E\u011fer bu limit a\u015f\u0131l\u0131rsa,\u2064 s\u00f6zle\u015fmenin ilgili h\u00fckm\u00fc ge\u00e7ersiz olur ve mahkeme, ge\u00e7erli olan t\u00fcketici fiyat endeksi ortalamas\u0131n\u0131 g\u00f6z \u00f6n\u00fcnde bulundurarak kirac\u0131n\u0131n ve kiralayan\u0131n menfaatlerini dikkate \u2062alarak karar\u2063 verir.<\/p>\n<p>Ayr\u0131ca, kiralama s\u00fcresinin be\u015f y\u0131ldan uzun olmas\u0131 durumunda, s\u00f6zle\u015fmenin sona ermesinin ard\u0131ndan, 12 ayl\u0131k d\u00f6nem dikkate al\u0131narak bir art\u0131\u015f belirlenir. Kira bedelinin tespitinde, kiralad\u0131\u011f\u0131n\u0131z yerin konumu, durumu ve emsal kira bedelleri dikkate al\u0131narak mahkeme karar\u0131n\u0131 olu\u015fturur.
