edilmi\u015f oldu\u011fu g\u00f6r\u00fclmektedir. Bu kapsamda 2911 say\u0131l\u0131 kanunun 3. maddesinin 2. f\u0131kras\u0131yla, yabanc\u0131lar\u0131n i\u015fbu kanun h\u00fck\u00fcmlerine g\u00f6re toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenlemelerinin, \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019n\u0131n iznine ba\u011fland\u0131\u011f\u0131 ve yabanc\u0131lar\u0131n yine bu kanuna g\u00f6re d\u00fczenlenen toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinde toplulu\u011fa hitap etmelerinin, afi\u015f, pankart, resim, flama, levha, ara\u00e7 ve gere\u00e7ler ta\u015f\u0131malar\u0131n\u0131n, toplant\u0131n\u0131n yap\u0131laca\u011f\u0131 mahallin en b\u00fcy\u00fck m\u00fclk\u00ee idare amirli\u011fine toplant\u0131dan en az k\u0131rk sekiz saat \u00f6nce yap\u0131lacak bildirimle m\u00fcmk\u00fcn oldu\u011fu belirtilmektedir.<\/p>\n<p>Daha a\u00e7\u0131k ve net bir ifadeyle \u015fu husus s\u00f6ylenebilmektedir ki; toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131 herkese tan\u0131nmakla, bu hakk\u0131n kullan\u0131lmas\u0131nda vatanda\u015flarla di\u011fer ki\u015filer bak\u0131m\u0131ndan usul ve \u015fart y\u00f6n\u00fcnden farkl\u0131l\u0131k bulunmaktad\u0131r. Vatanda\u015flar i\u00e7in izne gerek yokken, yabanc\u0131lar\u0131n izin almas\u0131 zorunluluk arz etmektedir.<\/p>\n<p>b. \u0130stisna H\u00fck\u00fcmler<\/p>\n<p>Siyasi partilerin, kamu kurumu niteli\u011findeki meslek kurulu\u015flar\u0131n\u0131n, sendikalar\u0131n, vak\u0131flar\u0131n, derneklerin, ticari ortakl\u0131klar\u0131n ve di\u011fer t\u00fczel ki\u015filerin \u00f6zel kanunlar\u0131na ve kendi t\u00fcz\u00fcklerine g\u00f6re yapacaklar\u0131 kapal\u0131 yer toplant\u0131lar\u0131; kanunlara uymak, kendi kural ve s\u0131n\u0131rlar\u0131 i\u00e7inde kalmak \u015fart\u0131yla kanun veya gelenek ve g\u00f6reneklere g\u00f6re yap\u0131lacak toplant\u0131, t\u00f6ren, \u015fenlik, kar\u015f\u0131lama ve u\u011furlamalar; spor faaliyetleri ile bilimsel, ticari ve ekonomik ama\u00e7larla yap\u0131lan toplant\u0131lar; Cumhurba\u015fkan\u0131, Cumhurba\u015fkan\u0131 yard\u0131mc\u0131lar\u0131 ve bakanlar\u0131n Devlet i\u015fleri hakk\u0131ndaki toplant\u0131 ve konu\u015fmalar\u0131 ile T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcyelerinin halk ile yapacaklar\u0131 sohbet niteli\u011findeki g\u00f6r\u00fc\u015fmeler, 2911 say\u0131l\u0131 Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015fleri Kanunu\u2019na tabi olmay\u0131p, say\u0131lan hususlar hakk\u0131nda engel hal olmad\u0131\u011f\u0131 ve niteli\u011fine uygun d\u00fc\u015ft\u00fc\u011f\u00fc m\u00fcddet\u00e7e, ilgililerin kendi \u00f6zel kanun h\u00fck\u00fcmleri ile ba\u015fta 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu ve 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu olmak \u00fczere di\u011fer kanun h\u00fck\u00fcmleri uygulama alan\u0131 bulmaktad\u0131r.<\/p>\n<p>B. Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn Hukuki Dayanaklar\u0131 Nelerdir?<\/p>\n<p>1. Anayasal D\u00fczenleme<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenlenmesi hakk\u0131, Anayasal dayana\u011fa sahip olup; 1982 Anayasan\u0131n 34. maddesinde d\u00fczenlenmekte ve maddenin son f\u0131kras\u0131 ile toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131n\u0131n kullan\u0131lmas\u0131nda uygulanacak \u015fekil, \u015fart ve usullerin kanunda g\u00f6sterilece\u011fi belirtilmektedir.<\/p>\n<p>2. Uluslararas\u0131 D\u00fczeyde D\u00fczenleme<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi (A\u0130HS)\u2019nin 11. maddesiyle, toplant\u0131 ve dernek kurma \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yer verildi\u011fi ve belirtilen haklar\u0131n d\u00fczenleme alt\u0131na al\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. S\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn ilk f\u0131kras\u0131nda toplanma hakk\u0131 ile dernek kurma hakk\u0131, 2. f\u0131kras\u0131nda s\u0131n\u0131rlama sebepleri ile s\u0131n\u0131rlaman\u0131n s\u0131n\u0131rlar\u0131 belirtilmektedir.\u00a0<\/p>\n<p>\u00dclkemiz taraf\u0131ndan Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi onaylanm\u0131\u015f olup; A\u0130HS h\u00fck\u00fcmleri, 1982 Anayasas\u0131n\u0131n 90. maddesi uyar\u0131nca hukuk sistemimizin bir par\u00e7as\u0131 haline gelerek do\u011frudan uygulama alan\u0131 bulmaktad\u0131r. Zira i\u00e7 hukuk sistemimiz uyar\u0131nca, usul\u00fcne g\u00f6re y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015f milletleraras\u0131 antla\u015fmalar, kanun h\u00fckm\u00fcnde olup; bunlar hakk\u0131nda Anayasaya ayk\u0131r\u0131l\u0131k iddias\u0131 ile Anayasa Mahkemesi\u2019ne ba\u015fvurulamamaktad\u0131r. Usul\u00fcne g\u00f6re y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin milletleraras\u0131 antla\u015fmalarla kanunlar\u0131n ayn\u0131 konuda farkl\u0131 h\u00fck\u00fcmler i\u00e7ermesi nedeniyle \u00e7\u0131kabilecek uyu\u015fmazl\u0131klardaysa, milletleraras\u0131 antla\u015fma h\u00fck\u00fcmleri esas al\u0131nmaktad\u0131r.<\/p>\n<p>3. Yasal Dayanak<\/p>\n<p>Anayasa m. 34\/son ile ifade edildi\u011fi \u00fczere; 06.10.1983 kabul ve 08.10.1983 Resmi Gazete yay\u0131m tarihli 2911 say\u0131l\u0131 Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015fleri Kanunu kabul edilmi\u015f ve y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015ftur. 1. maddeyle, kanunun amac\u0131 ve kapsam\u0131 belirtilerek kanunun toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131n\u0131n kullan\u0131lmas\u0131nda uygulanacak \u015fekil, \u015fart ve usuller ile ger\u00e7ek ve t\u00fczel ki\u015filerin d\u00fczenleyecekleri toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin yerini, zaman\u0131n\u0131, usul ve \u015fartlar\u0131n\u0131, d\u00fczenleme kurulunun g\u00f6rev ve sorumluluklar\u0131n\u0131, yetkili merciin yasaklama ve erteleme hallerini, g\u00fcvenlik kuvvetlerinin g\u00f6rev ve yetkileri ile yasaklar\u0131 ve ceza h\u00fck\u00fcmlerini d\u00fczenledi\u011finin belirtildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>4. Kanunun Uygulanmas\u0131 Amac\u0131yla Y\u00f6netmelik<\/p>\n<p>Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015fleri Kanununun Uygulanmas\u0131na Dair Y\u00f6netmelik, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131n\u0131n kanunlara uygun olarak kullan\u0131lmas\u0131 ile g\u00f6rev, yetki ve sorumluluklar ile bildirim verilmesi, yasaklama ve erteleme kararlar\u0131na ili\u015fkin esas ve usuller ve di\u011fer hususlar bak\u0131m\u0131ndan belirleyici olmas\u0131 amac\u0131yla 2911 say\u0131l\u0131 Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015fleri Kanunu\u2019nun 10, 18 ve 37. uyar\u0131nca d\u00fczenlenerek y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015ftur. Y\u00f6netmeli\u011fin temel amac\u0131, 2911 say\u0131l\u0131 kanunun uygulanmas\u0131n\u0131 sa\u011flamakt\u0131r.<\/p>\n<p>C. Temel Kavramlar<\/p>\n<p>2911 say\u0131l\u0131 kanunun uygulanmas\u0131nda baz\u0131 kavramlar\u0131n anlamlar\u0131n\u0131n ve neyi ifade etti\u011finin kesin olarak bilinmesi gerekmekte ve bu husus b\u00fcy\u00fck \u00f6nem arz etmektedir. Bu kavramlar s\u0131ras\u0131yla, toplant\u0131, toplant\u0131 yeri, g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc, mahallin en b\u00fcy\u00fck m\u00fclki amiri ve mahallin g\u00fcvenlik amirleridir.<\/p>\n<p>1. Toplant\u0131<\/p>\n<p>Toplant\u0131, belirli konular \u00fczerinde halk\u0131 ayd\u0131nlatmak ve bir kamuoyu yaratmak suretiyle o konuyu benimsetmek i\u00e7in ger\u00e7ek ve t\u00fczel ki\u015filer taraf\u0131ndan 2911 say\u0131l\u0131 kanun \u00e7er\u00e7evesinde d\u00fczenlenen a\u00e7\u0131k ve kapal\u0131 yer toplant\u0131lar\u0131n\u0131 ifade etmektedir.<\/p>\n<p>2. Toplant\u0131 Yeri<\/p>\n<p>Toplant\u0131 yeri; mahallin en b\u00fcy\u00fck m\u00fclk\u00ee \u00e2miri taraf\u0131ndan \u00f6nceden tespit ve il\u00e2n edilmi\u015f, kanuna uygun bildirimde belirtilmi\u015f, yetkililer taraf\u0131ndan yasaklanmam\u0131\u015f ve ertelenmemi\u015f kapal\u0131 ve a\u00e7\u0131k yer toplant\u0131s\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yap\u0131lan mahal ile g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yap\u0131lan g\u00fczergah anlam\u0131na gelmektedir.<\/p>\n<p>3. G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fc<\/p>\n<p>G\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc, belirli konular \u00fczerinde halk\u0131 ayd\u0131nlatmak ve bir kamuoyu yaratmak suretiyle o konuyu benimsetmek i\u00e7in ger\u00e7ek ve t\u00fczel ki\u015filer taraf\u0131ndan 2911 say\u0131l\u0131 kanun \u00e7er\u00e7evesinde d\u00fczenlenen y\u00fcr\u00fcy\u00fc\u015fleri belirtmektedir.<\/p>\n<p>4. Mahallin En B\u00fcy\u00fck M\u00fclki Amiri<\/p>\n<p>Mahallin en b\u00fcy\u00fck m\u00fclki amiri; illerde vali, il\u00e7elerde kaymakam olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>5. Mahallin G\u00fcvenlik Amirleri<\/p>\n<p>Mahallin g\u00fcvenlik amirleri; illerde, il emniyet m\u00fcd\u00fcr\u00fc ve il jandarma komutan\u0131; il\u00e7elerde, il\u00e7e emniyet amiri veya komiseri ve il\u00e7e jandarma komutan\u0131; Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 i\u00e7in Sahil G\u00fcvenlik B\u00f6lge Komutan\u0131, Sahil G\u00fcvenlik Grup Komutan\u0131 ve Sahil G\u00fcvenlik Karakol Komutan\u0131 ile Sahil G\u00fcvenlik Gemi\/Bot Komutan\u0131d\u0131r. Ancak bir ile ba\u011fl\u0131 il\u00e7elerin, o ilin belediye s\u0131n\u0131rlar\u0131 i\u00e7indeki k\u0131s\u0131mlar\u0131na ili\u015fkin olarak 2911 say\u0131l\u0131 kanunun uygulamas\u0131 y\u00f6n\u00fcnden mahallin en b\u00fcy\u00fck m\u00fclki amiri, ilin valisi olmaktad\u0131r.<\/p>\n<p>II. TOPLANTI VE G\u00d6STER\u0130 Y\u00dcR\u00dcY\u00dc\u015e\u00dcN\u00dcN USUL VE KA\u0130DELER\u0130 <\/p>\n<p>A. Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn Usul\u00fc<\/p>\n<p>Anayasan\u0131n 34. maddesi uyar\u0131nca; herkes, \u00f6nceden izin almadan, silahs\u0131z ve sald\u0131r\u0131s\u0131z toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na sahiptir. Bu kapsamda anayasal d\u00fczeyde tan\u0131nan bu temel hak ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn, \u00f6nceden izin al\u0131nmaks\u0131z\u0131n kullan\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ancak bunun i\u00e7in yap\u0131lmak istenen toplant\u0131 ve\/veya g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn silahs\u0131z ve sald\u0131r\u0131s\u0131z olmas\u0131 gereklidir.<\/p>\n<p>Silah ve sald\u0131r\u0131 kavram\u0131n\u0131n Anayasan\u0131n 34. maddesi ve 2911 say\u0131l\u0131 kanun ve kanunun uygulanmas\u0131 maksad\u0131yla \u00e7\u0131kar\u0131lan y\u00f6netmelik h\u00fck\u00fcmleriyle ayr\u0131ca ve a\u00e7\u0131k\u00e7a tan\u0131mlanmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu sebeple 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun tan\u0131mlar ba\u015fl\u0131kl\u0131 h\u00fckm\u00fcn\u00fcn dikkate al\u0131nmas\u0131 gerekmektedir. Yasakl\u0131l\u0131k kapsam\u0131nda ve bu \u015fekilde silahl\u0131 olarak yap\u0131lan toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin hukuka uygunlu\u011fu bulunmamaktad\u0131r. Bu haller, tamamen yasak kapsam\u0131nda olup; ayr\u0131ca su\u00e7 te\u015fkil etmektedir.<\/p>\n<p>Benzer nitelikteki d\u00fczenleme, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 11. maddesinin 1. f\u0131kras\u0131nda da yer almakta olup; s\u00f6zle\u015fme h\u00fckm\u00fcyle, herkesin bar\u0131\u015f\u00e7\u0131l olarak toplanma ve dernek kurma hakk\u0131na sahip oldu\u011funun kabul edildi\u011fi g\u00f6r\u00fclmektedir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; s\u00f6z konusu h\u00fck\u00fcm, Anayasal d\u00fczenleme ile do\u011fru orant\u0131l\u0131 olup; hem ki\u015fi bak\u0131m\u0131ndan herkesi kapsam\u0131na almakta hem de toplanma hakk\u0131n\u0131n bar\u0131\u015f\u00e7\u0131l olarak kullan\u0131lmas\u0131n\u0131 konu edinmektedir. Bu sebeple toplanma hakk\u0131n\u0131n, bar\u0131\u015f\u00e7\u0131l olmayan yol ve y\u00f6ntemlerle uygulanmamas\u0131, silahl\u0131, \u00e7at\u0131\u015fmal\u0131, kavgac\u0131 hallere d\u00f6n\u00fc\u015fmemesi, yaralama, \u00f6ld\u00fcrme, mala zarar verme ve sair su\u00e7 te\u015fkil eden eylemlerle yap\u0131lmamas\u0131 zorunluluk arz etmekte; aksi hal ise, gerek i\u00e7 hukuk sistemimizde gerekse uluslararas\u0131 d\u00fczeyde korunmamakta ve yapt\u0131r\u0131ma tabi tutulmaktad\u0131r. \u00a0<\/p>\n<p>\u0130\u00e7erik y\u00f6n\u00fcnden Anayasal d\u00fczenlemeyle e\u015f\/benzer nitelikte denilebilecek bir di\u011fer d\u00fczenleme de, 2911 say\u0131l\u0131 kanunun 3. maddesinde yer almakta olup; yasal d\u00fczenlemenin ilk f\u0131kras\u0131na g\u00f6re herkes, \u00f6nceden izin almaks\u0131z\u0131n 2911 say\u0131l\u0131 kanun h\u00fck\u00fcmlerine g\u00f6re silahs\u0131z ve sald\u0131r\u0131s\u0131z olarak kanunlar\u0131n su\u00e7 saymad\u0131\u011f\u0131 belirli ama\u00e7larla toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na sahiptir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; kanunda, silahs\u0131z ve sald\u0131r\u0131s\u0131z ifadesinin yan\u0131 s\u0131ra toplanma ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin su\u00e7 te\u015fkil etmeyecek hareket ve davran\u0131\u015flarla yap\u0131lmas\u0131n\u0131n gerekti\u011fi ifade edilmektedir. Bu kapsamda polise asit at\u0131lmas\u0131, kamu kurumlar\u0131n\u0131n ya da belediyelerin camlar\u0131n\u0131n veya kap\u0131lar\u0131n\u0131n k\u0131r\u0131lmas\u0131, \u00f6zel i\u015f yerlerinin duvarlar\u0131na ve \u00f6zel ki\u015filerin sokaklardaki ara\u00e7lar\u0131na zarar verilmesi, vatanda\u015f\u0131n darp edilmesi tamamen yasakl\u0131 haller kapsam\u0131nda olup, ayr\u0131ca su\u00e7 te\u015fkil etmektedir.<\/p>\n<p>B. Bildirim Sistemi <\/p>\n<p>1. Bildirim Sistemine \u0130li\u015fkin A\u00e7\u0131klamalar<\/p>\n<p>Hukuk sistemimiz yabanc\u0131lar i\u00e7in izin sistemini kabul ederken, vatanda\u015flar i\u00e7in bildirim sistemini kabul etmektedir. Bu kapsamda 2911 say\u0131l\u0131 kanun uyar\u0131nca yap\u0131lacak toplant\u0131lar, fiil ehliyetine sahip ve on sekiz ya\u015f\u0131n\u0131 doldurmu\u015f, en az yedi ki\u015fiden olu\u015fan bir d\u00fczenleme kurulu taraf\u0131ndan d\u00fczenlenmektedir. Bu kurul, kendi aralar\u0131ndan birini ba\u015fkan olarak se\u00e7mekte ve diplomatik dokunulmazl\u0131klar\u0131 bulunan ki\u015filer, d\u00fczenleme kurulu ba\u015fkan veya \u00fcyesi olamamaktad\u0131r. T\u00fczel ki\u015filerin toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenlemeleri ise, yetkili organlar\u0131n\u0131n karar\u0131na ba\u011fl\u0131 olmaktad\u0131r.<\/p>\n<p>Bu bildirimde; toplant\u0131n\u0131n amac\u0131 ile yap\u0131laca\u011f\u0131 yer, g\u00fcn, ba\u015flay\u0131\u015f ve biti\u015f saatleri ile d\u00fczenleme kurulunun ba\u015fkan ile \u00fcyelerinin a\u00e7\u0131k kimlikleri, meslekleri, ikametgahlar\u0131 ve varsa \u00e7al\u0131\u015fma yerleri, belirtilmekle; bildirime y\u00f6netmelikte g\u00f6sterilen belgeler eklenmektedir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; bildirim sisteminin izin sistemine d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine y\u00f6nelik k\u00f6t\u00fc niyetli veya yasaklay\u0131c\u0131 yakla\u015f\u0131mlara kar\u015f\u0131, a\u00e7\u0131klanan temel hak ve h\u00fcrriyetin kullan\u0131m\u0131 noktas\u0131nda teredd\u00fcde yer b\u0131rakmayacak nitelikte d\u00fczenlemenin yap\u0131lmas\u0131 ve bildirimin, noter kanal\u0131yla ihbar \u015feklinde yap\u0131lmas\u0131n\u0131n kabul edilmesi, son derece yerindedir. Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fc Yerleri<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015fleri, t\u00fcm il ve il\u00e7e s\u0131n\u0131rlar\u0131 i\u00e7erisinde her yerde yap\u0131labilmektedir. Ancak\u00a0 bu husus, yer bak\u0131m\u0131ndan hi\u00e7bir s\u0131n\u0131r\u0131n olmad\u0131\u011f\u0131 anlam\u0131na gelmemektedir. Zira il ve il\u00e7elerde toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131, kamu d\u00fczenini ve genel asayi\u015fi bozmayacak, vatanda\u015flar\u0131n g\u00fcnl\u00fck ya\u015fam\u0131n\u0131 a\u015f\u0131r\u0131 ve katlan\u0131lmaz derecede zorla\u015ft\u0131rmayacak \u015fekilde ve yasakl\u0131 yerlere ili\u015fkin m. 22\/1\u2019de yer alan s\u0131n\u0131rlamalara uyulmas\u0131 kayd\u0131yla mahallin en b\u00fcy\u00fck m\u00fclki amiri taraf\u0131ndan belirlenmektedir. Ancak bu belirleme yap\u0131l\u0131rken, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nde grubu bulunan siyasi partilerin il ve il\u00e7e temsilcileri ile g\u00fczerg\u00e2h\u0131n ge\u00e7ece\u011fi il\u00e7e ve il belediye ba\u015fkanlar\u0131n\u0131n, en \u00e7ok \u00fcyeye sahip \u00fc\u00e7 sendikan\u0131n ve kamu kurumu niteli\u011findeki meslek kurulu\u015flar\u0131n\u0131n il ve il\u00e7e temsilcilerinin g\u00f6r\u00fc\u015flerinin al\u0131nmas\u0131 gerekmektedir.<\/p>\n<p>\u0130l ve il\u00e7enin b\u00fcy\u00fckl\u00fc\u011f\u00fc, geli\u015fmi\u015fli\u011fi ve yerle\u015fim \u00f6zellikleri dikkate al\u0131narak birden fazla toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131 belirlenebilmekte olup; belirlenen toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131, yerel gazeteler ve internet haber siteleri ile valilik ve kaymakaml\u0131k internet sitelerinden ilan edilerek halka duyurulmaktad\u0131r. Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015fleri yer ve g\u00fczerg\u00e2h\u0131 hakk\u0131nda sonradan yap\u0131lacak de\u011fi\u015fiklikler de, ayn\u0131 y\u00f6ntemle yap\u0131lmakta ve bu de\u011fi\u015fiklikler, duyurudan on be\u015f g\u00fcn sonra ge\u00e7erli olmaktad\u0131r. Birden fazla toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131n\u0131n belirlendi\u011fi il ve il\u00e7elerde d\u00fczenleme kurulu, belirlenen yer ve g\u00fczerg\u00e2hlardan kamu d\u00fczenini ve genel asayi\u015fi bozmayacak birisini tercih edebilme hakk\u0131na sahip bulunmaktad\u0131r.<\/p>\n<p>D. Ba\u015fka bir anlat\u0131mla s\u00f6z konusu anayasal hak bak\u0131m\u0131ndan da, genel h\u00fck\u00fcmlerde yer alan m. 13 h\u00fckm\u00fc uygulama alan\u0131 bulmaktad\u0131r.<\/p>\n<p>Temel hak ve h\u00fcrriyetlerin s\u0131n\u0131rlanmas\u0131n\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla yap\u0131lmas\u0131 zorunlu olup; bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gerekleri ile \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamamaktad\u0131r.<\/p>\n<p>Anayasan\u0131n 34. maddesinin 2. f\u0131kras\u0131nda yer alan \u00f6zel s\u0131n\u0131rlama sebepleri dikkate al\u0131nd\u0131\u011f\u0131nda; AY m. 13 ile m. 34\u2019te yer alan anayasal h\u00fck\u00fcmlerin birlikte de\u011ferlendirilmesi sonucu; toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc hakk\u0131n\u0131n ancak,\u00a0mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131\u011f\u0131n ve genel ahl\u00e2k\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 amac\u0131yla ve kanunla s\u0131n\u0131rlanabildi\u011fi; ancak m. 13\u2019te yer alan s\u0131n\u0131rlaman\u0131n s\u0131n\u0131rlar\u0131n\u0131n ihlal edilmemesinin ve temel hak ve h\u00fcrriyetlerin \u00f6zlerine dokunulmamas\u0131n\u0131n zorunlu oldu\u011fu g\u00f6r\u00fclmektedir. \u0130\u015fte bu dokunulmamas\u0131 gereken k\u0131s\u0131m, \u00e7ekirdek hakk\u0131 ifade etmekte olup, \u00e7ekirdek hakk\u0131n s\u0131n\u0131rlanamamas\u0131 esast\u0131r. Ancak her hak gibi temel hak ve h\u00fcrriyetlerin de k\u00f6t\u00fcye kullan\u0131lamamas\u0131 gerekli ve ayn\u0131 zamanda zorunludur.\u00a0<\/p>\n<p>b. Anayasan\u0131n 15. Maddesi Uyar\u0131nca Kabul Edilen Hususlar <\/p>\n<p>Sava\u015f, seferberlik veya ola\u011fan\u00fcst\u00fc hallerde, milletleraras\u0131 hukuktan do\u011fan y\u00fck\u00fcml\u00fcl\u00fckler ihlal edilmemek kayd\u0131yla, durumun gerektirdi\u011fi \u00f6l\u00e7\u00fcde temel hak ve h\u00fcrriyetlerin kullan\u0131lmas\u0131 k\u0131smen veya tamamen durdurulabilmekte veya bunlar i\u00e7in Anayasada \u00f6ng\u00f6r\u00fclen g\u00fcvencelere ayk\u0131r\u0131 tedbirler al\u0131nabilmekte; ancak bu hallerde dahi, sava\u015f hukukuna uygun fiiller sonucu meydana gelen \u00f6l\u00fcmler d\u0131\u015f\u0131nda, ki\u015finin ya\u015fama hakk\u0131na, maddi ve manevi varl\u0131\u011f\u0131n\u0131n b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamamakta; kimse din, vicdan, d\u00fc\u015f\u00fcnce ve kanaatlerini a\u00e7\u0131klamaya zorlanamamakta ve bunlardan dolay\u0131 su\u00e7lanamamakta; su\u00e7 ve cezalar ge\u00e7mi\u015fe y\u00fcr\u00fct\u00fclememekte; su\u00e7lulu\u011fu mahkeme karar\u0131 ile saptan\u0131ncaya kadar kimse su\u00e7lu say\u0131lamamaktad\u0131r. AY m. 15 ile, belirtilen ola\u011fan d\u0131\u015f\u0131 zaman ve durumlarda dahi, hi\u00e7bir \u015fekilde s\u0131n\u0131rlanamayan temel ve hak h\u00fcrriyetler say\u0131lmaktad\u0131r.<\/p>\n<p>c. Yabanc\u0131lar Hakk\u0131nda S\u0131n\u0131rlama<\/p>\n<p>Anayasan\u0131n 16. maddesi uyar\u0131nca; temel hak ve h\u00fcrriyetler, yabanc\u0131lar i\u00e7in, milletleraras\u0131 hukuka uygun olarak kanunla s\u0131n\u0131rlanabilmektedir.<\/p>\n<p>2. Yasal D\u00fczenlemeler<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc bak\u0131m\u0131ndan iki farkl\u0131 s\u0131n\u0131rlama s\u00f6z konusu olmaktad\u0131r. Bunlardan ilki, erteleme; di\u011feri de, yasaklama \u015feklinde kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>a. Ge\u00e7ici S\u00fcreyle Erteleme<\/p>\n<p>Bir il s\u0131n\u0131r\u0131 i\u00e7inde ayn\u0131 g\u00fcnde birden \u00e7ok toplant\u0131 yap\u0131lmak istenmesi halinde valinin; emrindeki g\u00fcvenlik kuvvetlerinin ve gerekti\u011finde yararlanabilece\u011fi di\u011fer g\u00fc\u00e7lerin bu toplant\u0131lar\u0131n g\u00fcvenlik i\u00e7inde yap\u0131lmas\u0131n\u0131 sa\u011flamaya yeterli olmad\u0131\u011f\u0131 kan\u0131s\u0131na varmas\u0131 halinde, toplant\u0131lardan bir k\u0131sm\u0131n\u0131 on g\u00fcn\u00fc a\u015fmamak \u00fczere bir kez erteleyebilme yetkisi bulunmaktad\u0131r. Ancak bu ertelemede m\u00fcracaat \u00f6nceli\u011fi g\u00f6z \u00f6n\u00fcnde bulundurulmak zorunda olup; bu h\u00fck\u00fcm, emredici nitelikte bulunmaktad\u0131r.<\/p>\n<p>Bir b\u00f6lge valili\u011fine ba\u011fl\u0131 illerden, birden \u00e7ok ilde ayn\u0131 g\u00fcnde toplant\u0131 yapmak i\u00e7in bildirim verilmesi \u00fczerine, toplant\u0131 g\u00fcvenli\u011fini sa\u011flamak amac\u0131yla ilgili valilerce b\u00f6lge valili\u011finden takviye istenmesi ve b\u00f6lge valisinin bu isteklerin kar\u015f\u0131lanamayaca\u011f\u0131 kan\u0131s\u0131na varmas\u0131 halinde; b\u00f6lge valili\u011fince, takviye g\u00f6nderilemeyen illerdeki toplant\u0131lar, on g\u00fcn\u00fc a\u015fmamak \u00fczere bir kez ertelenebilmektedir.<\/p>\n<p>Ayn\u0131 g\u00fcnde birden \u00e7ok b\u00f6lge valili\u011fine ba\u011fl\u0131 illerde toplant\u0131 yapmak i\u00e7in bildirim verilmesi \u00fczerine, toplant\u0131 g\u00fcvenli\u011fini sa\u011flamak amac\u0131yla ilgili b\u00f6lge valilerince \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019ndan takviye istenmesi ve \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019nca bu isteklerin kar\u015f\u0131lanamayaca\u011f\u0131 kan\u0131s\u0131na var\u0131lmas\u0131 halinde; \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019nca, takviye g\u00f6nderilemeyen b\u00f6lge valili\u011fine ba\u011fl\u0131 illerdeki toplant\u0131lar, on g\u00fcn\u00fc a\u015fmamak \u00fczere bir kez ertelenebilmektedir. Ertelemede m\u00fcracaat \u00f6nceli\u011fi de g\u00f6z \u00f6n\u00fcnde bulundurulmak zorundad\u0131r.<\/p>\n<p>Vali veya kaymakamlarca ertelenen veya yasaklanan toplant\u0131lara ili\u015fkin gerek\u00e7eli erteleme veya yasaklama kararlar\u0131, ilgililere tebli\u011f edilmekte olup; bu kararlar hakk\u0131nda, b\u00f6lge valili\u011fine ve \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na, b\u00f6lge valilerince ertelenen veya yasaklanan toplant\u0131lar i\u00e7inse \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na bilgi verilmesi zorunlu olmaktad\u0131r.\u00a0<\/p>\n<p>b. Ge\u00e7ici S\u00fcreyle Olmayan Erteleme veya Yasaklama<\/p>\n<p>B\u00f6lge valisi, vali veya kaymakam; mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131\u011f\u0131n ve genel ahl\u00e2k\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 amac\u0131yla belirli bir toplant\u0131y\u0131, bir ay\u0131 a\u015fmamak \u00fczere erteleyebilme veya su\u00e7 i\u015flenece\u011fine dair a\u00e7\u0131k ve yak\u0131n tehlikenin mevcut olmas\u0131 h\u00e2linde, yasaklayabilme yetkisine sahiptir.<\/p>\n<p>B\u00f6lge valisi; mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131\u011f\u0131n ve genel ahl\u00e2k\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 amac\u0131yla b\u00f6lgeye dahil illerin birinde veya birka\u00e7\u0131nda ya da bir ilin bir veya birka\u00e7 il\u00e7esinde b\u00fct\u00fcn toplant\u0131lar\u0131 bir ay\u0131 ge\u00e7memek \u00fczere erteleyebilmektedir. Benzer \u015fekilde valiler de ayn\u0131 sebeplere dayal\u0131 olarak ve su\u00e7 i\u015flenece\u011fine dair a\u00e7\u0131k ve yak\u0131n tehlikenin mevcut olmas\u0131 h\u00e2linde; ile ba\u011fl\u0131 il\u00e7elerin birinde veya birka\u00e7\u0131nda b\u00fct\u00fcn toplant\u0131lar\u0131 bir ay\u0131 ge\u00e7memek \u00fczere yasaklayabilme yetkisine haizdir. Yasaklama karar\u0131, gerek\u00e7eli olarak verilmek zorunda olup; karar\u0131n \u00f6zetinin, yasaklaman\u0131n uygulanaca\u011f\u0131 yerlerde mutat vas\u0131talarla ilan edilmesi ve ayr\u0131ca \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na bilgi verilmesi gerekmektedir.<\/p>\n<p>IV. YASAKLAR VE CEZALAR<\/p>\n<p>A. Yasaklar<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin; yasakl\u0131 yerlerde (parklarda, mabetlerde, kamu hizmeti g\u00f6r\u00fclen bina ve tesislerde ve bunlar\u0131n eklentilerinde ve T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019ne bir kilometre uzakl\u0131ktaki alan i\u00e7inde) veya bildirimsiz ya da belirtilen g\u00fcn ve saat d\u0131\u015f\u0131nda; ba\u015fta ate\u015fli silahlar veya havai fi\u015fek, molotof ve benzeri el yap\u0131m\u0131 olanlar d\u00e2hil patlay\u0131c\u0131 maddeler veya her t\u00fcrl\u00fc kesici, delici aletler veya ta\u015f, sopa, demir ve lastik \u00e7ubuklar, bo\u011fma teli veya zincir, demir bilye ve sapan gibi bereleyici ve bo\u011fucu ara\u00e7lar veya yak\u0131c\u0131, a\u015f\u0131nd\u0131r\u0131c\u0131, yaralay\u0131c\u0131 eczalar veya di\u011fer her t\u00fcrl\u00fc zehirler veya her t\u00fcrl\u00fc sis, gaz ve benzeri maddeler ile yasa d\u0131\u015f\u0131 \u00f6rg\u00fct ve topluluklara ait amblem ve i\u015faret ta\u015f\u0131narak veya bu i\u015faret ve amblemleri \u00fczerinde bulunduran \u00fcniformay\u0131 and\u0131r\u0131r giysiler giyilerek veya kimliklerini gizlemek amac\u0131yla y\u00fczlerini tamamen veya k\u0131smen bez vesair unsurlarla \u00f6rterek, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerine kat\u0131lmak \u015feklinde; kanunlar\u0131n su\u00e7 sayd\u0131\u011f\u0131 nitelik ta\u015f\u0131yan afi\u015f, pankart, d\u00f6viz, resim, levha, ara\u00e7 ve gere\u00e7ler ta\u015f\u0131narak veya bu nitelikte sloganlar s\u00f6ylenerek veya ses cihazlar\u0131 ile yay\u0131nlanmak olmak \u00fczere kanunda belirtilen di\u011fer esaslara ayk\u0131r\u0131 \u015fekilde; kanun uyar\u0131nca al\u0131nan ertelenme ve yasaklanma karar ve hallerine muhalefet ile; propaganda ve \u00e7a\u011fr\u0131 alet ve ara\u00e7lar\u0131nda; halk\u0131 su\u00e7 i\u015flemeye \u00f6zendiren veya k\u0131\u015fk\u0131rtan yaz\u0131 veya resim bulundurulmas\u0131 suretiyle; toplant\u0131 veya g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn yap\u0131laca\u011f\u0131 tarihten bir \u00f6nceki g\u00fcnden toplant\u0131 veya g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn ba\u015flayaca\u011f\u0131 saate kadar, g\u00fcne\u015fin do\u011fu\u015fundan bat\u0131\u015f\u0131na kadarki zaman i\u00e7inde olmak kayd\u0131yla ses y\u00fckselten veya ileten herhangi bir alet veya ara\u00e7 ile \u00e7a\u011fr\u0131 yap\u0131labilmesi dikkate al\u0131nd\u0131\u011f\u0131nda, bu s\u00fcre d\u0131\u015f\u0131nda \u00e7a\u011fr\u0131 i\u00e7in s\u00f6z\u00fc ge\u00e7en alet veya ara\u00e7lar\u0131n kullan\u0131lmas\u0131yla; kapal\u0131 yer toplant\u0131lar\u0131nda, ses y\u00fckseltici alet veya ara\u00e7larla d\u0131\u015far\u0131ya yay\u0131n yap\u0131lmas\u0131yla; halka kar\u015f\u0131, do\u011frudan do\u011fruya veya ses y\u00fckselten veya ileten herhangi bir alet veya ara\u00e7 ile s\u00f6z s\u00f6yleyerek veya seslenerek veya bas\u0131lm\u0131\u015f veya \u00e7o\u011falt\u0131lm\u0131\u015f veya elle yaz\u0131lm\u0131\u015f veya \u00e7izilmi\u015f ka\u011f\u0131tlar\u0131 duvarlara veya di\u011fer yerlere yap\u0131\u015ft\u0131rarak veya da\u011f\u0131tarak veya benzeri ara\u00e7 ve yollarla halk\u0131 kanuna ayk\u0131r\u0131 toplant\u0131 veya y\u00fcr\u00fcy\u00fc\u015fe \u00f6zendirilmek veya k\u0131\u015fk\u0131rt\u0131lmak \u015feklinde yap\u0131lmas\u0131 yasakt\u0131r.<\/p>\n<p>B. Cezalar<\/p>\n<p>1. \u00d6zel Kanun<\/p>\n<p>2911 say\u0131l\u0131 kanunun cezai nitelikteki \u00f6zel h\u00fck\u00fcmleri ile; yasaklara ayk\u0131r\u0131 hareket edilmesi, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcne veya devam\u0131na engel olunmas\u0131, huzur ve s\u00fckunu bozma fiillerinin i\u015flenmesi, kanuna ayk\u0131r\u0131 propaganda vas\u0131talar\u0131 ve su\u00e7 i\u015flemeye te\u015fvik etme halleri ile direnme (ihtara ve zor kullanmaya ra\u011fmen da\u011f\u0131lmamakta \u0131srar etme) fiillerinin sergilenmesi; toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerine, ate\u015fli silahlar veya havai fi\u015fek, molotof ve benzeri el yap\u0131m\u0131 olanlar d\u00e2hil patlay\u0131c\u0131 maddeler veya her t\u00fcrl\u00fc kesici, delici aletler veya ta\u015f, sopa, demir ve lastik \u00e7ubuklar, bo\u011fma teli veya zincir, demir bilye ve sapan gibi bereleyici ve bo\u011fucu ara\u00e7lar veya yak\u0131c\u0131, a\u015f\u0131nd\u0131r\u0131c\u0131, yaralay\u0131c\u0131 eczalar veya di\u011fer her t\u00fcrl\u00fc zehirler veya her t\u00fcrl\u00fc sis, gaz ve benzeri maddeler ta\u015f\u0131yarak veya kimliklerini gizlemek amac\u0131yla y\u00fczlerini tamamen veya k\u0131smen bez vesair unsurlarla \u00f6rterek ya da yasa d\u0131\u015f\u0131 \u00f6rg\u00fct ve topluluklara ait amblem ve i\u015faret ta\u015f\u0131yarak veya bu i\u015faret ve amblemleri \u00fczerinde bulunduran \u00fcniformay\u0131 and\u0131r\u0131r giysiler giyerek ya da kanunlar\u0131n su\u00e7 sayd\u0131\u011f\u0131 nitelik ta\u015f\u0131yan afi\u015f, pankart, d\u00f6viz, resim, levha, ara\u00e7 ve gere\u00e7ler ta\u015f\u0131yarak veya bu nitelikte sloganlar s\u00f6yleyerek veya ses cihazlar\u0131 ile yay\u0131nlayarak kat\u0131l\u0131m sa\u011flanmas\u0131 halinde,\u00a0 bu su\u00e7lar\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda yapt\u0131r\u0131m olarak h\u00fcrriyeti ba\u011flay\u0131c\u0131 nitelikte hapis cezalar\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>2. Genel Kanun<\/p>\n<p>2911 say\u0131l\u0131 yasada h\u00fck\u00fcm bulunmayan ve a\u00e7\u0131k\u00e7a su\u00e7 te\u015fkil etmesine ra\u011fmen \u00f6zel kanun kapsam\u0131nda d\u00fczenlenmeyen eylemler bak\u0131m\u0131ndan 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu uygulanmaktad\u0131r.<\/p>\n<p>3. Usul Kanunu <\/p>\n<p>Gerek 2911 say\u0131l\u0131 gerekse 5237 say\u0131l\u0131 kanunlar\u0131n kapsam\u0131na giren su\u00e7lar\u0131n i\u015flenmesi halinde, soru\u015fturma ve yarg\u0131lama usul\u00fc bak\u0131m\u0131ndan 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu uygulama alan\u0131 bulmaktad\u0131r.<\/p>\n<p>V. Ancak bir ile ba\u011fl\u0131 il\u00e7elerin, o ilin belediye s\u0131n\u0131rlar\u0131 i\u00e7indeki k\u0131s\u0131mlar\u0131na ili\u015fkin olarak 2911 say\u0131l\u0131 kanunun uygulamas\u0131 y\u00f6n\u00fcnden mahallin en b\u00fcy\u00fck m\u00fclki amiri, ilin valisi olmaktad\u0131r.<\/p>\n<p>II. TOPLANTI VE G\u00d6STER\u0130 Y\u00dcR\u00dcY\u00dc\u015e\u00dcN\u00dcN USUL VE KA\u0130DELER\u0130 <\/p>\n<p>A. Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn Usul\u00fc<\/p>\n<p>Anayasan\u0131n 34. maddesi uyar\u0131nca; herkes, \u00f6nceden izin almadan, silahs\u0131z ve sald\u0131r\u0131s\u0131z toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na sahiptir. Bu kapsamda anayasal d\u00fczeyde tan\u0131nan bu temel hak ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn, \u00f6nceden izin al\u0131nmaks\u0131z\u0131n kullan\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ancak bunun i\u00e7in yap\u0131lmak istenen toplant\u0131 ve\/veya g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn silahs\u0131z ve sald\u0131r\u0131s\u0131z olmas\u0131 gereklidir.<\/p>\n<p>Silah ve sald\u0131r\u0131 kavram\u0131n\u0131n Anayasan\u0131n 34. maddesi ve 2911 say\u0131l\u0131 kanun ve kanunun uygulanmas\u0131 maksad\u0131yla \u00e7\u0131kar\u0131lan y\u00f6netmelik h\u00fck\u00fcmleriyle ayr\u0131ca ve a\u00e7\u0131k\u00e7a tan\u0131mlanmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu sebeple 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun tan\u0131mlar ba\u015fl\u0131kl\u0131 h\u00fckm\u00fcn\u00fcn dikkate al\u0131nmas\u0131 gerekmektedir. S\u00f6z konusu h\u00fck\u00fcmde silah deyiminden; ate\u015fli silahlar, patlay\u0131c\u0131 maddeler, sald\u0131r\u0131 ve savunmada kullan\u0131lmak \u00fczere yap\u0131lm\u0131\u015f her t\u00fcrl\u00fc kesici, delici veya bereleyici alet, sald\u0131r\u0131 ve savunma amac\u0131yla yap\u0131lm\u0131\u015f olmasa bile fiilen sald\u0131r\u0131 ve savunmada kullan\u0131lmaya elveri\u015fli di\u011fer \u015feyler, yak\u0131c\u0131, a\u015f\u0131nd\u0131r\u0131c\u0131, yaralay\u0131c\u0131, bo\u011fucu, zehirleyici, s\u00fcrekli hastal\u0131\u011fa yol a\u00e7\u0131c\u0131 n\u00fckleer, radyoaktif, kimyasal, biyolojik maddelerin anla\u015f\u0131lmas\u0131 gerekti\u011fi belirtilmekte ve bu kanunda yer alan tan\u0131mlamalar\u0131n, 2911 say\u0131l\u0131 kanun y\u00f6n\u00fcnden de uygulama alan\u0131 bulmas\u0131 gerekmektedir. \u00d6rne\u011fin; havai fi\u015fek patlat\u0131lmas\u0131, patlay\u0131c\u0131 ya da yan\u0131c\u0131 madde at\u0131lmas\u0131, asit veya kezzap d\u00f6k\u00fclmesi, \u015fi\u015fe, sopa f\u0131rlat\u0131lmas\u0131, tornavida, pense veya balta ya da tahrayla sald\u0131r\u0131lmas\u0131, b\u0131\u00e7ak ve di\u011fer yasakl\u0131 aletlerin kullan\u0131lmas\u0131 gibi.. \u0130\u015fte t\u00fcm bu say\u0131lanlar, silah ve yasak kapsam\u0131na girmektedir. Yasakl\u0131l\u0131k kapsam\u0131nda ve bu \u015fekilde silahl\u0131 olarak yap\u0131lan toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin hukuka uygunlu\u011fu bulunmamaktad\u0131r. Bu haller, tamamen yasak kapsam\u0131nda olup; ayr\u0131ca su\u00e7 te\u015fkil etmektedir.<\/p>\n<p>Benzer nitelikteki d\u00fczenleme, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 11. maddesinin 1. f\u0131kras\u0131nda da yer almakta olup; s\u00f6zle\u015fme h\u00fckm\u00fcyle, herkesin bar\u0131\u015f\u00e7\u0131l olarak toplanma ve dernek kurma hakk\u0131na sahip oldu\u011funun kabul edildi\u011fi g\u00f6r\u00fclmektedir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; s\u00f6z konusu h\u00fck\u00fcm, Anayasal d\u00fczenleme ile do\u011fru orant\u0131l\u0131 olup; hem ki\u015fi bak\u0131m\u0131ndan herkesi kapsam\u0131na almakta hem de toplanma hakk\u0131n\u0131n bar\u0131\u015f\u00e7\u0131l olarak kullan\u0131lmas\u0131n\u0131 konu edinmektedir. Bu sebeple toplanma hakk\u0131n\u0131n, bar\u0131\u015f\u00e7\u0131l olmayan yol ve y\u00f6ntemlerle uygulanmamas\u0131, silahl\u0131, \u00e7at\u0131\u015fmal\u0131, kavgac\u0131 hallere d\u00f6n\u00fc\u015fmemesi, yaralama, \u00f6ld\u00fcrme, mala zarar verme ve sair su\u00e7 te\u015fkil eden eylemlerle yap\u0131lmamas\u0131 zorunluluk arz etmekte; aksi hal ise, gerek i\u00e7 hukuk sistemimizde gerekse uluslararas\u0131 d\u00fczeyde korunmamakta ve yapt\u0131r\u0131ma tabi tutulmaktad\u0131r. \u00a0<\/p>\n<p>\u0130\u00e7erik y\u00f6n\u00fcnden Anayasal d\u00fczenlemeyle e\u015f\/benzer nitelikte denilebilecek bir di\u011fer d\u00fczenleme de, 2911 say\u0131l\u0131 kanunun 3. maddesinde yer almakta olup; yasal d\u00fczenlemenin ilk f\u0131kras\u0131na g\u00f6re herkes, \u00f6nceden izin almaks\u0131z\u0131n 2911 say\u0131l\u0131 kanun h\u00fck\u00fcmlerine g\u00f6re silahs\u0131z ve sald\u0131r\u0131s\u0131z olarak kanunlar\u0131n su\u00e7 saymad\u0131\u011f\u0131 belirli ama\u00e7larla toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na sahiptir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; kanunda, silahs\u0131z ve sald\u0131r\u0131s\u0131z ifadesinin yan\u0131 s\u0131ra toplanma ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin su\u00e7 te\u015fkil etmeyecek hareket ve davran\u0131\u015flarla yap\u0131lmas\u0131n\u0131n gerekti\u011fi ifade edilmektedir. Bu kapsamda polise asit at\u0131lmas\u0131, kamu kurumlar\u0131n\u0131n ya da belediyelerin camlar\u0131n\u0131n veya kap\u0131lar\u0131n\u0131n k\u0131r\u0131lmas\u0131, \u00f6zel i\u015f yerlerinin duvarlar\u0131na ve \u00f6zel ki\u015filerin sokaklardaki ara\u00e7lar\u0131na zarar verilmesi, vatanda\u015f\u0131n darp edilmesi tamamen yasakl\u0131 haller kapsam\u0131nda olup, ayr\u0131ca su\u00e7 te\u015fkil etmektedir.<\/p>\n<p>B. Bildirim Sistemi <\/p>\n<p>1. Bildirim Sistemine \u0130li\u015fkin A\u00e7\u0131klamalar<\/p>\n<p>Hukuk sistemimiz yabanc\u0131lar i\u00e7in izin sistemini kabul ederken, vatanda\u015flar i\u00e7in bildirim sistemini kabul etmektedir. Bu kapsamda 2911 say\u0131l\u0131 kanun uyar\u0131nca yap\u0131lacak toplant\u0131lar, fiil ehliyetine sahip ve on sekiz ya\u015f\u0131n\u0131 doldurmu\u015f, en az yedi ki\u015fiden olu\u015fan bir d\u00fczenleme kurulu taraf\u0131ndan d\u00fczenlenmektedir. Bu kurul, kendi aralar\u0131ndan birini ba\u015fkan olarak se\u00e7mekte ve diplomatik dokunulmazl\u0131klar\u0131 bulunan ki\u015filer, d\u00fczenleme kurulu ba\u015fkan veya \u00fcyesi olamamaktad\u0131r. T\u00fczel ki\u015filerin toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenlemeleri ise, yetkili organlar\u0131n\u0131n karar\u0131na ba\u011fl\u0131 olmaktad\u0131r.<\/p>\n<p>Bu bildirimde; toplant\u0131n\u0131n amac\u0131 ile yap\u0131laca\u011f\u0131 yer, g\u00fcn, ba\u015flay\u0131\u015f ve biti\u015f saatleri ile d\u00fczenleme kurulunun ba\u015fkan ile \u00fcyelerinin a\u00e7\u0131k kimlikleri, meslekleri, ikametgahlar\u0131 ve varsa \u00e7al\u0131\u015fma yerleri, belirtilmekle; bildirime y\u00f6netmelikte g\u00f6sterilen belgeler eklenmektedir. Bu bildirim kar\u015f\u0131l\u0131\u011f\u0131nda g\u00fcn ve saati g\u00f6steren al\u0131nd\u0131 belgesi verilmesi zorunlu olup; bildirimin, valilik veya kaymakaml\u0131k\u00e7a kabul edilmemesi veya kar\u015f\u0131l\u0131\u011f\u0131nda al\u0131nd\u0131 belgesi verilmemesi halinde, keyfiyet bir tutanakla tespit edilerek ihbar noter vas\u0131tas\u0131yla yap\u0131lmaktad\u0131r. \u0130hbar saati, bildirimin verilme saati say\u0131lmaktad\u0131r. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; bildirim sisteminin izin sistemine d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine y\u00f6nelik k\u00f6t\u00fc niyetli veya yasaklay\u0131c\u0131 yakla\u015f\u0131mlara kar\u015f\u0131, a\u00e7\u0131klanan temel hak ve h\u00fcrriyetin kullan\u0131m\u0131 noktas\u0131nda teredd\u00fcde yer b\u0131rakmayacak nitelikte d\u00fczenlemenin yap\u0131lmas\u0131 ve bildirimin, noter kanal\u0131yla ihbar \u015feklinde yap\u0131lmas\u0131n\u0131n kabul edilmesi, son derece yerindedir. Zira aksi halde anayasal hakk\u0131n, keyfi \u015fekilde engellenmesi, geciktirilmesi veya yasaklanmas\u0131 s\u00f6z konusu olacakt\u0131r.<\/p>\n<p>2. Toplant\u0131 ve G\u00f6steri Y\u00fcr\u00fcy\u00fc\u015f\u00fc Yerleri<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015fleri, t\u00fcm il ve il\u00e7e s\u0131n\u0131rlar\u0131 i\u00e7erisinde her yerde yap\u0131labilmektedir. Ancak\u00a0 bu husus, yer bak\u0131m\u0131ndan hi\u00e7bir s\u0131n\u0131r\u0131n olmad\u0131\u011f\u0131 anlam\u0131na gelmemektedir. Zira il ve il\u00e7elerde toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131, kamu d\u00fczenini ve genel asayi\u015fi bozmayacak, vatanda\u015flar\u0131n g\u00fcnl\u00fck ya\u015fam\u0131n\u0131 a\u015f\u0131r\u0131 ve katlan\u0131lmaz derecede zorla\u015ft\u0131rmayacak \u015fekilde ve yasakl\u0131 yerlere ili\u015fkin m. 22\/1\u2019de yer alan s\u0131n\u0131rlamalara uyulmas\u0131 kayd\u0131yla mahallin en b\u00fcy\u00fck m\u00fclki amiri taraf\u0131ndan belirlenmektedir. Ancak bu belirleme yap\u0131l\u0131rken, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nde grubu bulunan siyasi partilerin il ve il\u00e7e temsilcileri ile g\u00fczerg\u00e2h\u0131n ge\u00e7ece\u011fi il\u00e7e ve il belediye ba\u015fkanlar\u0131n\u0131n, en \u00e7ok \u00fcyeye sahip \u00fc\u00e7 sendikan\u0131n ve kamu kurumu niteli\u011findeki meslek kurulu\u015flar\u0131n\u0131n il ve il\u00e7e temsilcilerinin g\u00f6r\u00fc\u015flerinin al\u0131nmas\u0131 gerekmektedir.<\/p>\n<p>\u0130l ve il\u00e7enin b\u00fcy\u00fckl\u00fc\u011f\u00fc, geli\u015fmi\u015fli\u011fi ve yerle\u015fim \u00f6zellikleri dikkate al\u0131narak birden fazla toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131 belirlenebilmekte olup; belirlenen toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131, yerel gazeteler ve internet haber siteleri ile valilik ve kaymakaml\u0131k internet sitelerinden ilan edilerek halka duyurulmaktad\u0131r. Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015fleri yer ve g\u00fczerg\u00e2h\u0131 hakk\u0131nda sonradan yap\u0131lacak de\u011fi\u015fiklikler de, ayn\u0131 y\u00f6ntemle yap\u0131lmakta ve bu de\u011fi\u015fiklikler, duyurudan on be\u015f g\u00fcn sonra ge\u00e7erli olmaktad\u0131r. Birden fazla toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yer ve g\u00fczerg\u00e2h\u0131n\u0131n belirlendi\u011fi il ve il\u00e7elerde d\u00fczenleme kurulu, belirlenen yer ve g\u00fczerg\u00e2hlardan kamu d\u00fczenini ve genel asayi\u015fi bozmayacak birisini tercih edebilme hakk\u0131na sahip bulunmaktad\u0131r.<\/p>\n<p>D. H\u00fckm\u00fcn, emredici nitelikte olmas\u0131 sebebiyle karinenin, kesin ve ayn\u0131 zamanda kanuni karine oldu\u011fu de\u011ferlendirilmekte ve adi karineden farkl\u0131 olarak aksinin ispat\u0131na imkan bulunmamaktad\u0131r.<\/p>\n<p>III. F\u0131kras\u0131 Uyar\u0131nca Kabul Edilen Hususlar<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn s\u0131n\u0131rlanmas\u0131 denildi\u011finde; \u00f6ncelikli olarak Anayasan\u0131n 13. maddesinin dikkate al\u0131nmas\u0131 gerekmektedir. Zira Anayasan\u0131n Temel Haklar ve \u00d6devler ba\u015fl\u0131kl\u0131 ikinci k\u0131sm\u0131n\u0131n Genel H\u00fck\u00fcmler ba\u015fl\u0131kl\u0131 birinci b\u00f6l\u00fcm\u00fcnde yer alan 13. maddesi ile temel hak ve h\u00fcrriyetlerin, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilece\u011fi; bu s\u0131n\u0131rlamalar\u0131n, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamayaca\u011f\u0131 d\u00fczenlenmektedir. Bu kapsamda temel hak ve h\u00fcrriyetlerden biri olan toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131 da Anayasan\u0131n 13. maddesi h\u00fck\u00fcmlerine tabi olmaktad\u0131r. Ba\u015fka bir anlat\u0131mla s\u00f6z konusu anayasal hak bak\u0131m\u0131ndan da, genel h\u00fck\u00fcmlerde yer alan m. 13 h\u00fckm\u00fc uygulama alan\u0131 bulmaktad\u0131r.<\/p>\n<p>Temel hak ve h\u00fcrriyetlerin s\u0131n\u0131rlanmas\u0131n\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla yap\u0131lmas\u0131 zorunlu olup; bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gerekleri ile \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamamaktad\u0131r.<\/p>\n<p>Anayasan\u0131n 34. maddesinin 2. f\u0131kras\u0131nda yer alan \u00f6zel s\u0131n\u0131rlama sebepleri dikkate al\u0131nd\u0131\u011f\u0131nda; AY m. 13 ile m. 34\u2019te yer alan anayasal h\u00fck\u00fcmlerin birlikte de\u011ferlendirilmesi sonucu; toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc hakk\u0131n\u0131n ancak,\u00a0mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131\u011f\u0131n ve genel ahl\u00e2k\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 amac\u0131yla ve kanunla s\u0131n\u0131rlanabildi\u011fi; ancak m. 13\u2019te yer alan s\u0131n\u0131rlaman\u0131n s\u0131n\u0131rlar\u0131n\u0131n ihlal edilmemesinin ve temel hak ve h\u00fcrriyetlerin \u00f6zlerine dokunulmamas\u0131n\u0131n zorunlu oldu\u011fu g\u00f6r\u00fclmektedir. \u0130\u015fte bu dokunulmamas\u0131 gereken k\u0131s\u0131m, \u00e7ekirdek hakk\u0131 ifade etmekte olup, \u00e7ekirdek hakk\u0131n s\u0131n\u0131rlanamamas\u0131 esast\u0131r. Ancak her hak gibi temel hak ve h\u00fcrriyetlerin de k\u00f6t\u00fcye kullan\u0131lamamas\u0131 gerekli ve ayn\u0131 zamanda zorunludur.\u00a0<\/p>\n<p>b. Anayasan\u0131n 15. Maddesi Uyar\u0131nca Kabul Edilen Hususlar <\/p>\n<p>Sava\u015f, seferberlik veya ola\u011fan\u00fcst\u00fc hallerde, milletleraras\u0131 hukuktan do\u011fan y\u00fck\u00fcml\u00fcl\u00fckler ihlal edilmemek kayd\u0131yla, durumun gerektirdi\u011fi \u00f6l\u00e7\u00fcde temel hak ve h\u00fcrriyetlerin kullan\u0131lmas\u0131 k\u0131smen veya tamamen durdurulabilmekte veya bunlar i\u00e7in Anayasada \u00f6ng\u00f6r\u00fclen g\u00fcvencelere ayk\u0131r\u0131 tedbirler al\u0131nabilmekte; ancak bu hallerde dahi, sava\u015f hukukuna uygun fiiller sonucu meydana gelen \u00f6l\u00fcmler d\u0131\u015f\u0131nda, ki\u015finin ya\u015fama hakk\u0131na, maddi ve manevi varl\u0131\u011f\u0131n\u0131n b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamamakta; kimse din, vicdan, d\u00fc\u015f\u00fcnce ve kanaatlerini a\u00e7\u0131klamaya zorlanamamakta ve bunlardan dolay\u0131 su\u00e7lanamamakta; su\u00e7 ve cezalar ge\u00e7mi\u015fe y\u00fcr\u00fct\u00fclememekte; su\u00e7lulu\u011fu mahkeme karar\u0131 ile saptan\u0131ncaya kadar kimse su\u00e7lu say\u0131lamamaktad\u0131r. AY m. 15 ile, belirtilen ola\u011fan d\u0131\u015f\u0131 zaman ve durumlarda dahi, hi\u00e7bir \u015fekilde s\u0131n\u0131rlanamayan temel ve hak h\u00fcrriyetler say\u0131lmaktad\u0131r.<\/p>\n<p>c. Yabanc\u0131lar Hakk\u0131nda S\u0131n\u0131rlama<\/p>\n<p>Anayasan\u0131n 16. maddesi uyar\u0131nca; temel hak ve h\u00fcrriyetler, yabanc\u0131lar i\u00e7in, milletleraras\u0131 hukuka uygun olarak kanunla s\u0131n\u0131rlanabilmektedir.<\/p>\n<p>2. Yasal D\u00fczenlemeler<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc bak\u0131m\u0131ndan iki farkl\u0131 s\u0131n\u0131rlama s\u00f6z konusu olmaktad\u0131r. Bunlardan ilki, erteleme; di\u011feri de, yasaklama \u015feklinde kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>a. Ge\u00e7ici S\u00fcreyle Erteleme<\/p>\n<p>Bir il s\u0131n\u0131r\u0131 i\u00e7inde ayn\u0131 g\u00fcnde birden \u00e7ok toplant\u0131 yap\u0131lmak istenmesi halinde valinin; emrindeki g\u00fcvenlik kuvvetlerinin ve gerekti\u011finde yararlanabilece\u011fi di\u011fer g\u00fc\u00e7lerin bu toplant\u0131lar\u0131n g\u00fcvenlik i\u00e7inde yap\u0131lmas\u0131n\u0131 sa\u011flamaya yeterli olmad\u0131\u011f\u0131 kan\u0131s\u0131na varmas\u0131 halinde, toplant\u0131lardan bir k\u0131sm\u0131n\u0131 on g\u00fcn\u00fc a\u015fmamak \u00fczere bir kez erteleyebilme yetkisi bulunmaktad\u0131r. Ancak bu ertelemede m\u00fcracaat \u00f6nceli\u011fi g\u00f6z \u00f6n\u00fcnde bulundurulmak zorunda olup; bu h\u00fck\u00fcm, emredici nitelikte bulunmaktad\u0131r.<\/p>\n<p>Bir b\u00f6lge valili\u011fine ba\u011fl\u0131 illerden, birden \u00e7ok ilde ayn\u0131 g\u00fcnde toplant\u0131 yapmak i\u00e7in bildirim verilmesi \u00fczerine, toplant\u0131 g\u00fcvenli\u011fini sa\u011flamak amac\u0131yla ilgili valilerce b\u00f6lge valili\u011finden takviye istenmesi ve b\u00f6lge valisinin bu isteklerin kar\u015f\u0131lanamayaca\u011f\u0131 kan\u0131s\u0131na varmas\u0131 halinde; b\u00f6lge valili\u011fince, takviye g\u00f6nderilemeyen illerdeki toplant\u0131lar, on g\u00fcn\u00fc a\u015fmamak \u00fczere bir kez ertelenebilmektedir.<\/p>\n<p>Ayn\u0131 g\u00fcnde birden \u00e7ok b\u00f6lge valili\u011fine ba\u011fl\u0131 illerde toplant\u0131 yapmak i\u00e7in bildirim verilmesi \u00fczerine, toplant\u0131 g\u00fcvenli\u011fini sa\u011flamak amac\u0131yla ilgili b\u00f6lge valilerince \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019ndan takviye istenmesi ve \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019nca bu isteklerin kar\u015f\u0131lanamayaca\u011f\u0131 kan\u0131s\u0131na var\u0131lmas\u0131 halinde; \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019nca, takviye g\u00f6nderilemeyen b\u00f6lge valili\u011fine ba\u011fl\u0131 illerdeki toplant\u0131lar, on g\u00fcn\u00fc a\u015fmamak \u00fczere bir kez ertelenebilmektedir. Ertelemede m\u00fcracaat \u00f6nceli\u011fi de g\u00f6z \u00f6n\u00fcnde bulundurulmak zorundad\u0131r.<\/p>\n<p>Vali veya kaymakamlarca ertelenen veya yasaklanan toplant\u0131lara ili\u015fkin gerek\u00e7eli erteleme veya yasaklama kararlar\u0131, ilgililere tebli\u011f edilmekte olup; bu kararlar hakk\u0131nda, b\u00f6lge valili\u011fine ve \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na, b\u00f6lge valilerince ertelenen veya yasaklanan toplant\u0131lar i\u00e7inse \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na bilgi verilmesi zorunlu olmaktad\u0131r.\u00a0<\/p>\n<p>b. Ge\u00e7ici S\u00fcreyle Olmayan Erteleme veya Yasaklama<\/p>\n<p>B\u00f6lge valisi, vali veya kaymakam; mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131\u011f\u0131n ve genel ahl\u00e2k\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 amac\u0131yla belirli bir toplant\u0131y\u0131, bir ay\u0131 a\u015fmamak \u00fczere erteleyebilme veya su\u00e7 i\u015flenece\u011fine dair a\u00e7\u0131k ve yak\u0131n tehlikenin mevcut olmas\u0131 h\u00e2linde, yasaklayabilme yetkisine sahiptir.<\/p>\n<p>B\u00f6lge valisi; mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131\u011f\u0131n ve genel ahl\u00e2k\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 amac\u0131yla b\u00f6lgeye dahil illerin birinde veya birka\u00e7\u0131nda ya da bir ilin bir veya birka\u00e7 il\u00e7esinde b\u00fct\u00fcn toplant\u0131lar\u0131 bir ay\u0131 ge\u00e7memek \u00fczere erteleyebilmektedir. Benzer \u015fekilde valiler de ayn\u0131 sebeplere dayal\u0131 olarak ve su\u00e7 i\u015flenece\u011fine dair a\u00e7\u0131k ve yak\u0131n tehlikenin mevcut olmas\u0131 h\u00e2linde; ile ba\u011fl\u0131 il\u00e7elerin birinde veya birka\u00e7\u0131nda b\u00fct\u00fcn toplant\u0131lar\u0131 bir ay\u0131 ge\u00e7memek \u00fczere yasaklayabilme yetkisine haizdir. Yasaklama karar\u0131, gerek\u00e7eli olarak verilmek zorunda olup; karar\u0131n \u00f6zetinin, yasaklaman\u0131n uygulanaca\u011f\u0131 yerlerde mutat vas\u0131talarla ilan edilmesi ve ayr\u0131ca \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na bilgi verilmesi gerekmektedir.<\/p>\n<p>IV. YASAKLAR VE CEZALAR<\/p>\n<p>A. Yasaklar<\/p>\n<p>Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerinin; yasakl\u0131 yerlerde (parklarda, mabetlerde, kamu hizmeti g\u00f6r\u00fclen bina ve tesislerde ve bunlar\u0131n eklentilerinde ve T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019ne bir kilometre uzakl\u0131ktaki alan i\u00e7inde) veya bildirimsiz ya da belirtilen g\u00fcn ve saat d\u0131\u015f\u0131nda; ba\u015fta ate\u015fli silahlar veya havai fi\u015fek, molotof ve benzeri el yap\u0131m\u0131 olanlar d\u00e2hil patlay\u0131c\u0131 maddeler veya her t\u00fcrl\u00fc kesici, delici aletler veya ta\u015f, sopa, demir ve lastik \u00e7ubuklar, bo\u011fma teli veya zincir, demir bilye ve sapan gibi bereleyici ve bo\u011fucu ara\u00e7lar veya yak\u0131c\u0131, a\u015f\u0131nd\u0131r\u0131c\u0131, yaralay\u0131c\u0131 eczalar veya di\u011fer her t\u00fcrl\u00fc zehirler veya her t\u00fcrl\u00fc sis, gaz ve benzeri maddeler ile yasa d\u0131\u015f\u0131 \u00f6rg\u00fct ve topluluklara ait amblem ve i\u015faret ta\u015f\u0131narak veya bu i\u015faret ve amblemleri \u00fczerinde bulunduran \u00fcniformay\u0131 and\u0131r\u0131r giysiler giyilerek veya kimliklerini gizlemek amac\u0131yla y\u00fczlerini tamamen veya k\u0131smen bez vesair unsurlarla \u00f6rterek, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerine kat\u0131lmak \u015feklinde; kanunlar\u0131n su\u00e7 sayd\u0131\u011f\u0131 nitelik ta\u015f\u0131yan afi\u015f, pankart, d\u00f6viz, resim, levha, ara\u00e7 ve gere\u00e7ler ta\u015f\u0131narak veya bu nitelikte sloganlar s\u00f6ylenerek veya ses cihazlar\u0131 ile yay\u0131nlanmak olmak \u00fczere kanunda belirtilen di\u011fer esaslara ayk\u0131r\u0131 \u015fekilde; kanun uyar\u0131nca al\u0131nan ertelenme ve yasaklanma karar ve hallerine muhalefet ile; propaganda ve \u00e7a\u011fr\u0131 alet ve ara\u00e7lar\u0131nda; halk\u0131 su\u00e7 i\u015flemeye \u00f6zendiren veya k\u0131\u015fk\u0131rtan yaz\u0131 veya resim bulundurulmas\u0131 suretiyle; toplant\u0131 veya g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn yap\u0131laca\u011f\u0131 tarihten bir \u00f6nceki g\u00fcnden toplant\u0131 veya g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcn\u00fcn ba\u015flayaca\u011f\u0131 saate kadar, g\u00fcne\u015fin do\u011fu\u015fundan bat\u0131\u015f\u0131na kadarki zaman i\u00e7inde olmak kayd\u0131yla ses y\u00fckselten veya ileten herhangi bir alet veya ara\u00e7 ile \u00e7a\u011fr\u0131 yap\u0131labilmesi dikkate al\u0131nd\u0131\u011f\u0131nda, bu s\u00fcre d\u0131\u015f\u0131nda \u00e7a\u011fr\u0131 i\u00e7in s\u00f6z\u00fc ge\u00e7en alet veya ara\u00e7lar\u0131n kullan\u0131lmas\u0131yla; kapal\u0131 yer toplant\u0131lar\u0131nda, ses y\u00fckseltici alet veya ara\u00e7larla d\u0131\u015far\u0131ya yay\u0131n yap\u0131lmas\u0131yla; halka kar\u015f\u0131, do\u011frudan do\u011fruya veya ses y\u00fckselten veya ileten herhangi bir alet veya ara\u00e7 ile s\u00f6z s\u00f6yleyerek veya seslenerek veya bas\u0131lm\u0131\u015f veya \u00e7o\u011falt\u0131lm\u0131\u015f veya elle yaz\u0131lm\u0131\u015f veya \u00e7izilmi\u015f ka\u011f\u0131tlar\u0131 duvarlara veya di\u011fer yerlere yap\u0131\u015ft\u0131rarak veya da\u011f\u0131tarak veya benzeri ara\u00e7 ve yollarla halk\u0131 kanuna ayk\u0131r\u0131 toplant\u0131 veya y\u00fcr\u00fcy\u00fc\u015fe \u00f6zendirilmek veya k\u0131\u015fk\u0131rt\u0131lmak \u015feklinde yap\u0131lmas\u0131 yasakt\u0131r.<\/p>\n<p>B. Cezalar<\/p>\n<p>1. \u00d6zel Kanun<\/p>\n<p>2911 say\u0131l\u0131 kanunun cezai nitelikteki \u00f6zel h\u00fck\u00fcmleri ile; yasaklara ayk\u0131r\u0131 hareket edilmesi, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fcne veya devam\u0131na engel olunmas\u0131, huzur ve s\u00fckunu bozma fiillerinin i\u015flenmesi, kanuna ayk\u0131r\u0131 propaganda vas\u0131talar\u0131 ve su\u00e7 i\u015flemeye te\u015fvik etme halleri ile direnme (ihtara ve zor kullanmaya ra\u011fmen da\u011f\u0131lmamakta \u0131srar etme) fiillerinin sergilenmesi; toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015flerine, ate\u015fli silahlar veya havai fi\u015fek, molotof ve benzeri el yap\u0131m\u0131 olanlar d\u00e2hil patlay\u0131c\u0131 maddeler veya her t\u00fcrl\u00fc kesici, delici aletler veya ta\u015f, sopa, demir ve lastik \u00e7ubuklar, bo\u011fma teli veya zincir, demir bilye ve sapan gibi bereleyici ve bo\u011fucu ara\u00e7lar veya yak\u0131c\u0131, a\u015f\u0131nd\u0131r\u0131c\u0131, yaralay\u0131c\u0131 eczalar veya di\u011fer her t\u00fcrl\u00fc zehirler veya her t\u00fcrl\u00fc sis, gaz ve benzeri maddeler ta\u015f\u0131yarak veya kimliklerini gizlemek amac\u0131yla y\u00fczlerini tamamen veya k\u0131smen bez vesair unsurlarla \u00f6rterek ya da yasa d\u0131\u015f\u0131 \u00f6rg\u00fct ve topluluklara ait amblem ve i\u015faret ta\u015f\u0131yarak veya bu i\u015faret ve amblemleri \u00fczerinde bulunduran \u00fcniformay\u0131 and\u0131r\u0131r giysiler giyerek ya da kanunlar\u0131n su\u00e7 sayd\u0131\u011f\u0131 nitelik ta\u015f\u0131yan afi\u015f, pankart, d\u00f6viz, resim, levha, ara\u00e7 ve gere\u00e7ler ta\u015f\u0131yarak veya bu nitelikte sloganlar s\u00f6yleyerek veya ses cihazlar\u0131 ile yay\u0131nlayarak kat\u0131l\u0131m sa\u011flanmas\u0131 halinde,\u00a0 bu su\u00e7lar\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda yapt\u0131r\u0131m olarak h\u00fcrriyeti ba\u011flay\u0131c\u0131 nitelikte hapis cezalar\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>2. Genel Kanun<\/p>\n<p>2911 say\u0131l\u0131 yasada h\u00fck\u00fcm bulunmayan ve a\u00e7\u0131k\u00e7a su\u00e7 te\u015fkil etmesine ra\u011fmen \u00f6zel kanun kapsam\u0131nda d\u00fczenlenmeyen eylemler bak\u0131m\u0131ndan 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu uygulanmaktad\u0131r.<\/p>\n<p>3. Usul Kanunu <\/p>\n<p>Gerek 2911 say\u0131l\u0131 gerekse 5237 say\u0131l\u0131 kanunlar\u0131n kapsam\u0131na giren su\u00e7lar\u0131n i\u015flenmesi halinde, soru\u015fturma ve yarg\u0131lama usul\u00fc bak\u0131m\u0131ndan 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu uygulama alan\u0131 bulmaktad\u0131r.<\/p>\n<p>V.
