Bu kapsamda, aidat ad\u0131 alt\u0131nda al\u0131nan ortak gider avanslar\u0131; sitenin g\u00fcvenli\u011fi, temizli\u011fi, bak\u0131m\u0131 ve ortak alanlar\u0131n y\u00f6netilmesi gibi temel ihtiya\u00e7lar\u0131n kar\u015f\u0131lanmas\u0131nda hayati bir rol oynamaktad\u0131r. Ancak aidat art\u0131\u015flar\u0131, \u00f6zellikle ekonomik dalgalanmalar\u0131n ya\u015fand\u0131\u011f\u0131 d\u00f6nemlerde ciddi ihtilaflara yol a\u00e7makta; bu durum yarg\u0131ya intikal eden \u00e7ok say\u0131da uyu\u015fmazl\u0131\u011fa neden olmaktad\u0131r. Makalemizde aidat art\u0131\u015f\u0131n\u0131n yasal temelleri, karar alma s\u00fcreci, Yarg\u0131tay i\u00e7tihatlar\u0131 do\u011frultusunda ge\u00e7erlilik \u015fartlar\u0131 ve uygulamadaki sorunlar ele al\u0131nacakt\u0131r.<\/p>\n<p>I. Hukuki \u00c7er\u00e7eve<\/p>\n<p>1. Kat M\u00fclkiyeti Kanunu\u2019nda Aidat\u0131n Hukuki Niteli\u011fi<\/p>\n<p>Kat M\u00fclkiyeti Kanunu\u2019nun 20. maddesine g\u00f6re her kat maliki, anagayrimenkul\u00fcn genel giderlerine ve bu giderler i\u00e7in toplanacak avansa arsa pay\u0131 oran\u0131nda kat\u0131lmakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu d\u00fczenleme, hem m\u00fclkiyet hakk\u0131n\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131n\u0131 hem de ortak ya\u015fam gerekliliklerinin yerine getirilmesini ama\u00e7lamaktad\u0131r. S\u00f6z konusu y\u00fck\u00fcml\u00fcl\u00fck, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn kullan\u0131l\u0131p kullan\u0131lmamas\u0131na bak\u0131lmaks\u0131z\u0131n do\u011frudan do\u011far. Kat maliki ile kirac\u0131 aras\u0131nda yap\u0131lm\u0131\u015f \u00f6zel anla\u015fmalar, kat malikinin y\u00f6netim kar\u015f\u0131s\u0131ndaki borcunu ortadan kald\u0131rmaz.<\/p>\n<p>2. Aidat\u0131n Belirlenmesi ve Art\u0131r\u0131lmas\u0131 Usul\u00fc<\/p>\n<p>KMK m. 34 ve 37 h\u00fck\u00fcmlerine g\u00f6re, aidat\u0131n belirlenmesi ve art\u0131r\u0131lmas\u0131 i\u00e7in \u201ci\u015fletme projesi\u201d haz\u0131rlanmas\u0131 ve bu projenin kat malikleri kurulu taraf\u0131ndan onaylanmas\u0131 gerekmektedir. \u0130\u015fletme projesinde; tahmini y\u0131ll\u0131k giderler, beklenen gelirler ve her bir kat malikinden tahsil edilecek aidat tutar\u0131 yer al\u0131r. Art\u0131\u015flar, bir \u00f6nceki y\u0131l\u0131n giderlerinin art\u0131\u015f\u0131 ile orant\u0131l\u0131 ve objektif olmal\u0131d\u0131r. Aksi h\u00e2lde keyfi art\u0131\u015flar, maliklerin dava a\u00e7mas\u0131na neden olabilmektedir. Yarg\u0131tay uygulamalar\u0131nda i\u015fletme projesinin sunulmad\u0131\u011f\u0131 ya da onaylanmad\u0131\u011f\u0131 durumlarda aidat art\u0131\u015f kararlar\u0131 ge\u00e7ersiz say\u0131lmaktad\u0131r. Y\u00f6netim veya kurul taraf\u0131ndan haz\u0131rlanan i\u015fletme projesi kat maliklerine posta yolu veya imza kar\u015f\u0131l\u0131\u011f\u0131nda tebli\u011f edilir. Fahi\u015f \u015fekilde haz\u0131rlanm\u0131\u015f bir i\u015fletme projesi var ise kat maliklerinin buna da tebli\u011fden itibaren 7 g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde itiraz etme hakk\u0131 bulundu\u011funu belirtmek gerekir. Yarg\u0131tay\u2019\u0131n yerle\u015fik uygulamas\u0131na g\u00f6re, kat malikleri kurulunca herhangi bir karar al\u0131nmam\u0131\u015f veya i\u015fletme projesi kat maliklerine tebli\u011f edilmemi\u015f, veya tebli\u011f edilip kesinle\u015fmemi\u015f olmas\u0131, itiraz etmek isteyen kat malikinin kat malikleri kurulu toplant\u0131s\u0131na kat\u0131lmam\u0131\u015f olmas\u0131, kat\u0131l\u0131p da muhalif olmas\u0131 kat malikinin ve onlar\u0131n ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcnde kira s\u00f6zle\u015fmesine veya ba\u015fka bir nedene dayanarak oturanlar\u0131n ortak gider borcu olan aidat \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ortadan kald\u0131rmayacakt\u0131r.<\/p>\n<p>II. Uygulamada Ortaya \u00c7\u0131kan Sorunlar<\/p>\n<p>1. Y\u00f6netim Plan\u0131na Dayal\u0131 Aidat Art\u0131\u015f\u0131<\/p>\n<p>Uygulamada baz\u0131 y\u00f6neticiler ya da y\u00f6netim firmalar\u0131, yaln\u0131zca y\u00f6netim plan\u0131ndaki h\u00fck\u00fcmlere dayanarak aidat art\u0131\u015f\u0131na gitmektedir. Ancak bu durum KMK h\u00fck\u00fcmleri ile \u00e7eli\u015fmektedir. Y\u00f6netim plan\u0131, genel kurula dan\u0131\u015f\u0131lmadan s\u0131n\u0131rs\u0131z art\u0131\u015f yetkisi tan\u0131yamaz. Aidat art\u0131\u015f\u0131 ancak kat malikleri kurulunca kararla\u015ft\u0131r\u0131labilir.<\/p>\n<p>2. Oy\u00e7oklu\u011fu ile Al\u0131nan Kararlar\u0131n Ge\u00e7erlili\u011fi<\/p>\n<p>Aidat art\u0131\u015f kararlar\u0131, KMK m. 30 uyar\u0131nca kat maliklerinin salt \u00e7o\u011funlu\u011fu ile al\u0131nabilir. Ancak bu karar\u0131n ge\u00e7erli olabilmesi i\u00e7in usul\u00fcne uygun toplant\u0131 \u00e7a\u011fr\u0131s\u0131 yap\u0131lmas\u0131, karar\u0131n gerek\u00e7elendirilmesi ve tutanakla kay\u0131t alt\u0131na al\u0131nmas\u0131 gerekmektedir. \u00d6zellikle \u00e7a\u011fr\u0131 usul\u00fcne uyulmayan toplant\u0131larda al\u0131nan kararlar, sonradan ge\u00e7erlilik kazanmaz. Usul\u00fcne uygun yap\u0131lmayan genel kurulda al\u0131nan aidat art\u0131\u015f kararlar\u0131n\u0131n da bu kapsamda ge\u00e7ersiz oldu\u011funu belirtmek gerekir.<\/p>\n<p>3. Kirac\u0131-Malik Ayr\u0131m\u0131 ve Aidat Borcu<\/p>\n<p>Kat maliklerinin sorumlulu\u011fu devam etti\u011fi h\u00e2lde, uygulamada y\u00f6neticiler do\u011frudan kirac\u0131lardan aidat tahsil etmeye \u00e7al\u0131\u015fmakta, \u00f6deme yap\u0131lmad\u0131\u011f\u0131nda ise malike kar\u015f\u0131 icra takibi ba\u015flat\u0131lmaktad\u0131r. KMK m. 20\u2019ye g\u00f6re aidat borcu yaln\u0131zca malike ait olup, kirac\u0131ya r\u00fccu hakk\u0131 malik ile kirac\u0131 aras\u0131ndaki kira s\u00f6zle\u015fmesi \u00e7er\u00e7evesinde m\u00fcmk\u00fcnd\u00fcr. Uygulamada bu ayr\u0131m yap\u0131lmadan ba\u015flat\u0131lan takiplerde, bor\u00e7lu s\u0131fat\u0131 a\u00e7\u0131s\u0131ndan usul hatalar\u0131 olu\u015fmaktad\u0131r.<\/p>\n<p>L\u00f6sungsvorschl\u00e4ge<\/p>\n<p>1. Y\u00f6netim planlar\u0131n\u0131n g\u00fcncellenmesi ve kat maliklerince onaylanmas\u0131, aidat art\u0131\u015flar\u0131nda keyfili\u011fin \u00f6n\u00fcne ge\u00e7ecektir.<\/p>\n<p>2. \u0130\u015fletme projesinin t\u00fcm maliklere sunulmas\u0131, mali \u015feffafl\u0131k a\u00e7\u0131s\u0131ndan zorunludur.<\/p>\n<p>3. Toplant\u0131 \u00e7a\u011fr\u0131lar\u0131n\u0131n noter arac\u0131l\u0131\u011f\u0131yla yap\u0131lmas\u0131, usul\u00fcne uygun tebli\u011f ve hukuki ge\u00e7erlili\u011fin ispat\u0131 bak\u0131m\u0131ndan \u00f6nemlidir.<\/p>\n<p>4. Aidat art\u0131\u015f\u0131 kararlar\u0131na kar\u015f\u0131 a\u00e7\u0131lacak davalar\u0131n ne kadar s\u00fcrede a\u00e7\u0131lmas\u0131 gerekti\u011fi KMK m. 33\u2019te yer alan \u015fekilde maliklere duyurulmal\u0131d\u0131r.<\/p>\n<p>5. Profesyonel y\u00f6netim \u015firketleri ile yap\u0131lan s\u00f6zle\u015fmelerin de hukuki denetime tabi tutulmas\u0131 yerinde olacakt\u0131r.<\/p>\n<p>Sonu\u00e7<\/p>\n<p>Aidat art\u0131\u015f\u0131, hem sitenin sa\u011fl\u0131kl\u0131 y\u00f6netimi hem de ortak alanlar\u0131n s\u00fcrd\u00fcr\u00fclebilirli\u011fi a\u00e7\u0131s\u0131ndan vazge\u00e7ilmezdir. Ancak bu art\u0131\u015flar\u0131n hukuka uygun y\u00f6ntemlerle yap\u0131lmas\u0131, maliklerin r\u0131zas\u0131 al\u0131narak y\u00fcr\u00fct\u00fclmesi ve \u015feffaf y\u00f6netim anlay\u0131\u015f\u0131 \u00e7er\u00e7evesinde ger\u00e7ekle\u015ftirilmesi gerekmektedir. Aksi h\u00e2lde y\u00f6netimle malik aras\u0131ndaki g\u00fcven ili\u015fkisi zedelenecek, yarg\u0131ya ta\u015f\u0131nan uyu\u015fmazl\u0131klar\u0131n say\u0131s\u0131 artacakt\u0131r. Yarg\u0131tay kararlar\u0131 da g\u00f6stermektedir ki; aidat art\u0131\u015f\u0131 konusundaki temel esaslar; hukuka uygunluk, usule riayet ve malik iradesine sayg\u0131d\u0131r.<\/p>\n<p>AV.
