Bu davalar\u0131n sa\u011fl\u0131kl\u0131 \u015fekilde y\u00fcr\u00fct\u00fclmesi ve amac\u0131na ula\u015fmas\u0131, yaln\u0131zca hukuki normlara de\u011fil, ayn\u0131 zamanda uygulamadaki teknik ayr\u0131nt\u0131lar\u0131n titizlikle de\u011ferlendirilmesine ba\u011fl\u0131d\u0131r.<\/p>\n<p>Kira tespit davalar\u0131n\u0131n yasal dayana\u011f\u0131, 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344 ve 345. maddelerinde d\u00fczenlenmi\u015ftir. S\u00f6z konusu d\u00fczenlemelere g\u00f6re, kira s\u00f6zle\u015fmesinde belirlenen art\u0131\u015f oran\u0131, be\u015f y\u0131ll\u0131k s\u00fcrenin dolmas\u0131n\u0131n ard\u0131ndan s\u0131n\u0131rlay\u0131c\u0131 olmaktan \u00e7\u0131kar ve h\u00e2kime kira bedelini serbest\u00e7e takdir etme yetkisi tan\u0131n\u0131r. Ancak bu takdir yetkisi keyfi de\u011fildir; emsal kira bedelleri, ta\u015f\u0131nmaz\u0131n fiziksel ve konumsal \u00f6zellikleri ile hakkaniyet ilkesi \u00e7er\u00e7evesinde s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r. Oysa T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 345. maddesi uyar\u0131nca, kira tespit davas\u0131, yeni kira d\u00f6neminin ba\u015flamas\u0131ndan en az otuz g\u00fcn \u00f6nce a\u00e7\u0131lmal\u0131 ya da bu tarihten \u00f6nce yaz\u0131l\u0131 ihtarda bulunulmal\u0131d\u0131r. Aksi takdirde mahkemece tespit edilen yeni kira bedeli, ancak bir sonraki kira d\u00f6nemi i\u00e7in ge\u00e7erli olur.<\/p>\n<p>Kira tespit davalar\u0131nda g\u00f6revli mahkeme Sulh Hukuk Mahkemesidir ve yetkili mahkeme ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesi olarak belirlenmi\u015ftir. 01.09.2023 tarihi itibar\u0131yla y\u00fcr\u00fcrl\u00fc\u011fe giren d\u00fczenleme ile bu davalarda arabuluculu\u011fa ba\u015fvuru dava \u015fart\u0131 haline getirilmi\u015ftir. Dolay\u0131s\u0131yla, arabuluculuk s\u00fcreci usul\u00fcne uygun i\u015fletilmeden a\u00e7\u0131lan davalar, dava \u015fart\u0131 yoklu\u011fu nedeniyle usulden reddedilme riski ta\u015f\u0131maktad\u0131r. Bu husus, Yarg\u0131tay 3. Hukuk Dairesi\u2019nin 2023 tarihli kararlar\u0131nda da a\u00e7\u0131k\u00e7a ifade edilmi\u015ftir. Dava a\u00e7\u0131lmadan \u00f6nceki d\u00f6nemlere ili\u015fkin kira fark\u0131 talep edilemeyece\u011finden, dava tarihinin ve ihtar s\u00fcresinin do\u011fru planlanmas\u0131, ekonomik a\u00e7\u0131dan anlaml\u0131 bir sonu\u00e7 elde edebilmek a\u00e7\u0131s\u0131ndan kritiktir.
