(De\u011fi\u015fik c\u00fcmle:28\/7\/2024-7524\/52 md.) Ancak, konusu otuz bir bin T\u00fcrk liras\u0131n\u0131 ge\u00e7meyen; vergi davalar\u0131, tam yarg\u0131 davalar\u0131 ve idari i\u015flemlere kar\u015f\u0131 a\u00e7\u0131lan iptal davalar\u0131 hakk\u0131nda idare ve vergi mahkemelerince verilen kararlar kesin olup, bunlara kar\u015f\u0131 istinaf yoluna ba\u015fvurulamaz. <\/p>\n<p>2. \u0130stinaf, temyizin \u015fekil ve usullerine tabidir. \u0130stinaf ba\u015fvurusuna konu olacak kararlara kar\u015f\u0131 yap\u0131lan kanun yolu ba\u015fvurular\u0131nda dilek\u00e7elerdeki hitap ve istekle ba\u011fl\u0131 kal\u0131nmaks\u0131z\u0131n dosyalar b\u00f6lge idare mahkemesine g\u00f6nderilir. (Ek c\u00fcmle:28\/7\/2024-7524\/52 md.) B\u00f6lge idare mahkemesinin 48 inci maddenin yedinci f\u0131kras\u0131 uyar\u0131nca verdi\u011fi kararlara kar\u015f\u0131 tebli\u011f tarihini izleyen g\u00fcnden itibaren yedi g\u00fcn i\u00e7inde temyiz yoluna ba\u015fvurulabilir. <\/p>\n<p>3. B\u00f6lge idare mahkemesi, yapt\u0131\u011f\u0131 inceleme sonunda ilk derece mahkemesi karar\u0131n\u0131 hukuka uygun bulursa istinaf ba\u015fvurusunun reddine karar verir. Karardaki maddi yanl\u0131\u015fl\u0131klar\u0131n d\u00fczeltilmesi m\u00fcmk\u00fcn ise gerekli d\u00fczeltmeyi yaparak ayn\u0131 karar\u0131 verir.<\/p>\n<p>4. B\u00f6lge idare mahkemesi, ilk derece mahkemesi karar\u0131n\u0131 hukuka uygun bulmad\u0131\u011f\u0131 takdirde istinaf ba\u015fvurusunun kabul\u00fc ile ilk derece mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na karar verir. Bu h\u00e2lde b\u00f6lge idare mahkemesi i\u015fin esas\u0131 hakk\u0131nda yeniden bir karar verir. \u0130nceleme s\u0131ras\u0131nda ihtiya\u00e7 duyulmas\u0131 h\u00e2linde karar\u0131 veren mahkeme veya ba\u015fka bir yer idare ya da vergi mahkemesi istinabe olunabilir. \u0130stinabe olunan mahkeme gerekli i\u015flemleri \u00f6ncelikle ve ivedilikle yerine getirir.<\/p>\n<p>5. B\u00f6lge idare mahkemesi, ilk inceleme \u00fczerine verilen kararlara kar\u015f\u0131 yap\u0131lan istinaf ba\u015fvurusunu hakl\u0131 buldu\u011fu, davaya g\u00f6revsiz veya yetkisiz mahkeme yahut reddedilmi\u015f veya yasaklanm\u0131\u015f h\u00e2kim taraf\u0131ndan bak\u0131lm\u0131\u015f olmas\u0131 h\u00e2llerinde, istinaf ba\u015fvurusunun kabul\u00fc ile ilk derece mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na karar vererek dosyay\u0131 ilgili mahkemeye g\u00f6nderir. B\u00f6lge idare mahkemesinin bu f\u0131kra uyar\u0131nca verilen kararlar\u0131 kesindir.<\/p>\n<p>6. B\u00f6lge idare mahkemelerinin 46 nc\u0131 maddeye g\u00f6re temyize a\u00e7\u0131k olmayan kararlar\u0131 kesindir. (Ek c\u00fcmle: 20\/7\/2017-7035\/6 md.) Bu kararlar, dosyayla birlikte karar\u0131 veren ilk derece mahkemesine g\u00f6nderilir ve bu mahkemelerce yedi g\u00fcn i\u00e7inde tebli\u011fe \u00e7\u0131kar\u0131l\u0131r.<\/p>\n<p>7. \u0130stinaf ba\u015fvurusuna konu edilen karar\u0131 veren ya da karara kat\u0131lan h\u00e2kim, ayn\u0131 davan\u0131n istinaf yoluyla b\u00f6lge idare mahkemesince incelenmesinde bulunamaz.<\/p>\n<p>8. \u0130vedi yarg\u0131lama usul\u00fcne tabi olan davalarda istinaf yoluna ba\u015fvurulamaz.\u201d<\/p>\n<p>B. \u0130lgili G\u00f6r\u00fclen Kanun H\u00fckm\u00fc<\/p>\n<p>Kanun\u2019un 46. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201cTemyiz:<\/p>\n<p>Madde 46 \u2013 (De\u011fi\u015fik: 18\/6\/2014-6545\/20 md.)<\/p>\n<p>Dan\u0131\u015ftay dava dairelerinin nihai kararlar\u0131 ile b\u00f6lge idare mahkemelerinin a\u015fa\u011f\u0131da say\u0131lan davalar hakk\u0131nda verdikleri kararlar, ba\u015fka kanunlarda aksine h\u00fck\u00fcm bulunsa dahi Dan\u0131\u015ftayda, karar\u0131n tebli\u011finden itibaren otuz g\u00fcn i\u00e7inde temyiz edilebilir:<\/p>\n<p>a) D\u00fczenleyici i\u015flemlere kar\u015f\u0131 a\u00e7\u0131lan iptal davalar\u0131.<\/p>\n<p>b) (\u0130ptal bent: Anayasa Mahkemesinin 26\/7\/2023 tarihli ve E.:2023\/36 K.:2023\/142 say\u0131l\u0131 Karar\u0131 ile) (Yeniden D\u00fczenleme:28\/7\/2024-7524\/53 md.) Konusu dokuz y\u00fcz yirmi bin T\u00fcrk liras\u0131n\u0131 a\u015fan; vergi davalar\u0131, tam yarg\u0131 davalar\u0131 ve idari i\u015flemler hakk\u0131nda a\u00e7\u0131lan davalar.<\/p>\n<p>c) (Ek:28\/7\/2024-7524\/53 md.) Konusu iki y\u00fcz yetmi\u015f bin T\u00fcrk liras\u0131n\u0131 a\u015f\u0131p dokuz y\u00fcz yirmi bin T\u00fcrk liras\u0131n\u0131 a\u015fmayan; vergi davalar\u0131, tam yarg\u0131 davalar\u0131 ve idari i\u015flemler hakk\u0131nda a\u00e7\u0131lan ve istinaf kanun yolu incelemesinde kald\u0131rma karar\u0131 \u00fczerine yeniden karar verilen davalar.<\/p>\n<p>d) Belli bir meslekten, kamu g\u00f6revinden veya \u00f6\u011frencilik stat\u00fcs\u00fcnden \u00e7\u0131kar\u0131lma sonucunu do\u011furan i\u015flemlere kar\u015f\u0131 a\u00e7\u0131lan iptal davalar\u0131.<\/p>\n<p>e) Belli bir ticari faaliyetin icras\u0131n\u0131 s\u00fcresiz veya otuz g\u00fcn yahut daha uzun s\u00fcreyle engelleyen i\u015flemlere kar\u015f\u0131 a\u00e7\u0131lan iptal davalar\u0131.<\/p>\n<p>f) M\u00fc\u015fterek kararnameyle yap\u0131lan atama, naklen atama ve g\u00f6revden alma i\u015flemleri ile daire ba\u015fkan\u0131 ve daha \u00fcst d\u00fczey kamu g\u00f6revlilerinin atama, naklen atama ve g\u00f6revden alma i\u015flemleri hakk\u0131nda a\u00e7\u0131lan iptal davalar\u0131.<\/p>\n<p>g) \u0130mar planlar\u0131, parselasyon i\u015flemlerinden kaynaklanan davalar.<\/p>\n<p>h) Tabiat Varl\u0131klar\u0131n\u0131 Koruma Merkez Komisyonu ve K\u00fclt\u00fcr Varl\u0131klar\u0131n\u0131 Koruma Y\u00fcksek Kurulunca itiraz \u00fczerine verilen kararlar ile 18\/11\/1983 tarihli ve 2960 say\u0131l\u0131 Bo\u011fazi\u00e7i Kanununun uygulanmas\u0131ndan do\u011fan davalar.<\/p>\n<p>\u0131) Maden, ta\u015focaklar\u0131, orman, jeotermal kaynaklar ve do\u011fal mineralli sular ile ilgili mevzuat\u0131n uygulanmas\u0131na ili\u015fkin i\u015flemlere kar\u015f\u0131 a\u00e7\u0131lan davalar.<\/p>\n<p>i) \u00dclke \u00e7ap\u0131nda uygulanan \u00f6\u011frenim ya da bir meslek veya sanat\u0131n icras\u0131 veyahut kamu hizmetine giri\u015f amac\u0131yla yap\u0131lan s\u0131navlar hakk\u0131nda a\u00e7\u0131lan davalar.<\/p>\n<p>j) Liman, kruvaziyer liman\u0131, yat liman\u0131, marina, iskele, r\u0131ht\u0131m, akaryak\u0131t ve s\u0131v\u0131la\u015ft\u0131r\u0131lm\u0131\u015f petrol gaz\u0131 boru hatt\u0131 gibi k\u0131y\u0131 tesislerine i\u015fletme izni verilmesine ili\u015fkin mevzuat\u0131n uygulanmas\u0131ndan do\u011fan davalar.<\/p>\n<p>k) 8\/6\/1994 tarihli ve 3996 say\u0131l\u0131 Baz\u0131 Yat\u0131r\u0131m ve Hizmetlerin Yap-\u0130\u015flet-Devret Modeli \u00c7er\u00e7evesinde Yapt\u0131r\u0131lmas\u0131 Hakk\u0131nda Kanunun uygulanmas\u0131ndan ve 16\/7\/1997 tarihli ve 4283 say\u0131l\u0131 Yap-\u0130\u015flet Modeli ile Elektrik Enerjisi \u00dcretim Tesislerinin Kurulmas\u0131 ve \u0130\u015fletilmesi ile Enerji Sat\u0131\u015f\u0131n\u0131n D\u00fczenlenmesi Hakk\u0131nda Kanunun uygulanmas\u0131ndan do\u011fan davalar.<\/p>\n<p>l) 6\/6\/1985 tarihli ve 3218 say\u0131l\u0131 Serbest B\u00f6lgeler Kanununun uygulanmas\u0131ndan do\u011fan davalar.<\/p>\n<p>m) 3\/7\/2005 tarihli ve 5403 say\u0131l\u0131 Toprak Koruma ve Arazi Kullan\u0131m\u0131 Kanununun uygulanmas\u0131ndan do\u011fan davalar.<\/p>\n<p>n) D\u00fczenleyici ve denetleyici kurullar taraf\u0131ndan g\u00f6revli olduklar\u0131 piyasa veya sekt\u00f6rle ilgili olarak al\u0131nan kararlara kar\u015f\u0131 a\u00e7\u0131lan davalar.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri gere\u011fince Kadir \u00d6ZKAYA, Hasan Tahsin G\u00d6KCAN, Basri BA\u011eCI, Engin YILDIRIM, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, \u0130rfan F\u0130DAN, Kenan YA\u015eAR, Muhterem \u0130NCE, Y\u0131lmaz AK\u00c7\u0130L, \u00d6mer \u00c7INAR ve Metin KIRATLI\u2019n\u0131n kat\u0131l\u0131mlar\u0131yla 4\/12\/2024 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda dosyada eksiklik bulunmad\u0131\u011f\u0131ndan i\u015fin esas\u0131n\u0131n incelenmesine OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130 <\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r Hilal YAZICI taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu ve ilgili g\u00f6r\u00fclen kanun h\u00fck\u00fcmleri, dayan\u0131lan ve ilgili g\u00f6r\u00fclen Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Anlam ve Kapsam<\/p>\n<p>3. 2577 say\u0131l\u0131 Kanun\u2019un 45. maddesinde idari yarg\u0131da istinaf kanun yoluna ili\u015fkin usul ve esaslar d\u00fczenlenmi\u015ftir. An\u0131lan maddede, konusu otuz bir bin T\u00fcrk liras\u0131n\u0131 ge\u00e7meyen vergi davalar\u0131, tam yarg\u0131 davalar\u0131 ve idari i\u015flemlere kar\u015f\u0131 a\u00e7\u0131lan iptal davalar\u0131 hakk\u0131nda idare ve vergi mahkemelerince verilen kararlar ile ivedi yarg\u0131lama usul\u00fcne tabi olan davalar hari\u00e7 idare ve vergi mahkemelerinin kararlar\u0131na kar\u015f\u0131, ba\u015fka kanunlarda farkl\u0131 bir kanun yolu \u00f6ng\u00f6r\u00fclm\u00fc\u015f olsa dahi, mahkemenin bulundu\u011fu yarg\u0131 \u00e7evresindeki b\u00f6lge idare mahkemesine, karar\u0131n tebli\u011finden itibaren otuz g\u00fcn i\u00e7inde istinaf yoluna ba\u015fvurulabilece\u011fi belirtilmi\u015ftir.<\/p>\n<p>4. S\u00f6z konusu maddenin (3) ve (4) numaral\u0131 f\u0131kralar\u0131nda ilk derece mahkemelerinin istinaf edilebilir kararlar\u0131na kar\u015f\u0131 yap\u0131lan istinaf ba\u015fvurusu \u00fczerine, ba\u015fvurunun esas\u0131 ile ilgili olarak b\u00f6lge idare mahkemelerinin verebilece\u011fi kararlara ili\u015fkin d\u00fczenlemelere yer verilmi\u015ftir.<\/p>\n<p>5. Bu \u00e7er\u00e7evede (3) numaral\u0131 f\u0131krada b\u00f6lge idare mahkemesinin yapt\u0131\u011f\u0131 inceleme sonunda ilk derece mahkemesi karar\u0131n\u0131 hukuka uygun bulmas\u0131 h\u00e2linde istinaf ba\u015fvurusunun reddine karar verece\u011fi ve karardaki maddi yanl\u0131\u015fl\u0131klar\u0131n d\u00fczeltilmesi m\u00fcmk\u00fcn ise gerekli d\u00fczeltmeyi ayn\u0131 kararda yapaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>6. (4) numaral\u0131 f\u0131kraya g\u00f6re ise b\u00f6lge idare mahkemesi, ilk derece mahkemesi karar\u0131n\u0131 hukuka uygun bulmad\u0131\u011f\u0131 takdirde istinaf ba\u015fvurusunun kabul\u00fc ile ilk derece mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na karar verir. Bu h\u00e2lde b\u00f6lge idare mahkemesi i\u015fin esas\u0131 hakk\u0131nda yeniden bir karar verir.<\/p>\n<p>7. (6) numaral\u0131 f\u0131kran\u0131n itiraz konusu birinci c\u00fcmlesinde b\u00f6lge idare mahkemelerinin 46. maddeye g\u00f6re temyize a\u00e7\u0131k olmayan kararlar\u0131n\u0131n kesin oldu\u011fu h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. \u0130tiraz konusu kural\u0131n at\u0131fta bulundu\u011fu 46. maddede b\u00f6lge idare mahkemelerinin konu itibar\u0131yla hangi davalardaki uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcne dair verdikleri kararlara kar\u015f\u0131 temyiz yoluna gidilebilece\u011fi d\u00fczenlenmi\u015ftir.<\/p>\n<p>8. Bu ba\u011flamda b\u00f6lge idare mahkemelerinin 46. maddeye g\u00f6re temyize a\u00e7\u0131k olmayan kararlar\u0131n\u0131n kesin oldu\u011funu h\u00fckme ba\u011flayan kuralda belirtilen b\u00f6lge idare mahkemesi kararlar\u0131n\u0131n konu itibar\u0131yla 46. maddede say\u0131lanlar d\u0131\u015f\u0131nda kalan davalardaki uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcne ili\u015fkin oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Ba\u015fka bir deyi\u015fle kuralla, istinaf merciinin 46. maddede say\u0131lmayan uyu\u015fmazl\u0131klar hakk\u0131nda verdi\u011fi kararlar\u0131n kesin olmas\u0131 \u00f6ng\u00f6r\u00fclmektedir. Kural \u201cistinaf ba\u015fvurusunun k\u0131smen veya t\u00fcmden kabul\u00fc hali\u201d y\u00f6n\u00fcnden incelenmi\u015ftir.<\/p>\n<p>B. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>9. Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kuralla b\u00f6lge idare mahkemelerinin temyiz yolu a\u00e7\u0131k olmayan kararlar\u0131n\u0131n davay\u0131 kesin olarak sona erdirmesinin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, bu kapsamda istinaf merciinin istinaf talebinin k\u0131smen veya t\u00fcmden kabul\u00fcne karar vererek yarg\u0131lamay\u0131 kesin h\u00fck\u00fcmle neticelendirebildi\u011fi, bu durumda kural gere\u011fince an\u0131lan kararlara kar\u015f\u0131 temyiz yoluna ba\u015fvurulmas\u0131na imk\u00e2n bulunmad\u0131\u011f\u0131, bu y\u00f6n\u00fcyle kural\u0131n derece mahkemesinden farkl\u0131 olarak verilmi\u015f yeni karara kar\u015f\u0131 kanun yoluna ba\u015fvurma imk\u00e2n\u0131n\u0131 ortadan kald\u0131rd\u0131\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019n\u0131n 36. maddesine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>C. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>10. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un 43. maddesi uyar\u0131nca kural, ilgisi nedeniyle Anayasa\u2019n\u0131n 13. maddesi y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>11. Anayasa\u2019n\u0131n 36. maddesinin birinci f\u0131kras\u0131nda \u201cHerkes, me\u015fr\u00fb vas\u0131ta ve yollardan faydalanmak suretiyle yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 veya daval\u0131 olarak iddia ve savunma ile adil yarg\u0131lanma hakk\u0131na sahiptir.\u201d denilerek yarg\u0131 organlar\u0131na davac\u0131 ve daval\u0131 olarak ba\u015fvurabilme hakk\u0131 ve bunun do\u011fal sonucu olarak da iddia, savunma ve adil yarg\u0131lanma hakk\u0131 g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu d\u00fczenleme ile g\u00fcvence alt\u0131na al\u0131nan hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc, kendisi bir temel hak niteli\u011fi ta\u015f\u0131mas\u0131n\u0131n \u00f6tesinde di\u011fer temel hak ve \u00f6zg\u00fcrl\u00fcklerden gereken \u015fekilde yararlan\u0131lmay\u0131 ve bunlar\u0131n korunmas\u0131n\u0131 sa\u011flayan en etkili g\u00fcvencelerden birisidir (AYM, E.2017\/120, K.2018\/33, 28\/3\/2018, \u00a7 17).<\/p>\n<p>12. Anayasa Mahkemesi kararlar\u0131nda, Anayasa\u2019n\u0131n mahkemelerce verilen h\u00fckm\u00fcn bir ba\u015fka yarg\u0131 mercii taraf\u0131ndan denetlenmesini talep etme hakk\u0131n\u0131 Anayasa\u2019n\u0131n 36. maddesinde d\u00fczenlenen hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda g\u00fcvenceye kavu\u015fturdu\u011fu kabul edilmi\u015ftir (AYM, E.2018\/71, K.2018\/118, 27\/12\/2018, \u00a7\u00a7 8-10; E.2020\/21, K.2020\/53, 1\/10\/2020, \u00a7 19; E.2022\/135, K.2023\/30, 16\/2\/2023, \u00a7 17).<\/p>\n<p>13. \u0130tiraz konusu kural, 2577 say\u0131l\u0131 Kanun\u2019un 46. maddesinde say\u0131lan temyiz yolu a\u00e7\u0131k davalar d\u0131\u015f\u0131nda b\u00f6lge idare mahkemelerince verilen kararlar\u0131n kesin oldu\u011funu h\u00fckme ba\u011flamak suretiyle s\u00f6z konusu davalara ili\u015fkin olarak b\u00f6lge idare mahkemelerinin ilk derece mahkemesi karar\u0131n\u0131 kald\u0131r\u0131p i\u015fin esas\u0131 hakk\u0131nda vermi\u015f oldu\u011fu kararlara kar\u015f\u0131 temyiz kanun yolu hakk\u0131 tan\u0131mamaktad\u0131r. Bu y\u00f6n\u00fcyle kural\u0131n h\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131na y\u00f6nelik s\u0131n\u0131rlama getirdi\u011fi a\u00e7\u0131kt\u0131r (ayn\u0131 y\u00f6nde bkz. AYM, E.2022\/89, K.2022\/129, 26\/10\/2022, \u00a7 28).<\/p>\n<p>14. Anayasa\u2019n\u0131n 13. maddesinde \u201cTemel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.\u201d denilmi\u015ftir. Buna g\u00f6re h\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131na s\u0131n\u0131rlama getiren d\u00fczenlemelerin kanunla yap\u0131lmas\u0131, Anayasa\u2019da \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlama sebebine uygun ve \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekir.<\/p>\n<p>15. Bu kapsamda h\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131n\u0131 s\u0131n\u0131rlamaya y\u00f6nelik bir kanuni d\u00fczenlemenin \u015feklen var olmas\u0131 yeterli olmay\u0131p yasal kurallar\u0131n keyf\u00eeli\u011fe izin vermeyecek \u015fekilde belirli, ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir nitelikte olmas\u0131 gerekir.<\/p>\n<p>16. Esasen temel hak ve \u00f6zg\u00fcrl\u00fckleri s\u0131n\u0131rlayan kanunun bu niteliklere sahip olmas\u0131 Anayasa\u2019n\u0131n 2. maddesinde g\u00fcvenceye al\u0131nan hukuk devleti ilkesinin de bir gere\u011fidir. Hukuk devletinde kanuni d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131, ayr\u0131ca kamu otoritelerinin keyf\u00ee uygulamalar\u0131na kar\u015f\u0131 koruyucu \u00f6nlem i\u00e7ermesi gerekir. Kanunda bulunmas\u0131 gereken bu nitelikler hukuki g\u00fcvenli\u011fin sa\u011flanmas\u0131 bak\u0131m\u0131ndan da zorunludur. Zira bu ilke hukuk normlar\u0131n\u0131n \u00f6ng\u00f6r\u00fclebilir olmas\u0131n\u0131, bireylerin t\u00fcm eylem ve i\u015flemlerinde devlete g\u00fcven duyabilmesini, devletin de yasal d\u00fczenlemelerinde bu g\u00fcven duygusunu zedeleyici y\u00f6ntemlerden ka\u00e7\u0131nmas\u0131n\u0131 gerekli k\u0131lar (AYM, E.2015\/41, K.2017\/98, 4\/5\/2017, \u00a7\u00a7 153, 154). Dolay\u0131s\u0131yla Anayasa\u2019n\u0131n 13. maddesinde s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fc olarak belirtilen kanunilik, Anayasa\u2019n\u0131n 2. maddesinde g\u00fcvenceye al\u0131nan hukuk devleti ilkesi \u0131\u015f\u0131\u011f\u0131nda yorumlanmal\u0131d\u0131r.<\/p>\n<p>17. An\u0131lan Kanun\u2019un 46. maddesinde hangi davalara ili\u015fkin olarak b\u00f6lge idare mahkemelerince verilen kararlar\u0131n temyize tabi oldu\u011fu sayma yoluyla belirtilmi\u015ftir. Kural ise b\u00f6lge idare mahkemelerinin s\u00f6z konusu maddeye g\u00f6re temyize a\u00e7\u0131k olan kararlar\u0131 d\u0131\u015f\u0131ndaki kararlar\u0131n\u0131n kesin oldu\u011funu h\u00fckme ba\u011flamaktad\u0131r.<\/p>\n<p>18. Kanun koyucu; b\u00f6lge idare mahkemelerinin di\u011fer kararlar\u0131 bak\u0131m\u0131ndan ise hangilerine kar\u015f\u0131 temyiz yolunun a\u00e7\u0131k oldu\u011fu, hangilerinin kesin oldu\u011fu hususunu ayr\u0131ca d\u00fczenlemi\u015ftir.<\/p>\n<p>19. Kanun\u2019un 45. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda istinaf ba\u015fvurusunun ilk incelemesi kapsam\u0131nda verilen kararlara kar\u015f\u0131 temyiz yolunun a\u00e7\u0131k oldu\u011fu belirtilmi\u015ftir. An\u0131lan maddenin (5) numaral\u0131 f\u0131kras\u0131nda ise b\u00f6lge idare mahkemelerinin, ilk inceleme \u00fczerine verilen kararlara kar\u015f\u0131 yap\u0131lan istinaf ba\u015fvurusunu hakl\u0131 buldu\u011fu, davaya g\u00f6revsiz veya yetkisiz mahkeme yahut reddedilmi\u015f veya yasaklanm\u0131\u015f h\u00e2kim taraf\u0131ndan bak\u0131lm\u0131\u015f olmas\u0131 h\u00e2llerinde, istinaf ba\u015fvurusunun kabul\u00fc ile ilk derece mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na karar vererek dosyay\u0131 ilgili mahkemeye g\u00f6ndermesine ili\u015fkin kararlar\u0131n\u0131n kesin oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>20. Buna g\u00f6re b\u00f6lge idare mahkemelerinin g\u00f6revlerinin neler oldu\u011fu, bu g\u00f6revler kapsam\u0131nda ne t\u00fcr kararlar verilece\u011finin ilgili kanunlarla d\u00fczenlenmi\u015f oldu\u011fu, dolay\u0131s\u0131yla kural\u0131n b\u00f6lge idare mahkemelerinin 46. maddede belirtilen davalara ili\u015fkin kararlar\u0131 d\u0131\u015f\u0131nda kalan hangi kararlar\u0131 konu edindi\u011fi hususunda bir teredd\u00fct bulunmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. A\u00e7\u0131klanan nedenle kural\u0131n belirli ve \u00f6ng\u00f6r\u00fclebilir oldu\u011fu ve bu kapsamda kanunilik \u015fart\u0131n\u0131 sa\u011flad\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. <\/p>\n<p>21. Anayasa\u2019n\u0131n 36. maddesinde hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc i\u00e7in herhangi bir s\u0131n\u0131rlama nedeni \u00f6ng\u00f6r\u00fclmemi\u015f olmakla birlikte bunun hi\u00e7bir \u015fekilde s\u0131n\u0131rlanmas\u0131 m\u00fcmk\u00fcn olmayan mutlak bir hak oldu\u011fu d\u00fc\u015f\u00fcn\u00fclemez. Anayasa Mahkemesi kararlar\u0131nda, Anayasa&#8217;n\u0131n ba\u015fka maddelerinde yer alan hak ve \u00f6zg\u00fcrl\u00fckler ile devlete y\u00fcklenen \u00f6devlerin \u00f6zel s\u0131n\u0131rlama sebebi g\u00f6sterilmemi\u015f hak ve \u00f6zg\u00fcrl\u00fcklere s\u0131n\u0131r te\u015fkil edebilece\u011fi kabul edilmektedir (AYM, E.2013\/95, K.2014\/176, 13\/11\/2014; E.2014\/177, K.2015\/49, 14\/5\/2015).<\/p>\n<p>22. Nitekim Anayasa\u2019n\u0131n an\u0131lan maddesinde g\u00fcvenceye ba\u011flanan adil yarg\u0131lanma hakk\u0131n\u0131n \u00f6nemli unsurlar\u0131ndan biri de makul s\u00fcrede yarg\u0131lanma hakk\u0131d\u0131r. Anayasa&#8217;n\u0131n 141. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda \u201cDavalar\u0131n en az giderle ve m\u00fcmk\u00fcn olan s\u00fcratle sonu\u00e7land\u0131r\u0131lmas\u0131, yarg\u0131n\u0131n g\u00f6revidir.\u201d denilmek suretiyle davalar\u0131n makul bir s\u00fcre i\u00e7inde bitirilmesi gereklili\u011fi a\u00e7\u0131k\u00e7a ifade edilmi\u015ftir. Bu hak gere\u011fince devlet, yarg\u0131lamalar\u0131n gereksiz yere uzamas\u0131n\u0131 engelleyecek etkin \u00e7areler olu\u015fturmak zorundad\u0131r (AYM, E.2013\/4, K.2013\/35, 28\/2\/2013).<\/p>\n<p>23. \u00d6te yandan an\u0131lan f\u0131krada davalar\u0131n en az giderle sonu\u00e7land\u0131r\u0131lmas\u0131 da bir ilke olarak d\u00fczenlenmi\u015ftir. Usul ekonomisi olarak da adland\u0131r\u0131lan bu ilke, yarg\u0131lama maliyetinin en d\u00fc\u015f\u00fck d\u00fczeyde olmas\u0131n\u0131 ve bu s\u00fcrecin m\u00fcmk\u00fcn olan en h\u0131zl\u0131 y\u00f6ntemlerle ger\u00e7ekle\u015ftirilmesini \u00f6ng\u00f6rmektedir. Dolay\u0131s\u0131yla davalar\u0131n makul s\u00fcre i\u00e7inde ve daha az masrafla sonu\u00e7lanmas\u0131n\u0131n sa\u011flanmas\u0131 amac\u0131yla h\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131n\u0131n s\u0131n\u0131rlanmas\u0131n\u0131n anayasal a\u00e7\u0131dan me\u015fru bir amaca dayand\u0131\u011f\u0131 g\u00f6r\u00fclmektedir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. AYM, E.2020\/21, K.2020\/53, 1\/10\/2020, \u00a7 30). Dolay\u0131s\u0131yla kuralla istisnai h\u00e2ller d\u0131\u015f\u0131nda b\u00f6lge idare mahkemesi kararlar\u0131n\u0131n kesin olmas\u0131 \u00f6ng\u00f6r\u00fclmek suretiyle davalar\u0131n makul s\u00fcre i\u00e7inde ve daha az masrafla sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131n ama\u00e7land\u0131\u011f\u0131, bu itibarla kural\u0131n anayasal a\u00e7\u0131dan me\u015fru bir amaca dayand\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r (benzer y\u00f6nde bkz. AYM, E.2022\/135, K.2023\/30, 16\/02\/2023, \u00a7 32).<\/p>\n<p>24. H\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131na getirilen s\u0131n\u0131rlaman\u0131n me\u015fru bir amaca y\u00f6nelik olmas\u0131 yeterli olmay\u0131p ayr\u0131ca \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekir. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. Elveri\u015flilik \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlaman\u0131n ula\u015f\u0131lmak istenen amac\u0131 ger\u00e7ekle\u015ftirmeye elveri\u015fli olmas\u0131n\u0131, gereklilik ula\u015f\u0131lmak istenen ama\u00e7 bak\u0131m\u0131ndan s\u0131n\u0131rlaman\u0131n zorunlu olmas\u0131n\u0131, di\u011fer bir ifadeyle ayn\u0131 amaca daha hafif bir s\u0131n\u0131rlama ile ula\u015f\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131n\u0131, orant\u0131l\u0131l\u0131k ise hakka getirilen s\u0131n\u0131rlama ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda makul bir dengenin g\u00f6zetilmesi gereklili\u011fini ifade etmektedir.<\/p>\n<p>25. B\u00f6lge idare mahkemelerinin baz\u0131 kararlar\u0131na kesin h\u00fck\u00fcm niteli\u011fi tan\u0131nmas\u0131 ve bu kararlara kar\u015f\u0131 temyiz yolunun kapat\u0131lmas\u0131 makul s\u00fcrede yarg\u0131lanma hakk\u0131 ve usul ekonomisinin gereklerinin yerine getirilmesi i\u00e7in al\u0131nan tedbirler olarak de\u011ferlendirilebilir. Bu itibarla s\u0131n\u0131rlaman\u0131n, belirtilen anayasal ama\u00e7lara ula\u015fmak bak\u0131m\u0131ndan elveri\u015fli olmad\u0131\u011f\u0131 s\u00f6ylenemez (benzer y\u00f6nde bkz. AYM, E.2022\/135, K.2023\/30, 16\/2\/2023, \u00a7 35).<\/p>\n<p>26. \u0130kinci olarak belirtilen arac\u0131n gerekli olup olmad\u0131\u011f\u0131 incelenmelidir. Gereklilik, hedeflenen amaca ula\u015f\u0131lmas\u0131 i\u00e7in hakka en az m\u00fcdahale te\u015fkil eden arac\u0131n se\u00e7ilmesini ifade etmektedir. Yarg\u0131 mercilerinin i\u015f y\u00fck\u00fcn\u00fcn hafifletilmesi amac\u0131yla hangi tedbirlerin gerekli oldu\u011funun de\u011ferlendirilmesinde kanun koyucu geni\u015f takdir yetkisine sahiptir.<\/p>\n<p>27. Bu bak\u0131mdan Dan\u0131\u015ftay\u0131n i\u015f y\u00fck\u00fcn\u00fcn hafifletilmesi ve belirli bir \u00f6nem derecesine sahip olmayan davalar\u0131n makul s\u00fcrede g\u00f6r\u00fclmesini sa\u011flayacak tedbirlerin al\u0131nmas\u0131, anayasal s\u0131n\u0131rlar i\u00e7inde kalmak \u015fart\u0131yla kanun koyucunun takdir yetkisi kapsam\u0131ndaki hususlardand\u0131r (AYM, E.2022\/135, K.2023\/30, 16\/2\/2023, \u00a7 35). Davalar\u0131n makul s\u00fcre i\u00e7inde ve daha az masrafla sonu\u00e7land\u0131r\u0131lmas\u0131 amac\u0131yla belirli bir \u00f6nem derecesini a\u015fmayan uyu\u015fmazl\u0131klara ili\u015fkin olarak b\u00f6lge idare mahkemesince verilen kararlar\u0131n kesin olmas\u0131n\u0131n \u00f6ng\u00f6r\u00fclmesi kural olarak h\u00fckm\u00fcn denetlenmesini talep hakk\u0131na ayk\u0131r\u0131l\u0131k te\u015fkil etmez (benzer y\u00f6nde bkz. AYM, E.2018\/71, K.2018\/118, 27\/12\/2018, \u00a7 30; E.2022\/135, K.2023\/30, 16\/02\/2023, \u00a7 32).<\/p>\n<p>28. Bununla birlikte kuralla, Kanun\u2019un 46. maddesi d\u0131\u015f\u0131nda kalan uyu\u015fmazl\u0131klara ili\u015fkin davalar\u0131n tamam\u0131 bak\u0131m\u0131ndan b\u00f6lge idare mahkemesi kararlar\u0131n\u0131n kesin oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131ndan temyiz yolu kapal\u0131 olan konularda b\u00f6lge idare mahkemesince istinaf ba\u015fvurusu kabul edilerek ilk derece mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131 ve i\u015fin esas\u0131 hakk\u0131nda yeni bir karar verilmesi h\u00e2linde b\u00f6lge idare mahkemesinin ilk elden verdi\u011fi bu karara kar\u015f\u0131 temyiz kanun yoluna ba\u015fvurulamamas\u0131 h\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131na ayk\u0131r\u0131l\u0131k te\u015fkil edebilir. Zira konusu 46. maddede belirtilen uyu\u015fmazl\u0131klardan olmayan davalar\u0131n tamam\u0131 bak\u0131m\u0131ndan b\u00f6lge idare mahkemesince verilen esasa ili\u015fkin bir karar\u0131n gerek hukuk aleminde gerekse ilgili bak\u0131m\u0131ndan yarataca\u011f\u0131 sonucun t\u00fcm\u00fcyle \u00f6nemsiz oldu\u011fu s\u00f6ylenemez. Kural ise istinaf merciinin bu t\u00fcr bir karar\u0131n\u0131n yarataca\u011f\u0131 sonu\u00e7lar\u0131n \u00f6nemi g\u00f6zetilerek uyu\u015fmazl\u0131\u011fa ili\u015fkin temyiz incelemesinin gerekli olup olmad\u0131\u011f\u0131 noktas\u0131nda herhangi bir de\u011ferlendirme yap\u0131lmas\u0131na imk\u00e2n vermeksizin temyiz kanun yolunu kapatmaktad\u0131r.<\/p>\n<p>29. \u00d6te yandan, 2577 say\u0131l\u0131 Kanun\u2019da 6545 say\u0131l\u0131 Kanun\u2019la yap\u0131lan de\u011fi\u015fikliklerin gerek\u00e7esinde de ifade edildi\u011fi \u00fczere belirli bir \u00f6nem derecesine sahip uyu\u015fmazl\u0131klara ili\u015fkin b\u00f6lge idare mahkemelerinin kararlar\u0131na kar\u015f\u0131 temyiz yolunun a\u00e7\u0131k tutulmas\u0131, bu t\u00fcr bir \u00f6neme sahip olmayan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan verilen kararlar\u0131n ise kesin olmas\u0131 \u00f6ng\u00f6r\u00fclmek suretiyle Dan\u0131\u015ftay\u0131n i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131 ve b\u00f6ylece temyize tabi uyu\u015fmazl\u0131klar ile istinaf a\u015famas\u0131nda kesinle\u015fen uyu\u015fmazl\u0131klar\u0131n incelemesinin makul bir s\u00fcrede tamamlanmas\u0131, i\u015f y\u00fck\u00fcn\u00fcn hafifletilmesiyle de Dan\u0131\u015ftay\u0131n i\u00e7tihat mahkemesi rol\u00fcn\u00fcn g\u00fc\u00e7lendirilmesi ama\u00e7lanm\u0131\u015ft\u0131r. H\u00fckm\u00fcn denetlenmesini talep etme hakk\u0131na y\u00f6nelik bu t\u00fcr bir s\u0131n\u0131rlaman\u0131n, i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131na katk\u0131 sunaca\u011f\u0131 s\u00f6ylenebilir ise de Dan\u0131\u015ftay\u0131n bir i\u00e7tihat mahkemesi olma vasf\u0131n\u0131 geli\u015ftirecek nitelikte bir tedbir olmad\u0131\u011f\u0131 da a\u00e7\u0131kt\u0131r. Zira kanunlarda belirtilen belirli konular d\u0131\u015f\u0131ndaki uyu\u015fmazl\u0131klara ili\u015fkin olarak temyiz yolunun kapal\u0131 olmas\u0131, i\u00e7tihad\u0131n geli\u015fmesi ve \u00e7e\u015fitlenmesine hizmet etmeyece\u011fi gibi i\u00e7tihad\u0131n k\u0131s\u0131r bir alana hapsolmas\u0131na da neden olabilir.
