A\u00e7\u0131k duru\u015fmaya ba\u015fland\u0131 ve haz\u0131r bulunan vekillerin s\u00f6zl\u00fc a\u00e7\u0131klamalar\u0131 dinlenildikten sonra noksanl\u0131\u011f\u0131n giderilmesi bak\u0131m\u0131ndan dosya mahalline geri \u00e7evrilmi\u015f, bu kez yeniden gelmekle; belli g\u00fcn ve saatte dosyadaki b\u00fct\u00fcn ka\u011f\u0131tlar okunarak Tetkik Hakiminin a\u00e7\u0131klamalar\u0131 dinlenip, gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc.<\/p>\n<p>Y A R G I T A Y K A R A R I<\/p>\n<p>Davac\u0131, taraflar aras\u0131nda d\u00fczenlenen 01\/02\/2005 tarihli kira s\u00f6zle\u015fmesi ile daval\u0131lara ait pansiyon niteli\u011findeki ta\u015f\u0131nmaz\u0131n 10 y\u0131l i\u00e7in kiralad\u0131\u011f\u0131n\u0131, s\u00f6zle\u015fmenin 5. maddesi ile kira d\u00f6nemi bitmeden tahliye veya i\u015fletmenin engellenmesi halinde 600.000 TL bedelin kay\u0131ts\u0131z \u015farts\u0131z \u00f6denece\u011finin d\u00fczenlendi\u011fini, m\u00fcvekkilinin s\u00f6z konusu yeri i\u015fletmeye uygun tadil ederek ve donatarak faaliyete ge\u00e7irdi\u011fini, 2007 y\u0131l\u0131nda sezon ba\u015flad\u0131\u011f\u0131nda i\u015fletmenin anahtarlar\u0131n\u0131n de\u011fi\u015ftirilerek ta\u015f\u0131nmaz\u0131n ba\u015fkas\u0131na kiraya verildi\u011fini g\u00f6rd\u00fcklerini, daval\u0131lar\u0131n i\u015fletmeye girmesinin engellendi\u011fini, 600.000 TL bedelin \u00f6denmesi i\u00e7in daval\u0131lar hakk\u0131nda takip ba\u015flat\u0131ld\u0131\u011f\u0131n\u0131 ancak takibe haks\u0131z olarak itiraz edildi\u011fini belirtirek itiraz\u0131n iptaline karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Daval\u0131lar, davan\u0131n reddini istemi\u015flerdir.<\/p>\n<p>Mahkemece, s\u00f6zle\u015fmedeki kira bedelinde tahrifat oldu\u011fu gibi dava konusu edilen 600.000 TL&#8217;nin kira bedeli ve yap\u0131lan i\u015fler kar\u015f\u0131l\u0131\u011f\u0131 olarak ayr\u0131ca belirtildi\u011fi, bu durumda s\u00f6zle\u015fmenin feshi halinde davac\u0131n\u0131n ta\u015f\u0131nmaza yapt\u0131\u011f\u0131 masraflar\u0131 talep edebilece\u011fi, kirac\u0131n\u0131n s\u00f6zle\u015fmede 600.000 TL&#8217;yi yapt\u0131\u011f\u0131 i\u015fler tutar\u0131 olarak belirleyerek talep etmesi kar\u015f\u0131s\u0131nda bu tutar\u0131 olu\u015fturan yapt\u0131\u011f\u0131 i\u015fleri ispat etmesi gerekti\u011fi, davac\u0131n\u0131n yapt\u0131\u011f\u0131 i\u015fleri ispat edecek delil ibraz etmedi\u011fi gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 vekili ve daval\u0131lar &#8230; ile &#8230; vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>1-Dosya kapsam\u0131na, toplanan delillere, mevcut deliller mahkemece takdir edilerek karar verilmi\u015f olmas\u0131na ve takdirde de bir isabetsizlik bulunmamas\u0131na g\u00f6re daval\u0131lar\u0131n temyiz itirazlar\u0131 yerinde de\u011fildir<\/p>\n<p>2-Davac\u0131n\u0131n temyiz itirazlar\u0131na gelince;<\/p>\n<p>Davaya dayanak yap\u0131lan ve h\u00fckme esas al\u0131nan 01\/02\/2005 tarihli, on y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinin 1. maddesinde &#8220;Kiralanan yer bo\u015f ve tadilata muhta\u00e7 bir \u015fekilde kiralayana teslim edilmi\u015f olup, kiralayan s\u00f6z konusu kiralayan\u0131 ba\u015ftan sona tadilata tabi tutarak t\u00fcm mefru\u015fat ve demirba\u015flar\u0131n\u0131 yenilemi\u015f birinci s\u0131n\u0131f bir pansiyon i\u015fletmesi \u015feklinde yeniden tadilat ve mefru\u015fat\u0131n\u0131 yapm\u0131\u015ft\u0131r. Bu i\u015fler kar\u015f\u0131l\u0131\u011f\u0131 olmak \u00fczere kiralayan kiraya verenlere on y\u0131ll\u0131k kira bedeli olan 600.000 TL&#8217;yi \u00f6demi\u015ftir.&#8221;, yine 5. maddesinde &#8220;Kira d\u00f6nemi sonunda kiraya verenin yeri tahliyesi halinde t\u00fcm yapt\u0131\u011f\u0131 ve ald\u0131\u011f\u0131 tadilat, mefru\u015fat, demirba\u015f t\u00fcr\u00fc \u015feyleri b\u0131rakmaya ve bir talepte bulunmamaya mecburdur. Kira d\u00f6neminden \u00f6nce herhangi bir \u015fekilde tahliye veya kiralanan\u0131n i\u015fletilmesinin engellenmesi halinde ise kiralayan\u0131n yapt\u0131\u011f\u0131 i\u015fler kar\u015f\u0131l\u0131\u011f\u0131 olan 600.000 TL mebla\u011f\u0131 kiraya verenler kay\u0131ts\u0131z \u015farts\u0131z \u00f6demeyi kabul ve taahh\u00fct eder. &#8221; d\u00fczenlemesi yer almaktad\u0131r.<\/p>\n<p>Kira s\u00f6zle\u015fmesinin 5. maddesindeki h\u00fck\u00fcm, T.B.K&#8217;nin 179 ve devam\u0131 maddelerinde d\u00fczenlenen cezai \u015fart niteli\u011findedir. Cezai \u015fart ge\u00e7erli bir borcun yerine getirilmemesi veya eksik yerine getirilmesi ya da belli bir yerde belirli bir zamandan yerine getirilmemesi durumunda, bor\u00e7lunun \u00f6demesi gereken bir edimdir. Taraflar\u0131n serbest iradesi ile kararla\u015ft\u0131r\u0131lan bu cezai \u015fart ge\u00e7erli olup taraflar\u0131 ba\u011flar. Taraflarca cezai \u015fart kararla\u015ft\u0131r\u0131lm\u0131\u015f olmas\u0131 halinde, alacakl\u0131 hi\u00e7bir zarara u\u011framam\u0131\u015f olsa bile TBK.n\u0131n 180. maddesi gere\u011fince kararla\u015ft\u0131r\u0131lan cezan\u0131n ifas\u0131n\u0131 talep edebilir.<\/p>\n<p>T.B.K. 182\/son maddesi hakime fahi\u015f g\u00f6rd\u00fc\u011f\u00fc cezai \u015fart\u0131 indirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc vermi\u015ftir. Bunun sonucu olarak a\u015f\u0131r\u0131 g\u00f6r\u00fclen cezai \u015fart\u0131n indirilmesinde tazmin ve ceza dengeli olarak korunmal\u0131d\u0131r. Ticari olmayan i\u015flemlerde bu kuraldan dolay\u0131 bor\u00e7lu ileri s\u00fcrmese bile, hakim cezai \u015farttan indirim yap\u0131l\u0131p yap\u0131lmayaca\u011f\u0131n\u0131 do\u011frudan g\u00f6revinden \u00f6t\u00fcr\u00fc saptamal\u0131d\u0131r. \u00d6te yandan TTK.nun 22 (eski 24.) maddesi gere\u011fince tacir s\u0131fat\u0131n\u0131 haiz bor\u00e7lu cezai \u015fart\u0131n indirilmesini isteyemez ise de, kararla\u015ft\u0131r\u0131lan ceza tutar\u0131 bor\u00e7lunun iktisaden sars\u0131lmas\u0131n\u0131, \u00e7\u00f6k\u00fcnt\u00fcye u\u011framas\u0131n\u0131 mucip olacak ise indirim isteyebilece\u011fi uygulamada kabul edilmektedir.<\/p>\n<p>Ayr\u0131ca, davac\u0131 kirac\u0131 hakk\u0131nda &#8230; Asliye Ceza Mahkemesinin 2011\/636 Esas say\u0131l\u0131 dosyas\u0131nda \u00f6zel belgede sahtecilik su\u00e7undan a\u00e7\u0131lan davada beraat karar\u0131 verildi\u011fi ve karar\u0131n kesinle\u015fti\u011fi anla\u015f\u0131lmaktad\u0131r. Ceza Mahkemesi kararlar\u0131n\u0131n, Hukuk Mahkemesindeki davaya etkisini d\u00fczenleyen TBK&#8217;n\u0131n 74.maddesinde; (BK. 53) hakimin, zarar verenin kusurunun olup olmad\u0131\u011f\u0131, ay\u0131rt etme g\u00fcc\u00fcn\u00fcn bulunup bulunmad\u0131\u011f\u0131 hakk\u0131nda karar verirken, ceza hukukunun sorumlulukla ilgili h\u00fck\u00fcmleriyle ba\u011fl\u0131 olmad\u0131\u011f\u0131, ceza hakimi taraf\u0131ndan verilen beraat karar\u0131yla ba\u011fl\u0131 bulunmad\u0131\u011f\u0131, ayn\u0131 \u015fekilde, ceza hakiminin kusurun de\u011ferlendirilmesine ve zarar\u0131n belirlenmesine ili\u015fkin karar\u0131n\u0131n da, hukuk hakimini ba\u011flamad\u0131\u011f\u0131 d\u00fczenlenmi\u015f ise de ;Ceza Mahkemesi taraf\u0131ndan maddi vak\u0131aya ili\u015fkin yap\u0131lan tespit ile Hukuk Hakimi ba\u011fl\u0131 olup, davac\u0131n\u0131n \u00f6zel belgede sahtecilik yapmad\u0131\u011f\u0131 hususu ceza yarg\u0131lamas\u0131 sonucunda belirlenmi\u015ftir. Dava konusu ta\u015f\u0131nmaz\u0131n 28\/04\/2008 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile daval\u0131lar taraf\u0131ndan dava d\u0131\u015f\u0131 \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye kiraland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>Bu durumda Mahkemece, yukar\u0131da a\u00e7\u0131klanan ilkeler g\u00f6zetilerek sonucuna g\u00f6re bir karar verilmesi gerekirken yan\u0131lg\u0131l\u0131 de\u011ferlendirme ile davac\u0131n\u0131n yapt\u0131\u011f\u0131n\u0131 iddia etti\u011fi i\u015fleri ispat edemedi\u011fi gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f olmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir.<\/p>\n<p>SONU\u00c7: Yukar\u0131da birinci bentte a\u00e7\u0131klanan nedenlerle daval\u0131lar\u0131n temyiz itirazlar\u0131n\u0131n reddine, ikinci bentte a\u00e7\u0131klanan nedenlere davac\u0131n\u0131n temyiz itirazlar\u0131n\u0131n kabul\u00fc ile h\u00fckm\u00fcn HUMK.nun 428.maddesi gere\u011fince davac\u0131 yarar\u0131na BOZULMASINA, 1.480 TL Yarg\u0131tay duru\u015fmas\u0131 vekalet \u00fccretinin daval\u0131lardan al\u0131n\u0131p davac\u0131 tarafa verilmesine, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde temyiz edene iadesine, 6100 say\u0131l\u0131 HMK&#8217;nun Ge\u00e7ici Madde 3 atf\u0131yla 1086 say\u0131l\u0131 HUMK&#8217;nun 440. maddesi gere\u011fince karar\u0131n tebli\u011finden itibaren 15 g\u00fcnl\u00fck s\u00fcre i\u00e7inde karar d\u00fczeltme yolu a\u00e7\u0131k olmak \u00fczere, 05.12.2017 tarihinde oybirli\u011fiyle karar verildi.\u00a0<\/p>\n<p>&#8212;&#8212;-<\/p>\n<p>T.C.<\/p>\n<p>Yarg\u0131tay<\/p>\n<p>3. Hukuk Dairesi<\/p>\n<p>2017\/11148 E., 2017\/10611 K.<\/p>\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n<p>MAHKEMES\u0130 :SULH HUKUK MAHKEMES\u0130<br \/>\nTaraflar aras\u0131ndaki alacak davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik olarak verilen h\u00fckm\u00fcn, s\u00fcresi i\u00e7inde taraf vekillerince temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>Y A R G I T A Y K A R A R I<\/p>\n<p>Davac\u0131 vekili dava dilek\u00e7esinde; m\u00fcvekkili \u015firket ile daval\u0131 \u015firketin aras\u0131nda 12\/03\/2013 tarihli 5 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi ile Movapark al\u0131\u015fveri\u015f merkezinde bulunan&#8230; ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn kiralanmas\u0131na ili\u015fkin s\u00f6zle\u015fme imzaland\u0131\u011f\u0131n\u0131, kirac\u0131 daval\u0131 \u015firketin tek tarafl\u0131 olarak Noter arac\u0131l\u0131\u011f\u0131 ile kira s\u00f6zle\u015fmesini feshetti\u011fini bildirdi\u011fi, m\u00fcvekkili \u015firketin kar\u015f\u0131 ihtarnamesinde feshe muvaffaklar\u0131n\u0131n olmad\u0131\u011f\u0131n\u0131 bildirdi\u011fini, ihtarda ileri s\u00fcr\u00fclen hususlar\u0131n ger\u00e7e\u011fi yans\u0131tmad\u0131\u011f\u0131n\u0131, feshi bildiriminin hukuken ge\u00e7erli olmad\u0131\u011f\u0131n\u0131, s\u00f6zle\u015fmenin s\u00fcresinden \u00f6nce feshi halinde u\u011fran\u0131lacak zarar ve ziyanlar ile s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan cezai \u015fart\u0131n talep ve dava edilece\u011finin bildirilmesine ra\u011fmen daval\u0131 \u015firketin anahtarlar\u0131 teslim etmeyerek 07\/02\/2013 tarihinde mecuru tahliye etti\u011fini belirterek taraflar aras\u0131ndaki kira s\u00f6zle\u015fmesinin 14.1 maddesi uyar\u0131nca s\u00f6zle\u015fmenin sonuna kadar olan ayl\u0131k kira bedellerinin cezai tazminat olarak \u00f6denmesi ve bu kapsamda fazlaya ili\u015fkin haklar\u0131n sakl\u0131 tutularak \u015eubat\/2013 tarihinden s\u00f6zle\u015fme s\u00fcresinin sonuna kadar olan 621.392 Euro kar\u015f\u0131l\u0131\u011f\u0131 1.465.801,00-TL tazminat\u0131n ticari reskont faizi ile birlikte daval\u0131dan tahsilini talep ve dava etmi\u015ftir.<\/p>\n<p>Daval\u0131 vekili cevap dilek\u00e7esinde; dava dilek\u00e7esinin HMK&#8217;n\u0131n 119\/f bendine ayk\u0131r\u0131 olarak d\u00fczenlendi\u011fini, dava dilek\u00e7esinin eklerinin taraflar\u0131na tebli\u011f edilmedi\u011fi, davac\u0131 taraf\u0131n cezai \u015fart olarak kira bedeli talebinin haks\u0131z, k\u00f6t\u00fc niyetli ve d\u00fcr\u00fcstl\u00fck kurallar\u0131na ayk\u0131r\u0131 oldu\u011funu, davac\u0131 \u015firketin kira s\u00f6zle\u015fmesinde \u00f6ng\u00f6r\u00fclen edimlerini yerine getirmedi\u011finden akdin feshedildi\u011fini, kira s\u00f6zle\u015fmesinin pek \u00e7ok h\u00fckm\u00fcn\u00fcn Bor\u00e7lar Kanunun 20-25. maddeleri kapsam\u0131nda ge\u00e7ersiz bulundu\u011funu, Bor\u00e7lar Kanunun 97. maddesi uyar\u0131nca s\u00f6zle\u015fmenin bir taraf\u0131n\u0131n borcunu ifa etmeden ya da ifas\u0131n\u0131 \u00f6nermeden s\u00f6zle\u015fmenin ifas\u0131n\u0131n istenemeyece\u011fini, bu kapsamda m\u00fcvekkili \u015firketin \u00f6demezlik defi&#8217;ni kulland\u0131\u011f\u0131n\u0131, kira s\u00f6zle\u015fmesini hakl\u0131 olarak fesh etti\u011fini, somut olayda taraflar aras\u0131nda vekalet ili\u015fkisinin s\u00f6z konusu oldu\u011funu, bu kapsamda da davac\u0131n\u0131n kendisine y\u00fcklenen edimleri yerine getirmedi\u011fini, s\u00f6zle\u015fme \u015fartlar\u0131n\u0131n yok h\u00fckm\u00fcnde say\u0131lmamas\u0131 halinde dahi cezai \u015fart h\u00fckm\u00fcn\u00fcn iptal ve tenkise tabi olmas\u0131 gerekti\u011fini belirterek davan\u0131n reddini savunmu\u015ftur.<\/p>\n<p>Mahkemece; davan\u0131n k\u0131smen kabul\u00fc ile, 255.655,00 TL cezai tazminat\u0131n dava tarihinden i\u015fleyecek ticari reeskont faizi ile birlikte daval\u0131dan tahsiline karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 ve daval\u0131 vekilleri taraf\u0131ndan ayr\u0131 ayr\u0131 temyiz edilmi\u015ftir.<\/p>\n<p>1-) Taraflar aras\u0131nda 12.03.2012 ba\u015flang\u0131\u00e7 tarihli ve 5 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi ile al\u0131\u015fveri\u015f merkezinde bulunan&#8230; ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin \u00e7ocuk e\u011flence ve bowling merkezi olarak kullan\u0131lmak \u00fczere kiraya verildi\u011fi hususunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. S\u00f6zle\u015fmenin \u00f6zel \u015fartlar S\u00f6zle\u015fmenin Feshi ba\u015fl\u0131kl\u0131 14.1. maddesinde, kirac\u0131 s\u00fcresinden \u00f6nce s\u00f6zle\u015fmeyi fesheder veya kiralanan\u0131 tahliye ederse s\u00f6zle\u015fme s\u00fcresinin sonuna kadar olan ayl\u0131k kira bedellerinin cezai tazminat olarak kiraya verene \u00f6denece\u011fi,&#8230;. maddesinde ise, i\u015f bu s\u00f6zle\u015fmeye uyulmayarak kiralananda ma\u011faza a\u00e7\u0131lmas\u0131 sa\u011flanamad\u0131\u011f\u0131 veya kirac\u0131 ya da kiralayan i\u015f bu s\u00f6zle\u015fmeden vazge\u00e7ti\u011fi takdirde s\u00f6zle\u015fmeye uymayan taraf\u0131n, her t\u00fcrl\u00fc zarar ziyan tazminat hakk\u0131 sakl\u0131 kalmak kayd\u0131yla di\u011ferine 1 y\u0131ll\u0131k asgari kira bedelini cezai \u015fart olarak \u00f6deyece\u011fi hususlar\u0131 d\u00fczenlenmi\u015ftir.<br \/>\nS\u00f6zle\u015fmeye ba\u011fl\u0131l\u0131k ilkesi uyar\u0131nca taraflar s\u00f6zle\u015fme s\u00fcresi ile ba\u011fl\u0131 olup kural olarak akdin s\u00fcresinden \u00f6nce ve hakl\u0131 bir nedene dayanmaks\u0131z\u0131n feshi durumunda feshe maruz kalan taraf a\u00e7\u0131s\u0131ndan u\u011fran\u0131lan zararlar\u0131n tazminini talep hakk\u0131 do\u011far. Daval\u0131 kirac\u0131 10.01.2013 ke\u015fide, 18.01.2013 tebli\u011f tarihli ihtarnamesinde, kira s\u00f6zle\u015fmesinde \u00f6ng\u00f6r\u00fclen edimlerin yerine getirilmedi\u011finden bahisle akdi feshettiklerini bildirmi\u015f, davac\u0131 \u015firket ise ihtar i\u00e7eri\u011finin ger\u00e7e\u011fi yans\u0131tmad\u0131\u011f\u0131n\u0131 ve tek tarafl\u0131 feshi kabul etmediklerini beyan etmi\u015ftir. Bu durumda \u00f6ncelikle uyu\u015fmazl\u0131k konusu, feshin hakl\u0131 olup olmad\u0131\u011f\u0131 noktas\u0131nda toplanmaktad\u0131r. Her ne kadar Mahkemece feshin hakl\u0131l\u0131\u011f\u0131na ili\u015fkin ileri s\u00fcr\u00fclen olgular\u0131n varl\u0131\u011f\u0131n\u0131n daval\u0131 taraf\u0131ndan kan\u0131tlanamad\u0131\u011f\u0131 belirtilmi\u015f ise de, bu hususta taraf delillerinin yeterince ara\u015ft\u0131r\u0131lmad\u0131\u011f\u0131, davac\u0131 iddialar\u0131 ile daval\u0131 savunmalar\u0131n\u0131n usul\u00fcnce de\u011ferlendirilmedi\u011fi anla\u015f\u0131lmaktad\u0131r. O halde Mahkemece \u00f6ncelikle daval\u0131 kirac\u0131n\u0131n fesihte hakl\u0131 olup olmad\u0131\u011f\u0131n\u0131n tam olarak tespit edilmesi i\u00e7in taraf delilerinin toplanarak de\u011ferlendirilmesi, feshin haks\u0131z oldu\u011funun anla\u015f\u0131lmas\u0131 halinde, s\u00f6zle\u015fmenin \u00f6zel \u015fartlar 14.1. maddesi ile 20.maddelerinden hangisinin \u015fartlar\u0131n\u0131n olu\u015ftu\u011funun de\u011ferlendirilmek suretiyle, cezai \u015fart\u0131n bu madde h\u00fck\u00fcmlerinden hangisine g\u00f6re tayin ve takdir edilmesi gerekece\u011finin belirlenmesi gerekir.<\/p>\n<p>\u00d6te yandan Mahkemenin de kabul\u00fcnde oldu\u011fu \u00fczere, s\u00f6zle\u015fmenin taraflar\u0131 ceza miktar\u0131n\u0131 tayinde serbest olmakla birlikte h\u00fckmedilecek ceza tutar\u0131n\u0131n hak, adalet ve nesafet kurallar\u0131na da uygun olmas\u0131 gerekir. T.B.K. 182\/son maddesi gere\u011fince Hakim bor\u00e7luyu iktisaden sarsan ceza miktar\u0131n\u0131 tenkisle m\u00fckellef olup, hakim taraf\u0131ndan resen nazara al\u0131nmas\u0131 gereken bu h\u00fck\u00fcm a\u00e7\u0131s\u0131ndan; borca ayk\u0131r\u0131 davran\u0131lmas\u0131 y\u00fcz\u00fcnden u\u011fran\u0131lan zarar ile tayin edilen ceza tutar\u0131 aras\u0131nda adalet ve hakkaniyet \u00f6l\u00e7\u00fcs\u00fcn\u00fc zedeleyen bir fark bulunmamal\u0131d\u0131r. Esasen TTK\u2019nun 22. Maddesi gere\u011fince tacir s\u0131fat\u0131n\u0131 haiz bor\u00e7lu cezai \u015fart\u0131n indirilmesini isteyemez ise de, kararla\u015ft\u0131r\u0131lan ceza tutar\u0131 bor\u00e7lunun iktisaden sars\u0131lmas\u0131n\u0131, \u00e7\u00f6k\u00fcnt\u00fcye u\u011framas\u0131n\u0131 mucip olacak ise indirim isteyebilece\u011fi uygulamada kabul edilmektedir.<\/p>\n<p>Somut olayda Mahkemece; s\u00f6zle\u015fme serbestisi gere\u011fi kira s\u00f6zle\u015fmesi h\u00fck\u00fcmlerinin tatbik olunaca\u011f\u0131, ne var ki daval\u0131 vekilinin cezai \u015fart\u0131n daval\u0131n\u0131n mahv\u0131na sebep olaca\u011f\u0131n\u0131 ileri s\u00fcrmekle, T.B.K. 182\/son maddesi gere\u011fince daval\u0131ya ait t\u00fcm ticari defter ve kay\u0131tlar ile belgeler getirtilerek, ticari defter ve kay\u0131tlar\u0131, bilan\u00e7osu ve ekonomik durumunu etkileyen di\u011fer unsurlar \u00fczerinde bilirki\u015fi incelemesi yap\u0131lmas\u0131, yap\u0131lan inceleme sonucunda s\u00f6zle\u015fmede belirlenen cezai \u015fart\u0131n \u00f6denmesinin, daval\u0131n\u0131n ekonomik a\u00e7\u0131dan mahv\u0131na sebebiyet verdi\u011finin anla\u015f\u0131lmas\u0131 halinde cezai \u015fart\u0131n makul bir miktara indirilmesi, ne miktar cezai \u015fart \u00f6denebilece\u011fi hususunda Yarg\u0131tay denetimine elveri\u015fli uzman bilirki\u015fi veya bilirki\u015fi kurulundan rapor al\u0131nmak suretiyle, tacir olan kirac\u0131 hakk\u0131nda TBK.nun 325.
