Kira tespit davas\u0131 ile bir kira y\u0131l\u0131na ait kira paras\u0131n\u0131n ne olaca\u011f\u0131n\u0131n belirlenmesi sa\u011flan\u0131r. Bu yaz\u0131m\u0131zda kira tespit davas\u0131 a\u00e7arken dikkat edilmesi gereken noktalar\u0131n neler oldu\u011funa ve uygulamada kira tespit davalar\u0131n\u0131n nas\u0131l y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcne ili\u015fkin hususlara de\u011finece\u011fiz.<\/p>\n<p>Kira tespiti davalar\u0131 kamu d\u00fczenine ili\u015fkin davalardand\u0131r. Bu dava kiraya veren taraf\u0131ndan a\u00e7\u0131labilece\u011fi gibi kirac\u0131 taraf\u0131ndan da a\u00e7\u0131labilmektedir. Kira tespit davas\u0131 yaln\u0131zca konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131n\u0131n tespiti i\u00e7in a\u00e7\u0131labilir. Kira tespit davas\u0131 kira bedelinin belirlenmesi ve tespit edilmesi amac\u0131yla a\u00e7\u0131l\u0131r. Bu davalar\u0131n sonunda yaln\u0131zca bedel belirlenecek olup bu bedelin tahsili i\u00e7in ayr\u0131 bir hukuki s\u00fcre\u00e7 izlenmektedir.<\/p>\n<p>Kira tespit davas\u0131n\u0131n a\u00e7\u0131labilmesi i\u00e7in \u00f6ncelikle ge\u00e7erli bir kira s\u00f6zle\u015fmesinin varl\u0131\u011f\u0131 gereklidir. T\u00fcrk Bor\u00e7lar Kanunu 344. Maddesi \u201cTaraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenir.\u201d demek suretiyle a\u00e7\u0131k ve net olarak her yeni be\u015f y\u0131ll\u0131k d\u00f6nemde kira bedelinin yeniden belirlenebilece\u011fini h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>K\u0130RA S\u00d6ZLE\u015eMES\u0130N\u0130N BE\u015e YILI DOLDURMAMASI DURUMUNDA;<\/p>\n<p>Be\u015f y\u0131l\u0131 doldurmayan kira s\u00f6zle\u015fmelerinde, s\u00f6zle\u015fmede art\u0131\u015f oran\u0131na ili\u015fkin h\u00fck\u00fcm bulunmamas\u0131 durumunda kira tespit davas\u0131 a\u00e7\u0131labilmektedir ancak belirlenecek olan kira bedeli T\u00dcFE oran\u0131n\u0131 ge\u00e7emeyecektir. TBK madde 344\/2 \u201cTaraflarca bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa, kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir.\u201d demektedir. S\u00f6z konusu kanun h\u00fckm\u00fcne g\u00f6re kira s\u00f6zle\u015fmesinde art\u0131\u015f \u015fart\u0131 belirlenmemi\u015fse 5 y\u0131ll\u0131k s\u00fcre dolmadan tespit davas\u0131 a\u00e7\u0131labilecek ancak hakim emsal kira bedellerine g\u00f6re de\u011fil hakkaniyete uygun ve T\u00dcFE oran\u0131n\u0131 ge\u00e7meyen bir bedel belirleyecektir.<\/p>\n<p>TESP\u0130T ED\u0130LECEK K\u0130RA BEDEL\u0130N\u0130N HANG\u0130 D\u00d6NEMDEN \u0130T\u0130BAREN GE\u00c7ERL\u0130 OLAB\u0130LECE\u011e\u0130 DURUMU;<\/p>\n<p>Kira tespit davalar\u0131nda kira s\u00f6zle\u015fmesinde art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm bulunup bulunmad\u0131\u011f\u0131 \u00f6nem arz etmektedir. Kira s\u00f6zle\u015fmesinde art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm var ise kira d\u00f6neminin sonuna kadar dava a\u00e7\u0131ld\u0131\u011f\u0131 taktirde verilecek h\u00fck\u00fcm i\u00e7inde bulunulan d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olacakt\u0131r. S\u00f6zle\u015fmede art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm bulunsa dahi dava a\u00e7arken i\u00e7inde bulunulan kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olmas\u0131 i\u00e7in \u00f6zellikle dilek\u00e7ede talep olarak belirtilmelidir.<\/p>\n<p>Kira s\u00f6zle\u015fmesinde art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm bulunmuyorsa kira tespit davas\u0131 yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan en az otuz g\u00fcn \u00f6nce a\u00e7\u0131lm\u0131\u015fsa ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla, izleyen yeni kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren kirac\u0131y\u0131 ba\u011flar.<\/p>\n<p>\u00d6zetle TBK madde 345 kira tespit davas\u0131n\u0131n her zaman a\u00e7\u0131labilece\u011fini ancak bu davan\u0131n yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren sonu\u00e7 do\u011furmas\u0131 i\u00e7in;<\/p>\n<p>&#8211; s\u00f6zle\u015fmede h\u00fck\u00fcm bulunmas\u0131 gerekti\u011fini,<\/p>\n<p>&#8211; s\u00f6zle\u015fmede h\u00fck\u00fcm yoksa yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan otuz g\u00fcn \u00f6nceki bir tarihte dava a\u00e7\u0131lmas\u0131 gerekti\u011fini ya da yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan otuz g\u00fcn \u00f6nceki bir tarihte kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fulu ile izleyen kira d\u00f6nemi sonuna kadar dava a\u00e7\u0131lmas\u0131 gerekti\u011fini a\u00e7\u0131k\u00e7a madde metninde belirtmi\u015ftir. Aksi takdirde a\u00e7\u0131lacak olan davada verilecek olan h\u00fck\u00fcm, sonu\u00e7lar\u0131n\u0131 bir sonraki kira d\u00f6nemi i\u00e7in do\u011furur.<\/p>\n<p>Hakim kira bedelini tespit ederken alan\u0131nda uzman bilirki\u015filerce yap\u0131lacak inceleme ve haz\u0131rlanacak rapor neticesinde, T\u00dcFE, kiralanan\u0131n durumu, rayi\u00e7 kira bedellerini dikkate alarak hakkaniyete uygun bir kira bedeline h\u00fckmeder. Burada bilirki\u015filerce haz\u0131rlanacak rapor ve hakkaniyet indirimi kavram\u0131 \u00f6nem arz etmektedir. Ta\u015f\u0131nmaz\u0131n bulundu\u011fu konum, fiziksel \u00f6zellikleri, \u00e7evresel fakt\u00f6rler, sosyal imkanlar bilirki\u015filerce detayl\u0131ca de\u011ferlendirilmeli, kiralanan\u0131n bulundu\u011fu b\u00f6lgede benzer \u00f6zelliklere sahip di\u011fer ta\u015f\u0131nmazlar\u0131n emsal kira bedelleri ara\u015ft\u0131r\u0131larak rapor haz\u0131rlanmal\u0131d\u0131r. Taraflarca sunulacak ta\u015f\u0131nmaza ili\u015fkin kira s\u00f6zle\u015fmesi, emsal kira s\u00f6zle\u015fmeleri, ihtarname, tan\u0131k beyanlar\u0131 gibi deliller \u00f6nem arz etmektedir. Hakim t\u00fcm delillerle beraber haz\u0131rlanan bilirki\u015fi raporunu da g\u00f6z \u00f6n\u00fcne alarak uygulamada eski kirac\u0131 indirimi olarak adland\u0131r\u0131lan ve genelde %10 ila %20 aras\u0131na tekab\u00fcl eden hakkaniyet indirimi ile kira bedelini tespit eder.<\/p>\n<p>Kira tespit davalar\u0131nda yeni kira d\u00f6neminde kiran\u0131n ne olaca\u011f\u0131 tespit edilmekte olup bu davalarda \u0131slah ve bedel art\u0131r\u0131m\u0131 yap\u0131lmamaktad\u0131r. Kira tespiti davalar\u0131 a\u00e7\u0131l\u0131rken, talep edilen kira bedeli ba\u015flang\u0131\u00e7ta tam ve net bir \u015fekilde belirtilmelidir. Yarg\u0131tay HGK, 2017\/2792 E., 2023\/267 K. Say\u0131l\u0131 karar\u0131nda \u201c\u2026Kira bedelinin tespiti davalar\u0131, sadece ilgili kira d\u00f6neminde ge\u00e7erli olacak bedelin belirlenmesine y\u00f6neliktir. Bu nedenle talep b\u00f6l\u00fcnemez, fazlaya dair haklar sakl\u0131 tutulamaz, \u0131slah m\u00fcmk\u00fcn de\u011fildir.\u201d \u015feklindeki karar\u0131 ile dava ba\u015flang\u0131c\u0131nda istenen kira bedelinin daha sonra bedel art\u0131\u015f\u0131 veya \u0131slah yoluyla de\u011fi\u015ftirilmesi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>Bir di\u011fer \u00f6nemli husus bu davalar\u0131n kesinle\u015fmeden icra edilememesidir. Karar kesinle\u015ftikten sonra yeni kira bedeline ili\u015fkin ilaml\u0131 icra yoluna gidilebilir, alacaklara uygulanacak faiz kesinle\u015fme tarihinden itibaren i\u015flemeye ba\u015flar.<\/p>\n<p>Kira Tespit Davas\u0131 a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvuru yap\u0131lmas\u0131 dava \u015fart\u0131d\u0131r. Arabuluculuk s\u00fcreci i\u015fletilmeden do\u011frudan dava a\u00e7\u0131lmas\u0131 halinde, dava usulden reddedilecektir.<\/p>\n<p>Bu davalarda g\u00f6revli ve yetkili mahkeme ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerdeki Sulh Hukuk Mahkemeleri olup, taraflar\u0131n her ikisinin tacir ya da kamu t\u00fczel ki\u015fisi olmas\u0131 ve yetki s\u00f6zle\u015fmesi yapmas\u0131 durumunda s\u00f6zle\u015fmede belirlenen yerde a\u00e7\u0131labilir.<\/p>\n<p>\u200bKira Tespit Davas\u0131, Kiraya Veren ve Kirac\u0131n\u0131n kira bedeli \u00fczerinde ihtilaf ya\u015famas\u0131 durumunda ortaya \u00e7\u0131kan ihtilaf\u0131 gidermeye y\u00f6nelik hukuki uygulama olarak tan\u0131mlanabilir. Kira tespit davas\u0131 ile bir kira y\u0131l\u0131na ait kira paras\u0131n\u0131n ne olaca\u011f\u0131n\u0131n belirlenmesi sa\u011flan\u0131r. Bu yaz\u0131m\u0131zda kira tespit davas\u0131 a\u00e7arken dikkat edilmesi gereken noktalar\u0131n neler oldu\u011funa ve uygulamada kira tespit davalar\u0131n\u0131n nas\u0131l y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcne ili\u015fkin hususlara de\u011finece\u011fiz.<\/p>\n<p>Kira tespiti davalar\u0131 kamu d\u00fczenine ili\u015fkin davalardand\u0131r. Kira tespit davas\u0131 kira bedelinin belirlenmesi ve tespit edilmesi amac\u0131yla a\u00e7\u0131l\u0131r. Bu davalar\u0131n sonunda yaln\u0131zca bedel belirlenecek olup bu bedelin tahsili i\u00e7in ayr\u0131 bir hukuki s\u00fcre\u00e7 izlenmektedir.<\/p>\n<p>Kira tespit davas\u0131n\u0131n a\u00e7\u0131labilmesi i\u00e7in \u00f6ncelikle ge\u00e7erli bir kira s\u00f6zle\u015fmesinin varl\u0131\u011f\u0131 gereklidir. Kira s\u00f6zle\u015fmesinde art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm var ise kira d\u00f6neminin sonuna kadar dava a\u00e7\u0131ld\u0131\u011f\u0131 taktirde verilecek h\u00fck\u00fcm i\u00e7inde bulunulan d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olacakt\u0131r. S\u00f6zle\u015fmede art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm bulunsa dahi dava a\u00e7arken i\u00e7inde bulunulan kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olmas\u0131 i\u00e7in \u00f6zellikle dilek\u00e7ede talep olarak belirtilmelidir.<\/p>\n<p>Kira s\u00f6zle\u015fmesinde art\u0131\u015fa ili\u015fkin h\u00fck\u00fcm bulunmuyorsa kira tespit davas\u0131 yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan en az otuz g\u00fcn \u00f6nce a\u00e7\u0131lm\u0131\u015fsa ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla, izleyen yeni kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren kirac\u0131y\u0131 ba\u011flar.<\/p>\n<p>\u00d6zetle TBK madde 345 kira tespit davas\u0131n\u0131n her zaman a\u00e7\u0131labilece\u011fini ancak bu davan\u0131n yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren sonu\u00e7 do\u011furmas\u0131 i\u00e7in;<\/p>\n<p>&#8211; s\u00f6zle\u015fmede h\u00fck\u00fcm bulunmas\u0131 gerekti\u011fini,<\/p>\n<p>&#8211; s\u00f6zle\u015fmede h\u00fck\u00fcm yoksa yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan otuz g\u00fcn \u00f6nceki bir tarihte dava a\u00e7\u0131lmas\u0131 gerekti\u011fini ya da yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan otuz g\u00fcn \u00f6nceki bir tarihte kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fulu ile izleyen kira d\u00f6nemi sonuna kadar dava a\u00e7\u0131lmas\u0131 gerekti\u011fini a\u00e7\u0131k\u00e7a madde metninde belirtmi\u015ftir.
