Giri\u015f<\/p>\n<p>Ceza adalet sisteminde baz\u0131 su\u00e7lar\u0131n mahkeme \u00f6n\u00fcne gitmeden \u00e7\u00f6z\u00fclebilmesi, hem yarg\u0131 s\u00fcre\u00e7lerinin h\u0131zlanmas\u0131 hem de taraflar aras\u0131nda toplumsal bar\u0131\u015f\u0131n tesisi a\u00e7\u0131s\u0131ndan \u00f6nem ta\u015f\u0131maktad\u0131r. Bu ama\u00e7la geli\u015ftirilen \u00f6n\u00f6deme ve uzla\u015ft\u0131rma gibi kurumlar, tabiri caiz ise failin uzun ve yorucu yarg\u0131lama stresi alt\u0131na girmeksizin ceza almadan dosyan\u0131n kapat\u0131lmas\u0131na imk\u00e2n tan\u0131maktad\u0131r. Ancak bu t\u00fcr alternatif \u00e7\u00f6z\u00fcm yollar\u0131, uygulamada her zaman amac\u0131na uygun \u015fekilde i\u015flememektedir. \u00d6zellikle hakaret su\u00e7una ili\u015fkin soru\u015fturmalarda, son y\u0131llarda dikkat \u00e7eken bir uygulama \u015fekli ortaya \u00e7\u0131km\u0131\u015ft\u0131r. \u015e\u00f6yle ki:<\/p>\n<p>Sosyal medya gibi a\u00e7\u0131k dijital platformlarda, kas\u0131tl\u0131 olarak kamuoyunu tahrik eden a\u00e7\u0131klamalar yapan ki\u015filer, bu yolla kendilerine hakaret edilmesini adeta te\u015fvik eder h\u00e2le gelmi\u015ftir. Ard\u0131ndan, hakarete u\u011frad\u0131klar\u0131 gerek\u00e7esiyle \u015fik\u00e2yet\u00e7i olarak s\u00fcrece dahil olmu\u015f ve \u201cma\u011fdur\u201d s\u0131fat\u0131yla uzla\u015ft\u0131rma g\u00f6r\u00fc\u015fmelerine kat\u0131lm\u0131\u015flard\u0131r. Uzla\u015ft\u0131rma sisteminde ma\u011fdurun failden maddi talepte bulunabilmesi, bu s\u00fcreci baz\u0131 ki\u015filer i\u00e7in gelir kap\u0131s\u0131na d\u00f6n\u00fc\u015ft\u00fcrm\u00fc\u015ft\u00fcr. B\u00f6yle bir uygulama prati\u011fi, uzla\u015ft\u0131rman\u0131n, ceza muhakemesinde ma\u011fdur odakl\u0131 \u00e7\u00f6z\u00fcm anlay\u0131\u015f\u0131 \u00e7er\u00e7evesindeki konumundan saparak, ki\u015fisel menfaatlerin ara\u00e7salla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 ve kamu g\u00fcc\u00fcn\u00fcn dolayl\u0131 yoldan kullan\u0131ld\u0131\u011f\u0131 bir alana d\u00f6n\u00fc\u015fmesine neden olmu\u015ftur. S\u00f6z konusu \u00f6rneklerin yayg\u0131nla\u015fmas\u0131, kamuoyunda ve hukuk \u00e7evrelerinde, uzla\u015ft\u0131rma kurumunun temel i\u015flevinden sapt\u0131\u011f\u0131 y\u00f6n\u00fcnde ele\u015ftirilere yol a\u00e7m\u0131\u015ft\u0131r. 7531 say\u0131l\u0131 Kanun ile \u00f6n\u00f6deme kapsam\u0131 geni\u015fletilmi\u015f, uzla\u015ft\u0131rma ise zikredilen su\u00e7lar bak\u0131m\u0131ndan kurumun d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u00c7al\u0131\u015fmam\u0131zda, iptale konu d\u00fczenlemelerin kanun sistemati\u011fi i\u00e7indeki yerini, hukuk\u00ee ba\u011flam\u0131n\u0131, Anayasa Mahkemesi\u2019nin kararlar\u0131nda dayand\u0131\u011f\u0131 gerek\u00e7eleri ve bu gerek\u00e7eler do\u011frultusunda ortaya \u00e7\u0131kan sonu\u00e7lar\u0131 inceleyece\u011fiz.<\/p>\n<p> II.  \u00d6n\u00f6deme Kurumunun Hukuk\u00ee Niteli\u011fi ve 7531 Say\u0131l\u0131 Kanun\u2019la Getirilen De\u011fi\u015fiklikler<\/p>\n<p>\u00d6n\u00f6deme, genel olarak yaln\u0131zca adl\u00ee para cezas\u0131n\u0131 gerektiren veya hapis cezas\u0131n\u0131n \u00fcst s\u0131n\u0131r\u0131 alt\u0131 ay\u0131 ge\u00e7meyen su\u00e7lar bak\u0131m\u0131ndan, kamu davas\u0131 a\u00e7\u0131lmadan \u00f6nce ya da kovu\u015fturma evresinde, failin kanunda g\u00f6sterilen usulle \u00f6deme yapmas\u0131 h\u00e2linde dosyan\u0131n d\u00fc\u015fmesine imk\u00e2n tan\u0131r. Bu kurum, klasik ceza muhakemesi i\u015fleyi\u015finden sapma anlam\u0131na gelse de, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 75. maddesinde tan\u0131mlanm\u0131\u015f ve sistemin istisnai bir unsuru olarak yasal bir zemine kavu\u015fturulmu\u015ftur. \u00d6n\u00f6deme kurumu ile kamu davas\u0131 a\u00e7\u0131lmas\u0131 veya a\u00e7\u0131lm\u0131\u015fsa devam etmesi ihtiyac\u0131 ortadan kalkmakta; dosya, yarg\u0131lamaya konu edilmeksizin sonu\u00e7land\u0131r\u0131lmas\u0131 ama\u00e7lanmaktad\u0131r. Nitekim, T\u00fcrk ceza muhakemesi sisteminde, su\u00e7un i\u015flendi\u011fi y\u00f6n\u00fcnde yeterli \u015f\u00fcphe olu\u015ftu\u011funda kamu davas\u0131 a\u00e7\u0131lmas\u0131 genel bir y\u00fck\u00fcml\u00fcl\u00fck olarak d\u00fczenlenmi\u015ftir. Ancak 5237 say\u0131l\u0131 Kanun\u2019un 75. maddesinde \u00f6ng\u00f6r\u00fclen \u00f6n\u00f6deme kurumu, ismen say\u0131lan su\u00e7 tipleri bak\u0131m\u0131ndan bu s\u00fcrecin ceza yarg\u0131lamas\u0131na ta\u015f\u0131nmadan sona erdirilmesine imk\u00e2n tan\u0131maktad\u0131r. Cumhuriyet savc\u0131s\u0131,  \u015fartlar ger\u00e7ekle\u015fti\u011finde fail hakk\u0131nda \u00f6n\u00f6deme teklifinde bulunur; failin \u00f6deme yapmas\u0131 durumunda kamu davas\u0131 a\u00e7\u0131lmaz. Yarg\u0131lama s\u00fcreci bu suretle sona ererken, \u00f6deme yap\u0131lmamas\u0131 h\u00e2linde soru\u015fturma devam eder. \u00d6n\u00f6demenin uzla\u015ft\u0131rmadan ayr\u0131ld\u0131\u011f\u0131 temel noktalar a\u00e7\u0131kt\u0131r. Ba\u015fka bir deyi\u015fle, \u00f6n\u00f6deme, devlet ile fail aras\u0131nda kurulan ve yaln\u0131zca madd\u00ee \u00f6deme ile sonu\u00e7lanan bir ili\u015fkidir. Uzla\u015ft\u0131rma ise fail ile ma\u011fdur aras\u0131nda y\u00fcr\u00fct\u00fclen, kar\u015f\u0131l\u0131kl\u0131 anla\u015fmay\u0131 gerektiren bir s\u00fcre\u00e7tir. Uzla\u015ft\u0131rmada ma\u011fdurun madd\u00ee bir edim talep etme imk\u00e2n\u0131 vard\u0131r; \u00f6n\u00f6demede b\u00f6yle bir hak tan\u0131nmam\u0131\u015ft\u0131r. Ayr\u0131ca uzla\u015ft\u0131rma, taraflar aras\u0131nda m\u00fczakereyi ve dolay\u0131s\u0131yla bir t\u00fcr ileti\u015fimi zorunlu k\u0131larken, \u00f6n\u00f6deme teknik ve tek tarafl\u0131 bir mekanizmad\u0131r. S\u00fcre\u00e7lerin sonu\u00e7lar\u0131 bak\u0131m\u0131ndan da fark g\u00f6zetilmelidir: Uzla\u015fman\u0131n sa\u011flanmas\u0131 kamu davas\u0131n\u0131n a\u00e7\u0131lmamas\u0131na yol a\u00e7arken, \u00f6n\u00f6deme yap\u0131lmazsa yarg\u0131lama s\u00fcreci i\u015flemeye devam eder.<\/p>\n<p>7531 say\u0131l\u0131 Kanun\u2019un 15. maddesiyle, TCK m.75\u2019in alt\u0131nc\u0131 f\u0131kras\u0131n\u0131n (a) bendine (2) numaral\u0131 alt bent eklenmi\u015ftir. Bu bentte, TCK m.125\u2019in ikinci f\u0131kras\u0131, \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (b) ve (c) bentleri ile d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda tan\u0131mlanan hakaret su\u00e7lar\u0131n\u0131n da \u00f6n\u00f6deme kapsam\u0131na al\u0131nd\u0131\u011f\u0131 kanunla\u015fm\u0131\u015ft\u0131r. Ayn\u0131 maddenin birinci f\u0131kras\u0131 ile \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (a) bendinde yer alan h\u00fck\u00fcmler bu kapsam\u0131n d\u0131\u015f\u0131ndad\u0131r. Buna paralel olarak, CMK m.253\/3\u2019te yap\u0131lan de\u011fi\u015fiklikle, bu bentte belirtilen hakaret su\u00e7lar\u0131n\u0131n uzla\u015ft\u0131rma d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. B\u00f6ylece baz\u0131 su\u00e7 tipleri bak\u0131m\u0131ndan uzla\u015ft\u0131rma yerine \u00f6n\u00f6deme usul\u00fc uygulanabilir h\u00e2le gelmi\u015ftir. \u00d6n\u00f6deme yap\u0131lmas\u0131 h\u00e2linde kamu davas\u0131 a\u00e7\u0131lmaz; a\u00e7\u0131lm\u0131\u015fsa d\u00fc\u015fer. Failin devlete \u00f6deme yapmas\u0131 yeterlidir. Ma\u011fdurun r\u0131zas\u0131 aranmaz. Uzla\u015ft\u0131rma uygulamas\u0131nda ise taraflar\u0131n anla\u015fmas\u0131 ve edim \u00fczerinde uzla\u015fmas\u0131 esast\u0131r. Bununla birlikte CMK\u2019ya eklenen ge\u00e7ici 7. madde ile bu d\u00fczenlemelerin yaln\u0131zca y\u00fcr\u00fcrl\u00fck tarihinden sonraki soru\u015fturma ve kovu\u015fturmalara uygulanaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>III.  Anayasa Mahkemesi\u2019nin 27\/3\/2025 Tarihli Karar\u0131n\u0131n Gerek\u00e7eleri ve De\u011ferlendirmesi<\/p>\n<p>Anayasa Mahkemesi\u2019nin 27\/3\/2025 tarihli ve E.2024\/197, K.2025\/86 say\u0131l\u0131 karar\u0131nda iptali talep edilen ilk h\u00fck\u00fcm, 7531 say\u0131l\u0131 Kanun\u2019un 15. maddesiyle, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 75. maddesinin alt\u0131nc\u0131 f\u0131kras\u0131n\u0131n (a) bendine eklenen (2) numaral\u0131 alt bentte yer alan: \u201c\u2026 ikinci f\u0131kras\u0131, \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (b) ve (c) bentleri ve d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 \u2026\u201d ibaresidir. An\u0131lan d\u00fczenleme ile TCK m.125 kapsam\u0131ndaki baz\u0131 hakaret su\u00e7lar\u0131 \u00f6n\u00f6deme kapsam\u0131na al\u0131nm\u0131\u015ft\u0131r. \u0130kinci norm, ayn\u0131 Kanun\u2019un 18. maddesiyle 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu\u2019na eklenen ge\u00e7ici 7. maddenin ikinci f\u0131kras\u0131d\u0131r. \u0130lgili f\u0131kra \u015f\u00f6yledir: \u201cBu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih itibar\u0131yla soru\u015fturma veya kovu\u015fturma evresinde bulunan dosyalar bak\u0131m\u0131ndan bu maddeyi ihdas eden Kanunla 253 \u00fcnc\u00fc maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda yap\u0131lan de\u011fi\u015fiklik ve 5237 say\u0131l\u0131 Kanunun 75 inci maddesinin alt\u0131nc\u0131 f\u0131kras\u0131nda yap\u0131lan de\u011fi\u015fiklik uygulanmaz. Bu dosyalar, 253 \u00fcnc\u00fc maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n de\u011fi\u015fiklikten \u00f6nceki h\u00fck\u00fcmlerine g\u00f6re sonu\u00e7land\u0131r\u0131l\u0131r.\u201d \u0130tiraz yoluna ba\u015fvuran mahkemeler ile iptal davas\u0131 a\u00e7an milletvekillerince, \u00f6n\u00f6deme kapsam\u0131na al\u0131nan hakaret su\u00e7u t\u00fcrleri aras\u0131nda yap\u0131lan ayr\u0131m\u0131n, benzer hukuki konumda olan ki\u015filere farkl\u0131 muameleye yol a\u00e7t\u0131\u011f\u0131; ge\u00e7ici maddenin ikinci f\u0131kras\u0131n\u0131n ise e\u015fit konumda bulunan yarg\u0131lamalara farkl\u0131 hukuk kurallar\u0131 uygulanmas\u0131na neden oldu\u011fu belirtilmi\u015ftir. Her iki h\u00fckm\u00fcn Anayasa\u2019n\u0131n 2. ve 10. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>Anayasa Mahkemesi, karar\u0131nda Anayasa\u2019n\u0131n 2. maddesinde yer alan hukuk devleti ilkesi, 10. maddesindeki kanun \u00f6n\u00fcnde e\u015fitlik ilkesi ve 38. maddesindeki aleyhe kanunun geriye y\u00fcr\u00fcme yasa\u011f\u0131 ilkelerine at\u0131f yapm\u0131\u015ft\u0131r. TCK m.75\/6-a-2 h\u00fckm\u00fc bak\u0131m\u0131ndan, su\u00e7un i\u015fleni\u015f bi\u00e7imi esas al\u0131narak \u00f6n\u00f6deme kapsam\u0131n\u0131n belirlenmesinin, benzer hukuki konumdaki ki\u015filer aras\u0131nda farkl\u0131 sonu\u00e7lara yol a\u00e7t\u0131\u011f\u0131na kanaat getirilmi\u015ftir. Mahkeme, hakaret su\u00e7unun ma\u011fduru muhatap alan sesli, yaz\u0131l\u0131 veya g\u00f6r\u00fcnt\u00fcl\u00fc iletiyle i\u015flenmesi h\u00e2lini d\u00fczenleyen TCK m.125\/2, nitelikli halleri i\u00e7eren m.125\/3-(b) ve (c) bentleri ile aleniyet unsurunu bar\u0131nd\u0131ran m.125\/4 h\u00fck\u00fcmlerinin \u00f6n\u00f6deme kapsam\u0131na al\u0131nm\u0131\u015f olmas\u0131na kar\u015f\u0131n, su\u00e7un do\u011frudan huzurda ya da kamu g\u00f6revlisine kar\u015f\u0131 i\u015flenmesi halleri kapsam d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131\u011f\u0131ndan, e\u015fitlik ilkesi bak\u0131m\u0131ndan farkl\u0131 muamele olu\u015ftu\u011fu de\u011ferlendirmesini yapm\u0131\u015ft\u0131r. Bu farkl\u0131l\u0131\u011f\u0131n nesnel ve makul bir temele dayanmad\u0131\u011f\u0131, benzer hukuki konumda olan ki\u015filer aras\u0131nda ayr\u0131mc\u0131l\u0131\u011fa neden oldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Bununla birlikte, CMK\u2019ya eklenen ge\u00e7ici 7. madde y\u00f6n\u00fcnden ise, ayn\u0131 su\u00e7a ili\u015fkin olup yaln\u0131zca y\u00fcr\u00fcrl\u00fck tarihine g\u00f6re ayr\u0131lan dosyalar aras\u0131nda farkl\u0131 usuller uygulanmas\u0131n\u0131n, \u00f6ng\u00f6r\u00fclebilirlik ve e\u015fitlik ilkelerine ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011fu kanaatine var\u0131lm\u0131\u015ft\u0131r. Mahkeme, ayn\u0131 normun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce ba\u015flat\u0131lm\u0131\u015f dosyalar bak\u0131m\u0131ndan uygulanmamas\u0131n\u0131, benzer konumda olan \u015f\u00fcpheli veya san\u0131klar aras\u0131nda farkl\u0131 sonu\u00e7lar do\u011furdu\u011fu gerek\u00e7esiyle Anayasa\u2019ya ayk\u0131r\u0131 bulmu\u015ftur. Mezkur d\u00fczenlemenin a\u00e7\u0131k\u00e7a geriye etkili olmamas\u0131 ve bu nedenle ge\u00e7mi\u015fte a\u00e7\u0131lm\u0131\u015f dosyalarda \u00f6nceki h\u00fck\u00fcmlerin uygulanmaya devam etmesinin, hem kanun \u00f6n\u00fcnde e\u015fitlik ilkesine hem de hukuk devleti ilkesinin gere\u011fi olan hukuki g\u00fcvenlik ve belirlilik ilkelerine zarar verdi\u011fi belirtilmi\u015ftir. Bu husus bizce k\u0131ymetlidir. \u015e\u00f6yle ki, Anayasa Mahkemesi\u2019nin iptal gerek\u00e7elerinde, normun \u201cgenel ve soyut yap\u0131\u201d ta\u015f\u0131mas\u0131 gerekti\u011fi vurgulanm\u0131\u015ft\u0131r. Su\u00e7un i\u015fleni\u015f bi\u00e7imine g\u00f6re \u00f6n\u00f6deme hakk\u0131n\u0131n tan\u0131n\u0131p tan\u0131nmamas\u0131 aras\u0131nda ayr\u0131m yap\u0131lmas\u0131, failin hukuki durumunu nesnel olmayan k\u0131staslara g\u00f6re \u015fekillendirmi\u015ftir. Kararda, benzer hukuki durumda bulunan ki\u015filerin e\u015fit muamele g\u00f6rmesi gerekti\u011fi vurgulanm\u0131\u015f, hukuki sonu\u00e7lar\u0131n ki\u015fisel ko\u015fullara veya takdiri de\u011ferlendirmelere b\u0131rak\u0131lmas\u0131n\u0131n \u00f6nlenmesi gerekti\u011fi ifade edilmi\u015ftir. CMK ge\u00e7ici 7. madde kapsam\u0131nda, ayn\u0131 su\u00e7tan yarg\u0131lanan ki\u015filere yaln\u0131zca yarg\u0131laman\u0131n ba\u015flat\u0131lma tarihine g\u00f6re yarg\u0131laman\u0131n sac aya\u011f\u0131 olan avukatlar\u0131n, hakimin, Cumhuriyet savc\u0131s\u0131n\u0131n \u00e7al\u0131\u015fkanl\u0131k durumlar\u0131na g\u00f6re farkl\u0131 normlar\u0131n uygulanmas\u0131, y\u00fcksek mahkemece kabul edilebilir bir farkl\u0131l\u0131k olarak de\u011ferlendirilmemi\u015ftir. Sistemde do\u011fan ayr\u0131\u015ft\u0131r\u0131c\u0131 etki, ceza muhakemesi s\u00fcrecinde failin yarg\u0131lamaya tabi olup olmamas\u0131n\u0131n su\u00e7un i\u015fleni\u015f bi\u00e7imi ve soru\u015fturma tarihine g\u00f6re \u015fekillenmesi sonucunu do\u011furmu\u015ftur. Tabiki de bu husus, hukuk devletinin temel ilkelerinden olan e\u015fitlik anlay\u0131\u015f\u0131 ile ba\u011fda\u015fmamaktad\u0131r.<\/p>\n<p>IV. Anayasa Mahkemesi Karar\u0131n\u0131n Normatif ve Uygulama Boyutlu Sonu\u00e7lar\u0131<\/p>\n<p>Anayasa Mahkemesi\u2019nin 27\/3\/2025 tarihli ve E.2024\/197, K.2025\/86 say\u0131l\u0131 karar\u0131yla iptal edilen h\u00fck\u00fcmler, \u00f6n\u00f6deme kurumunun uygulama alan\u0131n\u0131 TCK m.125 kapsam\u0131ndaki baz\u0131 hakaret fiillerini i\u00e7erecek \u015fekilde geni\u015fletmekteydi. Bu geni\u015fleme, ceza yarg\u0131lamas\u0131nda alternatif \u00e7\u00f6z\u00fcm yollar\u0131n\u0131n etkinle\u015ftirilmesi amac\u0131yla yap\u0131lsa da, e\u015fitlik ilkesinin yap\u0131sal anlamda g\u00f6z ard\u0131 edilmesine yol a\u00e7m\u0131\u015ft\u0131r. Mahkeme, \u00f6zellikle su\u00e7un i\u015fleni\u015f bi\u00e7imine g\u00f6re failin farkl\u0131 usullere tabi tutulmas\u0131n\u0131n, normlar\u0131n genel ve soyut olmas\u0131 gerekti\u011fine dair anayasal ilkeyle ba\u011fda\u015fmad\u0131\u011f\u0131n\u0131 vurgulam\u0131\u015ft\u0131r. Karar\u0131n dikkat \u00e7eken y\u00f6nlerinden biri de, su\u00e7un temel bi\u00e7imi ile nitelikli halleri aras\u0131nda kurulan uygulama farkl\u0131l\u0131\u011f\u0131n\u0131n ters y\u00f6nl\u00fc bir etki do\u011furmas\u0131n\u0131n ifade edili\u015fidir. Nitekim, TCK m.125\u2019in ikinci, \u00fc\u00e7\u00fcnc\u00fc (b) ve (c) bentleri ile d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda tan\u0131mlanan nitelikli hakaret fiilleri \u00f6n\u00f6deme kapsam\u0131na al\u0131n\u0131rken, ayn\u0131 maddenin birinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (a) bendi kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r. S\u00f6z konusu husus, ceza yarg\u0131lamas\u0131 ilkelerinden olan orant\u0131l\u0131l\u0131k ve \u00f6l\u00e7\u00fcl\u00fcl\u00fckle \u00e7eli\u015fmektedir. Zira daha a\u011f\u0131r nitelikli fiillere k\u0131yasen fail lehine sonu\u00e7 do\u011furan bir usul uygulan\u0131rken, daha hafif fiillerde bu imk\u00e2n\u0131n tan\u0131nmamas\u0131, failin hukuki durumunu a\u011f\u0131rla\u015ft\u0131rmakta ve tutars\u0131zl\u0131k yaratmaktad\u0131r. Benzer bir e\u015fitsizlik sorunu, CMK\u2019ya eklenen ge\u00e7ici 7. maddenin ikinci f\u0131kras\u0131nda ortaya \u00e7\u0131kmaktad\u0131r. Yukar\u0131da belirtildi\u011fi gibi, ayn\u0131 su\u00e7a ili\u015fkin dosyalar\u0131n yaln\u0131zca yarg\u0131lama evresine ge\u00e7i\u015f tarihine g\u00f6re farkl\u0131 usullere tabi tutulmas\u0131, yarg\u0131 sisteminde \u00f6znel fakt\u00f6rlerin belirleyici h\u00e2le gelmesine neden olmu\u015ftur. Say\u0131lan bu tarih\u00ee farkl\u0131l\u0131k, yarg\u0131lamaya hangi g\u00fcn, hangi savc\u0131 ya da mahkeme taraf\u0131ndan ba\u015fland\u0131\u011f\u0131na g\u00f6re de\u011fi\u015febilmekte; neticede ayn\u0131 hukuki durumda bulunan ki\u015filere farkl\u0131 sonu\u00e7lar do\u011furabilmektedir. Soru\u015fturman\u0131n ne zaman ba\u015flat\u0131ld\u0131\u011f\u0131, g\u00f6revli ki\u015finin i\u015f y\u00fck\u00fc, dosya yo\u011funlu\u011fu yahut uygulama prati\u011fi gibi d\u0131\u015fsal fakt\u00f6rlerin hukuk\u00ee sonuca etkili olmas\u0131, ceza muhakemesinde hem e\u015fitlik ilkesini hem de hukuki g\u00fcvenli\u011fi zedelemektedir.<\/p>\n<p>T\u00fcm bu de\u011ferlendirmeler \u0131\u015f\u0131\u011f\u0131nda, \u00f6n\u00f6deme kurumunun TCK m.125 kapsam\u0131nda yeniden yap\u0131land\u0131r\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r. \u00d6n\u00f6deme, do\u011fas\u0131 gere\u011fi fail lehine sonu\u00e7 do\u011furan bir kurumdur ve ceza siyaseti bak\u0131m\u0131ndan ayn\u0131 su\u00e7 tipinin daha hafif eylemleri i\u00e7in de \u00f6ng\u00f6r\u00fclebilir, etkili ve eri\u015filebilir olmal\u0131d\u0131r. Mevcut haliyle uygulama, daha a\u011f\u0131r fiilleri kapsarken daha hafif eylemleri kapsam d\u0131\u015f\u0131 b\u0131rakarak, ceza sisteminde ters y\u00f6nl\u00fc bir ayr\u0131cal\u0131k yaratmaktad\u0131r. Kapsam\u0131n nitelikli fiillerle s\u0131n\u0131rl\u0131 tutulmas\u0131, failin eylem niteli\u011fine g\u00f6re de\u011fil, kanuni d\u00fczenlemelerdeki se\u00e7ici tercihlere g\u00f6re farkl\u0131 sonu\u00e7lara tabi tutulmas\u0131na yol a\u00e7maktad\u0131r. \u00d6te yandan, iptal karar\u0131n\u0131n 29 \u015eubat 2026 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek olmas\u0131, uygulay\u0131c\u0131lar a\u00e7\u0131s\u0131ndan ge\u00e7ici bir d\u00f6nemde mevcut h\u00fck\u00fcmlerin uygulanmaya devam edece\u011fi anlam\u0131na gelmesi gerekir. Bu s\u00fcre zarf\u0131nda Cumhuriyet savc\u0131lar\u0131, y\u00fcr\u00fcrl\u00fckteki d\u00fczenlemelere g\u00f6re hareket etmelidir. Ancak bu uygulama s\u00fcresi, ayn\u0131 zamanda yasa koyucu i\u00e7in de \u00f6nemlidir. Mesele, bir fiilin hangi usule tabi olaca\u011f\u0131 sorusundan ibaret de\u011fil. Daha \u00f6nemlisi, bu tercihlerin ceza adaletinin y\u00f6n\u00fcn\u00fc nereden nereye \u00e7evirdi\u011finde. \u00c7\u00fcnk\u00fc usul dedi\u011fimiz \u015fey bir y\u00f6ntemin \u00f6tesindedir. Anayasa Mahkemesi yerindelik denetimi yapmaz. Ama kimi zaman olur, normu iptal ederken bir dili, bir y\u00f6n\u00fc de i\u015faret edebilmektedir.<\/p>\n<p>V. Sonu\u00e7<\/p>\n<p>\u00c7al\u0131\u015fmam\u0131zda, hakaret su\u00e7unun ceza muhakemesi i\u00e7indeki konumunu; bu su\u00e7la ilgili soru\u015fturmalarda uzla\u015ft\u0131rma ve \u00f6n\u00f6deme kurumlar\u0131n\u0131n ne \u015fekilde uyguland\u0131\u011f\u0131n\u0131 ve bu yap\u0131n\u0131n hangi gerek\u00e7elerle de\u011fi\u015ftirildi\u011fini de\u011ferlendirdik. \u00d6zellikle sosyal medya ortamlar\u0131nda, kamuoyunu bilerek provoke eden a\u00e7\u0131klamalarla ba\u015flayan ve ard\u0131ndan uzla\u015ft\u0131rma s\u00fcrecinin maddi talepler \u00fczerinden istismar edilmesine uzanan \u00f6rnekler, meselenin norm sorununun \u00f6tesinde oldu\u011funu g\u00f6stermektedir. Bu kapsamda, 7531 say\u0131l\u0131 Kanun ile hakaret su\u00e7unun baz\u0131 halleri uzla\u015ft\u0131rma kapsam\u0131ndan \u00e7\u0131kar\u0131lm\u0131\u015f ve \u00f6n\u00f6deme kapsam\u0131na al\u0131narak ceza muhakemesi s\u00fcreci a\u00e7\u0131s\u0131ndan farkl\u0131 bir usul benimsenmi\u015ftir. Anayasa Mahkemesi&#8217;nin ilgili iptal kararlar\u0131, \u00f6n\u00f6deme kapsam\u0131n\u0131n belirlenmesinde su\u00e7un i\u015fleni\u015f bi\u00e7iminin esas al\u0131nmas\u0131n\u0131n, e\u015fitlik ilkesine ayk\u0131r\u0131 sonu\u00e7lar do\u011furdu\u011fu gerek\u00e7esine dayanmaktad\u0131r. Benzer \u015fekilde, yarg\u0131laman\u0131n ba\u015flang\u0131\u00e7 tarihine g\u00f6re farkl\u0131 hukuk kurallar\u0131n\u0131n uygulanmas\u0131n\u0131n da hukuk devleti ilkesini zedeledi\u011fi kanaatine var\u0131lm\u0131\u015ft\u0131r. Mahkeme&#8217;nin, e\u015fitlik ve hukuki g\u00fcvenlik ilkelerine yapt\u0131\u011f\u0131 vurgu yerinde olmakla birlikte, bu de\u011ferlendirmeler ayn\u0131 zamanda yasa koyucunun normatif tercihlerinde daha b\u00fct\u00fcnc\u00fcl bir yakla\u015f\u0131m benimsemesi gerekti\u011fini de g\u00f6stermektedir. Bu ba\u011flamda, yasa koyucu, \u00f6n\u00f6deme ve uzla\u015ft\u0131rma gibi kurumlar\u0131 d\u00fczenlerken hem faillerin hem de ma\u011fdurlar\u0131n konumunu g\u00f6zeten bir yakla\u015f\u0131m benimsemelidir. Ceza muhakemesi s\u00fcreci a\u00e7\u0131s\u0131ndan ise \u00f6ng\u00f6r\u00fclebilirlik ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkeleri temel al\u0131narak, yap\u0131sal b\u00fct\u00fcnl\u00fck sa\u011flanmal\u0131d\u0131r<\/p>\n<p>Sonu\u00e7 olarak, 29 May\u0131s 2025 tarihli Resm\u00ee Gazete\u2019de yay\u0131mlanan Anayasa Mahkemesi&#8217;nin 27\/3\/2025 tarihli iptal karar\u0131, ceza muhakemesi s\u00fcrecinde \u00f6n\u00f6deme ve uzla\u015ft\u0131rma kurumlar\u0131n\u0131n s\u0131n\u0131rlar\u0131n\u0131n belirlenmesinde, hukuk devleti ve e\u015fitlik ilkelerinin g\u00f6z ard\u0131 edilemeyece\u011fini vurgulam\u0131\u015ft\u0131r. 7531 say\u0131l\u0131 Kanun ile hakaret su\u00e7unun baz\u0131 halleri uzla\u015ft\u0131rma kapsam\u0131ndan \u00e7\u0131kar\u0131larak \u00f6n\u00f6deme kapsam\u0131na al\u0131nm\u0131\u015f; ancak bu de\u011fi\u015fiklik, benzer hukuki durumda bulunan ki\u015filer aras\u0131nda farkl\u0131 usuller uygulanmas\u0131na yol a\u00e7m\u0131\u015ft\u0131r. Mahkeme, benzer hukuki durumda bulunan ki\u015filer i\u00e7in farkl\u0131 usuller uygulanmas\u0131n\u0131n, hukuki g\u00fcvenlik ilkesini zedeledi\u011fini ve kanunlar\u0131n herkese e\u015fit ve genelle\u015ftirilebilir kurallar i\u00e7ermesi gerekti\u011fi y\u00f6n\u00fcndeki anayasal ilkeyle \u00e7eli\u015fti\u011fine h\u00fckmetmi\u015ftir. Karar\u0131n, ceza muhakemesinde alternatif \u00e7\u00f6z\u00fcm yollar\u0131na ili\u015fkin yasal d\u00fczenlemelerin, hukuki g\u00fcvenlik, e\u015fitlik ve kamu yarar\u0131 ilkeleri \u00e7er\u00e7evesinde yeniden g\u00f6zden ge\u00e7irilmesine olanak sa\u011flayacak bir tart\u0131\u015fma zemini olu\u015fturmas\u0131n\u0131 temenni ediyoruz.<\/p>\n<p>\u200bHakaret Su\u00e7unda Uzla\u015ft\u0131rmadan \u00d6n\u00f6deme Usul\u00fcne Ge\u00e7i\u015fin Hukuki De\u011ferlendirmesi: 7531 Say\u0131l\u0131 Kanun ve Anayasa Mahkemesi\u2019nin 27\/3\/2025 Tarihli, E.2024\/197, K.2025\/86 Say\u0131l\u0131 \u0130ptal Karar\u0131<\/p>\n<p>I. Giri\u015f<\/p>\n<p>Ceza adalet sisteminde baz\u0131 su\u00e7lar\u0131n mahkeme \u00f6n\u00fcne gitmeden \u00e7\u00f6z\u00fclebilmesi, hem yarg\u0131 s\u00fcre\u00e7lerinin h\u0131zlanmas\u0131 hem de taraflar aras\u0131nda toplumsal bar\u0131\u015f\u0131n tesisi a\u00e7\u0131s\u0131ndan \u00f6nem ta\u015f\u0131maktad\u0131r. Bu ama\u00e7la geli\u015ftirilen \u00f6n\u00f6deme ve uzla\u015ft\u0131rma gibi kurumlar, tabiri caiz ise failin uzun ve yorucu yarg\u0131lama stresi alt\u0131na girmeksizin ceza almadan dosyan\u0131n kapat\u0131lmas\u0131na imk\u00e2n tan\u0131maktad\u0131r. Ancak bu t\u00fcr alternatif \u00e7\u00f6z\u00fcm yollar\u0131, uygulamada her zaman amac\u0131na uygun \u015fekilde i\u015flememektedir. \u00d6zellikle hakaret su\u00e7una ili\u015fkin soru\u015fturmalarda, son y\u0131llarda dikkat \u00e7eken bir uygulama \u015fekli ortaya \u00e7\u0131km\u0131\u015ft\u0131r. \u015e\u00f6yle ki:<\/p>\n<p>Sosyal medya gibi a\u00e7\u0131k dijital platformlarda, kas\u0131tl\u0131 olarak kamuoyunu tahrik eden a\u00e7\u0131klamalar yapan ki\u015filer, bu yolla kendilerine hakaret edilmesini adeta te\u015fvik eder h\u00e2le gelmi\u015ftir. Ard\u0131ndan, hakarete u\u011frad\u0131klar\u0131 gerek\u00e7esiyle \u015fik\u00e2yet\u00e7i olarak s\u00fcrece dahil olmu\u015f ve \u201cma\u011fdur\u201d s\u0131fat\u0131yla uzla\u015ft\u0131rma g\u00f6r\u00fc\u015fmelerine kat\u0131lm\u0131\u015flard\u0131r. Uzla\u015ft\u0131rma sisteminde ma\u011fdurun failden maddi talepte bulunabilmesi, bu s\u00fcreci baz\u0131 ki\u015filer i\u00e7in gelir kap\u0131s\u0131na d\u00f6n\u00fc\u015ft\u00fcrm\u00fc\u015ft\u00fcr. B\u00f6yle bir uygulama prati\u011fi, uzla\u015ft\u0131rman\u0131n, ceza muhakemesinde ma\u011fdur odakl\u0131 \u00e7\u00f6z\u00fcm anlay\u0131\u015f\u0131 \u00e7er\u00e7evesindeki konumundan saparak, ki\u015fisel menfaatlerin ara\u00e7salla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 ve kamu g\u00fcc\u00fcn\u00fcn dolayl\u0131 yoldan kullan\u0131ld\u0131\u011f\u0131 bir alana d\u00f6n\u00fc\u015fmesine neden olmu\u015ftur. S\u00f6z konusu \u00f6rneklerin yayg\u0131nla\u015fmas\u0131, kamuoyunda ve hukuk \u00e7evrelerinde, uzla\u015ft\u0131rma kurumunun temel i\u015flevinden sapt\u0131\u011f\u0131 y\u00f6n\u00fcnde ele\u015ftirilere yol a\u00e7m\u0131\u015ft\u0131r. 7531 say\u0131l\u0131 Kanun ile \u00f6n\u00f6deme kapsam\u0131 geni\u015fletilmi\u015f, uzla\u015ft\u0131rma ise zikredilen su\u00e7lar bak\u0131m\u0131ndan kurumun d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u00c7al\u0131\u015fmam\u0131zda, iptale konu d\u00fczenlemelerin kanun sistemati\u011fi i\u00e7indeki yerini, hukuk\u00ee ba\u011flam\u0131n\u0131, Anayasa Mahkemesi\u2019nin kararlar\u0131nda dayand\u0131\u011f\u0131 gerek\u00e7eleri ve bu gerek\u00e7eler do\u011frultusunda ortaya \u00e7\u0131kan sonu\u00e7lar\u0131 inceleyece\u011fiz.<\/p>\n<p> II.  \u00d6n\u00f6deme Kurumunun Hukuk\u00ee Niteli\u011fi ve 7531 Say\u0131l\u0131 Kanun\u2019la Getirilen De\u011fi\u015fiklikler<\/p>\n<p>\u00d6n\u00f6deme, genel olarak yaln\u0131zca adl\u00ee para cezas\u0131n\u0131 gerektiren veya hapis cezas\u0131n\u0131n \u00fcst s\u0131n\u0131r\u0131 alt\u0131 ay\u0131 ge\u00e7meyen su\u00e7lar bak\u0131m\u0131ndan, kamu davas\u0131 a\u00e7\u0131lmadan \u00f6nce ya da kovu\u015fturma evresinde, failin kanunda g\u00f6sterilen usulle \u00f6deme yapmas\u0131 h\u00e2linde dosyan\u0131n d\u00fc\u015fmesine imk\u00e2n tan\u0131r. Bu kurum, klasik ceza muhakemesi i\u015fleyi\u015finden sapma anlam\u0131na gelse de, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 75. maddesinde tan\u0131mlanm\u0131\u015f ve sistemin istisnai bir unsuru olarak yasal bir zemine kavu\u015fturulmu\u015ftur. \u00d6n\u00f6deme kurumu ile kamu davas\u0131 a\u00e7\u0131lmas\u0131 veya a\u00e7\u0131lm\u0131\u015fsa devam etmesi ihtiyac\u0131 ortadan kalkmakta; dosya, yarg\u0131lamaya konu edilmeksizin sonu\u00e7land\u0131r\u0131lmas\u0131 ama\u00e7lanmaktad\u0131r. Nitekim, T\u00fcrk ceza muhakemesi sisteminde, su\u00e7un i\u015flendi\u011fi y\u00f6n\u00fcnde yeterli \u015f\u00fcphe olu\u015ftu\u011funda kamu davas\u0131 a\u00e7\u0131lmas\u0131 genel bir y\u00fck\u00fcml\u00fcl\u00fck olarak d\u00fczenlenmi\u015ftir. Ancak 5237 say\u0131l\u0131 Kanun\u2019un 75. maddesinde \u00f6ng\u00f6r\u00fclen \u00f6n\u00f6deme kurumu, ismen say\u0131lan su\u00e7 tipleri bak\u0131m\u0131ndan bu s\u00fcrecin ceza yarg\u0131lamas\u0131na ta\u015f\u0131nmadan sona erdirilmesine imk\u00e2n tan\u0131maktad\u0131r. Cumhuriyet savc\u0131s\u0131,  \u015fartlar ger\u00e7ekle\u015fti\u011finde fail hakk\u0131nda \u00f6n\u00f6deme teklifinde bulunur; failin \u00f6deme yapmas\u0131 durumunda kamu davas\u0131 a\u00e7\u0131lmaz. Yarg\u0131lama s\u00fcreci bu suretle sona ererken, \u00f6deme yap\u0131lmamas\u0131 h\u00e2linde soru\u015fturma devam eder. \u00d6n\u00f6demenin uzla\u015ft\u0131rmadan ayr\u0131ld\u0131\u011f\u0131 temel noktalar a\u00e7\u0131kt\u0131r. Ba\u015fka bir deyi\u015fle, \u00f6n\u00f6deme, devlet ile fail aras\u0131nda kurulan ve yaln\u0131zca madd\u00ee \u00f6deme ile sonu\u00e7lanan bir ili\u015fkidir. Uzla\u015ft\u0131rma ise fail ile ma\u011fdur aras\u0131nda y\u00fcr\u00fct\u00fclen, kar\u015f\u0131l\u0131kl\u0131 anla\u015fmay\u0131 gerektiren bir s\u00fcre\u00e7tir. Uzla\u015ft\u0131rmada ma\u011fdurun madd\u00ee bir edim talep etme imk\u00e2n\u0131 vard\u0131r; \u00f6n\u00f6demede b\u00f6yle bir hak tan\u0131nmam\u0131\u015ft\u0131r. Ayr\u0131ca uzla\u015ft\u0131rma, taraflar aras\u0131nda m\u00fczakereyi ve dolay\u0131s\u0131yla bir t\u00fcr ileti\u015fimi zorunlu k\u0131larken, \u00f6n\u00f6deme teknik ve tek tarafl\u0131 bir mekanizmad\u0131r. S\u00fcre\u00e7lerin sonu\u00e7lar\u0131 bak\u0131m\u0131ndan da fark g\u00f6zetilmelidir: Uzla\u015fman\u0131n sa\u011flanmas\u0131 kamu davas\u0131n\u0131n a\u00e7\u0131lmamas\u0131na yol a\u00e7arken, \u00f6n\u00f6deme yap\u0131lmazsa yarg\u0131lama s\u00fcreci i\u015flemeye devam eder.<\/p>\n<p>7531 say\u0131l\u0131 Kanun\u2019un 15. maddesiyle, TCK m.75\u2019in alt\u0131nc\u0131 f\u0131kras\u0131n\u0131n (a) bendine (2) numaral\u0131 alt bent eklenmi\u015ftir. Bu bentte, TCK m.125\u2019in ikinci f\u0131kras\u0131, \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (b) ve (c) bentleri ile d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda tan\u0131mlanan hakaret su\u00e7lar\u0131n\u0131n da \u00f6n\u00f6deme kapsam\u0131na al\u0131nd\u0131\u011f\u0131 kanunla\u015fm\u0131\u015ft\u0131r. Ayn\u0131 maddenin birinci f\u0131kras\u0131 ile \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (a) bendinde yer alan h\u00fck\u00fcmler bu kapsam\u0131n d\u0131\u015f\u0131ndad\u0131r. Buna paralel olarak, CMK m.253\/3\u2019te yap\u0131lan de\u011fi\u015fiklikle, bu bentte belirtilen hakaret su\u00e7lar\u0131n\u0131n uzla\u015ft\u0131rma d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. B\u00f6ylece baz\u0131 su\u00e7 tipleri bak\u0131m\u0131ndan uzla\u015ft\u0131rma yerine \u00f6n\u00f6deme usul\u00fc uygulanabilir h\u00e2le gelmi\u015ftir. \u00d6n\u00f6deme yap\u0131lmas\u0131 h\u00e2linde kamu davas\u0131 a\u00e7\u0131lmaz; a\u00e7\u0131lm\u0131\u015fsa d\u00fc\u015fer. Failin devlete \u00f6deme yapmas\u0131 yeterlidir. Ma\u011fdurun r\u0131zas\u0131 aranmaz. Uzla\u015ft\u0131rma uygulamas\u0131nda ise taraflar\u0131n anla\u015fmas\u0131 ve edim \u00fczerinde uzla\u015fmas\u0131 esast\u0131r. Anayasa Mahkemesi\u2019nin 27\/3\/2025 Tarihli Karar\u0131n\u0131n Gerek\u00e7eleri ve De\u011ferlendirmesi<\/p>\n<p>Anayasa Mahkemesi\u2019nin 27\/3\/2025 tarihli ve E.2024\/197, K.2025\/86 say\u0131l\u0131 karar\u0131nda iptali talep edilen ilk h\u00fck\u00fcm, 7531 say\u0131l\u0131 Kanun\u2019un 15. maddesiyle, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 75. maddesinin alt\u0131nc\u0131 f\u0131kras\u0131n\u0131n (a) bendine eklenen (2) numaral\u0131 alt bentte yer alan: \u201c\u2026 ikinci f\u0131kras\u0131, \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (b) ve (c) bentleri ve d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 \u2026\u201d ibaresidir. An\u0131lan d\u00fczenleme ile TCK m.125 kapsam\u0131ndaki baz\u0131 hakaret su\u00e7lar\u0131 \u00f6n\u00f6deme kapsam\u0131na al\u0131nm\u0131\u015ft\u0131r. \u0130kinci norm, ayn\u0131 Kanun\u2019un 18. maddesiyle 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu\u2019na eklenen ge\u00e7ici 7. maddenin ikinci f\u0131kras\u0131d\u0131r. \u0130lgili f\u0131kra \u015f\u00f6yledir: \u201cBu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih itibar\u0131yla soru\u015fturma veya kovu\u015fturma evresinde bulunan dosyalar bak\u0131m\u0131ndan bu maddeyi ihdas eden Kanunla 253 \u00fcnc\u00fc maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda yap\u0131lan de\u011fi\u015fiklik ve 5237 say\u0131l\u0131 Kanunun 75 inci maddesinin alt\u0131nc\u0131 f\u0131kras\u0131nda yap\u0131lan de\u011fi\u015fiklik uygulanmaz. Bu dosyalar, 253 \u00fcnc\u00fc maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n de\u011fi\u015fiklikten \u00f6nceki h\u00fck\u00fcmlerine g\u00f6re sonu\u00e7land\u0131r\u0131l\u0131r.\u201d \u0130tiraz yoluna ba\u015fvuran mahkemeler ile iptal davas\u0131 a\u00e7an milletvekillerince, \u00f6n\u00f6deme kapsam\u0131na al\u0131nan hakaret su\u00e7u t\u00fcrleri aras\u0131nda yap\u0131lan ayr\u0131m\u0131n, benzer hukuki konumda olan ki\u015filere farkl\u0131 muameleye yol a\u00e7t\u0131\u011f\u0131; ge\u00e7ici maddenin ikinci f\u0131kras\u0131n\u0131n ise e\u015fit konumda bulunan yarg\u0131lamalara farkl\u0131 hukuk kurallar\u0131 uygulanmas\u0131na neden oldu\u011fu belirtilmi\u015ftir. Her iki h\u00fckm\u00fcn Anayasa\u2019n\u0131n 2. ve 10. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>Anayasa Mahkemesi, karar\u0131nda Anayasa\u2019n\u0131n 2. maddesinde yer alan hukuk devleti ilkesi, 10. maddesindeki kanun \u00f6n\u00fcnde e\u015fitlik ilkesi ve 38. maddesindeki aleyhe kanunun geriye y\u00fcr\u00fcme yasa\u011f\u0131 ilkelerine at\u0131f yapm\u0131\u015ft\u0131r. TCK m.75\/6-a-2 h\u00fckm\u00fc bak\u0131m\u0131ndan, su\u00e7un i\u015fleni\u015f bi\u00e7imi esas al\u0131narak \u00f6n\u00f6deme kapsam\u0131n\u0131n belirlenmesinin, benzer hukuki konumdaki ki\u015filer aras\u0131nda farkl\u0131 sonu\u00e7lara yol a\u00e7t\u0131\u011f\u0131na kanaat getirilmi\u015ftir. Mahkeme, hakaret su\u00e7unun ma\u011fduru muhatap alan sesli, yaz\u0131l\u0131 veya g\u00f6r\u00fcnt\u00fcl\u00fc iletiyle i\u015flenmesi h\u00e2lini d\u00fczenleyen TCK m.125\/2, nitelikli halleri i\u00e7eren m.125\/3-(b) ve (c) bentleri ile aleniyet unsurunu bar\u0131nd\u0131ran m.125\/4 h\u00fck\u00fcmlerinin \u00f6n\u00f6deme kapsam\u0131na al\u0131nm\u0131\u015f olmas\u0131na kar\u015f\u0131n, su\u00e7un do\u011frudan huzurda ya da kamu g\u00f6revlisine kar\u015f\u0131 i\u015flenmesi halleri kapsam d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131\u011f\u0131ndan, e\u015fitlik ilkesi bak\u0131m\u0131ndan farkl\u0131 muamele olu\u015ftu\u011fu de\u011ferlendirmesini yapm\u0131\u015ft\u0131r. Bu farkl\u0131l\u0131\u011f\u0131n nesnel ve makul bir temele dayanmad\u0131\u011f\u0131, benzer hukuki konumda olan ki\u015filer aras\u0131nda ayr\u0131mc\u0131l\u0131\u011fa neden oldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Bununla birlikte, CMK\u2019ya eklenen ge\u00e7ici 7. madde y\u00f6n\u00fcnden ise, ayn\u0131 su\u00e7a ili\u015fkin olup yaln\u0131zca y\u00fcr\u00fcrl\u00fck tarihine g\u00f6re ayr\u0131lan dosyalar aras\u0131nda farkl\u0131 usuller uygulanmas\u0131n\u0131n, \u00f6ng\u00f6r\u00fclebilirlik ve e\u015fitlik ilkelerine ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011fu kanaatine var\u0131lm\u0131\u015ft\u0131r. Mahkeme, ayn\u0131 normun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce ba\u015flat\u0131lm\u0131\u015f dosyalar bak\u0131m\u0131ndan uygulanmamas\u0131n\u0131, benzer konumda olan \u015f\u00fcpheli veya san\u0131klar aras\u0131nda farkl\u0131 sonu\u00e7lar do\u011furdu\u011fu gerek\u00e7esiyle Anayasa\u2019ya ayk\u0131r\u0131 bulmu\u015ftur. Mezkur d\u00fczenlemenin a\u00e7\u0131k\u00e7a geriye etkili olmamas\u0131 ve bu nedenle ge\u00e7mi\u015fte a\u00e7\u0131lm\u0131\u015f dosyalarda \u00f6nceki h\u00fck\u00fcmlerin uygulanmaya devam etmesinin, hem kanun \u00f6n\u00fcnde e\u015fitlik ilkesine hem de hukuk devleti ilkesinin gere\u011fi olan hukuki g\u00fcvenlik ve belirlilik ilkelerine zarar verdi\u011fi belirtilmi\u015ftir. Bu husus bizce k\u0131ymetlidir. \u015e\u00f6yle ki, Anayasa Mahkemesi\u2019nin iptal gerek\u00e7elerinde, normun \u201cgenel ve soyut yap\u0131\u201d ta\u015f\u0131mas\u0131 gerekti\u011fi vurgulanm\u0131\u015ft\u0131r. Su\u00e7un i\u015fleni\u015f bi\u00e7imine g\u00f6re \u00f6n\u00f6deme hakk\u0131n\u0131n tan\u0131n\u0131p tan\u0131nmamas\u0131 aras\u0131nda ayr\u0131m yap\u0131lmas\u0131, failin hukuki durumunu nesnel olmayan k\u0131staslara g\u00f6re \u015fekillendirmi\u015ftir. Kararda, benzer hukuki durumda bulunan ki\u015filerin e\u015fit muamele g\u00f6rmesi gerekti\u011fi vurgulanm\u0131\u015f, hukuki sonu\u00e7lar\u0131n ki\u015fisel ko\u015fullara veya takdiri de\u011ferlendirmelere b\u0131rak\u0131lmas\u0131n\u0131n \u00f6nlenmesi gerekti\u011fi ifade edilmi\u015ftir. CMK ge\u00e7ici 7. madde kapsam\u0131nda, ayn\u0131 su\u00e7tan yarg\u0131lanan ki\u015filere yaln\u0131zca yarg\u0131laman\u0131n ba\u015flat\u0131lma tarihine g\u00f6re yarg\u0131laman\u0131n sac aya\u011f\u0131 olan avukatlar\u0131n, hakimin, Cumhuriyet savc\u0131s\u0131n\u0131n \u00e7al\u0131\u015fkanl\u0131k durumlar\u0131na g\u00f6re farkl\u0131 normlar\u0131n uygulanmas\u0131, y\u00fcksek mahkemece kabul edilebilir bir farkl\u0131l\u0131k olarak de\u011ferlendirilmemi\u015ftir. Sistemde do\u011fan ayr\u0131\u015ft\u0131r\u0131c\u0131 etki, ceza muhakemesi s\u00fcrecinde failin yarg\u0131lamaya tabi olup olmamas\u0131n\u0131n su\u00e7un i\u015fleni\u015f bi\u00e7imi ve soru\u015fturma tarihine g\u00f6re \u015fekillenmesi sonucunu do\u011furmu\u015ftur. Tabiki de bu husus, hukuk devletinin temel ilkelerinden olan e\u015fitlik anlay\u0131\u015f\u0131 ile ba\u011fda\u015fmamaktad\u0131r.<\/p>\n<p>IV. Anayasa Mahkemesi Karar\u0131n\u0131n Normatif ve Uygulama Boyutlu Sonu\u00e7lar\u0131<\/p>\n<p>Anayasa Mahkemesi\u2019nin 27\/3\/2025 tarihli ve E.2024\/197, K.2025\/86 say\u0131l\u0131 karar\u0131yla iptal edilen h\u00fck\u00fcmler, \u00f6n\u00f6deme kurumunun uygulama alan\u0131n\u0131 TCK m.125 kapsam\u0131ndaki baz\u0131 hakaret fiillerini i\u00e7erecek \u015fekilde geni\u015fletmekteydi. Bu geni\u015fleme, ceza yarg\u0131lamas\u0131nda alternatif \u00e7\u00f6z\u00fcm yollar\u0131n\u0131n etkinle\u015ftirilmesi amac\u0131yla yap\u0131lsa da, e\u015fitlik ilkesinin yap\u0131sal anlamda g\u00f6z ard\u0131 edilmesine yol a\u00e7m\u0131\u015ft\u0131r. Mahkeme, \u00f6zellikle su\u00e7un i\u015fleni\u015f bi\u00e7imine g\u00f6re failin farkl\u0131 usullere tabi tutulmas\u0131n\u0131n, normlar\u0131n genel ve soyut olmas\u0131 gerekti\u011fine dair anayasal ilkeyle ba\u011fda\u015fmad\u0131\u011f\u0131n\u0131 vurgulam\u0131\u015ft\u0131r. Karar\u0131n dikkat \u00e7eken y\u00f6nlerinden biri de, su\u00e7un temel bi\u00e7imi ile nitelikli halleri aras\u0131nda kurulan uygulama farkl\u0131l\u0131\u011f\u0131n\u0131n ters y\u00f6nl\u00fc bir etki do\u011furmas\u0131n\u0131n ifade edili\u015fidir. Nitekim, TCK m.125\u2019in ikinci, \u00fc\u00e7\u00fcnc\u00fc (b) ve (c) bentleri ile d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda tan\u0131mlanan nitelikli hakaret fiilleri \u00f6n\u00f6deme kapsam\u0131na al\u0131n\u0131rken, ayn\u0131 maddenin birinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (a) bendi kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r. S\u00f6z konusu husus, ceza yarg\u0131lamas\u0131 ilkelerinden olan orant\u0131l\u0131l\u0131k ve \u00f6l\u00e7\u00fcl\u00fcl\u00fckle \u00e7eli\u015fmektedir. Zira daha a\u011f\u0131r nitelikli fiillere k\u0131yasen fail lehine sonu\u00e7 do\u011furan bir usul uygulan\u0131rken, daha hafif fiillerde bu imk\u00e2n\u0131n tan\u0131nmamas\u0131, failin hukuki durumunu a\u011f\u0131rla\u015ft\u0131rmakta ve tutars\u0131zl\u0131k yaratmaktad\u0131r. Benzer bir e\u015fitsizlik sorunu, CMK\u2019ya eklenen ge\u00e7ici 7. maddenin ikinci f\u0131kras\u0131nda ortaya \u00e7\u0131kmaktad\u0131r. Yukar\u0131da belirtildi\u011fi gibi, ayn\u0131 su\u00e7a ili\u015fkin dosyalar\u0131n yaln\u0131zca yarg\u0131lama evresine ge\u00e7i\u015f tarihine g\u00f6re farkl\u0131 usullere tabi tutulmas\u0131, yarg\u0131 sisteminde \u00f6znel fakt\u00f6rlerin belirleyici h\u00e2le gelmesine neden olmu\u015ftur. Say\u0131lan bu tarih\u00ee farkl\u0131l\u0131k, yarg\u0131lamaya hangi g\u00fcn, hangi savc\u0131 ya da mahkeme taraf\u0131ndan ba\u015fland\u0131\u011f\u0131na g\u00f6re de\u011fi\u015febilmekte; neticede ayn\u0131 hukuki durumda bulunan ki\u015filere farkl\u0131 sonu\u00e7lar do\u011furabilmektedir. Soru\u015fturman\u0131n ne zaman ba\u015flat\u0131ld\u0131\u011f\u0131, g\u00f6revli ki\u015finin i\u015f y\u00fck\u00fc, dosya yo\u011funlu\u011fu yahut uygulama prati\u011fi gibi d\u0131\u015fsal fakt\u00f6rlerin hukuk\u00ee sonuca etkili olmas\u0131, ceza muhakemesinde hem e\u015fitlik ilkesini hem de hukuki g\u00fcvenli\u011fi zedelemektedir.<\/p>\n<p>T\u00fcm bu de\u011ferlendirmeler \u0131\u015f\u0131\u011f\u0131nda, \u00f6n\u00f6deme kurumunun TCK m.125 kapsam\u0131nda yeniden yap\u0131land\u0131r\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r. \u00d6n\u00f6deme, do\u011fas\u0131 gere\u011fi fail lehine sonu\u00e7 do\u011furan bir kurumdur ve ceza siyaseti bak\u0131m\u0131ndan ayn\u0131 su\u00e7 tipinin daha hafif eylemleri i\u00e7in de \u00f6ng\u00f6r\u00fclebilir, etkili ve eri\u015filebilir olmal\u0131d\u0131r. Mevcut haliyle uygulama, daha a\u011f\u0131r fiilleri kapsarken daha hafif eylemleri kapsam d\u0131\u015f\u0131 b\u0131rakarak, ceza sisteminde ters y\u00f6nl\u00fc bir ayr\u0131cal\u0131k yaratmaktad\u0131r. Kapsam\u0131n nitelikli fiillerle s\u0131n\u0131rl\u0131 tutulmas\u0131, failin eylem niteli\u011fine g\u00f6re de\u011fil, kanuni d\u00fczenlemelerdeki se\u00e7ici tercihlere g\u00f6re farkl\u0131 sonu\u00e7lara tabi tutulmas\u0131na yol a\u00e7maktad\u0131r. \u00d6te yandan, iptal karar\u0131n\u0131n 29 \u015eubat 2026 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek olmas\u0131, uygulay\u0131c\u0131lar a\u00e7\u0131s\u0131ndan ge\u00e7ici bir d\u00f6nemde mevcut h\u00fck\u00fcmlerin uygulanmaya devam edece\u011fi anlam\u0131na gelmesi gerekir. Bu s\u00fcre zarf\u0131nda Cumhuriyet savc\u0131lar\u0131, y\u00fcr\u00fcrl\u00fckteki d\u00fczenlemelere g\u00f6re hareket etmelidir. Ancak bu uygulama s\u00fcresi, ayn\u0131 zamanda yasa koyucu i\u00e7in de \u00f6nemlidir. Mesele, bir fiilin hangi usule tabi olaca\u011f\u0131 sorusundan ibaret de\u011fil. Daha \u00f6nemlisi, bu tercihlerin ceza adaletinin y\u00f6n\u00fcn\u00fc nereden nereye \u00e7evirdi\u011finde. \u00c7\u00fcnk\u00fc usul dedi\u011fimiz \u015fey bir y\u00f6ntemin \u00f6tesindedir. Anayasa Mahkemesi yerindelik denetimi yapmaz. Ama kimi zaman olur, normu iptal ederken bir dili, bir y\u00f6n\u00fc de i\u015faret edebilmektedir.<\/p>\n<p>V. Sonu\u00e7<\/p>\n<p>\u00c7al\u0131\u015fmam\u0131zda, hakaret su\u00e7unun ceza muhakemesi i\u00e7indeki konumunu; bu su\u00e7la ilgili soru\u015fturmalarda uzla\u015ft\u0131rma ve \u00f6n\u00f6deme kurumlar\u0131n\u0131n ne \u015fekilde uyguland\u0131\u011f\u0131n\u0131 ve bu yap\u0131n\u0131n hangi gerek\u00e7elerle de\u011fi\u015ftirildi\u011fini de\u011ferlendirdik. \u00d6zellikle sosyal medya ortamlar\u0131nda, kamuoyunu bilerek provoke eden a\u00e7\u0131klamalarla ba\u015flayan ve ard\u0131ndan uzla\u015ft\u0131rma s\u00fcrecinin maddi talepler \u00fczerinden istismar edilmesine uzanan \u00f6rnekler, meselenin norm sorununun \u00f6tesinde oldu\u011funu g\u00f6stermektedir. Bu kapsamda, 7531 say\u0131l\u0131 Kanun ile hakaret su\u00e7unun baz\u0131 halleri uzla\u015ft\u0131rma kapsam\u0131ndan \u00e7\u0131kar\u0131lm\u0131\u015f ve \u00f6n\u00f6deme kapsam\u0131na al\u0131narak ceza muhakemesi s\u00fcreci a\u00e7\u0131s\u0131ndan farkl\u0131 bir usul benimsenmi\u015ftir. Anayasa Mahkemesi&#8217;nin ilgili iptal kararlar\u0131, \u00f6n\u00f6deme kapsam\u0131n\u0131n belirlenmesinde su\u00e7un i\u015fleni\u015f bi\u00e7iminin esas al\u0131nmas\u0131n\u0131n, e\u015fitlik ilkesine ayk\u0131r\u0131 sonu\u00e7lar do\u011furdu\u011fu gerek\u00e7esine dayanmaktad\u0131r. Benzer \u015fekilde, yarg\u0131laman\u0131n ba\u015flang\u0131\u00e7 tarihine g\u00f6re farkl\u0131 hukuk kurallar\u0131n\u0131n uygulanmas\u0131n\u0131n da hukuk devleti ilkesini zedeledi\u011fi kanaatine var\u0131lm\u0131\u015ft\u0131r. Mahkeme&#8217;nin, e\u015fitlik ve hukuki g\u00fcvenlik ilkelerine yapt\u0131\u011f\u0131 vurgu yerinde olmakla birlikte, bu de\u011ferlendirmeler ayn\u0131 zamanda yasa koyucunun normatif tercihlerinde daha b\u00fct\u00fcnc\u00fcl bir yakla\u015f\u0131m benimsemesi gerekti\u011fini de g\u00f6stermektedir.
