Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131nda, terfileri 27\/7\/1967 tarihli ve 926 say\u0131l\u0131 T\u00fcrk Sil\u00e2hl\u0131 Kuvvetleri Personel Kanunu, 28\/5\/1988 tarihli ve 3466 say\u0131l\u0131 Uzman Jandarma Kanunu, 18\/3\/1986 tarihli ve 3269 say\u0131l\u0131 Uzman Erba\u015f Kanunu ve 10\/3\/2011 tarihli ve 6191 say\u0131l\u0131 S\u00f6zle\u015fmeli Erba\u015f ve Er Kanunu h\u00fck\u00fcmlerine tabi olan personelin;<\/p>\n<p>\u00a0a) K\u0131sa s\u00fcreli durdurma cezas\u0131 verilmesini gerektiren hallerde br\u00fct ayl\u0131klar\u0131n\u0131n 1\/5\u2019i ila 1\/4\u2019\u00fc,.<\/p>\n<p>b) Uzun s\u00fcreli durdurma cezas\u0131 verilmesini gerektiren hallerde br\u00fct ayl\u0131klar\u0131n\u0131n 1\/3\u2019\u00fc ila 1\/2\u2019si,<\/p>\n<p>kesilir.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Kadir \u00d6ZKAYA, Hasan Tahsin G\u00d6KCAN, Basri BA\u011eCI, Engin YILDIRIM, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, \u0130rfan F\u0130DAN, Kenan YA\u015eAR, Muhterem \u0130NCE, Y\u0131lmaz AK\u00c7\u0130L, \u00d6mer \u00c7INAR ve Metin KIRATLI\u2019n\u0131n kat\u0131l\u0131mlar\u0131yla 16\/1\/2025 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda dosyada eksiklik bulunmad\u0131\u011f\u0131ndan i\u015fin esas\u0131n\u0131n incelenmesine OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r Burcu TA\u015eYAPAN taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fckm\u00fc, dayan\u0131lan Anayasa kural\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Genel A\u00e7\u0131klama<\/p>\n<p>3. 4\/1\/1961 tarihli ve 211 say\u0131l\u0131 T\u00fcrk Sil\u00e2hl\u0131 Kuvvetleri \u0130\u00e7 Hizmet Kanunu\u2019nun 1. maddesinde T\u00fcrk Sil\u00e2hl\u0131 Kuvvetleri (TSK); Kara, Deniz ve Hava Kuvvetleri subay, asker\u00ee memur, astsubay, erba\u015f ve erleri ile asker\u00ee \u00f6\u011frencilerden olu\u015fan ve seferde ihtiyatlarla ikmal edilen, kadro ve kurulu\u015flarla te\u015fkilat\u0131 g\u00f6sterilen silahl\u0131 devlet kuvveti olarak tan\u0131mlanm\u0131\u015ft\u0131r. S\u00f6z konusu maddede daha \u00f6nce Kara, Deniz ve Hava Kuvvetlerinin yan\u0131nda \u201c\u2026Jandarma\u2026\u201d ve \u201c\u2026Sahil G\u00fcvenlik\u2026\u201d ibareleri de yer almaktayken an\u0131lan ibareler 1\/2\/2018 tarihli ve 7073 say\u0131l\u0131 Kanun\u2019un 1. maddesiyle madde metninden \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla jandarma ve sahil g\u00fcvenlik te\u015fkilat\u0131 TSK\u2019n\u0131n bir unsuru olarak belirlenmemi\u015ftir.<\/p>\n<p>4. 10\/3\/1983 tarihli ve 2803 say\u0131l\u0131 Jandarma Te\u015fkilat, G\u00f6rev ve Yetkileri Kanunu\u2019nun 3. maddesinde T\u00fcrkiye Cumhuriyeti Jandarmas\u0131, emniyet ve asayi\u015f ile kamu d\u00fczeninin korunmas\u0131n\u0131 sa\u011flayan, di\u011fer kanunlar\u0131n ve Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin verdi\u011fi g\u00f6revleri yerine getiren silahl\u0131 genel kolluk kuvveti \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r. An\u0131lan Kanun\u2019un personele uygulanacak mevzuata ili\u015fkin d\u00fczenlemelerin yer ald\u0131\u011f\u0131 13. maddesinin birinci f\u0131kras\u0131nda jandarma hizmetleri s\u0131n\u0131f\u0131 personeline nas\u0131p ve terfi, ayl\u0131k ve di\u011fer mali ve sosyal haklar bak\u0131m\u0131ndan stat\u00fc ve r\u00fctbelerine g\u00f6re 27\/7\/1967 tarihli ve 926 say\u0131l\u0131 T\u00fcrk Sil\u00e2hl\u0131 Kuvvetleri Personel Kanunu, 13\/6\/2001 tarihli ve 4678 say\u0131l\u0131 T\u00fcrk Sil\u00e2hl\u0131 Kuvvetlerinde \u0130stihdam Edilecek S\u00f6zle\u015fmeli Subay ve Astsubaylar Hakk\u0131nda Kanun, 28\/5\/1988 tarihli ve 3466 say\u0131l\u0131 Uzman Jandarma Kanunu, 18\/3\/1986 tarihli ve 3269 say\u0131l\u0131 Uzman Erba\u015f Kanunu ile 10\/3\/2011 tarihli ve 6191 say\u0131l\u0131 S\u00f6zle\u015fmeli Erba\u015f ve Er Kanunu\u2019na tabi personel hakk\u0131ndaki h\u00fck\u00fcmlerin uygulanaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>5. 9\/7\/1982 tarihli ve 2692 say\u0131l\u0131 Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 Kanunu\u2019nun 2. maddesinde Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131n\u0131n \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 silahl\u0131 bir genel kolluk kuvveti oldu\u011fu belirtilmi\u015ftir. An\u0131lan Kanun\u2019un personele uygulanacak mevzuata ili\u015fkin d\u00fczenlemelerin yer ald\u0131\u011f\u0131 7. maddesinin birinci f\u0131kras\u0131nda Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 personelinin subay, astsubay, uzman erba\u015f, s\u00f6zle\u015fmeli erba\u015f ve er, \u00f6\u011frenci, erba\u015f ve erler ile devlet memuru, s\u00f6zle\u015fmeli personel ve i\u015f\u00e7ileri kapsad\u0131\u011f\u0131 ifade edilmi\u015f; sahil g\u00fcvenlik hizmetleri s\u0131n\u0131f\u0131 personeline nas\u0131p ve terfi, ayl\u0131k ve di\u011fer mali ve sosyal haklar bak\u0131m\u0131ndan stat\u00fc ve r\u00fctbelerine g\u00f6re 926 say\u0131l\u0131 Kanun\u2019a tabi personel hakk\u0131ndaki h\u00fck\u00fcmlerin uygulanaca\u011f\u0131, s\u00f6zle\u015fmeli subay ve astsubaylar\u0131n 4678 say\u0131l\u0131 Kanun\u2019a, uzman erba\u015flar\u0131n 3269 say\u0131l\u0131 Kanun\u2019a, s\u00f6zle\u015fmeli erba\u015f ve erlerin ise 6191 say\u0131l\u0131 Kanun\u2019a tabi oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>6. Buna g\u00f6re Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 b\u00fcnyesinde g\u00f6rev yapan personelin hukuki ve idari a\u00e7\u0131dan TSK mensubu olmamakla birlikte terfi sistemi bak\u0131m\u0131ndan meslek itibar\u0131yla emsalleri olan TSK mensuplar\u0131n\u0131n kanunlar\u0131na tabi k\u0131l\u0131nd\u0131klar\u0131, dolay\u0131s\u0131yla bunlar\u0131n r\u00fctbeleri, bekleme s\u00fcreleri, nas\u0131plar\u0131, r\u00fctbe terfisi ve kademe ilerlemesi \u015fartlar\u0131 gibi hususlar\u0131n s\u00f6z konusu kanunlarda d\u00fczenlenen usul ve esaslara g\u00f6re belirlenece\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>B. Anlam ve Kapsam<\/p>\n<p>7. 7068 say\u0131l\u0131 Kanun Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 personeline ili\u015fkin disiplinsizlik h\u00e2lleri ile cezalar\u0131n\u0131, disiplin amirlerini ve kurullar\u0131n\u0131, disiplin soru\u015fturma usul\u00fcn\u00fc ve ilgili di\u011fer hususlar\u0131 d\u00fczenlemektedir. An\u0131lan Kanun\u2019un 2. maddesine g\u00f6re Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc te\u015fkilat\u0131nda \u00e7al\u0131\u015fan her s\u0131n\u0131ftan memurlar, Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 te\u015fkilatlar\u0131nda g\u00f6rev yapan subay, astsubay, s\u00f6zle\u015fmeli subay, s\u00f6zle\u015fmeli astsubay, uzman jandarma, uzman erba\u015f, s\u00f6zle\u015fmeli erba\u015f ve s\u00f6zle\u015fmeli erler ile di\u011fer s\u0131n\u0131flardaki memurlar kanun kapsam\u0131nda yer almaktad\u0131r.<\/p>\n<p>8. Kanun\u2019un 7. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda fiilin niteli\u011fine g\u00f6re personele verilebilecek disiplin cezalar\u0131 uyarma, k\u0131nama, ayl\u0131ktan kesme, k\u0131sa s\u00fcreli durdurma, uzun s\u00fcreli durdurma, meslekten \u00e7\u0131karma ve devlet memurlu\u011fundan \u00e7\u0131karma cezas\u0131 olarak belirlenmi\u015ftir. An\u0131lan f\u0131kran\u0131n (\u00e7) bendinde k\u0131sa s\u00fcreli durdurman\u0131n personelin bulundu\u011fu kademede ilerlemesinin d\u00f6rt, alt\u0131 veya on ay s\u00fcre ile durdurulmas\u0131 oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>9. Kanun\u2019un disiplin cezas\u0131 verilecek fiillerin d\u00fczenlendi\u011fi 8. maddesinin (4) numaral\u0131 f\u0131kras\u0131nda k\u0131sa s\u00fcreli durdurma cezas\u0131n\u0131 gerektiren fiiller g\u00f6sterilmi\u015ftir. \u0130tiraz konusu kural ise Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131nda, terfileri 926, 3466, 3269 ve 6191 say\u0131l\u0131 Kanunlara tabi olan personelin k\u0131sa s\u00fcreli durdurma cezas\u0131 verilmesini gerektiren h\u00e2llerde br\u00fct ayl\u0131klar\u0131n\u0131n 1\/5\u2019i ila 1\/4\u2019\u00fcn\u00fcn kesilmesini \u00f6ng\u00f6rmektedir.<\/p>\n<p>10. Bu itibarla kuralla terfileri Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc te\u015fkilat\u0131 personeline uygulanan terfi usul ve esaslar\u0131ndan ayr\u0131, aslen TSK personeli i\u00e7in benimsenmi\u015f kendine \u00f6zg\u00fc bir terfi sistemine tabi k\u0131l\u0131nan Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 personelinin k\u0131sa s\u00fcreli durdurma cezas\u0131yla cezaland\u0131r\u0131lmas\u0131n\u0131 gerektiren bir fiil i\u015flemesi h\u00e2linde bu cezan\u0131n s\u00f6z konusu personele ne \u015fekilde uygulanaca\u011f\u0131na y\u00f6nelik bir d\u00fczenleme getirilmi\u015ftir. Kural uyar\u0131nca b\u00f6yle bir durumda an\u0131lan personelin bulundu\u011fu kademede ilerlemesinin durdurulmas\u0131 yoluna gidilmeksizin br\u00fct ayl\u0131\u011f\u0131ndan 1\/5 ila 1\/4 oran\u0131nda kesinti yap\u0131lmas\u0131 gerekmektedir. Nitekim kural\u0131n gerek\u00e7esinde k\u0131sa s\u00fcreli durdurma ve uzun s\u00fcreli durdurma cezas\u0131 verilmesini gerektiren disiplinsizlikleri i\u015fleyen subay, astsubay, uzman jandarma, uzman erba\u015f ve s\u00f6zle\u015fmeli erba\u015f ve erler bak\u0131m\u0131ndan s\u00f6z konusu disiplinsizli\u011fin cezas\u0131n\u0131n ayl\u0131ktan kesme cezas\u0131 olarak uygulanmas\u0131n\u0131n sa\u011flanmas\u0131n\u0131n ama\u00e7land\u0131\u011f\u0131 ifade edilmi\u015ftir (benzer y\u00f6ndeki de\u011ferlendirme i\u00e7in bkz. AYM, E.2020\/17, K.2022\/5, 26\/1\/2022, \u00a7 15).<\/p>\n<p>C. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>11. Ba\u015fvuru karar\u0131nda \u00f6zetle; kuralda d\u00f6rt, alt\u0131 ve on ay \u015feklinde \u00fc\u00e7 farkl\u0131 k\u0131sa s\u00fcreli durdurma cezas\u0131n\u0131n bulunmas\u0131na kar\u015f\u0131n bu s\u00fcreler g\u00f6zetilmeksizin 1\/5 ila 1\/4 oran\u0131nda ayl\u0131ktan kesme cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, disiplin kurullar\u0131na s\u0131n\u0131rlar\u0131 belirsiz bir takdir yetkisinin verildi\u011fi, bu durumun cezalar\u0131n uygulanmas\u0131nda e\u015fitsizli\u011fe neden olaca\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2.,10., 11. ve 35. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>\u00c7. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>12. Anayasa Mahkemesi 26\/1\/2022 tarihli ve E.2020\/17, K.2022\/5 say\u0131l\u0131 karar\u0131nda 7068 say\u0131l\u0131 Kanunu\u2019nun 8. maddesinin (7) numaral\u0131 f\u0131kras\u0131n\u0131n (b) bendinde d\u00fczenlenen ve Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131nda, terfileri 926, 3466, 3269 ve 6191 say\u0131l\u0131 Kanunlara tabi olan personelin uzun s\u00fcreli durdurma cezas\u0131 verilmesini gerektiren h\u00e2llerde br\u00fct ayl\u0131klar\u0131n\u0131n 1\/3\u2019\u00fc ila 1\/2\u2019sinin kesilmesini \u00f6ng\u00f6ren kural\u0131 incelemi\u015f ve an\u0131lan bendin Anayasa\u2019n\u0131n 2. maddesine ayk\u0131r\u0131 olmad\u0131\u011f\u0131na karar vermi\u015ftir.<\/p>\n<p>13. An\u0131lan kararda ilk olarak hukuk devletinde ceza hukukuna ili\u015fkin d\u00fczenlemelerde oldu\u011fu gibi idari yapt\u0131r\u0131mlar ve bu kapsamda disiplin cezalar\u0131 a\u00e7\u0131s\u0131ndan da belirli bir disiplin cezas\u0131n\u0131n neyi ifade etti\u011finin ve o cezan\u0131n ilgilisine ne \u015fekilde uygulanaca\u011f\u0131n\u0131n, ba\u015fka bir deyi\u015fle cezan\u0131n hangi bi\u00e7imde infaz edilece\u011finin belirlenmesinin anayasal ilke ve s\u0131n\u0131rlar i\u00e7inde kanun koyucunun takdirinde oldu\u011fu ancak kanun koyucunun takdir yetkisi i\u00e7indeki bu t\u00fcr d\u00fczenlemeleri yaparken hukuk devleti ilkesinin bir gere\u011fi olan \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesiyle de ba\u011fl\u0131 oldu\u011funa dikkat \u00e7ekilmi\u015ftir (AYM, E.2020\/17, K.2022\/5, 26\/1\/2022, \u00a7\u00a7 19, 20).<\/p>\n<p>14. Bu kapsamda s\u00f6z konusu bentle, an\u0131lan f\u0131kra kapsam\u0131nda say\u0131lan personel bak\u0131m\u0131ndan uzun s\u00fcreli durdurma cezas\u0131n\u0131 gerektiren disiplinsizli\u011fin cezas\u0131n\u0131n personelin br\u00fct ayl\u0131\u011f\u0131ndan belirli bir oranda kesinti yap\u0131lmas\u0131 \u015feklinde uygulanmas\u0131n\u0131n \u00f6ng\u00f6r\u00fclmesi suretiyle Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131ndaki hiyerar\u015fik d\u00fczenin korunmas\u0131n\u0131n ve b\u00f6ylece bu kurumlar\u0131n g\u00f6rev alan\u0131ndaki kamu hizmetinin sa\u011fl\u0131kl\u0131 bir bi\u00e7imde y\u00fcr\u00fct\u00fclmesinin ama\u00e7land\u0131\u011f\u0131 belirtilmi\u015ftir (AYM, E.2020\/17, K.2022\/5, 26\/1\/2022, \u00a7 23).<\/p>\n<p>15.
