{"id":106168,"date":"2025-06-04T11:26:00","date_gmt":"2025-06-04T08:26:00","guid":{"rendered":"https:\/\/denizcankizil.tr\/uncategorized-tr\/aymnin-2024-161-esas-2025-69-karar-sayili-karari\/"},"modified":"2025-06-04T11:26:00","modified_gmt":"2025-06-04T08:26:00","slug":"aymnin-2024-161-esas-2025-69-karar-sayili-karari","status":"publish","type":"post","link":"http:\/\/denizcankizil.tr\/en\/hukukihaber\/aymnin-2024-161-esas-2025-69-karar-sayili-karari\/","title":{"rendered":"AYM&#8217;nin 2024\/161 esas &#8211; 2025\/69 karar say\u0131l\u0131 karar\u0131"},"content":{"rendered":"<p>ANAYASA MAHKEMES\u0130 KARARI<\/p>\n<p>Esas Say\u0131s\u0131 : 2024\/161<\/p>\n<p>Karar Say\u0131s\u0131 : 2025\/69<\/p>\n<p>Karar Tarihi : 6\/3\/2025<\/p>\n<p>R.G.Tarih-Say\u0131 : 4\/6\/2025-32920<\/p>\n<p>\u0130T\u0130RAZ YOLUNA BA\u015eVURAN: Elmada\u011f Sulh Hukuk Mahkemesi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 7\/6\/2012 tarihli ve 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu\u2019na 28\/3\/2023 tarihli ve 7445 say\u0131l\u0131 Kanun\u2019un 37. maddesiyle eklenen 18\/B maddesinin (1) ve (3) numaral\u0131 f\u0131kralar\u0131n\u0131n Anayasa\u2019n\u0131n 9., 10., 35. ve 36. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptallerine karar verilmesi talebidir.<\/p>\n<p>OLAY: K\u0131s\u0131tl\u0131n\u0131n payda\u015f oldu\u011fu ta\u015f\u0131nmazdaki ortakl\u0131\u011f\u0131n sat\u0131\u015f suretiyle giderilmesine ili\u015fkin arabuluculuk anla\u015fma belgesine icra edilebilirlik \u015ferhi verilmesi davas\u0131nda itiraz konusu kurallar\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptalleri i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN KANUN H\u00dcK\u00dcMLER\u0130<\/p>\n<p>Kanun\u2019un itiraz konusu kurallar\u0131n da yer ald\u0131\u011f\u0131 18\/B maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cBaz\u0131 uyu\u015fmazl\u0131klarda dava \u015fart\u0131 olarak arabuluculuk<\/p>\n<p>MADDE 18\/B- (Ek:28\/3\/2023-7445\/37 md.)<\/p>\n<p> (1) A\u015fa\u011f\u0131daki uyu\u015fmazl\u0131klarda, dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r:<\/p>\n<p>a) Kiralanan ta\u015f\u0131nmazlar\u0131n 2004 say\u0131l\u0131 Kanuna g\u00f6re ilams\u0131z icra yoluyla tahliyesine ili\u015fkin h\u00fck\u00fcmler hari\u00e7 olmak \u00fczere, kira ili\u015fkisinden kaynaklanan uyu\u015fmazl\u0131klar.<\/p>\n<p>b) Ta\u015f\u0131n\u0131r ve ta\u015f\u0131nmazlar\u0131n payla\u015ft\u0131r\u0131lmas\u0131na ve ortakl\u0131\u011f\u0131n giderilmesine ili\u015fkin uyu\u015fmazl\u0131klar.<\/p>\n<p>c) 23\/6\/1965 tarihli ve 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunundan kaynaklanan uyu\u015fmazl\u0131klar.<\/p>\n<p>\u00e7) Kom\u015fu hakk\u0131ndan kaynaklanan uyu\u015fmazl\u0131klar.<\/p>\n<p> (2) Arabuluculuk s\u00fcreci sonunda taraflar\u0131n anla\u015fmas\u0131 halinde anla\u015fma belgesi, ta\u015f\u0131nmazla ilgili olarak kanunlarda yer alan s\u0131n\u0131rlamalar ile usul ve esaslar g\u00f6zetilmek suretiyle d\u00fczenlenir.<\/p>\n<p> (3) Bu madde kapsam\u0131nda d\u00fczenlenen anla\u015fma belgesinin icra edilebilirli\u011fine ili\u015fkin \u015ferhin al\u0131nmas\u0131 zorunlu olup bu \u015ferh ta\u015f\u0131nmazla ilgili anla\u015fma belgeleri bak\u0131m\u0131ndan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer, di\u011fer anla\u015fma belgeleri bak\u0131m\u0131ndan ise arabulucunun g\u00f6rev yapt\u0131\u011f\u0131 yer sulh hukuk mahkemesinden al\u0131n\u0131r. Mahkeme ta\u015f\u0131nmazla ilgili anla\u015fma belgeleri bak\u0131m\u0131ndan yapaca\u011f\u0131 incelemede anla\u015fma i\u00e7eri\u011fini, arabuluculu\u011fa ve cebri icraya elveri\u015fli olup olmad\u0131\u011f\u0131 ve ta\u015f\u0131nmazla ilgili olarak kanunlarda yer alan s\u0131n\u0131rlamalar ile usul ve esaslara uyulup uyulmad\u0131\u011f\u0131 y\u00f6n\u00fcnden denetler; bu kapsamda kurum veya kurulu\u015flardan bilgi veya belge talep edebilir ve gerekti\u011finde duru\u015fma a\u00e7abilir.<\/p>\n<p> (4) Anla\u015fma belgesinin icra edilebilirli\u011fine ili\u015fkin \u015ferhin verilmesiyle ilgili di\u011fer hususlar hakk\u0131nda 18 inci madde h\u00fckm\u00fc uygulan\u0131r.<\/p>\n<p> (5) (Ek:7\/11\/2024-7531\/26 md.) Ta\u015f\u0131nmaz\u0131n devrine veya ta\u015f\u0131nmaz \u00fczerinde s\u0131n\u0131rl\u0131 ayni hak kurulmas\u0131na ili\u015fkin anla\u015fma belgesinin taraflar\u0131ndan biri, icra edilebilirlik \u015ferhi verilmesinden sonra tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnden tescil talebinde bulunabilir. Tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce ta\u015f\u0131nmaza ili\u015fkin mevzuatta \u00f6ng\u00f6r\u00fclen gerekli inceleme ve de\u011ferlendirme yap\u0131ld\u0131ktan sonra resmi senet d\u00fczenlenmeksizin tescil talebi yerine getirilir.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Hasan Tahsin G\u00d6KCAN, Basri BA\u011eCI, Engin YILDIRIM, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, \u0130rfan F\u0130DAN, Kenan YA\u015eAR, Muhterem \u0130NCE, Y\u0131lmaz AK\u00c7\u0130L, \u00d6mer \u00c7INAR ve Metin KIRATLI\u2019n\u0131n kat\u0131l\u0131mlar\u0131yla 24\/9\/2024 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda \u00f6ncelikle uygulanacak kural ve s\u0131n\u0131rlama sorunlar\u0131 g\u00f6r\u00fc\u015f\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. Anayasa\u2019n\u0131n 152. ile 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 40. maddelerine g\u00f6re bir davaya bakmakta olan mahkeme, o dava sebebiyle uygulanacak bir kanunun veya Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesinin h\u00fck\u00fcmlerini Anayasa\u2019ya ayk\u0131r\u0131 g\u00f6rmesi h\u00e2linde veya taraflardan birinin ileri s\u00fcrd\u00fc\u011f\u00fc ayk\u0131r\u0131l\u0131k iddias\u0131n\u0131n ciddi oldu\u011fu kan\u0131s\u0131na varmas\u0131 durumunda bu h\u00fck\u00fcmlerin iptalleri i\u00e7in Anayasa Mahkemesine ba\u015fvurmaya yetkilidir. Ancak an\u0131lan maddeler uyar\u0131nca bir mahkemenin Anayasa Mahkemesine ba\u015fvurabilmesi i\u00e7in elinde y\u00f6ntemince a\u00e7\u0131lm\u0131\u015f ve mahkemenin g\u00f6revine giren bir davan\u0131n bulunmas\u0131, iptali talep edilen kural\u0131n da o davada uygulanacak olmas\u0131 gerekir. Uygulanacak kural ise bak\u0131lmakta olan davan\u0131n de\u011fi\u015fik evrelerinde ortaya \u00e7\u0131kan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde veya davay\u0131 sonu\u00e7land\u0131rmada olumlu ya da olumsuz y\u00f6nde etki yapacak nitelikte bulunan kurallard\u0131r.<\/p>\n<p>3. \u0130tiraz yoluna ba\u015fvuran Mahkeme 6325 say\u0131l\u0131 Kanun\u2019un 18\/B maddesinin (1) ve (3) numaral\u0131 f\u0131kralar\u0131n\u0131n iptallerini talep etmi\u015ftir. An\u0131lan maddenin itiraz konusu (1) numaral\u0131 f\u0131kras\u0131nda s\u00f6z konusu f\u0131kran\u0131n (a), (b), (c) ve (\u00e7) bentlerinde say\u0131lan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131 olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bak\u0131lmakta olan davan\u0131n konusunun f\u0131kran\u0131n (b) bendinde yer alan ortakl\u0131\u011f\u0131n giderilmesine ili\u015fkin arabuluculuk anla\u015fma belgesine icra edilebilirlik \u015ferhi verilmesi oldu\u011fu g\u00f6zetildi\u011finde arabuluculu\u011fu dava \u015fart\u0131 olarak d\u00fczenleyen f\u0131kran\u0131n (a), (c), (\u00e7) bentlerinin ve (b) bendinde yer alan \u201cTa\u015f\u0131n\u0131r ve ta\u015f\u0131nmazlar\u0131n payla\u015ft\u0131r\u0131lmas\u0131na ve&#8230;\u201d ibaresinin bak\u0131lmakta olan davada uygulanma imk\u00e2n\u0131 bulunmamaktad\u0131r. Bu itibarla s\u00f6z konusu bentlere ve ibareye ili\u015fkin ba\u015fvurunun Mahkemenin yetkisizli\u011fi nedeniyle reddi gerekir.<\/p>\n<p>4. Ayr\u0131ca f\u0131kran\u0131n birinci c\u00fcmlesi ile (b) bendinde yer alan \u201c\u2026ili\u015fkin uyu\u015fmazl\u0131klar.\u201d ibaresi ortakl\u0131\u011f\u0131n giderilmesine ili\u015fkin uyu\u015fmazl\u0131klar\u0131n yan\u0131 s\u0131ra f\u0131krada say\u0131lan bak\u0131lmakta olan davada uygulanma imk\u00e2n\u0131 olmayan di\u011fer h\u00fck\u00fcmler y\u00f6n\u00fcnden de ge\u00e7erli, ortak kural niteli\u011findedir. Bu itibarla bak\u0131lmakta olan davan\u0131n konusu g\u00f6zetilerek kural\u0131n kalan k\u0131sm\u0131n\u0131n esas\u0131na ili\u015fkin incelemenin \u201c\u2026ortakl\u0131\u011f\u0131n giderilmesine\u2026\u201d ibaresi ile s\u0131n\u0131rl\u0131 olarak yap\u0131lmas\u0131 gerekir.<\/p>\n<p>5. \u00d6te yandan 6216 say\u0131l\u0131 Kanun&#8217;un 40. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendinde \u201c\u0130ptali istenen kurallar\u0131n Anayasan\u0131n hangi maddelerine ayk\u0131r\u0131 olduklar\u0131n\u0131 a\u00e7\u0131klayan gerek\u00e7eli ba\u015fvuru karar\u0131n\u0131n asl\u0131\u201d Anayasa Mahkemesine g\u00f6nderilecek belgeler aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. An\u0131lan maddenin (4) numaral\u0131 f\u0131kras\u0131nda ise a\u00e7\u0131k bir \u015fekilde dayanaktan yoksun veya y\u00f6ntemine uygun olmayan itiraz ba\u015fvurular\u0131n\u0131n Anayasa Mahkemesi taraf\u0131ndan esas incelemeye ge\u00e7ilmeksizin gerek\u00e7eleriyle reddedilece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>6. S\u00f6z konusu \u0130\u00e7t\u00fcz\u00fck\u2019\u00fcn 46. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendinde itiraz yoluna ba\u015fvuran Mahkemenin gerek\u00e7eli karar\u0131nda Anayasa\u2019ya ayk\u0131r\u0131l\u0131klar\u0131 ileri s\u00fcr\u00fclen h\u00fck\u00fcmlerin her birinin Anayasa\u2019n\u0131n hangi maddelerine, hangi nedenlerle ayk\u0131r\u0131 oldu\u011funun ayr\u0131 ayr\u0131 ve gerek\u00e7eleriyle birlikte a\u00e7\u0131k\u00e7a g\u00f6sterilmesi gerekti\u011fi d\u00fczenlenmi\u015ftir. Yine \u0130\u00e7t\u00fcz\u00fck\u2019\u00fcn 49. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (b) bendinde Anayasa Mahkemesince yap\u0131lan ilk incelemede ba\u015fvuruda eksikliklerin bulundu\u011funun tespit edilmesi h\u00e2linde itiraz yoluna ili\u015fkin i\u015flerde esas incelemeye ge\u00e7ilmeksizin ba\u015fvurunun reddine karar verilece\u011fi belirtilmi\u015ftir.<\/p>\n<p>7. Yap\u0131lan incelemede itiraz yoluna ba\u015fvuran Mahkeme taraf\u0131ndan 6325 say\u0131l\u0131 Kanun\u2019un 18\/B maddesinin (3) numaral\u0131 f\u0131kras\u0131n\u0131n \u201c\u2026bu \u015ferh ta\u015f\u0131nmazla ilgili anla\u015fma belgeleri bak\u0131m\u0131ndan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer, di\u011fer anla\u015fma belgeleri bak\u0131m\u0131ndan ise arabulucunun g\u00f6rev yapt\u0131\u011f\u0131 yer sulh hukuk mahkemesinden al\u0131n\u0131r.\u201d b\u00f6l\u00fcm\u00fcn\u00fcn Anayasa\u2019n\u0131n hangi maddelerine hangi nedenlerle ayk\u0131r\u0131 oldu\u011funun ayr\u0131 ayr\u0131 ve gerek\u00e7eleriyle birlikte a\u00e7\u0131k\u00e7a g\u00f6sterilmedi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r. Bu itibarla an\u0131lan b\u00f6l\u00fcme ili\u015fkin ba\u015fvurunun y\u00f6ntemine uygun olmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>8. A\u00e7\u0131klanan nedenlerle 7\/6\/2012 tarihli ve 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu\u2019na 28\/3\/2023 tarihli ve 7445 say\u0131l\u0131 Kanun\u2019un 37. maddesiyle eklenen 18\/B maddesinin;<\/p>\n<p>A. (1) numaral\u0131 f\u0131kras\u0131n\u0131n;<\/p>\n<p>1. (a) bendinin, (b) bendinde yer alan \u201cTa\u015f\u0131n\u0131r ve ta\u015f\u0131nmazlar\u0131n payla\u015ft\u0131r\u0131lmas\u0131na ve&#8230;\u201d ibaresi ile (c) ve (\u00e7) bentlerinin itiraz ba\u015fvurusunda bulunan Mahkemenin bakmakta oldu\u011fu davada uygulanma imk\u00e2n\u0131 bulunmad\u0131\u011f\u0131ndan bu ibare ve bentlere ili\u015fkin ba\u015fvurunun Mahkemenin yetkisizli\u011fi nedeniyle REDD\u0130NE,<\/p>\n<p>2. Kalan k\u0131sm\u0131n\u0131n esas\u0131n\u0131n incelenmesine, esasa ili\u015fkin incelemenin an\u0131lan f\u0131kran\u0131n (b) bendinde yer alan \u201c\u2026ortakl\u0131\u011f\u0131n giderilmesine&#8230;\u201d ibaresi ile s\u0131n\u0131rl\u0131 olarak yap\u0131lmas\u0131na,<\/p>\n<p>B. (3) numaral\u0131 f\u0131kras\u0131n\u0131n;<\/p>\n<p>1. Birinci c\u00fcmlesinin \u201c&#8230;bu \u015ferh ta\u015f\u0131nmazla ilgili anla\u015fma belgeleri bak\u0131m\u0131ndan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer, di\u011fer anla\u015fma belgeleri bak\u0131m\u0131ndan ise arabulucunun g\u00f6rev yapt\u0131\u011f\u0131 yer sulh hukuk mahkemesinden al\u0131n\u0131r.\u201d b\u00f6l\u00fcm\u00fcne y\u00f6nelik itiraz ba\u015fvurusunun 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 40. maddesinin (4) numaral\u0131 f\u0131kras\u0131 gere\u011fince y\u00f6ntemine uygun olmad\u0131\u011f\u0131ndan REDD\u0130NE,<\/p>\n<p>2. Kalan k\u0131sm\u0131n\u0131n esas\u0131n\u0131n incelenmesine,<\/p>\n<p>OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>9. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r Muhammed Nuri \u00d6ZG\u00dcR taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fck\u00fcmleri, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Kanun\u2019un 18\/B Maddesinin (1) Numaral\u0131 F\u0131kras\u0131n\u0131n (b) Bendinde Yer Alan \u201c\u2026ortakl\u0131\u011f\u0131n giderilmesine\u2026\u201d \u0130baresinin \u0130ncelenmesi<\/p>\n<p>10. Anayasa\u2019n\u0131n \u201cAnayasaya ayk\u0131r\u0131l\u0131\u011f\u0131n di\u011fer mahkemelerde ileri s\u00fcr\u00fclmesi\u201d ba\u015fl\u0131kl\u0131 152. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda \u201cAnayasa Mahkemesinin i\u015fin esas\u0131na girerek verdi\u011fi red karar\u0131n\u0131n Resm\u00ee Gazetede yay\u0131mlanmas\u0131ndan sonra on y\u0131l ge\u00e7medik\u00e7e ayn\u0131 kanun h\u00fckm\u00fcn\u00fcn Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla tekrar ba\u015fvuruda bulunulamaz.\u201d denilmi\u015ftir.<\/p>\n<p>11. 6216 say\u0131l\u0131 Kanun\u2019un \u201cBa\u015fvuruya engel durumlar\u201d ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 41. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda da \u201cMahkemenin i\u015fin esas\u0131na girerek verdi\u011fi ret karar\u0131n\u0131n Resm\u00ee Gazetede yay\u0131mlanmas\u0131ndan itibaren on y\u0131l ge\u00e7medik\u00e7e ayn\u0131 kanun h\u00fckm\u00fcn\u00fcn Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla itiraz ba\u015fvurusu yap\u0131lamaz.\u201d h\u00fckm\u00fcne yer verilmi\u015ftir.<\/p>\n<p>12. \u0130tiraz yoluna ba\u015fvuran Mahkemenin iptalini talep etti\u011fi 6325 say\u0131l\u0131 Kanun\u2019un 18\/B maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (b) bendinde yer alan \u201c&#8230;ortakl\u0131\u011f\u0131n giderilmesine&#8230;\u201d ibaresine y\u00f6nelik iptal talebi Anayasa Mahkemesinin 27\/6\/2024 tarihli ve E.2023\/178, K.2024\/125 say\u0131l\u0131 karar\u0131yla reddedilmi\u015ftir. An\u0131lan karar 2\/10\/2024 tarihli ve 32680 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n<p>13. \u0130tiraz yoluna ba\u015fvuran Mahkeme an\u0131lan karar\u0131n Resm\u00ee Gazete\u2019de yay\u0131mland\u0131\u011f\u0131 tarihten \u00f6nce 5\/9\/2024 tarihinde itiraz yoluna ba\u015fvurmu\u015f ise de Anayasa Mahkemesinin ayn\u0131 konuda i\u015fin esas\u0131na girerek verdi\u011fi ret karar\u0131 yay\u0131mland\u0131\u011f\u0131 i\u00e7in Anayasa\u2019n\u0131n 152. maddesi uyar\u0131nca itiraz ba\u015fvurusunun incelenmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Anayasa\u2019n\u0131n an\u0131lan h\u00fckm\u00fcn\u00fcn amac\u0131 hem gereksiz ba\u015fvurular\u0131 \u00f6nleyerek Anayasa Mahkemesinin \u00e7al\u0131\u015fma d\u00fczenini korumak hem de uygulamada s\u00fcreklili\u011fi sa\u011flamakt\u0131r. Dolay\u0131s\u0131yla Anayasa Mahkemesi, \u00f6nceki karar\u0131n yay\u0131mland\u0131\u011f\u0131 tarihten sonra karar vermek durumunda ise ba\u015fvurunun \u00f6nceki karar\u0131n yay\u0131mlanmas\u0131ndan \u00f6nce ya da sonra yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131 \u00f6nem ta\u015f\u0131maks\u0131z\u0131n itiraz\u0131 reddetmek durumundad\u0131r (AYM, E.2023\/19, K.2023\/18, 16\/2\/2023, \u00a7 4; E.2021\/109, K.2021\/81, 4\/11\/2021, \u00a7 5).<\/p>\n<p>14. Bu itibarla itiraz ba\u015fvurusu a\u00e7\u0131s\u0131ndan Anayasa&#8217;n\u0131n 152. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 ile 6216 say\u0131l\u0131 Kanun&#8217;un 41. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen \u015fartlar\u0131n ger\u00e7ekle\u015fti\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>15. A\u00e7\u0131klanan nedenle 6325 say\u0131l\u0131 Kanun\u2019un 18\/B maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (b) bendinde yer alan \u201c&#8230;ortakl\u0131\u011f\u0131n giderilmesine&#8230;\u201d ibaresine y\u00f6nelik itiraz ba\u015fvurusunun Anayasa\u2019n\u0131n 152. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 ve 6216 say\u0131l\u0131 Kanun\u2019un 41. maddesinin (1) numaral\u0131 f\u0131kras\u0131 gere\u011fince reddi gerekir.<\/p>\n<p>B. Kanun\u2019un 18\/B Maddesinin (3) Numaral\u0131 F\u0131kras\u0131n\u0131n Birinci C\u00fcmlesinin \u201cBu madde kapsam\u0131nda d\u00fczenlenen anla\u015fma belgesinin icra edilebilirli\u011fine ili\u015fkin \u015ferhin al\u0131nmas\u0131 zorunlu olup\u2026\u201d B\u00f6l\u00fcm\u00fcn\u00fcn ve \u0130kinci C\u00fcmlesinin \u0130ncelenmesi<\/p>\n<p>1. Anlam ve Kapsam<\/p>\n<p>16. Arabuluculuk, 6325 say\u0131l\u0131 Kanun\u2019un 2. maddesinde sistematik teknikler uygulayarak g\u00f6r\u00fc\u015fmek ve m\u00fczakerelerde bulunmak amac\u0131yla taraflar\u0131 bir araya getiren, taraflar\u0131n birbirlerini anlamalar\u0131n\u0131 ve bu suretle \u00e7\u00f6z\u00fcmlerini kendilerinin \u00fcretmelerini sa\u011flamak i\u00e7in aralar\u0131nda ileti\u015fim s\u00fcrecinin kurulmas\u0131n\u0131 sa\u011flayan, taraflar\u0131n \u00e7\u00f6z\u00fcm \u00fcretemediklerinin ortaya \u00e7\u0131kmas\u0131 h\u00e2linde \u00e7\u00f6z\u00fcm \u00f6nerisi de getirebilen, uzmanl\u0131k e\u011fitimi alm\u0131\u015f olan tarafs\u0131z ve ba\u011f\u0131ms\u0131z bir \u00fc\u00e7\u00fcnc\u00fc ki\u015finin kat\u0131l\u0131m\u0131yla y\u00fcr\u00fct\u00fclen uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm y\u00f6ntemi olarak tan\u0131mlanm\u0131\u015ft\u0131r (AYM, E.2017\/178, K.2018\/82, 11\/7\/2018, \u00a7 4).<\/p>\n<p>17. An\u0131lan Kanun\u2019un 2. maddesinin gerek\u00e7esinde de belirtildi\u011fi \u00fczere uyu\u015fmazl\u0131\u011f\u0131n taraflar\u0131n\u0131n kendilerini yeterince ifade etme imk\u00e2n\u0131 bulduklar\u0131 ve \u00e7\u00f6z\u00fcm\u00fcn bizzat taraflarca \u00fcretildi\u011fi arabuluculuk y\u00f6nteminde arabulucudan beklenen, diyalog s\u00fcrecinin i\u015flerlik kazanmas\u0131na ve canl\u0131 tutulmas\u0131na katk\u0131 sa\u011flamas\u0131d\u0131r. Bu \u015fekilde taraflar aras\u0131nda etkili bir ileti\u015fim kurularak her iki taraf\u0131n da menfaatlerinin en uygun \u015fekilde dengelenmesi esas\u0131na dayal\u0131 olarak y\u00fcr\u00fct\u00fclen arabuluculuk m\u00fczakereleri ile uyu\u015fmazl\u0131klar\u0131n kesin ve kal\u0131c\u0131 \u015fekilde, daha k\u0131sa s\u00fcrede ve daha az masrafla \u00e7\u00f6z\u00fcmlenmesi ama\u00e7lanmaktad\u0131r (AYM, E.2017\/178, K.2018\/82, 11\/7\/2018, \u00a7 5).<\/p>\n<p>18. Arabuluculukta taraflar\u0131n anla\u015fmas\u0131 h\u00e2linde uygulanacak usul ve esaslar\u0131 d\u00fczenleyen Kanun\u2019un 18. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda var\u0131lan anla\u015fman\u0131n kapsam\u0131n\u0131n taraflarca belirlenece\u011fi, anla\u015fma belgesi d\u00fczenlenmesi h\u00e2linde bu belgenin taraflar ve arabulucu taraf\u0131ndan imzalanaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>19. An\u0131lan maddenin (2) numaral\u0131 f\u0131kras\u0131nda taraflar\u0131n arabuluculuk faaliyeti sonunda d\u00fczenlenen anla\u015fma belgesinin icra edilebilirli\u011fine ili\u015fkin olarak \u015ferh verilmesini talep edebilecekleri ve bu \u015ferhi i\u00e7eren anla\u015fman\u0131n ilam niteli\u011finde belge say\u0131laca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>20. Maddenin (3) numaral\u0131 f\u0131kras\u0131nda icra edilebilirlik \u015ferhi verilmesinin \u00e7eki\u015fmesiz yarg\u0131 i\u015fi oldu\u011fu, buna ili\u015fkin incelemenin dosya \u00fczerinden yap\u0131laca\u011f\u0131 ve incelemenin kapsam\u0131n\u0131n, anla\u015fma i\u00e7eri\u011finin arabuluculu\u011fa ve cebr\u00ee icraya elveri\u015fli olup olmad\u0131\u011f\u0131 hususlar\u0131yla s\u0131n\u0131rl\u0131 oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>21. (4) numaral\u0131 f\u0131kraya g\u00f6re icra edilebilirlik \u015ferhi al\u0131nmas\u0131n\u0131n kanunlarda zorunlu k\u0131l\u0131nd\u0131\u011f\u0131 durumlar hari\u00e7 olmak \u00fczere taraflar ve avukatlar\u0131 ile arabulucunun, ticari uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan ise avukatlar ile arabulucunun birlikte imzalad\u0131klar\u0131 anla\u015fma belgesi ilam niteli\u011finde belge say\u0131l\u0131r.<\/p>\n<p>22. Kanun\u2019un 18\/B maddesinde arabulucuya ba\u015fvurulmas\u0131n\u0131n dava \u015fart\u0131 olarak \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc baz\u0131 uyu\u015fmazl\u0131klar say\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re kiralanan ta\u015f\u0131nmazlar\u0131n 9\/6\/1932 tarihli ve 2004 say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu\u2019na g\u00f6re ilams\u0131z icra yoluyla tahliyesine ili\u015fkin h\u00fck\u00fcmler hari\u00e7 olmak \u00fczere kira ili\u015fkisinden kaynaklanan uyu\u015fmazl\u0131klar, ta\u015f\u0131n\u0131r ve ta\u015f\u0131nmazlar\u0131n payla\u015ft\u0131r\u0131lmas\u0131na ve ortakl\u0131\u011f\u0131n giderilmesine ili\u015fkin uyu\u015fmazl\u0131klar, 23\/6\/1965 tarihli ve 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019ndan kaynaklanan uyu\u015fmazl\u0131klar ve kom\u015fu hakk\u0131ndan kaynaklanan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmas\u0131 zorunludur. An\u0131lan maddenin (2) numaral\u0131 f\u0131kras\u0131na g\u00f6re arabuluculuk s\u00fcreci sonunda taraflar\u0131n anla\u015fmas\u0131 h\u00e2linde anla\u015fma belgesi ta\u015f\u0131nmazla ilgili olarak kanunlarda yer alan s\u0131n\u0131rlamalar ile usul ve esaslar g\u00f6zetilmek suretiyle d\u00fczenlenir.<\/p>\n<p>23. Maddenin (3) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinin itiraz konusu b\u00f6l\u00fcm\u00fcne g\u00f6re maddede say\u0131lan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan arabuluculuk faaliyeti sonucunda anla\u015fmaya var\u0131lmas\u0131 h\u00e2linde d\u00fczenlenecek anla\u015fma belgesinin icra edilebilirli\u011fine ili\u015fkin \u015ferhin al\u0131nmas\u0131 zorunlu tutulmu\u015ftur. S\u00f6z konusu \u015ferhin ta\u015f\u0131nmazla ilgili anla\u015fma belgeleri bak\u0131m\u0131ndan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer, di\u011fer anla\u015fma belgeleri bak\u0131m\u0131ndan ise arabulucunun g\u00f6rev yapt\u0131\u011f\u0131 yer sulh hukuk mahkemesinden al\u0131nmas\u0131 gerekmektedir. Bu itibarla maddede say\u0131lan uyu\u015fmazl\u0131klarda taraflar ve avukatlar\u0131 ile arabulucunun birlikte imzalad\u0131klar\u0131 anla\u015fma belgesi ilam niteli\u011finde kabul edilmemi\u015ftir.<\/p>\n<p>24. An\u0131lan f\u0131kran\u0131n itiraz konusu ikinci c\u00fcmlesinde ise ta\u015f\u0131nmazla ilgili anla\u015fma belgesini inceleyen mahkemenin anla\u015fman\u0131n i\u00e7eri\u011fini, arabuluculu\u011fa ve cebr\u00ee icraya elveri\u015fli olup olmad\u0131\u011f\u0131 ve ta\u015f\u0131nmazla ilgili olarak kanunlarda yer alan s\u0131n\u0131rlamalar ile usul ve esaslara uyulup uyulmad\u0131\u011f\u0131 y\u00f6n\u00fcnden denetleyece\u011fi; bu kapsamda kurum veya kurulu\u015flardan bilgi veya belge talep edebilece\u011fi ve gerekti\u011finde duru\u015fma a\u00e7abilece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>2. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>25. Ba\u015fvuru karar\u0131nda \u00f6zetle; ta\u015f\u0131nmazlar\u0131n devri ve payla\u015f\u0131lmas\u0131 konusunda mevzuatta \u00e7ok say\u0131da h\u00fck\u00fcm bulunmas\u0131 nedeniyle uygulamada arabuluculuk anla\u015fma belgelerinin \u00e7o\u011funlukla mevzuata ayk\u0131r\u0131 h\u00fck\u00fcmler i\u00e7erdi\u011fi, bu anla\u015fma belgelerine icra edilebilirlik \u015ferhi verilmesi taleplerinin reddedilmesi gerekti\u011finden ta\u015f\u0131nmazlar\u0131n devri ve ortakl\u0131\u011f\u0131n giderilmesinde arabuluculu\u011fun dava \u015fart\u0131 olarak \u00f6ng\u00f6r\u00fclmesinin ve arabuluculuk anla\u015fma belgelerine icra edilebilirlik \u015ferhi al\u0131nmas\u0131n\u0131n zorunlu tutulmas\u0131n\u0131n dava yoluna k\u0131yasla daha fazla masrafa ve zaman kayb\u0131na neden oldu\u011fu, icra edilebilirlik \u015ferhi verilmesi talep edilen mahkemenin arabuluculuk anla\u015fma belgesinde yer alan baz\u0131 hususlarda gerekli ara\u015ft\u0131rmalar\u0131 yapmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131, t\u00fcm bu hususlar\u0131n uygulamada sorunlara yol a\u00e7t\u0131\u011f\u0131 belirtilerek kurallar\u0131n Anayasa\u2019n\u0131n 9., 10., 35. ve 36. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>3. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>26. 6216 say\u0131l\u0131 Kanun\u2019un 43. maddesi uyar\u0131nca kurallar, ilgisi nedeniyle Anayasa\u2019n\u0131n 141. ve 142. maddeleri y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>27. Anayasa\u2019n\u0131n 36. maddesinin birinci f\u0131kras\u0131nda \u201cHerkes, me\u015fru vas\u0131ta ve yollardan faydalanmak suretiyle yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 ve daval\u0131 olarak iddia ve savunma ile adil yarg\u0131lanma hakk\u0131na sahiptir.\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. An\u0131lan maddeyle g\u00fcvence alt\u0131na al\u0131nan hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve adil yarg\u0131lanma hakk\u0131, kendisi bir temel hak niteli\u011fi ta\u015f\u0131mas\u0131n\u0131n yan\u0131nda, di\u011fer temel hak ve \u00f6zg\u00fcrl\u00fcklerden gereken \u015fekilde yararlan\u0131lmas\u0131n\u0131 ve bunlar\u0131n korunmas\u0131n\u0131 sa\u011flayan en etkili g\u00fcvencelerden biridir.<\/p>\n<p>28. Anayasa\u2019n\u0131n 141. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda \u201cDavalar\u0131n en az giderle ve m\u00fcmk\u00fcn olan s\u00fcratle sonu\u00e7land\u0131r\u0131lmas\u0131, yarg\u0131n\u0131n g\u00f6revidir.\u201d denilmi\u015f ve usul ekonomisi olarak da adland\u0131r\u0131lan bu ilkeyle yarg\u0131lama maliyetinin en d\u00fc\u015f\u00fck \u015fekilde olmas\u0131n\u0131n ve bu s\u00fcrecin m\u00fcmk\u00fcn olan en h\u0131zl\u0131 y\u00f6ntemlerle ger\u00e7ekle\u015ftirilmesinin yarg\u0131n\u0131n g\u00f6revlerinden oldu\u011fu ifade edilmi\u015ftir.<\/p>\n<p>29. Anayasa\u2019n\u0131n 142. maddesinde \u201cMahkemelerin kurulu\u015fu, g\u00f6rev ve yetkileri, i\u015fleyi\u015fi ve yarg\u0131lama usulleri kanunla d\u00fczenlenir.\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. Hukuk devletinde kanun koyucu, Anayasa\u2019n\u0131n temel ilkelerine ve Anayasa\u2019da \u00f6ng\u00f6r\u00fclen kurallara ba\u011fl\u0131 kalmak ko\u015fuluyla, yarg\u0131lama usullerinin belirlenmesi konusunda takdir yetkisine sahiptir.<\/p>\n<p>30. Davalar\u0131n m\u00fcmk\u00fcn olan s\u00fcratle sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131 \u00f6ng\u00f6ren Anayasa\u2019n\u0131n 141. maddesi ile mahkemelerin kurulu\u015fu, g\u00f6rev ve yetkileri, i\u015fleyi\u015fi ve yarg\u0131lama usullerinin kanunla d\u00fczenlenece\u011fini \u00f6ng\u00f6ren Anayasa\u2019n\u0131n 142. maddesinin Anayasa\u2019n\u0131n 36. maddesiyle g\u00fcvence alt\u0131na al\u0131nan hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve adil yarg\u0131lanma hakk\u0131n\u0131n kapsam\u0131n\u0131n belirlenmesinde g\u00f6zetilmesi gerekti\u011fi a\u00e7\u0131kt\u0131r. Anayasa\u2019n\u0131n t\u00fcm maddeleri ayn\u0131 etki ve de\u011ferde olup aralar\u0131nda bir \u00fcst\u00fcnl\u00fck s\u0131ralamas\u0131 bulunmad\u0131\u011f\u0131ndan uygulamada bunlardan birine \u00f6ncelik tan\u0131mak m\u00fcmk\u00fcn de\u011fildir. Bu nedenle Anayasa\u2019da ayn\u0131 konuya ili\u015fkin bulunan farkl\u0131 d\u00fczenlemelerin birlikte uygulanmas\u0131n\u0131 sa\u011flayacak \u015fekilde yorum yap\u0131lmas\u0131 gerekir. Bu ba\u011flamda hukuk sisteminin ve \u00f6zellikle yarg\u0131lama usul\u00fcn\u00fcn yarg\u0131lamalar\u0131n makul s\u00fcre i\u00e7inde bitirilmesini m\u00fcmk\u00fcn k\u0131lacak \u015fekilde d\u00fczenlenmesi ve bu d\u00fczenlemelerde davalar\u0131n nedensiz olarak uzamas\u0131na yol a\u00e7acak usul kurallar\u0131na yer verilmemesi makul s\u00fcrede yarg\u0131lanma ilkesinin bir gere\u011fidir. Ancak bu ama\u00e7la al\u0131nacak kanuni tedbirlerin yarg\u0131lama sonucunda i\u015fin esas\u0131na y\u00f6nelik adil ve hakkaniyete uygun bir karar verilmesine engel olu\u015fturmamas\u0131 gerekir. A\u00e7\u0131klanan bu h\u00fck\u00fcmlere uygun olmak kayd\u0131yla yarg\u0131lama y\u00f6ntemini belirlemek ise Anayasa\u2019n\u0131n 142. maddesi gere\u011fince kanun koyucunun takdir yetkisi kapsam\u0131ndad\u0131r (AYM, E.2017\/120, K.2018\/33, 28\/3\/2018, \u00a7 20; E.2020\/101, K.2021\/95, 16\/12\/2021, \u00a7 23).<\/p>\n<p>31. Hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc a\u00e7\u0131s\u0131ndan devletin ger\u00e7ekle\u015ftirmesi gereken pozitif y\u00fck\u00fcml\u00fcl\u00fckler bulunmaktad\u0131r. Bu kapsamda devletin bir yarg\u0131 te\u015fkilat\u0131 kurmas\u0131 ayn\u0131 zamanda mahkemelerin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ve tarafs\u0131zl\u0131\u011f\u0131n\u0131, silahlar\u0131n e\u015fitli\u011fi, \u00e7eli\u015fmeli yarg\u0131lama, aleni yarg\u0131lama gibi maddi ger\u00e7e\u011fe ula\u015fmak i\u00e7in gerekli usule ili\u015fkin g\u00fcvenceleri, davalar\u0131n makul bir s\u00fcrede ve usul ekonomisini g\u00f6zeterek sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131 da sa\u011flamas\u0131 gerekir (AYM, E.2022\/89, K.2022\/129, 26\/10\/2022, \u00a7 24; E.2022\/140, K.2023\/46, 9\/3\/2023, \u00a7 17).<\/p>\n<p>32. Taraflar\u0131n hak ve menfaatlerinin \u00f6zenli bi\u00e7imde g\u00f6zetildi\u011fi, etkili sonu\u00e7lar ortaya \u00e7\u0131karabilen alternatif uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm mekanizmalar\u0131n\u0131n geli\u015ftirilmesi Anayasa ile devlete y\u00fcklenen yarg\u0131lamalar\u0131n gereksiz yere uzamas\u0131n\u0131n engellenmesi \u00f6devinin yerine getirilmesi amac\u0131na y\u00f6neliktir. Nitekim uyu\u015fmazl\u0131klar\u0131n yarg\u0131 yetkisi kullan\u0131larak mahkemeler arac\u0131l\u0131\u011f\u0131yla \u00e7\u00f6z\u00fclmesi esas olmakla birlikte her uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fcn\u00fcn mahkemelerden beklenmesi mahkemelerin i\u015f y\u00fck\u00fcn\u00fcn artmas\u0131na ve davalar\u0131n makul s\u00fcrelerde bitirilememesine yol a\u00e7abilir. B\u00f6yle bir durumun taraflar\u0131n menfaatlerine hizmet etmemesi de s\u00f6z konusu olabilir (AYM, E.2023\/160, K.2024\/77, 14\/3\/2024, \u00a7\u00a7 22, 23).<\/p>\n<p>33. Bu ba\u011flamda yarg\u0131 g\u00f6revinin a\u011f\u0131r i\u015f y\u00fck\u00fc alt\u0131nda yerine getirilmesinin zorla\u015fmas\u0131 kar\u015f\u0131s\u0131nda yarg\u0131n\u0131n i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131, adalete eri\u015fimin kolayla\u015ft\u0131r\u0131lmas\u0131 ve usul ekonomisi gibi \u00e7e\u015fitli nedenlerle yarg\u0131ya ili\u015fkin anayasal kurallar\u0131n etkilili\u011finin sa\u011flanmas\u0131 amac\u0131yla uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in arabuluculuk gibi y\u00f6ntemlerin uygulamaya konulmas\u0131 tercih edilebilmektedir. Kanun koyucunun bu y\u00f6nde d\u00fczenlemeler yapma konusunda takdir yetkisinin bulundu\u011fu a\u00e7\u0131kt\u0131r. Bununla birlikte bu yetkinin anayasal s\u0131n\u0131rlar i\u00e7inde kullan\u0131lmas\u0131 gerekir (AYM, E.2017\/178, K.2018\/82, 11\/7\/2018, \u00a7 16).<\/p>\n<p>34. 6325 say\u0131l\u0131 Kanun\u2019un 18\/B maddesinin (1) numaral\u0131 f\u0131kras\u0131nda say\u0131lan uyu\u015fmazl\u0131klarda dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131n\u0131n dava \u015fart\u0131 olarak \u00f6ng\u00f6r\u00fclmesi suretiyle bu uyu\u015fmazl\u0131klar\u0131n arabuluculuk y\u00f6ntemiyle olabildi\u011fince h\u0131zl\u0131 ve az giderle \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131na ve yarg\u0131n\u0131n i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131na katk\u0131 sunulmas\u0131n\u0131n ama\u00e7land\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r.<\/p>\n<p>35. An\u0131lan maddenin (2) numaral\u0131 f\u0131kras\u0131nda ise (1) numaral\u0131 f\u0131krada say\u0131lan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan arabuluculuk s\u00fcreci sonunda taraflar\u0131n anla\u015fmas\u0131 h\u00e2linde anla\u015fma belgesinin ta\u015f\u0131nmazla ilgili kanunlarda yer alan s\u0131n\u0131rlamalar ile usul ve esaslar g\u00f6zetilmek suretiyle d\u00fczenlenece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>36. Anayasa Mahkemesi \u00f6nceki kararlar\u0131nda baz\u0131 uyu\u015fmazl\u0131klar\u0131n h\u0131zl\u0131 ve az giderle \u00e7\u00f6z\u00fcme kavu\u015fturularak yarg\u0131n\u0131n i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131na katk\u0131 sunmak amac\u0131yla ihdas edilen arabuluculuk kurumunun Anayasa\u2019ya ayk\u0131r\u0131 olmad\u0131\u011f\u0131na karar vermi\u015ftir (ortakl\u0131\u011f\u0131n giderilmesini ili\u015fkin uyu\u015fmazl\u0131klar y\u00f6n\u00fcnden bkz. AYM, E.2023\/178, K.2024\/125, 27\/6\/2024, \u00a7\u00a7 21-31; bireysel veya toplu i\u015f s\u00f6zle\u015fmesine dayanan i\u015f\u00e7i veya i\u015fveren alaca\u011f\u0131 ve tazminat\u0131 ile i\u015fe iadeye y\u00f6nelik uyu\u015fmazl\u0131klar y\u00f6n\u00fcnden bkz. E.2017\/178, K.2018\/82, 11\/7\/2018, \u00a7\u00a7 16-29).<\/p>\n<p>37. Alternatif uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm yollar\u0131ndan biri olarak arabuluculuk kurumunun \u00f6ng\u00f6r\u00fclmesiyle birlikte an\u0131lan kurumun i\u015fleyi\u015fiyle ilgili d\u00fczenlemelerin de kurumun ihdas amac\u0131na uygun \u015fekilde belirlenmesi, bu kapsamda yap\u0131lacak d\u00fczenlemelerin yarg\u0131lamalar\u0131n h\u0131zl\u0131 ve seri \u015fekilde sona erdirilmesi amac\u0131n\u0131 ger\u00e7ekle\u015ftirmeye elveri\u015fli olmas\u0131 gerekir. Aksi durum uzla\u015fman\u0131n alternatif \u00e7\u00f6z\u00fcm yolu olma niteli\u011fini i\u015flevsiz h\u00e2le getirebilir. Alternatif \u00e7\u00f6z\u00fcm y\u00f6ntemlerinde de devletin pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc uyu\u015fmazl\u0131klar\u0131n adalete uygun bir \u015fekilde sonu\u00e7land\u0131r\u0131lmas\u0131 i\u00e7in gerekli g\u00fcvencelerin olu\u015fturulmas\u0131 zorunlulu\u011funu ortadan kald\u0131rmamaktad\u0131r.<\/p>\n<p>38. Maddenin (3) numaral\u0131 f\u0131kras\u0131nda, ayn\u0131 maddenin (1) numaral\u0131 f\u0131kras\u0131nda say\u0131lan uyu\u015fmazl\u0131klar i\u00e7in arabuluculuk kapsam\u0131nda taraflar\u0131n anla\u015fmaya varmalar\u0131 h\u00e2linde anla\u015fman\u0131n i\u00e7eri\u011fi, arabuluculu\u011fa ve cebr\u00ee icraya elveri\u015fli olup olmad\u0131\u011f\u0131 ve ta\u015f\u0131nmazla ilgili olarak kanunlarda yer alan s\u0131n\u0131rlamalar ile usul ve esaslara uyulup uyulmad\u0131\u011f\u0131 y\u00f6n\u00fcnden inceleme yapmak \u00fczere mahkemeye denetim yetkisi verilmi\u015ftir. B\u00f6ylelikle s\u00f6z konusu uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan anla\u015fma belgesinin ilam niteli\u011finde belge kabul edilmesi, mahkemenin yapaca\u011f\u0131 inceleme sonucunda talebi kabul etmesi ve icra edilebilirlik \u015ferhi vermesi \u015fart\u0131na ba\u011flanm\u0131\u015ft\u0131r. Ger\u00e7ekten de ortakl\u0131\u011f\u0131n giderilmesi gibi genellikle \u00e7ok tarafl\u0131 olan uyu\u015fmazl\u0131klar\u0131n teknik hatalara ve ileride telafisi zor hak kay\u0131plar\u0131n\u0131n ortaya \u00e7\u0131kmas\u0131na elveri\u015fli olmas\u0131 nedeniyle daha uzun dava s\u00fcre\u00e7lerini gerektiren olumsuzluklar\u0131n ortaya \u00e7\u0131kmamas\u0131 i\u00e7in bu anla\u015fmalar\u0131n mahkeme denetimine tabi k\u0131l\u0131nmas\u0131 gerekli olabilir. Bununla birlikte bu denetiminin kapsam ve niteli\u011finin de arabuluculuk kurumunun ihdas amac\u0131n\u0131 ortadan kald\u0131rmamas\u0131 gerekmektedir.<\/p>\n<p>39. Maddenin (3) numaral\u0131 f\u0131kras\u0131nda mahkemenin anla\u015fmayla ilgili denetim faaliyeti belli konularla s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f, mahkemeye bu kapsamda kurum ve kurulu\u015flardan bilgi veya belge talep edebilme ve gerekti\u011finde duru\u015fma a\u00e7ma yetkisi tan\u0131nm\u0131\u015ft\u0131r. Nitekim maddenin gerek\u00e7esinde bu husus \u201cD\u00fczenlemeyle anla\u015fma belgesinin icra edilebilirli\u011fine ili\u015fkin \u015ferh verecek mahkemeye i\u00e7erik denetimi yapma yetkisi verilmekte ve bu suretle taraflar\u0131n hak ve menfaatlerinin korunmas\u0131 ile olas\u0131 hak kay\u0131plar\u0131n\u0131n \u00f6nlenmesi ama\u00e7lanmaktad\u0131r.\u201d \u015feklinde ifade edilmi\u015ftir.<\/p>\n<p>40. Kanun koyucunun bir yandan uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcn\u00fc kolayla\u015ft\u0131rmak, adalet yap\u0131s\u0131n\u0131n i\u015fleyi\u015fini h\u0131zland\u0131rmak amac\u0131yla an\u0131lan maddede say\u0131lan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan arabuluculu\u011fa ba\u015fvurmay\u0131 dava \u015fart\u0131 olarak \u00f6ng\u00f6r\u00fcrken di\u011fer yandan yarg\u0131lamalar\u0131n adil bir \u015fekilde y\u00fcr\u00fct\u00fclmesi i\u00e7in gerekli g\u00fcvenceleri de olu\u015fturmas\u0131 gerekir.<\/p>\n<p>41. \u0130tiraz konusu kurallarla icra edilebilirlik \u015ferhi al\u0131nmas\u0131 s\u00fcrecinde anla\u015fman\u0131n yarg\u0131sal denetime tabi tutulmas\u0131 \u00f6ng\u00f6r\u00fclmek suretiyle baz\u0131 uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan d\u00fczenlenecek anla\u015fma belgelerinin kanunlarda yer alan s\u0131n\u0131rlamalara uygun olmas\u0131 ve icra edilebilir nitelik ta\u015f\u0131mas\u0131 y\u00f6n\u00fcnden gerekli g\u00fcvenceler sa\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>42. \u00d6te yandan Kanun\u2019un 18. maddesinin (3) numaral\u0131 f\u0131kras\u0131na g\u00f6re arabuluculuk s\u00fcreci sonunda d\u00fczenlenecek anla\u015fma belgesine icra edilebilirlik \u015ferhinin verilmesi \u00e7eki\u015fmesiz yarg\u0131 i\u015fi olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015f ve s\u00f6z konusu incelemenin dosya \u00fczerinden yap\u0131lmas\u0131 esas\u0131 benimsenmi\u015ftir. B\u00f6ylece mahkemenin bu a\u015famadaki denetim faaliyetinin h\u0131zl\u0131 bir \u015fekilde sonu\u00e7land\u0131r\u0131lmas\u0131 ama\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n<p>43. Dolay\u0131s\u0131yla Kanun\u2019un 18\/B maddesinin (1) numaral\u0131 f\u0131kras\u0131nda say\u0131lan uyu\u015fmazl\u0131klarda arabulucuya ba\u015fvurulmas\u0131 dava \u015fart\u0131 olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015f, (3) numaral\u0131 f\u0131krada anla\u015fma belgesine icra edilebilirlik \u015ferhinin al\u0131nmas\u0131 zorunlu tutulmu\u015ftur. Bununla birlikte s\u00fcrecin h\u0131zl\u0131 bir \u015fekilde tamamlanmas\u0131 ve say\u0131lan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan anla\u015fma belgesinin kanunlarda yer alan s\u0131n\u0131rlamalara uygun olarak d\u00fczenlenmesi i\u00e7in gerekli ara\u00e7lar sa\u011flanm\u0131\u015f, arabuluculuk s\u00fcrecinin etkili h\u00e2le getirilmesi ve s\u00fcre\u00e7 sonunda d\u00fczenlenen anla\u015fma belgesinin icra edilebilir nitelikte olmas\u0131 i\u00e7in Kanun\u2019da yeterli g\u00fcvencelere yer verilmi\u015ftir.<\/p>\n<p>44. Bu itibarla kurallarda arabuluculuk s\u00fcrecinde taraflar\u0131n anla\u015fmaya varmalar\u0131 h\u00e2linde anla\u015fman\u0131n icra edilebilirli\u011fine ili\u015fkin \u015ferhin verilmesi konusunda mahkemeye tan\u0131nan denetim yetkisinin belli uyu\u015fmazl\u0131klara m\u00fcnhas\u0131r ve s\u0131n\u0131rl\u0131 oldu\u011fu, dolay\u0131s\u0131yla s\u00f6z konusu denetimin kapsam ve nitelik itibar\u0131yla davaya alternatif \u00e7\u00f6z\u00fcm yolu olarak \u00f6ng\u00f6r\u00fclen arabuluculuk y\u00f6ntemiyle uyu\u015fmazl\u0131klar\u0131n h\u0131zl\u0131, seri ve adalete uygun bir \u015fekilde sonu\u00e7land\u0131r\u0131lmas\u0131 amac\u0131na ayk\u0131r\u0131 olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla kurallarda devletin yarg\u0131lamalar\u0131n gereksiz yere uzamas\u0131n\u0131n engellenmesi ve i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 bir y\u00f6n bulunmamaktad\u0131r.<\/p>\n<p>45.
