Zira d\u00fc\u015f\u00fcnce ve d\u00fc\u015f\u00fcnd\u00fcklerini ifade etme \u00f6zg\u00fcrl\u00fc\u011f\u00fc, hem yeni ve farkl\u0131 d\u00fc\u015f\u00fcncelerin ortaya \u00e7\u0131k\u00admas\u0131na olanak sa\u011flar, hem de bireylere farkl\u0131 d\u00fc\u015f\u00fcnceler aras\u0131nda se\u00e7im yapma ve yan\u0131 s\u0131ra kendi d\u00fc\u015f\u00fcncelerinin do\u011fru veya yanl\u0131\u015f oldu\u011funu s\u0131nama olana\u011f\u0131n\u0131 verir.<\/p>\n<p>Yine d\u00fc\u015f\u00fcnce ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn vazge\u00e7ilmez bir par\u00e7as\u0131 olan ele\u015ftiri hakk\u0131, demokratik hukuk dev\u00adletinde y\u00f6netilen konumundaki her bireyin sahip oldu\u011fu temel bir hakt\u0131r.<\/p>\n<p>Esasen ele\u015ftiri k\u00fclt\u00fcr\u00fcn\u00fc \u00f6z\u00fcmseyenler i\u00e7in ele\u015ftiri, hangi konumda olursa olsun ele\u015ftirilen ki\u015fi veya ki\u015filerin ki\u015filik haklar\u0131na kar\u015f\u0131 bir sald\u0131r\u0131 olmay\u0131p, o ki\u015fi ya da ki\u015fileri d\u00fczelmeye davet, ele\u015ftiriye a\u00e7\u0131k olmak ise, d\u00fczelmeyi kabul etmektir.<\/p>\n<p>O nedenle, her d\u00fczeyde kamusal yetki kullanan ki\u015filerin, yasan\u0131n ve kamuoyunun denetimine tabi ve sivil ele\u015ftirilere a\u00e7\u0131k olmas\u0131 gerekir.<\/p>\n<p>Ama her hak ve \u00f6zg\u00fcrl\u00fck gibi ele\u015ftiri hakk\u0131n\u0131n da ki\u015fili\u011fi hedef almamas\u0131, itibar suikast\u0131 yapmamas\u0131, sadece ki\u015filerin yapt\u0131klar\u0131n\u0131 veya yapmad\u0131klar\u0131n\u0131 hedef almas\u0131 ve bu \u00e7er\u00e7evede kullan\u0131lmas\u0131 gerekir.<\/p>\n<p>Y\u00fczy\u0131l\u0131m\u0131z\u0131n en \u00f6nemli ki\u015filerinden biri olan, ele\u015ftirmenlerce \u2018bug\u00fcn bizim i\u00e7in Galileo, Descartes, Newton, Mozart ya da Picasso ne anlam ta\u015f\u0131yorsa, gelecek y\u00fczy\u0131llar i\u00e7in de o anlam\u0131 ta\u015f\u0131yacakt\u0131r\u2019 de\u00adnilen ve halen ya\u015fayan insanlar i\u00e7inde eserlerinden en \u00e7ok al\u0131nt\u0131 yap\u0131lan ki\u015fi olan (Art and Humanities Citation Index\u2019te 1980 ile 1992 y\u0131llar\u0131 aras\u0131nda eserlerinden yap\u0131lan al\u0131nt\u0131 say\u0131s\u0131 4000 olarak verilmektedir), Marx\u2019\u0131 ve Freud\u2019u da i\u00e7eren, b\u00fct\u00fcn zamanlar\u0131n en \u00e7ok al\u0131nt\u0131 yap\u0131lan ki\u015fileri listesinde sekizinci s\u0131rada yer alan, dilbilim, felsefe, politika, bili\u015fsel bilimler ve psikolojinin de i\u00e7inde bulundu\u011fu \u00e7e\u015fitli konularda yetmi\u015fi a\u015fk\u0131n kitap ve bini a\u015fk\u0131n makale yay\u0131mlayan Amerikal\u0131 d\u00fc\u015f\u00fcn\u00fcr Noam Chomsky, \u2018susturucu gerek\u00e7eler ya da insanlar\u0131 yaln\u0131zca birilerinin duymak istemedikleri \u015feyleri s\u00f6yledikleri i\u00e7in susturman\u0131n yanl\u0131\u015f oldu\u011funa\u2019 i\u015faret ediyor ve devamla \u015f\u00f6yle diyor; \u2018Hi\u00e7 kimsenin hi\u00e7bir \u015feye izin verme yetkisi olmamal\u0131d\u0131r ve -en \u00f6nemlisi- ben serbest ifadeye izin verme nedeninin, yararl\u0131 ya da de\u00ad\u011ferli \u015feylerin bast\u0131r\u0131labilece\u011fi endi\u015fesi oldu\u011funu \u00f6ne s\u00fcrm\u00fcyorum. Esasen bana g\u00f6re bu tiksindirici bir tutumdur. Ancak ben \u00e7ok \u00f6n\u00adceleri \u00f6zg\u00fcrl\u00fck\u00e7\u00fc denen insanlar\u0131n standart tutumunun bu oldu\u011funu da biliyorum.\u2019<\/p>\n<p>Noam Chomsky\u2019nin ismini telaffuz etmeden, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc fayda temelinde savundu\u011fu i\u00e7in ele\u015ftirdi\u011fi John Stuart Mill ise, hen\u00fcz a\u015f\u0131lamam\u0131\u015f olan 1859 y\u0131l\u0131nda yazd\u0131\u011f\u0131 \u2018\u00d6zg\u00fcrl\u00fck \u00dcst\u00fcne\u2019 isimli abidevi eserinin merkezini olu\u015fturan fikir ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc konusunda \u2018bir fikrin susturulmas\u0131n\u0131n, fikri susturulan insandan \u00e7ok insan cinsine, ya\u015fayan nesle oldu\u011fu kadar gelecek nesillere kar\u015f\u0131 da hay\u00addutluk oldu\u011funa\u2019 i\u015faret ediyor ve devamla \u015f\u00f6yle diyor; \u2018\u015eayet bir teki hari\u00e7 b\u00fct\u00fcn insanlar ayn\u0131 fikirde olsalar ve yaln\u0131z bir ki\u015fi muhalif fikirde olsa, nas\u0131l bir \u015fahs\u0131n, elinde kuvvet olsa, insanlar\u0131 susturmaya hakk\u0131 yoksa, insanlar\u0131n da bu tek ki\u015fiyi susturmaya daha fazla haklar\u0131 yoktur.\u2019<\/p>\n<p>Di\u011fer taraftan Avrupa \u0130nsan Haklar\u0131 Mahkemesi, Fressoz &amp; Roire v.France\/1999 ve TBKP v. Turkey\/1998 kararlar\u0131nda \u2018\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile bunun bir par\u00e7as\u0131 olan ele\u015ftiri hakk\u0131, demokratik bir toplu\u00admun temellerindendir. S\u00f6zle\u015fmenin 10. maddesinin 2. f\u0131kras\u0131n\u0131n ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc i\u00e7in getirdi\u011fi g\u00fcvence, sadece uygun bulunan, benimsenen ve rahats\u0131zl\u0131k duyulmayan yahut kay\u0131ts\u0131z kal\u0131nan bilgi ve\/veya fikirler i\u00e7in de\u011fil, ayn\u0131 zamanda rahats\u0131z edici, sars\u0131c\u0131 ve\/veya alt\u00fcst edici bilgi ve fikirler i\u00e7in de ge\u00e7erlidir. Zira biz ele\u015ftirilerden ders almak ve yararlanmak yerine dalkavuklara itibar ediyoruz ve dedikodu ile tezvirat yapmay\u0131 daha \u00e7ok seviyoruz.
