A\u011f\u0131r Ceza Mahkemesi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 4\/12\/2004 tarihli ve 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu\u2019nun;<\/p>\n<p>A. 142. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201c\u2026oturdu\u011fu yer\u2026\u201d ibaresinden sonra gelen \u201c&#8230;a\u011f\u0131r ceza mahkemesinde\u2026\u201d ve \u201c\u2026en yak\u0131n yer a\u011f\u0131r ceza mahkemesinde&#8230;\u201d ibarelerinin,<\/p>\n<p>B. 142. maddesinin (8) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201c\u2026Cumhuriyet savc\u0131s\u0131\u2026\u201d ibaresinin,<\/p>\n<p>C. 142. maddesine 1\/2\/2018 tarihli ve 7078 say\u0131l\u0131 Kanun\u2019un 139. maddesiyle eklenen (9) numaral\u0131 f\u0131kran\u0131n ikinci c\u00fcmlesinin,<\/p>\n<p>Anayasa\u2019n\u0131n 2., 37. ve 142. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptallerine karar verilmesi talebidir.<\/p>\n<p>OLAY: Koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda itiraz konusu kurallar\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptalleri i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN KANUN H\u00dcK\u00dcMLER\u0130<\/p>\n<p>Kanun\u2019un itiraz konusu kurallar\u0131n da yer ald\u0131\u011f\u0131 142. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201cTazminat isteminin ko\u015fullar\u0131<\/p>\n<p>Madde 142 \u2013 (1) Karar veya h\u00fck\u00fcmlerin kesinle\u015fti\u011finin ilgilisine tebli\u011finden itibaren \u00fc\u00e7 ay ve her h\u00e2lde karar veya h\u00fck\u00fcmlerin kesinle\u015fme tarihini izleyen bir y\u0131l i\u00e7inde tazminat isteminde bulunulabilir.<\/p>\n<p>\u00a0(2) \u0130stem, zarara u\u011frayan\u0131n oturdu\u011fu yer a\u011f\u0131r ceza mahkemesinde ve e\u011fer o yer a\u011f\u0131r ceza mahkemesi tazminat konusu i\u015flemle ili\u015fkili ise ve ayn\u0131 yerde ba\u015fka bir a\u011f\u0131r ceza dairesi yoksa, en yak\u0131n yer a\u011f\u0131r ceza mahkemesinde karara ba\u011flan\u0131r. (Ek c\u00fcmleler:2\/3\/2024-7499\/13 md.) Ancak, 141 inci maddenin birinci f\u0131kras\u0131n\u0131n (e), (f) ve (l) bentleri kapsam\u0131ndaki istemler bak\u0131m\u0131ndan 9\/1\/2013 tarihli ve 6384 say\u0131l\u0131 Tazminat Komisyonunun G\u00f6revleri ile \u00c7al\u0131\u015fma Usul ve Esaslar\u0131 Hakk\u0131nda Kanun h\u00fck\u00fcmleri uygulan\u0131r. Bu f\u0131kra uyar\u0131nca 6384 say\u0131l\u0131 Kanun kapsam\u0131nda olmas\u0131na ra\u011fmen a\u011f\u0131r ceza mahkemesine yap\u0131lan istemler, Komisyona g\u00f6nderilir. A\u011f\u0131r ceza mahkemesinin g\u00f6rev alan\u0131na giren ve girmeyen istemler birlikte yap\u0131lm\u0131\u015f ise a\u011f\u0131r ceza mahkemesi g\u00f6rev alan\u0131na girmeyen istemleri ay\u0131rmak suretiyle Komisyona g\u00f6nderir. Bu h\u00e2llerde a\u011f\u0131r ceza mahkemesine yap\u0131lan istem tarihi esas al\u0131n\u0131r.<\/p>\n<p>(3) Tazminat isteminde bulunan ki\u015finin dilek\u00e7esine, a\u00e7\u0131k kimlik ve adresini, zarara u\u011frad\u0131\u011f\u0131 i\u015flemin ve zarar\u0131n nitelik ve niceli\u011fini kaydetmesi ve bunlar\u0131n belgelerini eklemesi gereklidir.<\/p>\n<p>\u00a0(4) Dilek\u00e7esindeki bilgi ve belgelerin yetersizli\u011fi durumunda mahkeme, eksikli\u011fin bir ay i\u00e7inde giderilmesini, aksi h\u00e2lde istemin reddedilece\u011fini ilgiliye duyurur. S\u00fcresinde eksi\u011fi tamamlanmayan dilek\u00e7e, mahkemece, itiraz yolu a\u00e7\u0131k olmak \u00fczere reddolunur.<\/p>\n<p>\u00a0(5) Mahkeme, dosyay\u0131 inceledikten sonra yeterlili\u011fini belirledi\u011fi dilek\u00e7e ve eki belgelerin bir \u00f6rne\u011fini Devlet Hazinesinin kendi yarg\u0131 \u00e7evresindeki temsilcisine tebli\u011f ederek, varsa beyan ve itirazlar\u0131n\u0131 iki hafta i\u00e7inde yaz\u0131l\u0131 olarak bildirmesini ister.<\/p>\n<p>\u00a0(6) \u0130stemin ve ispat belgelerinin de\u011ferlendirilmesinde ve tazminat hukukunun genel prensiplerine g\u00f6re verilecek tazminat miktar\u0131n\u0131n saptanmas\u0131nda mahkeme gerekli g\u00f6rd\u00fc\u011f\u00fc her t\u00fcrl\u00fc ara\u015ft\u0131rmay\u0131 yapmaya veya h\u00e2kimlerinden birine yapt\u0131rmaya yetkilidir.<\/p>\n<p>\u00a0(7) (De\u011fi\u015fik: 25\/5\/2005 &#8211; 5353\/20 md.) Mahkeme, karar\u0131n\u0131 duru\u015fmal\u0131 olarak verir. \u0130stemde bulunan ile Hazine temsilcisi, a\u00e7\u0131klamal\u0131 \u00e7a\u011fr\u0131 k\u00e2\u011f\u0131d\u0131 tebli\u011fine ra\u011fmen gelmezlerse, yokluklar\u0131nda karar verilebilir.<\/p>\n<p>\u00a0(8) Karara kar\u015f\u0131, istemde bulunan, Cumhuriyet savc\u0131s\u0131 veya Hazine temsilcisi, istinaf yoluna ba\u015fvurabilir; inceleme \u00f6ncelikle ve ivedilikle yap\u0131l\u0131r. (Ek c\u00fcmleler:2\/3\/2024-7499\/13 md.) Karar yerinde g\u00f6r\u00fclmezse b\u00f6lge adliye mahkemesince i\u015fin esas\u0131 hakk\u0131nda karar verilir. B\u00f6lge adliye mahkemelerince bu f\u0131kra uyar\u0131nca verilen kararlar kesindir.<\/p>\n<p>\u00a0(9) (Ek: 15\/8\/2017-KHK-694\/144 md.; Aynen kabul: 1\/2\/2018-7078\/139 md.) Tazminat davalar\u0131 nedeniyle Avukatl\u0131k Asgari \u00dccret Tarifesi gere\u011fince hesaplanan nisb\u00ee avukatl\u0131k \u00fccreti \u00f6denir. Ancak, \u00f6denecek miktar Tarifede sulh ceza h\u00e2kimliklerinde takip edilen i\u015fler i\u00e7in belirlenen maktu \u00fccretten az, a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenen maktu \u00fccretten fazla olamaz.<\/p>\n<p>\u00a0(10) (Ek: 15\/8\/2017-KHK-694\/144 md.; Aynen kabul: 1\/2\/2018-7078\/139 md.) Tazminata ili\u015fkin mahkeme kararlar\u0131, kesinle\u015fmeden ve idari ba\u015fvuru s\u00fcreci tamamlanmadan icra takibine konulamaz. Kesinle\u015fen mahkeme karar\u0131nda h\u00fckmedilen tazminat ile vek\u00e2let \u00fccreti, davac\u0131 veya vekilinin daval\u0131 idareye yaz\u0131l\u0131 \u015fekilde bildirece\u011fi banka hesap numaras\u0131na, bu bildirimin yap\u0131ld\u0131\u011f\u0131 tarihten itibaren otuz g\u00fcn i\u00e7inde \u00f6denir. Bu s\u00fcre i\u00e7inde \u00f6deme yap\u0131lmamas\u0131 halinde, karar genel h\u00fck\u00fcmler dairesinde infaz ve icra olunur.\u201d <\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Kadir \u00d6ZKAYA, Hasan Tahsin G\u00d6KCAN, Basri BA\u011eCI, Engin YILDIRIM, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, Kenan YA\u015eAR, Muhterem \u0130NCE, Y\u0131lmaz AK\u00c7\u0130L ve \u00d6mer \u00c7INAR\u2019\u0131n kat\u0131l\u0131mlar\u0131yla 27\/6\/2024 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda \u00f6ncelikle ba\u015fvuruya engel bir durumun varl\u0131\u011f\u0131 ile uygulanacak kural sorunlar\u0131 g\u00f6r\u00fc\u015f\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. Anayasa\u2019n\u0131n 152. ile 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 40. maddelerine g\u00f6re bir davaya bakmakta olan mahkeme, o dava sebebiyle uygulanacak bir kanunun veya Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesinin h\u00fck\u00fcmlerini Anayasa\u2019ya ayk\u0131r\u0131 g\u00f6rmesi h\u00e2linde veya taraflardan birinin ileri s\u00fcrd\u00fc\u011f\u00fc ayk\u0131r\u0131l\u0131k iddias\u0131n\u0131n ciddi oldu\u011fu kan\u0131s\u0131na varmas\u0131 durumunda bu h\u00fck\u00fcmlerin iptalleri i\u00e7in Anayasa Mahkemesine ba\u015fvurmaya yetkilidir. Ancak an\u0131lan maddeler uyar\u0131nca bir mahkemenin Anayasa Mahkemesine ba\u015fvurabilmesi i\u00e7in elinde y\u00f6ntemince a\u00e7\u0131lm\u0131\u015f ve mahkemenin g\u00f6revine giren bir davan\u0131n bulunmas\u0131, iptali talep edilen kural\u0131n da o davada uygulanacak olmas\u0131 gerekir. Uygulanacak kural ise bak\u0131lmakta olan davan\u0131n de\u011fi\u015fik evrelerinde ortaya \u00e7\u0131kan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde veya davay\u0131 sonu\u00e7land\u0131rmada olumlu ya da olumsuz y\u00f6nde etki yapacak nitelikte bulunan kurallard\u0131r.<\/p>\n<p>3. 5271 say\u0131l\u0131 Kanun\u2019un 142. maddesinde tazminat isteminin \u015fartlar\u0131 ve yarg\u0131lama usul\u00fc d\u00fczenlenmi\u015ftir. An\u0131lan maddenin (2) numaral\u0131 f\u0131kras\u0131n\u0131n itiraz konusu ibarelerin yer ald\u0131\u011f\u0131 birinci c\u00fcmlesinde tazminat davas\u0131n\u0131n a\u00e7\u0131laca\u011f\u0131 g\u00f6revli ve yetkili mahkeme belirlenmi\u015ftir. An\u0131lan c\u00fcmleye g\u00f6re tazminat istemi, zarara u\u011frayan\u0131n oturdu\u011fu yer a\u011f\u0131r ceza mahkemesinde ve e\u011fer o yer a\u011f\u0131r ceza mahkemesi tazminat konusu i\u015flemle ili\u015fkili ise ve ayn\u0131 yerde ba\u015fka bir a\u011f\u0131r ceza dairesi yoksa en yak\u0131n yer a\u011f\u0131r ceza mahkemesinde karara ba\u011flanacakt\u0131r.<\/p>\n<p>4. \u0130tiraz yoluna ba\u015fvuran Mahkeme, koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda yetki hususunu de\u011ferlendirirken Kanun\u2019un 142. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n \u201c\u0130stem, zarara u\u011frayan\u0131n oturdu\u011fu yer a\u011f\u0131r ceza mahkemesinde \u2026 karara ba\u011flan\u0131r.\u201d k\u0131sm\u0131na dayanm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla davaya konu tazminat talebiyle ilgili olarak zarara u\u011frayan\u0131n oturdu\u011fu yerdeki a\u011f\u0131r ceza mahkemesinin tazminat konusu i\u015flemle ili\u015fkili olmas\u0131 ve ayn\u0131 yerde ba\u015fka bir a\u011f\u0131r ceza dairesinin bulunmamas\u0131 nedeniyle en yak\u0131n yer a\u011f\u0131r ceza mahkemesinde tazminat talebinin ileri s\u00fcr\u00fclmesi hususlar\u0131n\u0131n s\u00f6z konusu olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu itibarla an\u0131lan c\u00fcmlede yer alan \u201c\u2026en yak\u0131n yer a\u011f\u0131r ceza mahkemesinde&#8230;\u201d ibaresinin bak\u0131lmakta olan davada uygulanma imk\u00e2n\u0131n\u0131n bulunmamas\u0131 nedeniyle s\u00f6z konusu ibareye ili\u015fkin ba\u015fvurunun Mahkemenin yetkisizli\u011fi nedeniyle reddi gerekir.<\/p>\n<p>5. \u00d6te yandan Anayasa\u2019n\u0131n \u201cAnayasaya ayk\u0131r\u0131l\u0131\u011f\u0131n di\u011fer mahkemelerde ileri s\u00fcr\u00fclmesi\u201d ba\u015fl\u0131kl\u0131 152. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda \u201cAnayasa Mahkemesinin i\u015fin esas\u0131na girerek verdi\u011fi red karar\u0131n\u0131n Resm\u00ee Gazetede yay\u0131mlanmas\u0131ndan sonra on y\u0131l ge\u00e7medik\u00e7e ayn\u0131 kanun h\u00fckm\u00fcn\u00fcn Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla tekrar ba\u015fvuruda bulunulamaz.\u201d denilmi\u015ftir. 6216 say\u0131l\u0131 Kanun\u2019un \u201cBa\u015fvuruya engel durumlar\u201d ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 41. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda da \u201cMahkemenin i\u015fin esas\u0131na girerek verdi\u011fi ret karar\u0131n\u0131n Resm\u00ee Gazetede yay\u0131mlanmas\u0131ndan itibaren on y\u0131l ge\u00e7medik\u00e7e ayn\u0131 kanun h\u00fckm\u00fcn\u00fcn Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla itiraz ba\u015fvurusu yap\u0131lamaz.\u201d h\u00fckm\u00fcne yer verilmi\u015ftir.<\/p>\n<p>6. 5271 say\u0131l\u0131 Kanun\u2019un 142. maddesine 7078 say\u0131l\u0131 Kanun\u2019un 139. maddesiyle eklenen (9) numaral\u0131 f\u0131kran\u0131n itiraz konusu ikinci c\u00fcmlesinin \u201c\u2026\u00f6denecek miktar Tarifede sulh ceza h\u00e2kimliklerinde takip edilen i\u015fler i\u00e7in belirlenen maktu \u00fccretten az\u2026\u201d b\u00f6l\u00fcm\u00fcne y\u00f6nelik iptal talebi Anayasa Mahkemesinin 4\/5\/2023 tarihli ve E.2023\/54, K.2023\/90 say\u0131l\u0131 karar\u0131yla esastan reddedilmi\u015f ve bu karar 15\/6\/2023 tarihli ve 32222 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanm\u0131\u015ft\u0131r. Anayasa Mahkemesince itiraz ba\u015fvurusu \u00fczerine i\u015fin esas\u0131na girilerek reddedilen b\u00f6l\u00fcm hakk\u0131nda yeni bir ba\u015fvurunun yap\u0131labilmesi i\u00e7in \u00f6nceki karar\u0131n Resm\u00ee Gazete\u2019de yay\u0131mland\u0131\u011f\u0131 15\/6\/2023 tarihinden ba\u015flayarak ge\u00e7mesi gereken on y\u0131ll\u0131k s\u00fcre hen\u00fcz dolmam\u0131\u015ft\u0131r. Bu itibarla an\u0131lan b\u00f6l\u00fcme y\u00f6nelik itiraz ba\u015fvurusunun Anayasa\u2019n\u0131n 152. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 ile 6216 say\u0131l\u0131 Kanun\u2019un 41. maddesinin (1) numaral\u0131 f\u0131kras\u0131 gere\u011fince reddi gerekir.<\/p>\n<p>7. A\u00e7\u0131klanan nedenlerle 5271 say\u0131l\u0131 Kanun\u2019un;<\/p>\n<p>A. 142. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201c\u2026en yak\u0131n yer a\u011f\u0131r ceza mahkemesinde&#8230;\u201d ibaresinin itiraz ba\u015fvurusunda bulunan Mahkemenin bakmakta oldu\u011fu davada uygulanma imk\u00e2n\u0131 bulunmad\u0131\u011f\u0131ndan bu ibareye ili\u015fkin ba\u015fvurunun Mahkemenin yetkisizli\u011fi nedeniyle REDD\u0130NE,<\/p>\n<p>B. 142. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201c&#8230;a\u011f\u0131r ceza mahkemesinde\u2026\u201d ve (8) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201c\u2026Cumhuriyet savc\u0131s\u0131\u2026\u201d ibarelerinin esas\u0131n\u0131n incelenmesine,<\/p>\n<p>C. 142. maddesine 1\/2\/2018 tarihli ve 7078 say\u0131l\u0131 Kanun\u2019un 139. maddesiyle eklenen (9) numaral\u0131 f\u0131kran\u0131n ikinci c\u00fcmlesinin;<\/p>\n<p>1. \u201c&#8230;\u00f6denecek miktar Tarifede sulh ceza h\u00e2kimliklerinde takip edilen i\u015fler i\u00e7in belirlenen maktu \u00fccretten az,&#8230;\u201d b\u00f6l\u00fcm\u00fcne y\u00f6nelik itiraz ba\u015fvurusunun Anayasa\u2019n\u0131n 152. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 ile 6216 say\u0131l\u0131 Kanun\u2019un 41. maddesinin (1) numaral\u0131 f\u0131kras\u0131 gere\u011fince REDD\u0130NE,<\/p>\n<p>2. Kalan k\u0131sm\u0131n\u0131n esas\u0131n\u0131n incelenmesine,<\/p>\n<p>OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>8. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r \u00d6mer MENC\u0130K taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fck\u00fcmleri, dayan\u0131lan ve ilgili g\u00f6r\u00fclen Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Genel A\u00e7\u0131klama<\/p>\n<p>9. Ceza muhakemesi faaliyetinin amac\u0131na uygun olarak y\u00fcr\u00fct\u00fclebilmesi ve muhakeme sonucunda h\u00fckm\u00fcn infaz edilebilmesi i\u00e7in soru\u015fturma ve kovu\u015fturma evresinde \u015f\u00fcpheli veya san\u0131k hakk\u0131nda koruma tedbirleri uygulanmaktad\u0131r. Temel hak ve \u00f6zg\u00fcrl\u00fcklere do\u011frudan m\u00fcdahale niteli\u011finde olmas\u0131 nedeniyle koruma tedbirleri kanunda ayr\u0131nt\u0131l\u0131 bir \u015fekilde d\u00fczenlenmi\u015f ve belirli \u015fartlara ba\u011flanm\u0131\u015ft\u0131r. Bu \u015fartlar ger\u00e7ekle\u015fmeden tedbirlere maruz kalan ki\u015filerin maddi ve manevi zarara u\u011framalar\u0131 s\u00f6z konusu olabilir (AYM, E.2023\/54, K.2023\/90, 4\/5\/2023, \u00a7 3).<\/p>\n<p>10. \u00dclkemizde hukuka ayk\u0131r\u0131 olarak hakk\u0131nda koruma tedbiri uygulanan ki\u015filerin maddi ve manevi zararlar\u0131n\u0131n giderilmesi amac\u0131yla tazminat yolu \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Buna g\u00f6re 5271 say\u0131l\u0131 Kanun\u2019un 141. maddesinde su\u00e7 soru\u015fturmas\u0131 ve kovu\u015fturmas\u0131 s\u0131ras\u0131nda ki\u015filerin u\u011frad\u0131\u011f\u0131 her t\u00fcrl\u00fc maddi ve manevi zararlar\u0131n\u0131 devletten isteyebilecekleri d\u00fczenlemesine yer verilmi\u015ftir. An\u0131lan Kanun\u2019un 141. maddesinde tazminat nedenleri, 142. maddesinde tazminat talebinin \u015fartlar\u0131 ve yarg\u0131lama usul\u00fc, 143. maddesinde tazminat\u0131n geri al\u0131nmas\u0131n\u0131 gerektiren h\u00e2ller, 144. maddesinde ise tazminat isteyemeyecek ki\u015filer d\u00fczenlenmi\u015ftir.<\/p>\n<p>11. Koruma tedbirlerinden dolay\u0131 tazminat davas\u0131 a\u00e7ma hakk\u0131, hakk\u0131nda koruma tedbiri uygulanan ki\u015filere tan\u0131nm\u0131\u015ft\u0131r. Tazminat davas\u0131 bir dilek\u00e7e ile a\u00e7\u0131l\u0131r. Kanun\u2019un 142. maddesinin (3) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca tazminat isteminde bulunan ki\u015finin dilek\u00e7esine a\u00e7\u0131k kimlik ve adresini, zarara u\u011frad\u0131\u011f\u0131 i\u015flemin ve zarar\u0131n nitelik ve niceli\u011fini kaydetmesi ve bunlar\u0131n belgelerini eklemesi gereklidir. An\u0131lan maddenin (6) numaral\u0131 f\u0131kras\u0131nda ise s\u00f6z konusu davalarda mahkemenin tazminat miktar\u0131n\u0131 tazminat hukukunun genel ilkelerine g\u00f6re belirleyece\u011fi belirtilmi\u015ftir.<\/p>\n<p>12. Koruma tedbiri nedeniyle tazminat davas\u0131nda daval\u0131 Hazinedir. Maddenin (5) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca mahkeme dosyay\u0131 inceledikten sonra yeterlili\u011fini belirledi\u011fi dilek\u00e7e ve eki belgelerin bir \u00f6rne\u011fini devlet Hazinesinin kendi yarg\u0131 \u00e7evresindeki temsilcisine tebli\u011f ederek varsa beyan ve itirazlar\u0131n\u0131 on be\u015f g\u00fcn i\u00e7inde yaz\u0131l\u0131 olarak bildirmesini ister. (7) numaral\u0131 f\u0131krada ise mahkemenin karar\u0131n\u0131 duru\u015fmal\u0131 olarak verece\u011fi, istemde bulunan ile Hazine temsilcisinin a\u00e7\u0131klamal\u0131 \u00e7a\u011fr\u0131 k\u00e2\u011f\u0131d\u0131 tebli\u011fine ra\u011fmen duru\u015fmaya gelmemeleri h\u00e2linde yokluklar\u0131nda karar verilebilece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>B. Kanun\u2019un 142. Maddesinin (2) Numaral\u0131 F\u0131kras\u0131n\u0131n Birinci C\u00fcmlesinde Yer Alan \u201c\u2026oturdu\u011fu yer\u2026\u201d \u0130baresinden Sonra Gelen \u201c&#8230;a\u011f\u0131r ceza mahkemesinde\u2026\u201d \u0130baresinin \u0130ncelenmesi<\/p>\n<p>1. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>13. Ba\u015fvuru karar\u0131nda \u00f6zetle; 5271 say\u0131l\u0131 Kanun\u2019un 141. maddesinde \u00f6ng\u00f6r\u00fclen maddi ve manevi tazminata konu olan ve ceza yarg\u0131lamas\u0131 s\u0131ras\u0131nda meydana gelen hukuka ayk\u0131r\u0131 i\u015flemlerin tespitinin a\u011f\u0131r ceza mahkemelerince yap\u0131lmas\u0131n\u0131n gerekli olmad\u0131\u011f\u0131, bu tespitin hukuk mahkemelerince de yap\u0131labilece\u011fi, a\u011f\u0131r ceza mahkemelerinin as\u0131l g\u00f6revinin nitelikli baz\u0131 su\u00e7lar\u0131n yarg\u0131lamalar\u0131n\u0131 y\u00fcr\u00fctmek oldu\u011fu, dolay\u0131s\u0131yla tazminat yarg\u0131lamalar\u0131 hususunda yeterli tecr\u00fcbeye sahip olmad\u0131klar\u0131, bu durumun ise davac\u0131lar ve daval\u0131 bak\u0131m\u0131ndan hak kay\u0131plar\u0131na neden olabilece\u011fi belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2., 37. ve 142. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>14. 6216 say\u0131l\u0131 Kanun\u2019un 43. maddesi uyar\u0131nca kural, ilgisi nedeniyle Anayasa\u2019n\u0131n 36. maddesi y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>15. \u0130tiraz konusu kuralda koruma tedbirleri nedeniyle tazminat isteminin zarara u\u011frayan\u0131n oturdu\u011fu yer a\u011f\u0131r ceza mahkemesinde g\u00f6r\u00fclece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>16. Anayasa\u2019n\u0131n \u201cHak arama h\u00fcrriyeti\u201d ba\u015fl\u0131kl\u0131 36. maddesinin birinci f\u0131kras\u0131nda \u201cHerkes, me\u015fru vas\u0131ta ve yollardan faydalanmak suretiyle yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 veya daval\u0131 olarak iddia ve savunma ile adil yarg\u0131lanma hakk\u0131na sahiptir.\u201d denilmektedir. An\u0131lan maddeyle g\u00fcvence alt\u0131na al\u0131nan hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc, kendisi bir temel hak niteli\u011fi ta\u015f\u0131mas\u0131n\u0131n yan\u0131nda di\u011fer temel hak ve \u00f6zg\u00fcrl\u00fcklerden gereken \u015fekilde yararlan\u0131lmas\u0131n\u0131 ve bunlar\u0131n korunmas\u0131n\u0131 sa\u011flayan en etkili g\u00fcvencelerden biridir (AYM, E.2021\/9, K.2022\/4, 26\/1\/2022, \u00a7 28).<\/p>\n<p>17. Anayasa\u2019n\u0131n 142. maddesinde \u201cMahkemelerin kurulu\u015fu, g\u00f6rev ve yetkileri, i\u015fleyi\u015fi ve yarg\u0131lama usulleri kanunla d\u00fczenlenir.\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. Buna g\u00f6re usul kanunlar\u0131n\u0131n Anayasa\u2019ya uygun olmak \u015fart\u0131yla d\u00fczenlenmesi hususu kanun koyucunun takdirine b\u0131rak\u0131lm\u0131\u015ft\u0131r. Kanun koyucu takdir yetkisini kullan\u0131rken Anayasa\u2019daki kurallara, \u00f6zellikle de hukuk devleti ilkesine ve adil yarg\u0131lanma hakk\u0131na uygun hareket etmelidir (AYM, E.2014\/164, K.2015\/12, 14\/1\/2015).<\/p>\n<p>18. Bu itibarla kanun koyucu, uyu\u015fmazl\u0131klar\u0131n niteliklerini g\u00f6zeterek Anayasa\u2019daki yarg\u0131 ile ilgili temel ilkelere ve g\u00fcvence kurallar\u0131na ayk\u0131r\u0131 bulunmamak \u015fart\u0131 ile mahkemelerin g\u00f6revini ve yetkisini belirleyebilecektir. Bu ba\u011flamda getirilen usul kurallar\u0131n\u0131n Anayasa&#8217;n\u0131n 36. maddesinde d\u00fczenlenen adil yarg\u0131lanma hakk\u0131n\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc g\u00fcvencelere ayk\u0131r\u0131l\u0131k ta\u015f\u0131mamas\u0131 gerekmektedir (AYM, E.2015\/37, K.2015\/119, 23\/12\/2015, \u00a7 13).<\/p>\n<p>19. Kuralda koruma tedbirleri nedeniyle tazminat davas\u0131n\u0131n zarara u\u011frayan\u0131n oturdu\u011fu yer a\u011f\u0131r ceza mahkemesinde g\u00f6r\u00fclece\u011fi h\u00fckme ba\u011flanmak suretiyle s\u00f6z konusu davalara bakmakla g\u00f6revli ve yetkili olan mahkeme belirlemi\u015ftir. Haks\u0131z koruma tedbirlerine kar\u015f\u0131 a\u00e7\u0131lacak tazminat davalar\u0131n\u0131n a\u011f\u0131r ceza mahkemesi d\u0131\u015f\u0131nda ba\u015fka bir mahkemede incelenmesini zorunlu k\u0131lan herhangi bir anayasal h\u00fck\u00fcm bulunmamaktad\u0131r. Anayasal ba\u011flamda tazminat davalar\u0131nda g\u00f6zetilecek temel ilke s\u00f6z konusu talebin ba\u011f\u0131ms\u0131z ve tarafs\u0131z bir mahkemede adil yarg\u0131lanma hakk\u0131n\u0131n g\u00fcvencelerine uygun bir \u015fekilde incelenerek uyu\u015fmazl\u0131\u011f\u0131n esas\u0131n\u0131n \u00e7\u00f6z\u00fcmlenmesi imk\u00e2n\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131d\u0131r.<\/p>\n<p>20. 5271 say\u0131l\u0131 Kanun\u2019un 142. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda karar veya h\u00fck\u00fcmlerin kesinle\u015fti\u011finin ilgilisine tebli\u011finden itibaren \u00fc\u00e7 ay ve her h\u00e2lde karar veya h\u00fck\u00fcmlerin kesinle\u015fme tarihini izleyen bir y\u0131l i\u00e7inde tazminat isteminde bulunulabilece\u011fi; ayn\u0131 maddenin (6) numaral\u0131 f\u0131kras\u0131nda ise tazminat miktar\u0131n\u0131n belirlenmesinde mahkemenin gerekli g\u00f6rd\u00fc\u011f\u00fc her t\u00fcrl\u00fc ara\u015ft\u0131rmay\u0131 yapmaya veya h\u00e2kimlerden birine yapt\u0131rmaya yetkili oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>21. An\u0131lan d\u00fczenlemeler dikkate al\u0131nd\u0131\u011f\u0131nda koruma tedbiri niteli\u011findeki uygulamalar nedeniyle haks\u0131z olarak zarara u\u011frad\u0131\u011f\u0131 gerek\u00e7esiyle tazminat isteminde bulunan ki\u015finin dava a\u00e7ma, iddia ve savunmada bulunma, her t\u00fcrl\u00fc delili ileri s\u00fcrebilme hakk\u0131n\u0131n bulunmas\u0131 yan\u0131nda ilgili mahkemenin de gerekli g\u00f6rd\u00fc\u011f\u00fc ara\u015ft\u0131rmalar\u0131 yapmaya yetkili oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>22. \u00d6te yandan koruma tedbirleri, soru\u015fturma ve kovu\u015fturma s\u00fcrecinde bir temel hakk\u0131 h\u00fckm\u00fcn kesinle\u015fmesinden \u00f6nce k\u0131s\u0131tlayan, ge\u00e7ici, gecikemez ve ilke olarak h\u00e2kim karar\u0131n\u0131 gerektiren tedbirlerdir (H\u00fclya Kar [GK], B. No: 2015\/20360, 27\/2\/2019, \u00a7 17). Koruma tedbirleri kanunlarda ayr\u0131nt\u0131l\u0131 bir \u015fekilde d\u00fczenlenmi\u015f ve belirli \u015fartlara ba\u011flanm\u0131\u015ft\u0131r. Baz\u0131 koruma tedbirleri y\u00f6n\u00fcnden an\u0131lan \u015fartlara uyulmamas\u0131 s\u00f6z konusu Kanun\u2019un 141. maddesinde tazminat nedeni olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>23. An\u0131lan maddede say\u0131lan koruma tedbirleri y\u00f6n\u00fcnden tazminat hakk\u0131n\u0131n do\u011fabilmesi i\u00e7in ki\u015finin hukuka ayk\u0131r\u0131 bir i\u015fleme tabi tutuldu\u011funun tespit edilmesi gerekmektedir. Bu durum ise ilke olarak tazminat davas\u0131na ili\u015fkin yarg\u0131lamay\u0131 y\u00fcr\u00fcten mahkemenin \u00f6ncelikle davaya konu tedbirin hukuka ayk\u0131r\u0131 oldu\u011funu tespit etmesini gerektirecektir (benzer bir de\u011ferlendirme i\u00e7in bkz. M.E. [2.B], B. No: 2018\/696, 9\/5\/2019, \u00a7 46).<\/p>\n<p>24. Dolay\u0131s\u0131yla ceza muhakemesi s\u00fcrecinde ba\u015fvurulan bir koruma tedbirinin hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n\u0131n tespitinin ceza mahkemesine b\u0131rak\u0131lmas\u0131n\u0131 \u00f6ng\u00f6ren kural\u0131n mahkemeler aras\u0131nda ihtisasla\u015fman\u0131n sa\u011flanmas\u0131n\u0131n bir gere\u011fi olarak kanun koyucunun takdir yetkisi kapsam\u0131nda yapt\u0131\u011f\u0131 bir d\u00fczenleme oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Bu itibarla kural\u0131n adil yarg\u0131lanma hakk\u0131 g\u00fcvencelerine ayk\u0131r\u0131 bir y\u00f6n\u00fc bulunmamaktad\u0131r.<\/p>\n<p>25. \u00d6te yandan kural kapsam\u0131nda koruma tedbiri niteli\u011findeki uygulamalar nedeniyle tazminat taleplerinin zarara u\u011frayan ki\u015finin oturdu\u011fu yer a\u011f\u0131r ceza mahkemesinde g\u00f6r\u00fclmesinin yarg\u0131lama usul\u00fcne ili\u015fkin olarak kanun koyucunun takdir yetkisi kapsam\u0131nda oldu\u011fu bu y\u00f6n\u00fcyle kural\u0131n Anayasa\u2019n\u0131n 142. maddesiyle de \u00e7eli\u015fmedi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>26. A\u00e7\u0131klanan nedenlerle kural, Anayasa\u2019n\u0131n 36. ve 142. maddelerine ayk\u0131r\u0131 de\u011fildir. \u0130tiraz\u0131n reddi gerekir.<\/p>\n<p>Kural\u0131n Anayasa\u2019n\u0131n 2. maddesine de ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015f ise de bu ba\u011flamda belirtilen hususlar\u0131n Anayasa\u2019n\u0131n 36. ve 142. maddeleri y\u00f6n\u00fcnden yap\u0131lan de\u011ferlendirmeler kapsam\u0131nda ele al\u0131nm\u0131\u015f olmas\u0131 nedeniyle Anayasa\u2019n\u0131n 2. maddesi y\u00f6n\u00fcnden ayr\u0131ca bir inceleme yap\u0131lmas\u0131na gerek g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>Kural\u0131n Anayasa\u2019n\u0131n 37. maddesiyle ilgisi g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>C. Kanun\u2019un 142. Maddesinin (8) Numaral\u0131 F\u0131kras\u0131n\u0131n Birinci C\u00fcmlesinde Yer Alan \u201c\u2026Cumhuriyet savc\u0131s\u0131\u2026\u201d \u0130baresinin \u0130ncelenmesi<\/p>\n<p>1. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>27. Ba\u015fvuru karar\u0131nda \u00f6zetle; as\u0131l g\u00f6revi ceza soru\u015fturmas\u0131 y\u00fcr\u00fctmek olan Cumhuriyet savc\u0131s\u0131n\u0131n hukuk muhakemesinin uyguland\u0131\u011f\u0131 koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davalar\u0131nda yeterli tecr\u00fcbeye sahip olamayaca\u011f\u0131, bu durumun da hak kay\u0131plar\u0131na yol a\u00e7aca\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2., 37. ve 142. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>28. \u0130tiraz konusu kuralda, koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davalar\u0131nda mahkeme karar\u0131na kar\u015f\u0131 Cumhuriyet savc\u0131s\u0131n\u0131n da istinaf kanun yoluna ba\u015fvurabilece\u011fi d\u00fczenlenmi\u015ftir.<\/p>\n<p>29. Anayasa\u2019n\u0131n 2. maddesinde belirtilen hukuk devleti; eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adil bir hukuk d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, hukuki g\u00fcvenli\u011fi sa\u011flayan, Anayasa\u2019ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukuk kurallar\u0131yla kendini ba\u011fl\u0131 sayan ve yarg\u0131 denetimine a\u00e7\u0131k olan devlettir.<\/p>\n<p>30. Hukuk devleti ilkesi gere\u011fince kanunlar\u0131n kamu yarar\u0131n\u0131 ger\u00e7ekle\u015ftirmek amac\u0131yla yap\u0131lmas\u0131 gerekir. Anayasa Mahkemesince kamu yarar\u0131 konusunda yap\u0131lacak inceleme, kanunun kamu yarar\u0131 amac\u0131yla yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131yla s\u0131n\u0131rl\u0131d\u0131r. Anayasa\u2019n\u0131n \u00e7e\u015fitli h\u00fck\u00fcmlerinde yer alan kamu yarar\u0131 kavram\u0131n\u0131n Anayasa\u2019da bir tan\u0131m\u0131 yap\u0131lmam\u0131\u015ft\u0131r. Ancak Anayasa Mahkemesinin kararlar\u0131nda da belirtildi\u011fi gibi kamu yarar\u0131; bireysel, \u00f6zel \u00e7\u0131karlardan ayr\u0131 ve bunlara \u00fcst\u00fcn olan toplumsal yarard\u0131r. Kamu yarar\u0131 d\u00fc\u015f\u00fcncesi olmaks\u0131z\u0131n yaln\u0131z \u00f6zel \u00e7\u0131karlar i\u00e7in veya sadece belli ki\u015filerin yarar\u0131na kanun h\u00fckm\u00fc konulamaz. B\u00f6yle bir durumun a\u00e7\u0131k bir bi\u00e7imde ve kesin olarak saptanmas\u0131 h\u00e2linde s\u00f6z konusu kanun h\u00fckm\u00fc Anayasa\u2019n\u0131n 2. maddesine ayk\u0131r\u0131 d\u00fc\u015fer. A\u00e7\u0131klanan istisnai h\u00e2l d\u0131\u015f\u0131nda bir kanun h\u00fckm\u00fcn\u00fcn gereksinimlere uygun olup olmad\u0131\u011f\u0131, hangi ara\u00e7 ve y\u00f6ntemlerle kamu yarar\u0131n\u0131n sa\u011flanabilece\u011fi kanun koyucunun takdirinde oldu\u011fundan bu kapsamda kamu yarar\u0131 de\u011ferlendirmesi yapmak anayasa yarg\u0131s\u0131yla ba\u011fda\u015fmaz (AYM, E.2020\/53, K.2021\/55, 14\/7\/2021, \u00a7 23).<\/p>\n<p>31. H\u00e2kimin gerek maddi vak\u0131alar\u0131n de\u011ferlendirilmesinde gerekse hukuk kurallar\u0131n\u0131n uygulanmas\u0131nda yan\u0131lg\u0131ya d\u00fc\u015fmesi ve buna ba\u011fl\u0131 olarak hukuka ayk\u0131r\u0131 h\u00fck\u00fcm vermesi s\u00f6z konusu olabilmektedir. Bu nitelikteki kararlara ilgililerin veya toplumun katlanmas\u0131n\u0131 beklemek adalete olan g\u00fcveni sarsar ve hukuk devletini zedeler. Bu nedenle adil ve isabetli olmad\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclen bir h\u00fckm\u00fcn ba\u015fka bir yarg\u0131 mercii taraf\u0131ndan denetlenmesi bir gereklilik olarak ortaya \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>32. Bununla birlikte mahkemelerce verilen h\u00fck\u00fcmlerin denetlenmesi konusunda devletin kanuni d\u00fczenleme yapmas\u0131 gerekmektedir. Mahkeme kararlar\u0131na kar\u015f\u0131 ne t\u00fcr bir denetim mekanizmas\u0131n\u0131n \u00f6ng\u00f6r\u00fclece\u011finin, bu denetimin hangi yarg\u0131sal makam taraf\u0131ndan ger\u00e7ekle\u015ftirilece\u011finin, kapsam ve s\u0131n\u0131rlar\u0131n\u0131n, kimlerin talepte bulunabilece\u011finin belirlenmesi hususlar\u0131nda anayasal s\u0131n\u0131rlar i\u00e7inde kanun koyucunun geni\u015f takdir yetkisi bulunmaktad\u0131r (benzer bir de\u011ferlendirme i\u00e7in bkz. AYM, E.2020\/21, K.2020\/53, 1\/10\/2020, \u00a7 20).<\/p>\n<p>33. 5271 say\u0131l\u0131 Kanun\u2019un \u201cDuru\u015fmada haz\u0131r bulunacaklar\u201d ba\u015fl\u0131kl\u0131 188. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda ceza mahkemelerince yap\u0131lan duru\u015fmalarda, h\u00fckme kat\u0131lacak h\u00e2kimler ve Cumhuriyet savc\u0131s\u0131 ile zab\u0131t k\u00e2tibinin ve an\u0131lan Kanun\u2019un zorunlu m\u00fcdafili\u011fi kabul etti\u011fi h\u00e2llerde m\u00fcdafiin haz\u0131r bulunmas\u0131n\u0131n \u015fart oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davalar\u0131 y\u00f6n\u00fcnden herhangi bir istisna \u00f6ng\u00f6r\u00fclmedi\u011finden Cumhuriyet savc\u0131s\u0131n\u0131n an\u0131lan davalar\u0131n yarg\u0131lamalar\u0131na kat\u0131laca\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Kanun\u2019un 33. maddesinin (1) numaral\u0131 f\u0131kras\u0131na g\u00f6re ise duru\u015fmada verilecek kararlar Cumhuriyet savc\u0131s\u0131, duru\u015fmada haz\u0131r bulunan m\u00fcdafi, vekil ve di\u011fer ilgililer dinlendikten; duru\u015fma d\u0131\u015f\u0131ndaki kararlar Cumhuriyet savc\u0131s\u0131n\u0131n yaz\u0131l\u0131 veya s\u00f6zl\u00fc g\u00f6r\u00fc\u015f\u00fc al\u0131nd\u0131ktan sonra verilecektir. S\u00f6z konusu d\u00fczenlemeler gere\u011fince koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davalar\u0131nda Cumhuriyet savc\u0131s\u0131 duru\u015fmalara bizzat kat\u0131lacak, mahkemelere sundu\u011fu m\u00fctalaalarla yarg\u0131lama s\u00fcrecine do\u011frudan etkide bulunacakt\u0131r.<\/p>\n<p>34. Ceza muhakemesi hukukunda hakikatin ara\u015ft\u0131r\u0131larak ger\u00e7e\u011fe ula\u015f\u0131lmas\u0131, kolektif yarg\u0131lama y\u00f6ntemi ile sa\u011flanmaktad\u0131r. Kolektif yarg\u0131lama; h\u00fckm\u00fcn verilmesine iddia, savunma ve yarg\u0131lama makamlar\u0131n\u0131n birlikte kat\u0131lmas\u0131n\u0131 ifade eder. Kolektif yarg\u0131laman\u0131n metodu, h\u00fck\u00fcm verme faaliyetine kat\u0131lacaklar\u0131n d\u00fc\u015f\u00fcncelerini kar\u015f\u0131l\u0131kl\u0131 olarak bildirerek b\u00fct\u00fcn s\u00fcjelerin birbirlerinin fikirlerini \u00f6\u011frenmeleridir (AYM, E.2011\/43, K.2012\/10, 19\/1\/2012).<\/p>\n<p>35. Cumhuriyet savc\u0131s\u0131, ceza muhakemesinin gayesini ger\u00e7ekle\u015ftirmek i\u00e7in san\u0131\u011f\u0131n lehine ve aleyhine deliller ileri s\u00fcrebilen, taleplerde bulunabilen, as\u0131l amac\u0131 muhakeme diyalekti\u011finin sa\u011flanmas\u0131 olan, kendine has stat\u00fc i\u00e7inde bir ceza muhakemesi s\u00fcjesidir (AYM, E.2011\/43, K.2012\/10, 19\/1\/2012).<\/p>\n<p>36. \u0130ddia makam\u0131 olan Cumhuriyet savc\u0131s\u0131, kolektif h\u00fck\u00fcm verme faaliyetinin ve bunun sonucunda maddi ger\u00e7e\u011fe ula\u015fman\u0131n vazge\u00e7ilmez bir unsuru olarak kabul edilmektedir. Cumhuriyet savc\u0131s\u0131 bu g\u00f6revini maddi ger\u00e7e\u011fin ara\u015ft\u0131r\u0131lmas\u0131n\u0131 ama\u00e7 edinen bir soru\u015fturma yapmak, \u015f\u00fcpheli veya san\u0131\u011f\u0131n lehine ve aleyhine elde etti\u011fi b\u00fct\u00fcn delilleri h\u00e2kim veya mahkemeye sunmak, bu delillerin tart\u0131\u015f\u0131lmas\u0131n\u0131 sa\u011flamak, bunun i\u00e7in duru\u015fmalara kat\u0131lmak ve kararlara kar\u015f\u0131 yasa yollar\u0131na ba\u015fvurmak suretiyle yerine getirir (benzer bir de\u011ferlendirme i\u00e7in bkz. AYM, E.2011\/43, K.2012\/10, 19\/1\/2012).<\/p>\n<p>37. Cumhuriyet savc\u0131s\u0131n\u0131n kanun yoluna ba\u015fvurabilece\u011fi mahkeme kararlar\u0131, onun hukuka ayk\u0131r\u0131 oldu\u011funu de\u011ferlendirdi\u011fi kararlard\u0131r. Koruma tedbirleri nedenine dayal\u0131 tazminat davalar\u0131nda bir yarg\u0131lama s\u00fcjesi olarak dava hakk\u0131nda yakinen bilgi sahibi olan Cumhuriyet savc\u0131s\u0131n\u0131n hukuka ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esiyle mahkeme kararlar\u0131 i\u00e7in kanun yoluna ba\u015fvurarak s\u00f6z konusu kararlar\u0131n hukuka uygun olup olmad\u0131\u011f\u0131n\u0131n istinaf mahkemelerince denetlenmesine imk\u00e2n tan\u0131mas\u0131n\u0131n adalete olan g\u00fcveninin sa\u011flanmas\u0131na, bireylerin hak ve \u00f6zg\u00fcrl\u00fckleri ile toplum menfaatinin korunmas\u0131na hizmet edece\u011fi a\u00e7\u0131kt\u0131r. Bu itibarla koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davalar\u0131nda mahkeme karar\u0131na kar\u015f\u0131 Cumhuriyet savc\u0131s\u0131n\u0131n da istinaf kanun yoluna ba\u015fvurabilmesini \u00f6ng\u00f6ren kural\u0131n kamu yarar\u0131 amac\u0131na y\u00f6nelik oldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>38. \u00d6te yandan kuralda Cumhuriyet savc\u0131s\u0131na istinaf kanun yoluna ba\u015fvurmas\u0131 hususunda yetki verilmesinin yarg\u0131lama usul\u00fcne y\u00f6nelik bir d\u00fczenleme oldu\u011fu ve bu hususun kanun koyucunun takdir yetkisi kapsam\u0131nda bulundu\u011fu g\u00f6zetildi\u011finde kural\u0131n Anayasa\u2019n\u0131n 142. maddesiyle de \u00e7eli\u015fmedi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>39. A\u00e7\u0131klanan nedenlerle kural, Anayasa&#8217;n\u0131n 2. ve 142. maddelerine ayk\u0131r\u0131 de\u011fildir. \u0130tiraz\u0131n reddi gerekir.<\/p>\n<p>Kural\u0131n Anayasa\u2019n\u0131n 37. maddesiyle ilgisi g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>\u00c7. Kanun\u2019un 142. Maddesinin (9) Numaral\u0131 F\u0131kras\u0131n\u0131n \u0130kinci C\u00fcmlesinde Yer Alan \u201cAncak, \u2026\u201d ve \u201c\u2026a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenen maktu \u00fccretten fazla olamaz.\u201d \u0130barelerinin \u0130ncelenmesi<\/p>\n<p>1. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>40. Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kurallarla davac\u0131 ve daval\u0131 vekilleri ad\u0131na h\u00fckmedilen vek\u00e2let \u00fccretlerine y\u00f6nelik olarak hukuk mahkemelerinde g\u00f6r\u00fclen tazminat davalar\u0131ndan farkl\u0131 olarak \u00f6nemli \u00f6l\u00e7\u00fcde s\u0131n\u0131rlama getirildi\u011fi, bu durumun ise vekiller y\u00f6n\u00fcnden hak kayb\u0131na yol a\u00e7aca\u011f\u0131 belirtilerek kurallar\u0131n Anayasa\u2019n\u0131n 2., 37. ve 142. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>41. 6216 say\u0131l\u0131 Kanun\u2019un 43. maddesi uyar\u0131nca kurallar, ilgisi nedeniyle Anayasa\u2019n\u0131n 13. ve 36. maddeleri y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>42. \u0130tiraz konusu kurallarla koruma tedbiri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda h\u00fckmedilecek vek\u00e2let \u00fccretinin, Avukatl\u0131k Asgari \u00dccret Tarifesinde (Tarife) a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenen maktu \u00fccretten fazla olamayaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>43. Kurallarla \u00f6ng\u00f6r\u00fclen d\u00fczenlemenin hakk\u0131nda koruma tedbiri uygulanan davac\u0131 ile daval\u0131 devlet bak\u0131m\u0131ndan iki y\u00f6n\u00fc bulunmaktad\u0131r. Dolay\u0131s\u0131yla kurallar\u0131n anayasall\u0131k denetiminde bu iki hususun ayr\u0131 ayr\u0131 ele al\u0131nmas\u0131 gerekmektedir.<\/p>\n<p>44. Hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn temel unsurlar\u0131ndan biri mahkemeye eri\u015fim hakk\u0131d\u0131r. Mahkemeye eri\u015fim hakk\u0131, hukuki bir uyu\u015fmazl\u0131\u011f\u0131n bu konuda karar verme yetkisine sahip bir mahkeme \u00f6n\u00fcne g\u00f6t\u00fcr\u00fclmesi hakk\u0131n\u0131 da kapsar. Ki\u015finin u\u011frad\u0131\u011f\u0131 bir haks\u0131zl\u0131\u011fa veya zarara kar\u015f\u0131 kendisini savunabilmesinin ya da maruz kald\u0131\u011f\u0131 haks\u0131z bir uygulama veya i\u015fleme kar\u015f\u0131 hakl\u0131l\u0131\u011f\u0131n\u0131 ileri s\u00fcr\u00fcp kan\u0131tlayabilmesinin ya da zarar\u0131n\u0131 giderebilmesinin en etkili ve g\u00fcvenceli yolu yarg\u0131 mercileri \u00f6n\u00fcnde dava hakk\u0131n\u0131 kullanabilmesidir (AYM, E.2021\/37, K.2021\/63, 22\/9\/2021, \u00a7 17; E.2021\/20, K.2022\/84, 30\/6\/2022, \u00a7 10; E.2022\/104, K.2023\/28, 16\/2\/2023, \u00a7 10).<\/p>\n<p>45. Dava hakk\u0131n\u0131n etkili bir \u015fekilde kullan\u0131labilmesi, hukuk, idari ve ceza yarg\u0131lamalar\u0131nda ki\u015filere avukat yard\u0131m\u0131ndan faydalanmalar\u0131 hususunda gerekli imk\u00e2nlar\u0131n sa\u011flanmas\u0131yla m\u00fcmk\u00fcnd\u00fcr. Yarg\u0131lama gideri olan vek\u00e2let \u00fccretinin miktar\u0131n\u0131n, hangi taraftan tahsil edilece\u011finin ve buna ili\u015fkin \u015fartlar\u0131n da bu kapsamda de\u011ferlendirilmesi gerekir (AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7 20).<\/p>\n<p>46. Bu itibarla dava a\u015famas\u0131nda kimin lehine ya da aleyhine h\u00fckmedilece\u011fi belli olmayan bu \u00fccret y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, bir usul h\u00fckm\u00fc olup mahkemeye eri\u015fim hakk\u0131 ile ili\u015fkilidir (Serkan Acar, B. No: 2013\/1613, 2\/10\/2013, \u00a7 38; Mehmet Okutan ve Mustafa Okutan, B. No: 2018\/293, 18\/5\/2021, \u00a7 43). Dolay\u0131s\u0131yla taraflar aleyhine vek\u00e2let \u00fccretine ve yarg\u0131lama giderlerine h\u00fckmedilmesini ve taraflar\u0131n yarg\u0131lama s\u00fcrecinde y\u00fcklendikleri giderlerin kar\u015f\u0131 tarafa y\u00fckletilmesi talebinin reddini \u00f6ng\u00f6ren d\u00fczenlemeler mahkemeye eri\u015fim hakk\u0131n\u0131 s\u0131n\u0131rlayabilir (Hilmi Kocabey ve di\u011ferleri, B. No: 2018\/27686, 17\/11\/2021, \u00a7 98). Bununla birlikte taraflar lehine h\u00fckmedilmesi gereken vek\u00e2let \u00fccretinden tamamen veya k\u0131smen yoksun b\u0131rak\u0131lmas\u0131 sonucunu do\u011furan uygulamalar da an\u0131lan hak a\u00e7\u0131s\u0131ndan s\u0131n\u0131rlamalara neden olabilir (benzer bir de\u011ferlendirme i\u00e7in bkz. AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7 21).<\/p>\n<p>47. Kurallar, dava de\u011ferinin y\u00fcksek oldu\u011fu yarg\u0131lamalarda hakk\u0131nda koruma tedbiri uygulanan ve davac\u0131 konumunda olan ger\u00e7ek ki\u015fi veya \u00f6zel hukuk t\u00fczel ki\u015fileri lehine karar verilmesi y\u00f6n\u00fcnden incelendi\u011finde; h\u00fckmedilecek vek\u00e2let \u00fccretinin oransal hesaplama (nispi vek\u00e2let \u00fccreti) yerine Tarifede a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenmi\u015f maktu \u00fccretin \u00fcst s\u0131n\u0131r\u0131na kadar h\u00fckmedilmesi, davac\u0131 lehine daha az vek\u00e2let \u00fccretinin takdir edilmesi sonucunu do\u011furacakt\u0131r.<\/p>\n<p>48. Davac\u0131n\u0131n, lehine h\u00fckmedilmesi gereken vek\u00e2let \u00fccretinden k\u0131smen yoksun b\u0131rak\u0131lma sonucunu do\u011furan kurallar mahkemeye eri\u015fim hakk\u0131na s\u0131n\u0131rlama getirmektedir.<\/p>\n<p>49. Anayasa\u2019n\u0131n 13. maddesinde \u201cTemel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.\u201d denilmi\u015ftir. Buna g\u00f6re mahkemeye eri\u015fim hakk\u0131na s\u0131n\u0131rlama getiren d\u00fczenlemelerin kanunla yap\u0131lmas\u0131, Anayasa\u2019da \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlama sebebine uygun ve \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekir.<\/p>\n<p>50. Bu kapsamda mahkemeye eri\u015fim hakk\u0131n\u0131 s\u0131n\u0131rlamaya y\u00f6nelik kanuni d\u00fczenlemenin \u015feklen var olmas\u0131 yeterli olmay\u0131p kurallar keyf\u00eeli\u011fe izin vermeyecek \u015fekilde belirli ve \u00f6ng\u00f6r\u00fclebilir nitelikte olmal\u0131d\u0131r.<\/p>\n<p>51. Esasen temel haklar\u0131 s\u0131n\u0131rlayan kanunun bu niteliklere sahip olmas\u0131 Anayasa\u2019n\u0131n 2. maddesinde g\u00fcvenceye al\u0131nan hukuk devleti ilkesinin de bir gere\u011fidir. Hukuk devletinde kanuni d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131, ayr\u0131ca kamu otoritelerinin keyf\u00ee uygulamalar\u0131na kar\u015f\u0131 koruyucu \u00f6nlem i\u00e7ermesi gerekir. Kanunda bulunmas\u0131 gereken bu nitelikler hukuki g\u00fcvenli\u011fin sa\u011flanmas\u0131 bak\u0131m\u0131ndan da zorunludur. Zira bu ilke hukuk normlar\u0131n\u0131n \u00f6ng\u00f6r\u00fclebilir olmas\u0131n\u0131, bireylerin t\u00fcm eylem ve i\u015flemlerinde devlete g\u00fcven duyabilmesini, devletin de yasal d\u00fczenlemelerinde bu g\u00fcven duygusunu zedeleyici y\u00f6ntemlerden ka\u00e7\u0131nmas\u0131n\u0131 gerekli k\u0131lar (AYM, E.2015\/41, K.2017\/98, 4\/5\/2017, \u00a7\u00a7 153, 154). Dolay\u0131s\u0131yla Anayasa\u2019n\u0131n 13. maddesinde s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fc olarak belirtilen kanunilik Anayasa\u2019n\u0131n 2. maddesinde g\u00fcvenceye ba\u011flanan hukuk devleti ilkesi \u0131\u015f\u0131\u011f\u0131nda yorumlanmal\u0131d\u0131r.<\/p>\n<p>52. 5271 say\u0131l\u0131 Kanun\u2019un 142. maddesinin itiraz konusu kurallar\u0131n da yer ald\u0131\u011f\u0131 (9) numaral\u0131 f\u0131kras\u0131nda koruma tedbiri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda Tarife gere\u011fince hesaplanan nispi vek\u00e2let \u00fccretine h\u00fckmedilece\u011fi d\u00fczenlenmi\u015f, itiraz konusu kurallarda ise nispi vek\u00e2let \u00fccreti i\u00e7in bir \u00fcst s\u0131n\u0131r belirlenerek \u00f6denecek vek\u00e2let \u00fccretinin Tarifede a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenmi\u015f maktu \u00fccretten fazla olamayaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Buna g\u00f6re koruma tedbiri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda vek\u00e2let \u00fccretinin tespitinde Tarifenin esas al\u0131nmas\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>53. Taraflar\u0131n avukatl\u0131k s\u00f6zle\u015fmesi \u00e7er\u00e7evesinde avukat vas\u0131tas\u0131yla takip ettikleri bir ceza yarg\u0131lamas\u0131nda mahkeme taraf\u0131ndan yarg\u0131lama gideri kabul edilerek kararda ilgilisine y\u00fckletilecek vek\u00e2let \u00fccretinin belirlendi\u011fi Tarife 19\/3\/1969 tarihli ve 1136 say\u0131l\u0131 Avukatl\u0131k Kanunu\u2019nun 168. maddesi uyar\u0131nca her y\u0131l T\u00fcrkiye Barolar Birli\u011fi (TBB) Y\u00f6netim Kurulunca haz\u0131rlanmakta ve Adalet Bakanl\u0131\u011f\u0131nca onaylanarak y\u00fcr\u00fcrl\u00fc\u011fe girmektedir.<\/p>\n<p>54. Tarifede genellikle vek\u00e2let \u00fccretinin hesaplanmas\u0131nda konusu para olmayan ve para ile \u00f6l\u00e7\u00fclemeyen davalarda maktu tarife, konusu para olan veya para ile \u00f6l\u00e7\u00fclebilen davalarda ise nispi tarife esas al\u0131nmaktad\u0131r. Baz\u0131 durumlarda ise konusu para olan veya para ile de\u011ferlendirilebilen davalarda dahi maktu tarifenin uygulanmas\u0131 kararla\u015ft\u0131r\u0131labilmektedir. Baz\u0131 istisnalar haricinde kanunlarda hangi davalarda nispi, hangilerinde ise maktu tarifenin uygulanaca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm bulunmamakta olup bu husus TBB\u2019nin takdirine b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>55. Kurallarda koruma tedbiri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda Tarife gere\u011fince hesaplanan nispi vek\u00e2let \u00fccretinin uygulanmas\u0131 esas\u0131 benimsenmi\u015f olmakla birlikte h\u00fckmedilecek nispi vek\u00e2let \u00fccretinin yine Tarifede a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenen maktu \u00fccretten fazla olmayaca\u011f\u0131 belirtilmek suretiyle bu davalar y\u00f6n\u00fcnden \u00f6denecek \u00fccretin \u00fcst s\u0131n\u0131r\u0131 kanunla tespit edilmi\u015ftir.<\/p>\n<p>56. Buna g\u00f6re kurallarda koruma tedbiri nedeniyle a\u00e7\u0131lan tazminat davas\u0131nda h\u00fckmedilebilecek vek\u00e2let \u00fccretiyle ilgili olarak \u00f6ng\u00f6r\u00fclen \u00fcst s\u0131n\u0131r\u0131n herhangi bir teredd\u00fcde yer vermeyecek \u015fekilde a\u00e7\u0131k ve net olarak d\u00fczenlendi\u011fi g\u00f6zetildi\u011finde kurallar\u0131n belirli, ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir nitelikte oldu\u011fu ve bu y\u00f6n\u00fcyle kanunilik \u015fart\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>57. Anayasa\u2019n\u0131n 36. maddesinde mahkemeye eri\u015fim hakk\u0131 i\u00e7in herhangi bir s\u0131n\u0131rlama nedeni \u00f6ng\u00f6r\u00fclmemi\u015f olmakla birlikte \u00f6zel s\u0131n\u0131rlama nedeni belirtilmemi\u015f haklar\u0131n da hakk\u0131n do\u011fas\u0131ndan kaynaklanan baz\u0131 s\u0131n\u0131rlar\u0131n\u0131n bulundu\u011fu kabul edilmektedir. \u00d6te yandan Anayasa\u2019n\u0131n ba\u015fka maddelerinde yer alan hak ve \u00f6zg\u00fcrl\u00fckler ile devlete y\u00fcklenen \u00f6devler, \u00f6zel s\u0131n\u0131rlama sebebi g\u00f6sterilmemi\u015f hak ve \u00f6zg\u00fcrl\u00fcklere s\u0131n\u0131r te\u015fkil edebilir (AYM, E.2023\/101, K.2023\/207, 30\/11\/2023, \u00a7 27).<\/p>\n<p>58. Ayr\u0131ca adil yarg\u0131lanma hakk\u0131, niteli\u011fi gere\u011fi devletin d\u00fczenleme yapmas\u0131n\u0131 gerektiren bir hakt\u0131r. Zira bu hakk\u0131n Anayasa\u2019da zikredilmi\u015f olmas\u0131 kendi ba\u015f\u0131na bir anlam ifade etmemekte, bireylerin bu haktan yararlanabilmesi i\u00e7in devletin en az\u0131ndan yarg\u0131 te\u015fkilat\u0131n\u0131 kurmas\u0131 ve yarg\u0131lama usullerini belirlemesi gerekmektedir. Devletin d\u00fczenleme yetkisini haiz oldu\u011fu alanlarda belli \u00f6l\u00e7\u00fcde takdir yetkisine sahip oldu\u011funun kabul\u00fc gerekir. Bu sebeple adil yarg\u0131lanma hakk\u0131na y\u00f6nelik s\u0131n\u0131rlamalar getirilirken kanun koyucuyu ba\u011flayan belli bir me\u015fru ama\u00e7lar listesi bulunmamaktad\u0131r. Ancak kanun koyucunun bu takdir yetkisinin Anayasa Mahkemesinin denetimine tabi oldu\u011fu a\u00e7\u0131kt\u0131r (Bekir S\u00f6zen [GK], B. No: 2016\/14586, 10\/11\/2022, \u00a7 74).<\/p>\n<p>59. Kurallar\u0131n, koruma tedbirleri nedeniyle tazminat davalar\u0131nda davan\u0131n kabul\u00fc h\u00e2linde vekalet \u00fccretinden sorumlu olan Hazinenin a\u015f\u0131r\u0131 y\u00fcksek ve a\u011f\u0131r yarg\u0131lama gideri y\u00fck\u00fcyle kar\u015f\u0131la\u015fmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesine katk\u0131 sunaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Kamu kaynaklar\u0131n\u0131n mali a\u00e7\u0131dan y\u00f6netiminin do\u011fru ve etkin bir \u015fekilde yap\u0131labilmesi i\u00e7in devletin kar\u015f\u0131la\u015ft\u0131\u011f\u0131 yarg\u0131lama giderlerinin azalt\u0131lmas\u0131 y\u00f6n\u00fcnde d\u00fczenlemelerin yap\u0131lmas\u0131, kamunun b\u00fct\u00e7e dengesinin korunmas\u0131n\u0131 sa\u011flayacakt\u0131r. Bu itibarla kamuya a\u015f\u0131r\u0131 mali k\u00fclfet y\u00fckleyece\u011fi gerek\u00e7esiyle koruma tedbirleri nedeniyle tazminat davalar\u0131nda Hazinenin \u00f6deyece\u011fi vek\u00e2let \u00fccretini azaltan kurallar\u0131n anayasal y\u00f6nden me\u015fru bir amac\u0131n\u0131n olmad\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>60. Kurallarla mahkemeye eri\u015fim hakk\u0131na getirilen s\u0131n\u0131rlaman\u0131n Anayasa\u2019ya ayk\u0131r\u0131 olmamas\u0131 i\u00e7in ayn\u0131 zamanda \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekir. Anayasa\u2019n\u0131n 13. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. Elveri\u015flilik \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlaman\u0131n amaca ula\u015fmaya elveri\u015fli olmas\u0131n\u0131, gereklilik ama\u00e7 bak\u0131m\u0131ndan s\u0131n\u0131rlaman\u0131n zorunlu olmas\u0131n\u0131, di\u011fer bir ifadeyle ayn\u0131 amaca daha hafif bir s\u0131n\u0131rlama ile ula\u015f\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131n\u0131, orant\u0131l\u0131l\u0131k ise hakka getirilen s\u0131n\u0131rlama ile ama\u00e7 aras\u0131nda makul bir dengenin g\u00f6zetilmesi gereklili\u011fini ifade etmektedir.<\/p>\n<p>61. Kurallar gere\u011fince devletin \u00f6deyece\u011fi vek\u00e2let \u00fccretinin Tarifede a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenen maktu vek\u00e2let \u00fccretinin \u00fczerinde olmamas\u0131n\u0131n, devletin a\u015f\u0131r\u0131 y\u00fcksek ve a\u011f\u0131r yarg\u0131lama gideri y\u00fck\u00fcyle kar\u015f\u0131la\u015fmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesini sa\u011flayaca\u011f\u0131, bu itibarla kurallar\u0131n an\u0131lan me\u015fru amaca ula\u015fma bak\u0131m\u0131ndan elveri\u015fli oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>62. Kamu kaynaklar\u0131n\u0131n korunmas\u0131 amac\u0131yla Hazinenin a\u015f\u0131r\u0131 y\u00fcksek ve a\u011f\u0131r yarg\u0131lama gideri y\u00fck\u00fcyle kar\u015f\u0131la\u015fmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesi i\u00e7in al\u0131nacak \u00f6nlemler hususundaki takdir yetkisi kanun koyucuya aittir. Koruma tedbirleri nedeniyle tazminat davas\u0131 a\u00e7an davac\u0131n\u0131n yarg\u0131lama sonunda alaca\u011f\u0131 vek\u00e2let \u00fccreti i\u00e7in maktu bir \u00fcst s\u0131n\u0131r\u0131n \u00f6ng\u00f6r\u00fclmesi de s\u00f6z konusu yetki kapsam\u0131nda de\u011ferlendirilebilecek ara\u00e7lardand\u0131r. Dolay\u0131s\u0131yla kurallarla \u00f6ng\u00f6r\u00fclen vek\u00e2let \u00fccretine ili\u015fkin s\u0131n\u0131rlaman\u0131n s\u00f6z konusu ama\u00e7lara ula\u015fma bak\u0131m\u0131ndan gerekli olmad\u0131\u011f\u0131 da s\u00f6ylenemez.<\/p>\n<p>63. Mahkemeye eri\u015fim hakk\u0131na y\u00f6nelik s\u0131n\u0131rlaman\u0131n \u00f6l\u00e7\u00fcl\u00fc olabilmesi i\u00e7in orant\u0131l\u0131l\u0131k ilkesi gere\u011fince \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlama ile elde edilmek istenen kamu yarar\u0131 amac\u0131 aras\u0131nda adil ve makul bir denge g\u00f6zetilmelidir. Bu kapsamda mahkemeye eri\u015fim hakk\u0131na \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlaman\u0131n, kamu yarar\u0131n\u0131n gerekleri ile bireyin haklar\u0131 aras\u0131nda kurulmaya \u00e7al\u0131\u015f\u0131lan adil dengeyi bozacak \u015fekilde birey aleyhine katlan\u0131lmas\u0131 zor k\u00fclfetler y\u00fcklememi\u015f olmas\u0131 gerekir.<\/p>\n<p>64. Hukuk devletinde, bir kimsenin, ba\u015fka bir ki\u015finin hukuka ayk\u0131r\u0131 i\u015flem ve eylemi nedeniyle u\u011frad\u0131\u011f\u0131 zarar\u0131 o ki\u015fiden tazmin etmesini sa\u011flayacak hukuksal mekanizmalar\u0131n olu\u015fturulmas\u0131 gerekir. Bu durum, ayn\u0131 zamanda Anayasa\u2019n\u0131n 36. maddesinde d\u00fczenlenen hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve adil yarg\u0131lanma hakk\u0131n\u0131n da bir gere\u011fidir. Bu anlamda, haks\u0131z yere dava a\u00e7mak zorunda b\u0131rak\u0131lan veya kendisine kar\u015f\u0131 haks\u0131z yere dava a\u00e7\u0131lan bir kimsenin o dava nedeniyle yapt\u0131\u011f\u0131 masraflar\u0131n kar\u015f\u0131 taraftan tazmini amac\u0131yla tedbir al\u0131nmas\u0131 hukuk devletinin bir gere\u011fidir (baz\u0131 farklarla birlikte bkz. AYM, E.2013\/95, K.2014\/176, 13\/11\/2014).<\/p>\n<p>65. Haks\u0131z yere dava a\u00e7an veya dava a\u00e7\u0131lmas\u0131na sebebiyet veren ki\u015finin kar\u015f\u0131 taraf\u0131n yapt\u0131\u011f\u0131 masraflardan sorumlu tutulmas\u0131 suretiyle mali bir k\u00fclfete katlanmas\u0131, yarg\u0131lama masraflar\u0131n\u0131n bu ki\u015fi \u00fczerinde b\u0131rak\u0131lmas\u0131n\u0131 gerektirmektedir. Ba\u015fka bir ifadeyle yarg\u0131lama giderinin haks\u0131z \u00e7\u0131kan taraftan tahsil edilmesi, davada hakl\u0131 \u00e7\u0131kan taraf\u0131n o dava nedeniyle yapt\u0131\u011f\u0131 masraflar\u0131n giderilmesini sa\u011flamaktad\u0131r (AYM, E.2013\/95, K.2014\/176, 13\/11\/2014). Hakl\u0131 \u00e7\u0131kan taraf\u0131n masraflar\u0131n\u0131n giderilmesine y\u00f6nelik s\u00f6z konusu amac\u0131n etkili bir yarg\u0131lama yap\u0131larak maddi ger\u00e7e\u011fe ula\u015f\u0131lmas\u0131 a\u00e7\u0131s\u0131ndan da \u00f6nemli oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>66. Dava de\u011ferinden ba\u011f\u0131ms\u0131z olarak a\u00e7\u0131lan her davan\u0131n taraflar\u0131 a\u00e7\u0131s\u0131ndan belirli \u00f6l\u00e7\u00fclerde ortalama bir maliyeti bulunmaktad\u0131r. Davan\u0131n nitelik itibar\u0131yla karma\u015f\u0131k ve \u00e7\u00f6z\u00fcm\u00fcn\u00fcn zor olmas\u0131 h\u00e2linde vekilinin harcayaca\u011f\u0131 emek ve mesainin daha fazla olaca\u011f\u0131, bu durumun ise vek\u00e2let \u00fccreti ba\u011flam\u0131nda yarg\u0131lama maliyetini daha da art\u0131raca\u011f\u0131 ku\u015fkusuzdur. Dolay\u0131s\u0131yla davac\u0131n\u0131n dava a\u00e7makla katlanaca\u011f\u0131 k\u00fclfetin avukat\u0131n hukuki yard\u0131m\u0131ndan etkili ve g\u00fcvenceli bir \u015fekilde yararlanmas\u0131, bu suretle yarg\u0131lamada maddi ger\u00e7e\u011fin sa\u011fl\u0131kl\u0131 bir \u015fekilde ortaya \u00e7\u0131kar\u0131lmas\u0131 amac\u0131n\u0131 zedelememesi ya da ortadan kald\u0131rmamas\u0131 gerekir (benzer de\u011ferlendirmeler i\u00e7in bkz. AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7\u00a7 58, 59).<\/p>\n<p>67. Davan\u0131n konusunun para olmas\u0131 ya da parayla de\u011ferlendirilebilir nitelikte olmas\u0131 h\u00e2linde vek\u00e2let \u00fccreti ve har\u00e7 gibi yarg\u0131lama giderlerinin bu de\u011fere g\u00f6re belirlenmesi gerekti\u011fi s\u00f6ylenebilir. Bu durumda taraflar\u0131n avukata \u00f6dedi\u011fi \u00fccret davan\u0131n de\u011ferine g\u00f6re de\u011fi\u015febilecektir. Ancak baz\u0131 durumlarda davan\u0131n de\u011ferinden ba\u011f\u0131ms\u0131z olarak objektif ve kabul edilebilir miktarlarla maktu vek\u00e2let \u00fccretleri belirlenebilir. Dolay\u0131s\u0131yla yarg\u0131lama giderlerine katlanmak zorunda kalan taraf\u0131n hakl\u0131l\u0131\u011f\u0131n\u0131n tespit edilmesi durumunda yapt\u0131\u011f\u0131 masraflar\u0131n giderilmesi i\u00e7in kendisine \u00f6denecek vek\u00e2let \u00fccreti bak\u0131m\u0131ndan asgari ve \u00fcst s\u0131n\u0131r\u0131n belirlenmesi m\u00fcmk\u00fcnd\u00fcr (benzer bir de\u011ferlendirme i\u00e7in bkz. AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7 39).<\/p>\n<p>68. Davada hakl\u0131 \u00e7\u0131kan taraf ile avukat aras\u0131nda d\u00fczenlenen avukatl\u0131k s\u00f6zle\u015fmesindeki \u00fccretin her bir s\u00f6zle\u015fmede \u00e7ok farkl\u0131 miktarlarda olmas\u0131 m\u00fcmk\u00fcnd\u00fcr. H\u00fckmedilecek vek\u00e2let \u00fccretinin tespitinde avukatl\u0131k s\u00f6zle\u015fmesinde belirlenen tutar\u0131n esas al\u0131nmas\u0131n\u0131n farkl\u0131 ve haks\u0131z uygulamalara yol a\u00e7abilece\u011fi a\u00e7\u0131kt\u0131r. Bu durum konusu ve sebebi birbiriyle tamamen ayn\u0131 olan davalarda farkl\u0131 vek\u00e2let \u00fccretlerine h\u00fckmedilmesine, davada haks\u0131z \u00e7\u0131kan baz\u0131 ki\u015filerin benzer durumdaki di\u011fer ki\u015filere nazaran y\u00fcksek miktarlarda vek\u00e2let \u00fccreti k\u00fclfetiyle kar\u015f\u0131la\u015fmas\u0131na sebebiyet verebilecektir (AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7 38).<\/p>\n<p>69. Bunun yan\u0131 s\u0131ra taraflar\u0131n kendi aralar\u0131nda yapt\u0131klar\u0131 s\u00f6zle\u015fmede belirlenen \u00fccretin \u00f6znel olmas\u0131 ve denetlenebilir bir \u00f6l\u00e7\u00fct\u00fcn\u00fcn olmamas\u0131 nedeniyle taraf a\u00e7\u0131s\u0131ndan bu \u00fccrete g\u00f6re de\u011ferlendirilebilecek bir maliyetin de her durumda ger\u00e7ek maliyeti ifade etmeyebilece\u011fi belirtilmelidir (AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7 61). Dolay\u0131s\u0131yla yarg\u0131lama sonucunda haks\u0131z \u00e7\u0131kan ki\u015fi aleyhine h\u00fckmedilecek vek\u00e2let \u00fccreti tutar\u0131n\u0131n belirlenmesinde hakl\u0131 \u00e7\u0131kan ki\u015finin avukat\u0131yla yapt\u0131\u011f\u0131 s\u00f6zle\u015fmedeki \u00fccretin de\u011fil standarda ba\u011flanm\u0131\u015f bir tarifenin esas al\u0131nmas\u0131n\u0131n makul oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>70. Di\u011fer yandan kurallar kapsam\u0131nda taraflar\u0131n lehine ya da aleyhine karar verilmesi h\u00e2linde h\u00fckmedilecek vek\u00e2let \u00fccreti i\u00e7in \u00f6ng\u00f6r\u00fclen maktu vek\u00e2let \u00fccreti her y\u0131l TBB taraf\u0131ndan yay\u0131mlanan Tarifede belirlenmektedir. Nitekim Kanun\u2019da vek\u00e2let \u00fccreti ile ilgili d\u00fczenlemelerin yap\u0131laca\u011f\u0131 belirtilen ve 3\/10\/2024 tarihli ve 32681 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan Tarifenin ikinci k\u0131sm\u0131n\u0131n ikinci b\u00f6l\u00fcm\u00fcnde a\u011f\u0131r ceza mahkemelerinde takip edilen davalarda maktu vekalet \u00fccreti 48.000 TL olarak belirlenmi\u015ftir.<\/p>\n<p>71. Anayasa Mahkemesi, yarg\u0131 mercilerince kar\u015f\u0131 tarafa y\u00fckletilecek vek\u00e2let \u00fccretine y\u00f6nelik d\u00fczenleme \u00f6ng\u00f6ren 1136 say\u0131l\u0131 Kanun\u2019un 169. maddesinin \u201c\u2026avukatl\u0131k \u00fccret tarifesinde yaz\u0131l\u0131 miktardan az ve \u00fc\u00e7 kat\u0131ndan fazla olamaz.\u201d b\u00f6l\u00fcm\u00fcn\u00fc inceledi\u011fi karar\u0131nda an\u0131lan b\u00f6l\u00fcm\u00fc dava de\u011ferinin y\u00fcksek oldu\u011fu yarg\u0131lamalarda ger\u00e7ek ki\u015fi veya \u00f6zel hukuk t\u00fczel ki\u015fileri lehine karar verilmesi y\u00f6n\u00fcnden incelenmi\u015ftir. S\u00f6z konusu kararda hukuk, idari ve vergi uyu\u015fmazl\u0131klar\u0131nda davalar\u0131n niteli\u011fi, yarg\u0131lama s\u00fcreci, sarf edilen emek ve mesai gibi \u00f6l\u00e7\u00fctler dikkate al\u0131narak b\u00f6l\u00fcm kapsam\u0131nda yarg\u0131 mercilerince taraflar lehine maktu \u00fccrete g\u00f6re belirlenen alt ve \u00fcst s\u0131n\u0131rlar i\u00e7inde vek\u00e2let \u00fccretine h\u00fckmedilmesine imk\u00e2n tan\u0131nmas\u0131n\u0131n makul oldu\u011fu belirtilerek kural\u0131n bu y\u00f6nden orant\u0131l\u0131 oldu\u011funa h\u00fckmedilmi\u015ftir (AYM, E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7\u00a7 62-64).<\/p>\n<p>72. Kurallarla a\u011f\u0131r ceza mahkemelerince dava de\u011ferinden ba\u011f\u0131ms\u0131z olarak kar\u015f\u0131 tarafa y\u00fckletilecek vek\u00e2let \u00fccreti i\u00e7in Tarifeye g\u00f6re belirlenen maktu vek\u00e2let \u00fccretinin \u00fcst s\u0131n\u0131r\u0131n\u0131n \u00fclke \u015fartlar\u0131nda makul ve kabul edilebilir d\u00fczeyde oldu\u011fu dolay\u0131s\u0131yla kurallardaki kamu yarar\u0131n\u0131n gerekleri ile bireyin haklar\u0131 aras\u0131ndaki dengenin bozulmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>73. Bu itibarla koruma tedbirleri nedeniyle tazminat davalar\u0131nda davan\u0131n niteli\u011fi, yarg\u0131lama s\u00fcreci, sarf edilen emek ve mesai gibi \u00f6l\u00e7\u00fctler dikkate al\u0131narak kurallar kapsam\u0131nda a\u011f\u0131r ceza mahkemelerince davac\u0131 lehine maktu \u00fccrete g\u00f6re belirlenen \u00fcst s\u0131n\u0131r i\u00e7inde vek\u00e2let \u00fccretine h\u00fckmedilmesine imk\u00e2n tan\u0131nmas\u0131n\u0131n makul oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Di\u011fer yandan a\u011f\u0131r ceza mahkemelerince bu s\u0131n\u0131r\u0131 ge\u00e7memek kayd\u0131yla d\u00fc\u015f\u00fck veya y\u00fcksek miktarda vek\u00e2let \u00fccretine h\u00fckmedilmesi durumunda da buna ili\u015fkin gerek\u00e7elerin kararda g\u00f6sterilmesi gerekti\u011fi, bu y\u00f6ndeki itirazlar\u0131n \u00fcst derece mahkemeleri nezdinde ileri s\u00fcr\u00fclmesinin m\u00fcmk\u00fcn oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>74. Dolay\u0131s\u0131yla kurallarda \u00f6ng\u00f6r\u00fclen s\u0131n\u0131r nedeniyle dava de\u011ferinin y\u00fcksek oldu\u011fu yarg\u0131lamalarda davac\u0131 lehine daha az vek\u00e2let \u00fccretine h\u00fckmedilmesiyle davac\u0131n\u0131n dava a\u00e7makla katlanaca\u011f\u0131 k\u00fclfet aras\u0131ndaki makul dengenin ortadan kald\u0131r\u0131ld\u0131\u011f\u0131 s\u00f6ylenemez. Bu itibarla kurallarla davac\u0131 lehine h\u00fckmedilecek vek\u00e2let \u00fccreti i\u00e7in \u00f6ng\u00f6r\u00fclen \u00fcst s\u0131n\u0131r\u0131n hedeflenen me\u015fru ama\u00e7 bak\u0131m\u0131ndan orant\u0131l\u0131 oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>75. Di\u011fer yandan kurallar, dava de\u011ferinin y\u00fcksek oldu\u011fu yarg\u0131lamalarda daval\u0131 Hazine lehine karar verilmesi y\u00f6n\u00fcnden incelendi\u011finde; daval\u0131 Hazine lehine, dava de\u011feri dikkate al\u0131nmadan Tarifede a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenmi\u015f maktu \u00fccretin \u00fcst s\u0131n\u0131r\u0131na kadar vek\u00e2let \u00fccretine h\u00fckmedilmesi, Hazine lehine daha az vek\u00e2let \u00fccretinin takdir edilmesi sonucunu do\u011furacakt\u0131r.<\/p>\n<p>76. Anayasa\u2019n\u0131n 142. maddesine g\u00f6re yarg\u0131lama usul\u00fcne ili\u015fkin kurallar\u0131n belirlenmesi ve bu konuda ihtiya\u00e7 duyulan d\u00fczenlemelerin yap\u0131lmas\u0131, bu kapsamda taraflar\u0131n yapt\u0131\u011f\u0131 hangi t\u00fcr giderlerin yarg\u0131lama gideri olarak kabul edilece\u011fi ile yarg\u0131lama gideri ad\u0131 alt\u0131nda h\u00fckmedilecek vek\u00e2let \u00fccretinin hangi \u00f6l\u00e7\u00fctlere g\u00f6re tespit edilece\u011finin belirlenmesi anayasal ilke ve s\u0131n\u0131rlar i\u00e7inde kanun koyucunun takdirindedir (AYM, E.2023\/54, K.2023\/90, 4\/5\/2023, \u00a7 36; E.2021\/58, K.2024\/14, 23\/1\/2024, \u00a7 50).<\/p>\n<p>77. Kanun koyucu takdir yetkisi kapsam\u0131nda an\u0131lan d\u00fczenlemeleri yaparken hukuk devleti ilkesinin bir gere\u011fi olan \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesiyle de ba\u011fl\u0131d\u0131r. Bu ilke gere\u011fince bir kural ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda makul bir dengenin bulunmas\u0131 zorunludur (AYM, E.2021\/18, K.2022\/97, 8\/9\/2022, \u00a7 20).<\/p>\n<p>78. Kurallar, daval\u0131 devlet lehine karar verilmesi durumunda koruma tedbirlerine maruz kalan davac\u0131 aleyhine h\u00fckmedilecek vek\u00e2let \u00fccretinin tayininde esas al\u0131nacak mebla\u011f\u0131n objektif olarak belirli, \u00f6ng\u00f6r\u00fclebilir ve ekonomik y\u00f6nden onun \u00fczerinde \u00e7ok a\u011f\u0131r ve ciddi bir etki yaratmayacak, adalet ve hakkaniyet duygusunu zedelemeyecek makul bir miktar olmas\u0131n\u0131n sa\u011flanmas\u0131n\u0131 ama\u00e7lamaktad\u0131r. Bu itibarla kurallar\u0131n bu y\u00f6n\u00fcyle de me\u015fru bir ama\u00e7 ta\u015f\u0131mad\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>79. Davada haks\u0131z \u00e7\u0131kan tarafa y\u00fckletilecek vek\u00e2let \u00fccreti bak\u0131m\u0131ndan bir \u00fcst s\u0131n\u0131r \u00f6ng\u00f6r\u00fclmesinin objektif ve kabul edilebilir nedenlerinin bulundu\u011fu g\u00f6zetildi\u011finde kurallar\u0131n an\u0131lan me\u015fru amaca ula\u015fma bak\u0131m\u0131ndan elveri\u015fli ve gerekli oldu\u011fu da anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>80. Kanun koyucunun baz\u0131 davalar\u0131n \u00f6zel niteli\u011fini de dikkate alarak taraflar\u0131n y\u00fcksek miktarlarda vek\u00e2let \u00fccreti tehdidi alt\u0131nda kalmamas\u0131 amac\u0131yla dava de\u011ferinden ba\u011f\u0131ms\u0131z olarak bu konularda belirli s\u0131n\u0131rlar \u00f6ng\u00f6rmesi do\u011fal kar\u015f\u0131lanabilir. Ancak bu s\u0131n\u0131rlara ili\u015fkin kurallarla ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda makul bir dengenin de bulunmas\u0131 zorunludur.<\/p>\n<p>81. Avukat\u0131n eme\u011fi, \u00e7abas\u0131, i\u015fin \u00f6nemi, niteli\u011fi ve davan\u0131n s\u00fcresi gibi nesnel \u00f6l\u00e7\u00fctlerle en fazla Tarifede a\u011f\u0131r ceza mahkemelerinde takip edilen davalar i\u00e7in belirlenen maktu vek\u00e2let \u00fccreti kadar h\u00fckmedilecek \u00fccretin standarda ba\u011flanm\u0131\u015f kabul edilebilir bir maliyeti ifade etti\u011fi a\u00e7\u0131kt\u0131r. Bu itibarla koruma tedbirleri nedeniyle a\u00e7\u0131lan tazminat davalar\u0131n\u0131n niteli\u011fi, yarg\u0131lama s\u00fcreci, sarf edilen emek ve mesai gibi \u00f6l\u00e7\u00fctler dikkate al\u0131narak kurallar kapsam\u0131nda a\u011f\u0131r ceza mahkemelerince taraflar lehine maktu \u00fccrete g\u00f6re belirlenen \u00fcst s\u0131n\u0131ra kadar vek\u00e2let \u00fccretine h\u00fckmedilmesine imk\u00e2n tan\u0131nmas\u0131n\u0131n makul oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>82. Di\u011fer yandan a\u011f\u0131r ceza mahkemelerince bu s\u0131n\u0131r\u0131 ge\u00e7memek kayd\u0131yla d\u00fc\u015f\u00fck veya y\u00fcksek miktarda vek\u00e2let \u00fccretine h\u00fckmedilmesi durumunda da buna ili\u015fkin gerek\u00e7elerin kararda g\u00f6sterilmesi gerekti\u011fi, bu y\u00f6ndeki itirazlar\u0131n \u00fcst derece mahkemeleri nezdinde ileri s\u00fcr\u00fclmesinin m\u00fcmk\u00fcn oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla kurallar nedeniyle dava de\u011ferinin y\u00fcksek oldu\u011fu yarg\u0131lamalarda Hazine lehine daha az vek\u00e2let \u00fccretine h\u00fckmedilmesi sonucunda devletin haks\u0131z bir \u015fekilde davaya muhatap olmakla katlanaca\u011f\u0131 k\u00fclfet ile davac\u0131 taraf\u0131n y\u00fcksek miktarlarda vek\u00e2let \u00fccreti tehdidi alt\u0131nda kalmamas\u0131 \u015feklindeki bireysel yarar aras\u0131ndaki makul dengenin ortadan kald\u0131r\u0131ld\u0131\u011f\u0131 s\u00f6ylenemez. Bu itibarla kurallarla Hazine lehine h\u00fckmedilecek vek\u00e2let \u00fccreti i\u00e7in \u00f6ng\u00f6r\u00fclen \u00fcst s\u0131n\u0131r\u0131n hedeflenen me\u015fru ama\u00e7 bak\u0131m\u0131ndan \u00f6l\u00e7\u00fcl\u00fc oldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>83. A\u00e7\u0131klanan nedenlerle kurallar, Anayasa\u2019n\u0131n 2., 13, 36. ve 142. maddelerine ayk\u0131r\u0131 de\u011fildir. \u0130tiraz\u0131n reddi gerekir.<\/p>\n<p>Kurallar\u0131n Anayasa\u2019n\u0131n 37. maddesiyle ilgisi g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>IV.
