G\u0130R\u0130\u015e<\/p>\n<p>6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nda (\u201cTBK\u201d) kira s\u00f6zle\u015fmeleri 4 farkl\u0131 tipte d\u00fczenlenmi\u015ftir. Konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131, uygulamada en \u00e7ok kar\u015f\u0131la\u015f\u0131lan ve ihtilafa neden olan kira s\u00f6zle\u015fmesi tipi olmu\u015ftur. Kanun koyucu, kiralanan\u0131n tahliyesini s\u0131n\u0131rl\u0131 say\u0131da d\u00fczenlemi\u015f olup kiraya veren bu sebepler haricinde kiralanan\u0131n tahliyesi yoluna gidememektedir.<\/p>\n<p>Tahliye sebepleri kiraya verenden ve kirac\u0131dan kaynakl\u0131 olarak iki ayr\u0131 ba\u015fl\u0131kta d\u00fczenlenmi\u015ftir. \u0130htiya\u00e7 nedeniyle tahliye talebi uygulamada en s\u0131k ba\u015fvurulan tahliye sebebi olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda ihtiya\u00e7 nedenine dayal\u0131 tahliye davas\u0131 a\u00e7\u0131lmadan \u00f6nce kirac\u0131ya bildirimde bulunma zorunlulu\u011fu konusunda uygulamada kafa kar\u0131\u015f\u0131kl\u0131klar\u0131 do\u011fmaktad\u0131r. Bu hususa dikkat edilmemesi halinde ise a\u00e7\u0131lan davan\u0131n s\u00fcresinde a\u00e7\u0131lmamas\u0131 nedeniyle usulden reddi s\u00f6z konusu olmaktad\u0131r.<\/p>\n<p>Bu yaz\u0131m\u0131zda belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda ihtiya\u00e7 nedenine dayal\u0131 tahliye davas\u0131 kavram\u0131na k\u0131saca de\u011finip dava a\u00e7madan \u00f6nce kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunma zorunlulu\u011fu olup olmad\u0131\u011f\u0131n\u0131 ele alaca\u011f\u0131z. <\/p>\n<p>II. \u0130HT\u0130YA\u00c7 KAVRAMI<\/p>\n<p>\u0130htiya\u00e7 sebebiyle tahliye davas\u0131 kira s\u00f6zle\u015fmesini dava yoluyla sona erdiren bir tahliye t\u00fcr\u00fc olup TBK madde 350\u2019de d\u00fczenlenmi\u015ftir. Buna g\u00f6re; \u201cKiraya veren, kira s\u00f6zle\u015fmesini; Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.\u201d <\/p>\n<p>Buna g\u00f6re, ihtiya\u00e7 kavram\u0131 iki \u015fekildedir. Bunlardan birincisi kiralanan\u0131n belirli ki\u015filerce konut ya da i\u015fyeri olarak kullanma, ikincisi ise kiralanan\u0131n kullan\u0131m\u0131n\u0131 imk\u00e2ns\u0131z hale getirecek \u015fekilde esasl\u0131 ve kapsaml\u0131 tadilat zorunlulu\u011fudur. Bu hallerden birisinin varl\u0131\u011f\u0131 halinde kiraya veren, ihtiya\u00e7 sebebiyle tahliye davas\u0131 a\u00e7mak suretiyle kira s\u00f6zle\u015fmesini dava yoluyla sona erdirebilecektir.<\/p>\n<p>III. B\u0130LD\u0130R\u0130M ve DAVA A\u00c7MA S\u00dcRES\u0130 <\/p>\n<p>Kira hukuku, tahliye dava a\u00e7ma s\u00fcrelerinin belirlenmesinde s\u0131k\u0131 \u015fekil \u015fartlar\u0131na tabi tutulmu\u015ftur. \u0130htiya\u00e7 sebebine dayal\u0131 tahliye davas\u0131n\u0131n hangi s\u00fcrede a\u00e7\u0131laca\u011f\u0131 TBK 350\u2019de d\u00fczenlenmi\u015ftir. Buna g\u00f6re; belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir. Yaz\u0131m\u0131z\u0131n konusu belirli s\u00fcreli kira s\u00f6zle\u015fmeleri oldu\u011fundan sadece bu y\u00f6nde a\u00e7\u0131klama yap\u0131lacakt\u0131r.<\/p>\n<p>Bu noktada belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00fcre sonunda s\u00f6zle\u015fmenin belirli s\u00fcreli mi yoksa belirsiz s\u00fcreli olarak m\u0131 devam eti\u011finin tespiti olduk\u00e7a \u00f6nemlidir. Zira s\u00f6zle\u015fmenin belirli-belirsiz olmas\u0131 dava a\u00e7ma s\u00fcresi bak\u0131m\u0131ndan farkl\u0131l\u0131k yaratmaktad\u0131r. Bu da davan\u0131n usulden reddedilme riskini getirmektedir.<\/p>\n<p>Uygulamada belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131n\u0131n s\u00fcre sonunda \u201cbelirli devam edece\u011fi\u201d kural\u0131nda bilgi kirlili\u011fi bulunmaktad\u0131r. Bunun sebebinin kira hukuku genel h\u00fck\u00fcmlerinde s\u00fcrenin sona ermesiyle s\u00f6zle\u015fmenin sona ermesini d\u00fczenleyen TBK 327 h\u00fckm\u00fc oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyoruz. \u0130lgili h\u00fckme g\u00f6re; \u201cA\u00e7\u0131k veya \u00f6rt\u00fcl\u00fc bi\u00e7imde bir s\u00fcre belirlenmi\u015fse, kira s\u00f6zle\u015fmesi bu s\u00fcrenin sonunda kendili\u011finden sona erer. Taraflar, bu durumda, a\u00e7\u0131k bir anla\u015fma olmaks\u0131z\u0131n kira ili\u015fkisini s\u00fcrd\u00fcr\u00fcrlerse, kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6n\u00fc\u015f\u00fcr.\u201d Burada \u00f6nemle alt\u0131 \u00e7izilmesi gereken husus bu h\u00fck\u00fcm konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 bak\u0131m\u0131ndan uygulanmamas\u0131d\u0131r. <\/p>\n<p>TBK 347 h\u00fckm\u00fc gere\u011fi, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda belirli s\u00fcreli s\u00f6zle\u015fme s\u00fcre bitiminde belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6nmemektedir. S\u00f6zle\u015fme ayn\u0131 \u015fartlarda 1 y\u0131l belirli s\u00fcreli olarak uzar. \u201cBuna g\u00f6re mahkemece i\u015fin esas\u0131 incelenerek sonucuna g\u00f6re bir karar verilmesi gerekirken, konut ve \u00e7at\u0131l\u0131 i\u015fyerlerinde s\u00f6zle\u015fmenin uzamas\u0131 halinde belirsiz s\u00fcreli hale gelmeyece\u011fi, s\u00f6zle\u015fmenin belirli s\u00fcreli oldu\u011fu dikkate al\u0131nmadan yaz\u0131l\u0131 \u015fekilde karar verilmesi do\u011fru olmam\u0131\u015f, bozmay\u0131 gerektirmi\u015ftir.\u201d[1]<\/p>\n<p>Belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131n\u0131n s\u00fcre bitiminde belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6nmeyece\u011fini etrafl\u0131ca izah ettikten sonra bildirimde bulunma hususunun ve dava a\u00e7ma s\u00fcresinin tespiti daha sa\u011fl\u0131kl\u0131 \u015fekilde yap\u0131lacakt\u0131r. TBK 350\u2019de d\u00fczenlendi\u011fi gibi ihtiya\u00e7 sebebine dayal\u0131 tahliye davas\u0131 belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonundan itibaren bir ay i\u00e7inde a\u00e7\u0131labilir. Ancak bildirim hususu dava a\u00e7ma s\u00fcresinde \u00f6zel bir durum yaratabilmektedir. \u015e\u00f6yle ki,<\/p>\n<p>Dava a\u00e7madan \u00f6nce kirac\u0131ya ihtarname \u00e7ekme gereklili\u011fi konusunda ikili bir ayr\u0131m bulunmaktad\u0131r. Kural olarak, dava a\u00e7madan \u00f6nce kirac\u0131ya ihtarname \u00e7ekme zorunlulu\u011fu bulunmamaktad\u0131r. Ancak taraflar aras\u0131nda imzalanan s\u00f6zle\u015fmede; \u201ctaraflar\u0131n belirli bir s\u00fcreden \u00f6nce yaz\u0131l\u0131 bildirimde bulunmamas\u0131 halinde s\u00f6zle\u015fmenin yenilece\u011fi\u201d \u015feklinde fesih ihbar s\u00fcresi belirlenmi\u015fse Yarg\u0131tay bu s\u00fcreye uyulmas\u0131 gerekti\u011fini kabul etmektedir. Di\u011fer bir ifadeyle kiraya veren, s\u00f6zle\u015fmeden belirtilen bu s\u00fcreye uygun olarak yaz\u0131l\u0131 \u015fekilde bildirimde bulunmak zorundad\u0131r. Aksi halde davan\u0131n s\u00fcresinde a\u00e7\u0131ld\u0131\u011f\u0131ndan bahsedilemeyecektir. \u201cOlay\u0131m\u0131za gelince; davaya dayanak olup h\u00fckme esas al\u0131nan ve taraflar aras\u0131nda bir uyu\u015fmazl\u0131k bulunmayan 15.02.2010 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinin \u00f6zel \u015fartlar 8. maddesinde &#8221;kirac\u0131 veya mal sahibi kira s\u00f6zle\u015fmesinin sona erdirilmesi hususundaki irade beyanlar\u0131n\u0131 kontrat s\u00fcresinin bitiminden 2 ay \u00f6nce kar\u015f\u0131 tarafa bildirmek zorundad\u0131r. aksi takdirde kira s\u00fcresi 1 y\u0131l daha uzam\u0131\u015f say\u0131l\u0131r.&#8221; d\u00fczenlemesi mevcuttur. An\u0131lan s\u00f6zle\u015fme h\u00fckm\u00fc gere\u011fince davac\u0131 taraf\u0131ndan s\u00f6zle\u015fme bitim tarihinden 2 ay \u00f6nce daval\u0131ya g\u00f6nderilen bir ihtar bulunmad\u0131\u011f\u0131ndan kira s\u00f6zle\u015fmesi ayn\u0131 ko\u015fullarla bir y\u0131l uzam\u0131\u015f olup 11.09.2015 tarihinde a\u00e7\u0131lan dava s\u00fcresinde de\u011fildir. A\u00e7\u0131klanan bu olgu kar\u015f\u0131s\u0131nda s\u00fcresinde a\u00e7\u0131lmayan davan\u0131n reddine karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde kiralanan\u0131n tahliyesine karar verilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r.\u201d[2]<\/p>\n<p>\u201cOlay\u0131m\u0131za gelince; Taraflar aras\u0131nda imzalanan 01.01.2012 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi hususunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Kira s\u00f6zle\u015fmesinin 19. maddesinde, Kontrat\u0131n sona ermesinden bir ay evvel taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 s\u00fcrece kontrat\u0131n yenilenmi\u015f kabul edilece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Davac\u0131 taraf\u0131ndan 11\/12\/2012 tarihinde tebli\u011f edilen ihtarname ile ihtiya\u00e7 nedeniyle ta\u015f\u0131nmaz\u0131n tahliye edilmesi bildirilmi\u015f kiralanan\u0131n tahliye edilmemesi \u00fczerine 30.01.2013 tarihinde a\u00e7\u0131lan davada i\u015fyeri ihtiyac\u0131 nedeniyle tahliyeye karar verilmesi istenmi\u015ftir. Davac\u0131n\u0131n g\u00f6nderdi\u011fi ihtarname 1 ay \u00f6ncesi kapsamad\u0131\u011f\u0131ndan s\u00fcresinde kabul edilemez.\u201d [3]<\/p>\n<p>B\u00f6lge Adliye Mahkemesi kararlar\u0131na bak\u0131ld\u0131\u011f\u0131nda ise, Yarg\u0131tay uygulamas\u0131na paralel karar verildi\u011fini g\u00f6rmekteyiz. \u201cSomut dava bu kapsamda de\u011ferlendirildi\u011finde, davac\u0131n\u0131n e\u015fi ile birlikte ta\u015f\u0131nmaz\u0131 13.03.2020&#8217;de sat\u0131n ald\u0131klar\u0131, taraflar aras\u0131ndaki kira s\u00f6zle\u015fmesinin 01.05.2020 ba\u015flang\u0131\u00e7 tarihli oldu\u011fu, kira s\u00f6zle\u015fmesinin 7. maddesinde, kontrat\u0131n sona ermesinden 60 g\u00fcn evvel taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 s\u00fcrece kontrat\u0131n yenilenmi\u015f kabul edilece\u011finin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131, davac\u0131 15\/04\/2021&#8217;de ihtar g\u00f6ndermekle birlikte taraflar s\u00f6zle\u015fmenin sona ermesinden 60 g\u00fcn \u00f6nce s\u00f6zle\u015fmenin devam etmeyece\u011fine ili\u015fkin yaz\u0131l\u0131 ihtar g\u00f6ndermediklerinden s\u00f6zle\u015fmenin 01\/05\/2020 tarihinden itibaren 1 y\u0131l s\u00fcreyle yenilendi\u011fi, bu durumda mahkemece dava s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131ndan davan\u0131n reddine karar verilmesi gerekirken davan\u0131n kabul\u00fcne karar verilmesi hatal\u0131 oldu\u011fundan daval\u0131n\u0131n istinaf talebinin kabul\u00fcne karar verilmi\u015ftir.\u201d[4]<\/p>\n<p>\u201c01\/08\/2017 tarihli kira s\u00f6zle\u015fmesinin hususi \u015fartlar 7. Maddesinde &#8221; s\u00f6zle\u015fme s\u00fcresi olan bir y\u0131l\u0131n sona ermesinden 45 g\u00fcn \u00f6nce kirac\u0131 ve kiralayan taraf\u0131ndan s\u00f6zle\u015fmenin feshi yaz\u0131l\u0131 olarak bildirilmedi\u011fi takdirde s\u00f6zle\u015fme ayn\u0131 ko\u015fullar alt\u0131nda % 10 un alt\u0131na d\u00fc\u015fmeyecek \u015fekilde y\u0131ll\u0131k \u00fcfe ortalamas\u0131nda art\u0131\u015fla bir y\u0131l daha uzat\u0131lm\u0131\u015f say\u0131l\u0131r &#8221; \u00f6nceden ihbar \u015fart\u0131 olup taraflar\u0131n serbest iradeleri ile s\u00f6zle\u015fmeye koymu\u015f olduklar\u0131 h\u00fck\u00fcmler taraflar y\u00f6n\u00fcnden ba\u011flay\u0131c\u0131 ve ge\u00e7erlidir. Davac\u0131 taraf\u0131ndan daval\u0131ya g\u00f6nderildi\u011fi anla\u015f\u0131lan s\u00f6zle\u015fmenin ihtiya\u00e7 nedeniyle yenilenmeyece\u011fi iradesini bildirir ihtarnamenin daval\u0131ya s\u00f6zle\u015fmenin bitiminden 45 g\u00fcn \u00f6nce \u00f6nce tebli\u011f edilmesi gerektigi halde, 22\/06\/2021 tarihinde tebli\u011f edildi\u011fi, bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerine getirilmedi\u011fi, (s\u00f6zle\u015fmede belirtilen 45 g\u00fcn \u00f6nce feshi ihbar\u0131n 39 g\u00fcn \u00f6nce yap\u0131ld\u0131\u011f\u0131) ihtar\u0131n s\u00fcresi i\u00e7inde yap\u0131lmad\u0131\u011f\u0131, davan\u0131n s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131ndan davan\u0131n reddine karar verilmesi gerektigi, daval\u0131n\u0131n istinaf nedenlerinin de\u011fi\u015fik gerek\u00e7e ile yerinde oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d[5]<\/p>\n<p>\u201cKira s\u00f6zle\u015fmesinin \u00f6zel ko\u015fullar 2. maddesinde; s\u00f6zle\u015fmenin sona ermesinden iki ay \u00f6nce taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 takdirde s\u00f6zle\u015fmenin bir y\u0131l daha uzam\u0131\u015f ve yenilenmi\u015f olaca\u011f\u0131 kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Bu d\u00fczenleme ge\u00e7erlidir ve taraflar\u0131 ba\u011flar. Davac\u0131 kiralayan taraf\u0131ndan s\u00f6zle\u015fmenin bitim tarihi olan 15.7.2016 tarihinden 2 ay \u00f6nce feshi ihbar g\u00f6nderilmemesi nedeniyle s\u00f6zle\u015fmenin 2.maddesi gere\u011fince dayanak s\u00f6zle\u015fme ayn\u0131 \u015fartlarla bir y\u0131l daha uzam\u0131\u015ft\u0131r. Bu durumda 21.7.2016 tarihinde a\u00e7\u0131lan dava s\u00fcresinde de\u011fildir. Dava s\u00fcresi kamu d\u00fczenine ili\u015fkin olup H\u00e2kim taraf\u0131ndan re&#8217;sen her a\u015famada dikkate al\u0131nmas\u0131 gerekmektedir. Mahkemece davan\u0131n s\u00fcresinde a\u00e7\u0131lmamas\u0131 nedeniyle s\u00fcreden reddine karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde karar verilmesi do\u011fru olmad\u0131\u011f\u0131ndan, daval\u0131 vekilinin istinaf kanun yolu ba\u015fvurusunun kabul\u00fc ile a\u015fa\u011f\u0131daki \u015fekilde h\u00fck\u00fcm kurulmu\u015ftur.\u201d[6]<\/p>\n<p>B\u00f6lge Adliye Mahkemesi kararlar\u0131nda \u0130stanbul BAM 35. Hukuk Dairesine ve Bursa BAM 4. Hukuk Dairesine ayr\u0131 bir parantez a\u00e7mam\u0131z gerekecektir. \u0130stanbul BAM 35. Hukuk Dairesindeki heyetler bu konuda farkl\u0131 y\u00f6nde kararlar vermektedir. Bir heyet, \u201cKira s\u00f6zle\u015fmesinin 20.maddesinde &#8220;&#8230;Kontrat\u0131n sona ermesinden bir ay evvel taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 s\u00fcrece kontrat yenilenmi\u015f kabul edilir.&#8221; h\u00fckm\u00fcn\u00fcn kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131, getirilen d\u00fczenlemenin tahliye davas\u0131 a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen bir ihbar \u015fart\u0131 olmad\u0131\u011f\u0131, dava a\u00e7ma s\u00fcresinin TBK&#8217;n\u0131n 350. maddesi ile kira s\u00fcresinin bitiminden itibaren bir ay olarak d\u00fczenlendi\u011fi, an\u0131lan s\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn TBK 350. maddesindeki yasal dava a\u00e7ma s\u00fcresini bertaraf etmeyece\u011fi, davan\u0131n 1 ayl\u0131k yasal s\u00fcrede a\u00e7\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc ile mahkemenin esasa girerek davay\u0131 sonu\u00e7land\u0131rmas\u0131 gerekirken, davan\u0131n s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131na ili\u015fkin karar\u0131n\u0131n hatal\u0131 oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d [7] Ayn\u0131 y\u00f6nde bknz.[8]<\/p>\n<p>Di\u011fer heyet ise, Yarg\u0131tay ve di\u011fer B\u00f6lge Adliye Mahkemeleriyle (Bursa hari\u00e7) paralel \u015fekilde karar vermektedir. \u201cTaraflar aras\u0131nda 05.04.2010 tarihli ve 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi konusunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. S\u00f6zle\u015fmenin Hususi \u015eartlar B\u00f6l\u00fcm\u00fcn\u00fcn 11. Maddesinde kontrat\u0131n sona ermesinden 1 ay \u00f6nce taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 taktirde kontrat\u0131n 1 y\u0131l daha uzayaca\u011f\u0131 ve yenilenece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Davac\u0131 taraf\u0131ndan daval\u0131ya Ankara &#8230; Noterli\u011finin 01.04.2019 tarihli &#8230; yevmiye say\u0131l\u0131 ithamnamesiyle ta\u015f\u0131nmazda yeniden in\u015fa ve imar \u00e7al\u0131\u015fmalar\u0131n\u0131n ba\u015flad\u0131\u011f\u0131, kira s\u00fcresinin bitiminde 05.04.2019 tarihi itibar\u0131yla ta\u015f\u0131nmaz\u0131n tahliye edilmesi aksi takdirde tahliye davas\u0131 a\u00e7\u0131laca\u011f\u0131n\u0131n ihtar edildi\u011fi, ihtarnamenin 09.04.2019 tarihinde tebli\u011f edildi\u011fi g\u00f6r\u00fclm\u00fc\u015fse de, s\u00f6zle\u015fmenin 11.madde h\u00fckm\u00fcyle kararla\u015ft\u0131r\u0131lan ihtar \u015fart\u0131n\u0131n s\u00fcresinde yerine getirilmedi\u011fi anla\u015f\u0131lm\u0131\u015f, kira s\u00f6zle\u015fmesinin ayn\u0131 ko\u015fullarla 05.04.2019 tarihinden itibaren bir y\u0131l s\u00fcre ile uzad\u0131\u011f\u0131n\u0131n kabul\u00fc gerekmi\u015ftir. Bu durumda TBK 353.maddesinin uygulanma imk\u00e2n\u0131 bulunmad\u0131\u011f\u0131, Yarg\u0131tay 3.HD&#8217;nin 2017\/16499 Esas, 2017\/17280 Karar say\u0131l\u0131, 07\/12\/2017 tarihli ilam\u0131 ile ayn\u0131 Dairenin 2018\/1166 Esas, 2018\/2175 Karar say\u0131l\u0131 08\/03\/2018 tarihli benzer emsal kararlar\u0131n\u0131n da ayn\u0131 y\u00f6nde oldu\u011fu nazara al\u0131nd\u0131\u011f\u0131nda, dava s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131ndan reddine karar verilmesi gerekirken, davan\u0131n kabul\u00fcne ili\u015fkin karar\u0131n yerinde olmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d[9] Ayn\u0131 y\u00f6nde bknz.[10]<\/p>\n<p>Bursa B\u00f6lge Adliye Mahkemesi de Yarg\u0131tay g\u00f6r\u00fc\u015f\u00fcn\u00fc benimsememi\u015ftir. \u201cSomut olayda ise kira s\u00f6zle\u015fmesinin hususi \u015fartlar 19. maddesindeki d\u00fczenleme yaln\u0131zca bildirim yoluyla feshe ili\u015fkin bir d\u00fczenleme olup, bu d\u00fczenlemenin yorum yolu ile geni\u015fletilip t\u00fcm tahliye davalar\u0131n\u0131n feshi ihbar ko\u015fuluna ba\u011flanm\u0131\u015f oldu\u011fu kabul edilemez. S\u00f6zle\u015fmenin 19. maddesindeki d\u00fczenlemenin kira s\u00f6zle\u015fmesinin sona erdirilmesine ili\u015fkin t\u00fcm dava sebepleri y\u00f6n\u00fcnden feshi ihbar ko\u015fulu olarak kabul edilmesi amac\u0131 a\u015fan bir yorum olacakt\u0131r. \u2026. Dairemizin 2018\/586 Esas, 2018\/621 Karar say\u0131l\u0131 karar\u0131nda, kira s\u00f6zle\u015fmelerinde bulunan benzer ko\u015fullar\u0131n s\u00f6zle\u015fmenin dava yoluyla sona erdirilmesi sebepleri i\u00e7inde yer alan ihtiya\u00e7 nedeniyle tahliye davalar\u0131nda feshi ihbar ko\u015fulu olarak ge\u00e7erli oldu\u011fu kabul edilmi\u015f ise de, dairemizce yap\u0131lan de\u011ferlendirmede bu i\u00e7tihatlara uymak m\u00fcmk\u00fcn olmam\u0131\u015f ve dairemiz uygulamas\u0131n\u0131n buna g\u00f6re de\u011fi\u015ftirilmesi gerekmi\u015ftir. Nitekim, \u0130stanbul B\u00f6lge Adliye Mahkemesi 35. Hukuk Dairesi&#8217;nin 2021\/2114 Esas, 2023\/2227 Karar say\u0131l\u0131 karar\u0131nda da benzer d\u00fczenlemenin s\u00f6zle\u015fmenin dava yoluyla sona erdirilmesi y\u00f6n\u00fcnden feshi ihbar ko\u015fulu olarak ge\u00e7ersiz oldu\u011fu kabul edilmi\u015ftir.\u201d[11] Bu kararda Bursa 4. Hukuk Dairesinin \u00f6nceki g\u00f6r\u00fc\u015f\u00fcn\u00fc de\u011fi\u015ftirdi\u011fini g\u00f6r\u00fcyoruz.<\/p>\n<p>IV. SONU\u00c7 <\/p>\n<p>Belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ihtiya\u00e7 sebebine dayal\u0131 tahliye davas\u0131 a\u00e7madan evvel yaz\u0131l\u0131 bildirimde bulunma zorunlulu\u011fu bulunmamaktad\u0131r. Ancak taraflar aras\u0131nda imzalanan s\u00f6zle\u015fmede taraflar\u0131n ya da kiraya verenin belirli s\u00fcre \u00f6nceden bildirimde bulunmamas\u0131 halinde s\u00f6zle\u015fmenin yenilece\u011fi \u015feklinde bir h\u00fck\u00fcm varsa, kiraya veren s\u00f6zle\u015fmedeki s\u00fcreye g\u00f6re yaz\u0131l\u0131 bildirimde bulunmak zorundad\u0131r. Aksi halde, dava her ne kadar s\u00fcre bitiminden itibaren 1 ay i\u00e7inde a\u00e7\u0131lsa da s\u00fcresinde a\u00e7\u0131lmam\u0131\u015f kabul edilecektir.<\/p>\n<p>\u0130stanbul B\u00f6lge Adliye Mahkemesinde kira uyu\u015fmazl\u0131klar\u0131na 5 ayr\u0131 daire (35.,36.,49.,54.,55.) bakmaktad\u0131r. Hukuk Dairesi daha \u00f6nceki kararlar\u0131nda Yarg\u0131tay g\u00f6r\u00fc\u015f\u00fcne dirense de bozulan bir kararlar\u0131 sonras\u0131 g\u00f6r\u00fc\u015f\u00fcnde \u0131srar etmemi\u015f ve Yarg\u0131tay g\u00f6r\u00fc\u015f\u00fcne d\u00f6nm\u00fc\u015ft\u00fcr. \u0130stanbul 35. Konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131, uygulamada en \u00e7ok kar\u015f\u0131la\u015f\u0131lan ve ihtilafa neden olan kira s\u00f6zle\u015fmesi tipi olmu\u015ftur. Kanun koyucu, kiralanan\u0131n tahliyesini s\u0131n\u0131rl\u0131 say\u0131da d\u00fczenlemi\u015f olup kiraya veren bu sebepler haricinde kiralanan\u0131n tahliyesi yoluna gidememektedir.<\/p>\n<p>Tahliye sebepleri kiraya verenden ve kirac\u0131dan kaynakl\u0131 olarak iki ayr\u0131 ba\u015fl\u0131kta d\u00fczenlenmi\u015ftir. \u0130htiya\u00e7 nedeniyle tahliye talebi uygulamada en s\u0131k ba\u015fvurulan tahliye sebebi olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda ihtiya\u00e7 nedenine dayal\u0131 tahliye davas\u0131 a\u00e7\u0131lmadan \u00f6nce kirac\u0131ya bildirimde bulunma zorunlulu\u011fu konusunda uygulamada kafa kar\u0131\u015f\u0131kl\u0131klar\u0131 do\u011fmaktad\u0131r. Bu hususa dikkat edilmemesi halinde ise a\u00e7\u0131lan davan\u0131n s\u00fcresinde a\u00e7\u0131lmamas\u0131 nedeniyle usulden reddi s\u00f6z konusu olmaktad\u0131r.<\/p>\n<p>Bu yaz\u0131m\u0131zda belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda ihtiya\u00e7 nedenine dayal\u0131 tahliye davas\u0131 kavram\u0131na k\u0131saca de\u011finip dava a\u00e7madan \u00f6nce kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunma zorunlulu\u011fu olup olmad\u0131\u011f\u0131n\u0131 ele alaca\u011f\u0131z. <\/p>\n<p>II. \u0130HT\u0130YA\u00c7 KAVRAMI<\/p>\n<p>\u0130htiya\u00e7 sebebiyle tahliye davas\u0131 kira s\u00f6zle\u015fmesini dava yoluyla sona erdiren bir tahliye t\u00fcr\u00fc olup TBK madde 350\u2019de d\u00fczenlenmi\u015ftir. Buna g\u00f6re; \u201cKiraya veren, kira s\u00f6zle\u015fmesini; Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.\u201d <\/p>\n<p>Buna g\u00f6re, ihtiya\u00e7 kavram\u0131 iki \u015fekildedir. Bunlardan birincisi kiralanan\u0131n belirli ki\u015filerce konut ya da i\u015fyeri olarak kullanma, ikincisi ise kiralanan\u0131n kullan\u0131m\u0131n\u0131 imk\u00e2ns\u0131z hale getirecek \u015fekilde esasl\u0131 ve kapsaml\u0131 tadilat zorunlulu\u011fudur. Bu hallerden birisinin varl\u0131\u011f\u0131 halinde kiraya veren, ihtiya\u00e7 sebebiyle tahliye davas\u0131 a\u00e7mak suretiyle kira s\u00f6zle\u015fmesini dava yoluyla sona erdirebilecektir.<\/p>\n<p>III. B\u0130LD\u0130R\u0130M ve DAVA A\u00c7MA S\u00dcRES\u0130 <\/p>\n<p>Kira hukuku, tahliye dava a\u00e7ma s\u00fcrelerinin belirlenmesinde s\u0131k\u0131 \u015fekil \u015fartlar\u0131na tabi tutulmu\u015ftur. \u0130htiya\u00e7 sebebine dayal\u0131 tahliye davas\u0131n\u0131n hangi s\u00fcrede a\u00e7\u0131laca\u011f\u0131 TBK 350\u2019de d\u00fczenlenmi\u015ftir. Buna g\u00f6re; belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir. Yaz\u0131m\u0131z\u0131n konusu belirli s\u00fcreli kira s\u00f6zle\u015fmeleri oldu\u011fundan sadece bu y\u00f6nde a\u00e7\u0131klama yap\u0131lacakt\u0131r.<\/p>\n<p>Bu noktada belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00fcre sonunda s\u00f6zle\u015fmenin belirli s\u00fcreli mi yoksa belirsiz s\u00fcreli olarak m\u0131 devam eti\u011finin tespiti olduk\u00e7a \u00f6nemlidir. Zira s\u00f6zle\u015fmenin belirli-belirsiz olmas\u0131 dava a\u00e7ma s\u00fcresi bak\u0131m\u0131ndan farkl\u0131l\u0131k yaratmaktad\u0131r. Bu da davan\u0131n usulden reddedilme riskini getirmektedir.<\/p>\n<p>Uygulamada belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131n\u0131n s\u00fcre sonunda \u201cbelirli devam edece\u011fi\u201d kural\u0131nda bilgi kirlili\u011fi bulunmaktad\u0131r. Bunun sebebinin kira hukuku genel h\u00fck\u00fcmlerinde s\u00fcrenin sona ermesiyle s\u00f6zle\u015fmenin sona ermesini d\u00fczenleyen TBK 327 h\u00fckm\u00fc oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyoruz. \u0130lgili h\u00fckme g\u00f6re; \u201cA\u00e7\u0131k veya \u00f6rt\u00fcl\u00fc bi\u00e7imde bir s\u00fcre belirlenmi\u015fse, kira s\u00f6zle\u015fmesi bu s\u00fcrenin sonunda kendili\u011finden sona erer. Taraflar, bu durumda, a\u00e7\u0131k bir anla\u015fma olmaks\u0131z\u0131n kira ili\u015fkisini s\u00fcrd\u00fcr\u00fcrlerse, kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6n\u00fc\u015f\u00fcr.\u201d Burada \u00f6nemle alt\u0131 \u00e7izilmesi gereken husus bu h\u00fck\u00fcm konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 bak\u0131m\u0131ndan uygulanmamas\u0131d\u0131r. <\/p>\n<p>TBK 347 h\u00fckm\u00fc gere\u011fi, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda belirli s\u00fcreli s\u00f6zle\u015fme s\u00fcre bitiminde belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6nmemektedir. S\u00f6zle\u015fme ayn\u0131 \u015fartlarda 1 y\u0131l belirli s\u00fcreli olarak uzar. \u201cBuna g\u00f6re mahkemece i\u015fin esas\u0131 incelenerek sonucuna g\u00f6re bir karar verilmesi gerekirken, konut ve \u00e7at\u0131l\u0131 i\u015fyerlerinde s\u00f6zle\u015fmenin uzamas\u0131 halinde belirsiz s\u00fcreli hale gelmeyece\u011fi, s\u00f6zle\u015fmenin belirli s\u00fcreli oldu\u011fu dikkate al\u0131nmadan yaz\u0131l\u0131 \u015fekilde karar verilmesi do\u011fru olmam\u0131\u015f, bozmay\u0131 gerektirmi\u015ftir.\u201d[1]<\/p>\n<p>Belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131n\u0131n s\u00fcre bitiminde belirsiz s\u00fcreli s\u00f6zle\u015fmeye d\u00f6nmeyece\u011fini etrafl\u0131ca izah ettikten sonra bildirimde bulunma hususunun ve dava a\u00e7ma s\u00fcresinin tespiti daha sa\u011fl\u0131kl\u0131 \u015fekilde yap\u0131lacakt\u0131r. TBK 350\u2019de d\u00fczenlendi\u011fi gibi ihtiya\u00e7 sebebine dayal\u0131 tahliye davas\u0131 belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonundan itibaren bir ay i\u00e7inde a\u00e7\u0131labilir. Ancak bildirim hususu dava a\u00e7ma s\u00fcresinde \u00f6zel bir durum yaratabilmektedir. \u015e\u00f6yle ki,<\/p>\n<p>Dava a\u00e7madan \u00f6nce kirac\u0131ya ihtarname \u00e7ekme gereklili\u011fi konusunda ikili bir ayr\u0131m bulunmaktad\u0131r. Kural olarak, dava a\u00e7madan \u00f6nce kirac\u0131ya ihtarname \u00e7ekme zorunlulu\u011fu bulunmamaktad\u0131r. Di\u011fer bir ifadeyle kiraya veren, s\u00f6zle\u015fmeden belirtilen bu s\u00fcreye uygun olarak yaz\u0131l\u0131 \u015fekilde bildirimde bulunmak zorundad\u0131r. An\u0131lan s\u00f6zle\u015fme h\u00fckm\u00fc gere\u011fince davac\u0131 taraf\u0131ndan s\u00f6zle\u015fme bitim tarihinden 2 ay \u00f6nce daval\u0131ya g\u00f6nderilen bir ihtar bulunmad\u0131\u011f\u0131ndan kira s\u00f6zle\u015fmesi ayn\u0131 ko\u015fullarla bir y\u0131l uzam\u0131\u015f olup 11.09.2015 tarihinde a\u00e7\u0131lan dava s\u00fcresinde de\u011fildir. A\u00e7\u0131klanan bu olgu kar\u015f\u0131s\u0131nda s\u00fcresinde a\u00e7\u0131lmayan davan\u0131n reddine karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde kiralanan\u0131n tahliyesine karar verilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r.\u201d[2]<\/p>\n<p>\u201cOlay\u0131m\u0131za gelince; Taraflar aras\u0131nda imzalanan 01.01.2012 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi hususunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Kira s\u00f6zle\u015fmesinin 19. maddesinde, Kontrat\u0131n sona ermesinden bir ay evvel taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 s\u00fcrece kontrat\u0131n yenilenmi\u015f kabul edilece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Davac\u0131 taraf\u0131ndan 11\/12\/2012 tarihinde tebli\u011f edilen ihtarname ile ihtiya\u00e7 nedeniyle ta\u015f\u0131nmaz\u0131n tahliye edilmesi bildirilmi\u015f kiralanan\u0131n tahliye edilmemesi \u00fczerine 30.01.2013 tarihinde a\u00e7\u0131lan davada i\u015fyeri ihtiyac\u0131 nedeniyle tahliyeye karar verilmesi istenmi\u015ftir. Davac\u0131n\u0131n g\u00f6nderdi\u011fi ihtarname 1 ay \u00f6ncesi kapsamad\u0131\u011f\u0131ndan s\u00fcresinde kabul edilemez.\u201d [3]<\/p>\n<p>B\u00f6lge Adliye Mahkemesi kararlar\u0131na bak\u0131ld\u0131\u011f\u0131nda ise, Yarg\u0131tay uygulamas\u0131na paralel karar verildi\u011fini g\u00f6rmekteyiz. \u201cSomut dava bu kapsamda de\u011ferlendirildi\u011finde, davac\u0131n\u0131n e\u015fi ile birlikte ta\u015f\u0131nmaz\u0131 13.03.2020&#8217;de sat\u0131n ald\u0131klar\u0131, taraflar aras\u0131ndaki kira s\u00f6zle\u015fmesinin 01.05.2020 ba\u015flang\u0131\u00e7 tarihli oldu\u011fu, kira s\u00f6zle\u015fmesinin 7. maddesinde, kontrat\u0131n sona ermesinden 60 g\u00fcn evvel taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 s\u00fcrece kontrat\u0131n yenilenmi\u015f kabul edilece\u011finin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131, davac\u0131 15\/04\/2021&#8217;de ihtar g\u00f6ndermekle birlikte taraflar s\u00f6zle\u015fmenin sona ermesinden 60 g\u00fcn \u00f6nce s\u00f6zle\u015fmenin devam etmeyece\u011fine ili\u015fkin yaz\u0131l\u0131 ihtar g\u00f6ndermediklerinden s\u00f6zle\u015fmenin 01\/05\/2020 tarihinden itibaren 1 y\u0131l s\u00fcreyle yenilendi\u011fi, bu durumda mahkemece dava s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131ndan davan\u0131n reddine karar verilmesi gerekirken davan\u0131n kabul\u00fcne karar verilmesi hatal\u0131 oldu\u011fundan daval\u0131n\u0131n istinaf talebinin kabul\u00fcne karar verilmi\u015ftir.\u201d[4]<\/p>\n<p>\u201c01\/08\/2017 tarihli kira s\u00f6zle\u015fmesinin hususi \u015fartlar 7. Maddesinde &#8221; s\u00f6zle\u015fme s\u00fcresi olan bir y\u0131l\u0131n sona ermesinden 45 g\u00fcn \u00f6nce kirac\u0131 ve kiralayan taraf\u0131ndan s\u00f6zle\u015fmenin feshi yaz\u0131l\u0131 olarak bildirilmedi\u011fi takdirde s\u00f6zle\u015fme ayn\u0131 ko\u015fullar alt\u0131nda % 10 un alt\u0131na d\u00fc\u015fmeyecek \u015fekilde y\u0131ll\u0131k \u00fcfe ortalamas\u0131nda art\u0131\u015fla bir y\u0131l daha uzat\u0131lm\u0131\u015f say\u0131l\u0131r &#8221; \u00f6nceden ihbar \u015fart\u0131 olup taraflar\u0131n serbest iradeleri ile s\u00f6zle\u015fmeye koymu\u015f olduklar\u0131 h\u00fck\u00fcmler taraflar y\u00f6n\u00fcnden ba\u011flay\u0131c\u0131 ve ge\u00e7erlidir. Davac\u0131 taraf\u0131ndan daval\u0131ya g\u00f6nderildi\u011fi anla\u015f\u0131lan s\u00f6zle\u015fmenin ihtiya\u00e7 nedeniyle yenilenmeyece\u011fi iradesini bildirir ihtarnamenin daval\u0131ya s\u00f6zle\u015fmenin bitiminden 45 g\u00fcn \u00f6nce \u00f6nce tebli\u011f edilmesi gerektigi halde, 22\/06\/2021 tarihinde tebli\u011f edildi\u011fi, bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerine getirilmedi\u011fi, (s\u00f6zle\u015fmede belirtilen 45 g\u00fcn \u00f6nce feshi ihbar\u0131n 39 g\u00fcn \u00f6nce yap\u0131ld\u0131\u011f\u0131) ihtar\u0131n s\u00fcresi i\u00e7inde yap\u0131lmad\u0131\u011f\u0131, davan\u0131n s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131ndan davan\u0131n reddine karar verilmesi gerektigi, daval\u0131n\u0131n istinaf nedenlerinin de\u011fi\u015fik gerek\u00e7e ile yerinde oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d[5]<\/p>\n<p>\u201cKira s\u00f6zle\u015fmesinin \u00f6zel ko\u015fullar 2. maddesinde; s\u00f6zle\u015fmenin sona ermesinden iki ay \u00f6nce taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 takdirde s\u00f6zle\u015fmenin bir y\u0131l daha uzam\u0131\u015f ve yenilenmi\u015f olaca\u011f\u0131 kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Bu d\u00fczenleme ge\u00e7erlidir ve taraflar\u0131 ba\u011flar. Davac\u0131 kiralayan taraf\u0131ndan s\u00f6zle\u015fmenin bitim tarihi olan 15.7.2016 tarihinden 2 ay \u00f6nce feshi ihbar g\u00f6nderilmemesi nedeniyle s\u00f6zle\u015fmenin 2.maddesi gere\u011fince dayanak s\u00f6zle\u015fme ayn\u0131 \u015fartlarla bir y\u0131l daha uzam\u0131\u015ft\u0131r. Bu durumda 21.7.2016 tarihinde a\u00e7\u0131lan dava s\u00fcresinde de\u011fildir. Dava s\u00fcresi kamu d\u00fczenine ili\u015fkin olup H\u00e2kim taraf\u0131ndan re&#8217;sen her a\u015famada dikkate al\u0131nmas\u0131 gerekmektedir. Mahkemece davan\u0131n s\u00fcresinde a\u00e7\u0131lmamas\u0131 nedeniyle s\u00fcreden reddine karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde karar verilmesi do\u011fru olmad\u0131\u011f\u0131ndan, daval\u0131 vekilinin istinaf kanun yolu ba\u015fvurusunun kabul\u00fc ile a\u015fa\u011f\u0131daki \u015fekilde h\u00fck\u00fcm kurulmu\u015ftur.\u201d[6]<\/p>\n<p>B\u00f6lge Adliye Mahkemesi kararlar\u0131nda \u0130stanbul BAM 35. Hukuk Dairesine ve Bursa BAM 4. Hukuk Dairesine ayr\u0131 bir parantez a\u00e7mam\u0131z gerekecektir. \u0130stanbul BAM 35. Hukuk Dairesindeki heyetler bu konuda farkl\u0131 y\u00f6nde kararlar vermektedir. Bir heyet, \u201cKira s\u00f6zle\u015fmesinin 20.maddesinde &#8220;&#8230;Kontrat\u0131n sona ermesinden bir ay evvel taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 s\u00fcrece kontrat yenilenmi\u015f kabul edilir.&#8221; h\u00fckm\u00fcn\u00fcn kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131, getirilen d\u00fczenlemenin tahliye davas\u0131 a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen bir ihbar \u015fart\u0131 olmad\u0131\u011f\u0131, dava a\u00e7ma s\u00fcresinin TBK&#8217;n\u0131n 350. maddesi ile kira s\u00fcresinin bitiminden itibaren bir ay olarak d\u00fczenlendi\u011fi, an\u0131lan s\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn TBK 350. maddesindeki yasal dava a\u00e7ma s\u00fcresini bertaraf etmeyece\u011fi, davan\u0131n 1 ayl\u0131k yasal s\u00fcrede a\u00e7\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc ile mahkemenin esasa girerek davay\u0131 sonu\u00e7land\u0131rmas\u0131 gerekirken, davan\u0131n s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131na ili\u015fkin karar\u0131n\u0131n hatal\u0131 oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d [7] Ayn\u0131 y\u00f6nde bknz.[8]<\/p>\n<p>Di\u011fer heyet ise, Yarg\u0131tay ve di\u011fer B\u00f6lge Adliye Mahkemeleriyle (Bursa hari\u00e7) paralel \u015fekilde karar vermektedir. \u201cTaraflar aras\u0131nda 05.04.2010 tarihli ve 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi konusunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. S\u00f6zle\u015fmenin Hususi \u015eartlar B\u00f6l\u00fcm\u00fcn\u00fcn 11. Maddesinde kontrat\u0131n sona ermesinden 1 ay \u00f6nce taraflar yaz\u0131l\u0131 olarak ihtarda bulunmad\u0131klar\u0131 taktirde kontrat\u0131n 1 y\u0131l daha uzayaca\u011f\u0131 ve yenilenece\u011fi kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Davac\u0131 taraf\u0131ndan daval\u0131ya Ankara &#8230; Noterli\u011finin 01.04.2019 tarihli &#8230; yevmiye say\u0131l\u0131 ithamnamesiyle ta\u015f\u0131nmazda yeniden in\u015fa ve imar \u00e7al\u0131\u015fmalar\u0131n\u0131n ba\u015flad\u0131\u011f\u0131, kira s\u00fcresinin bitiminde 05.04.2019 tarihi itibar\u0131yla ta\u015f\u0131nmaz\u0131n tahliye edilmesi aksi takdirde tahliye davas\u0131 a\u00e7\u0131laca\u011f\u0131n\u0131n ihtar edildi\u011fi, ihtarnamenin 09.04.2019 tarihinde tebli\u011f edildi\u011fi g\u00f6r\u00fclm\u00fc\u015fse de, s\u00f6zle\u015fmenin 11.madde h\u00fckm\u00fcyle kararla\u015ft\u0131r\u0131lan ihtar \u015fart\u0131n\u0131n s\u00fcresinde yerine getirilmedi\u011fi anla\u015f\u0131lm\u0131\u015f, kira s\u00f6zle\u015fmesinin ayn\u0131 ko\u015fullarla 05.04.2019 tarihinden itibaren bir y\u0131l s\u00fcre ile uzad\u0131\u011f\u0131n\u0131n kabul\u00fc gerekmi\u015ftir. Bu durumda TBK 353.maddesinin uygulanma imk\u00e2n\u0131 bulunmad\u0131\u011f\u0131, Yarg\u0131tay 3.HD&#8217;nin 2017\/16499 Esas, 2017\/17280 Karar say\u0131l\u0131, 07\/12\/2017 tarihli ilam\u0131 ile ayn\u0131 Dairenin 2018\/1166 Esas, 2018\/2175 Karar say\u0131l\u0131 08\/03\/2018 tarihli benzer emsal kararlar\u0131n\u0131n da ayn\u0131 y\u00f6nde oldu\u011fu nazara al\u0131nd\u0131\u011f\u0131nda, dava s\u00fcresinde a\u00e7\u0131lmad\u0131\u011f\u0131ndan reddine karar verilmesi gerekirken, davan\u0131n kabul\u00fcne ili\u015fkin karar\u0131n yerinde olmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d[9] Ayn\u0131 y\u00f6nde bknz.[10]<\/p>\n<p>Bursa B\u00f6lge Adliye Mahkemesi de Yarg\u0131tay g\u00f6r\u00fc\u015f\u00fcn\u00fc benimsememi\u015ftir. \u201cSomut olayda ise kira s\u00f6zle\u015fmesinin hususi \u015fartlar 19. maddesindeki d\u00fczenleme yaln\u0131zca bildirim yoluyla feshe ili\u015fkin bir d\u00fczenleme olup, bu d\u00fczenlemenin yorum yolu ile geni\u015fletilip t\u00fcm tahliye davalar\u0131n\u0131n feshi ihbar ko\u015fuluna ba\u011flanm\u0131\u015f oldu\u011fu kabul edilemez. S\u00f6zle\u015fmenin 19. maddesindeki d\u00fczenlemenin kira s\u00f6zle\u015fmesinin sona erdirilmesine ili\u015fkin t\u00fcm dava sebepleri y\u00f6n\u00fcnden feshi ihbar ko\u015fulu olarak kabul edilmesi amac\u0131 a\u015fan bir yorum olacakt\u0131r. \u2026. Dairemizin 2018\/586 Esas, 2018\/621 Karar say\u0131l\u0131 karar\u0131nda, kira s\u00f6zle\u015fmelerinde bulunan benzer ko\u015fullar\u0131n s\u00f6zle\u015fmenin dava yoluyla sona erdirilmesi sebepleri i\u00e7inde yer alan ihtiya\u00e7 nedeniyle tahliye davalar\u0131nda feshi ihbar ko\u015fulu olarak ge\u00e7erli oldu\u011fu kabul edilmi\u015f ise de, dairemizce yap\u0131lan de\u011ferlendirmede bu i\u00e7tihatlara uymak m\u00fcmk\u00fcn olmam\u0131\u015f ve dairemiz uygulamas\u0131n\u0131n buna g\u00f6re de\u011fi\u015ftirilmesi gerekmi\u015ftir. Nitekim, \u0130stanbul B\u00f6lge Adliye Mahkemesi 35. Hukuk Dairesi&#8217;nin 2021\/2114 Esas, 2023\/2227 Karar say\u0131l\u0131 karar\u0131nda da benzer d\u00fczenlemenin s\u00f6zle\u015fmenin dava yoluyla sona erdirilmesi y\u00f6n\u00fcnden feshi ihbar ko\u015fulu olarak ge\u00e7ersiz oldu\u011fu kabul edilmi\u015ftir.\u201d[11] Bu kararda Bursa 4. Hukuk Dairesinin \u00f6nceki g\u00f6r\u00fc\u015f\u00fcn\u00fc de\u011fi\u015ftirdi\u011fini g\u00f6r\u00fcyoruz.<\/p>\n<p>IV. SONU\u00c7 <\/p>\n<p>Belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ihtiya\u00e7 sebebine dayal\u0131 tahliye davas\u0131 a\u00e7madan evvel yaz\u0131l\u0131 bildirimde bulunma zorunlulu\u011fu bulunmamaktad\u0131r. Ancak taraflar aras\u0131nda imzalanan s\u00f6zle\u015fmede taraflar\u0131n ya da kiraya verenin belirli s\u00fcre \u00f6nceden bildirimde bulunmamas\u0131 halinde s\u00f6zle\u015fmenin yenilece\u011fi \u015feklinde bir h\u00fck\u00fcm varsa, kiraya veren s\u00f6zle\u015fmedeki s\u00fcreye g\u00f6re yaz\u0131l\u0131 bildirimde bulunmak zorundad\u0131r. Aksi halde, dava her ne kadar s\u00fcre bitiminden itibaren 1 ay i\u00e7inde a\u00e7\u0131lsa da s\u00fcresinde a\u00e7\u0131lmam\u0131\u015f kabul edilecektir.<\/p>\n<p>\u0130stanbul B\u00f6lge Adliye Mahkemesinde kira uyu\u015fmazl\u0131klar\u0131na 5 ayr\u0131 daire (35.,36.,49.,54.,55.) bakmaktad\u0131r.
