BA\u015eVURUNUN KONUSU<\/p>\n<p>1. Ba\u015fvuru, velayet alt\u0131nda bulunan ba\u015fvurucuya bebeklik d\u00f6nemi a\u015f\u0131lar\u0131n\u0131n uygulanmas\u0131 ebeveyn taraf\u0131ndan kabul edilmedi\u011fi h\u00e2lde bu hususta Mahkemece sa\u011fl\u0131k tedbiri uygulanmas\u0131na karar verilmesi nedeniyle maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131n\u0131n ihlali iddias\u0131na ili\u015fkindir. <\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru, 26\/2\/2013 tarihinde Sivasl\u0131 \u0130cra Hukuk Mahkemesi vas\u0131tas\u0131yla yap\u0131lm\u0131\u015ft\u0131r. \u0130dari y\u00f6nden yap\u0131lan \u00f6n inceleme neticesinde ba\u015fvurunun Komisyona sunulmas\u0131na engel te\u015fkil edecek bir eksikli\u011finin bulunmad\u0131\u011f\u0131 tespit edilmi\u015ftir.<\/p>\n<p>3. Birinci B\u00f6l\u00fcm \u0130kinci Komisyonunca, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir. <\/p>\n<p>4. B\u00f6l\u00fcm taraf\u0131ndan 7\/11\/2013 tarihli toplant\u0131da, ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>5. Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) ba\u015fvuru konusu olay ve olgular bildirilmi\u015f, ba\u015fvuru belgelerinin bir \u00f6rne\u011fi g\u00f6r\u00fc\u015f i\u00e7in g\u00f6nderilmi\u015ftir. Bakanl\u0131\u011f\u0131n 27\/12\/2013 tarihli g\u00f6r\u00fc\u015f yaz\u0131s\u0131 7\/1\/2014 tarihinde ba\u015fvurucu temsilcisine tebli\u011f edilmi\u015f olup ba\u015fvurucu taraf\u0131ndan Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 21\/1\/2014 tarihli beyan dilek\u00e7esi ibraz edilmi\u015ftir.<\/p>\n<p>6. Birinci B\u00f6l\u00fcm taraf\u0131ndan 14\/10\/2015 tarihinde yap\u0131lan toplant\u0131da ba\u015fvurunun, niteli\u011fi itibar\u0131yla Genel Kurul taraf\u0131ndan karara ba\u011flanmas\u0131 gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fcnden Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 28. maddesinin (3) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca Genel Kurula sevkine karar verilmi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR<\/p>\n<p>A. Olaylar<\/p>\n<p>7. Ba\u015fvuru formu ve ekleri ile ba\u015fvuruya konu yarg\u0131lama dosyas\u0131 i\u00e7eri\u011finden tespit edilen ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>8. Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 U\u015fak \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce 2\/11\/2012 havale tarihli dilek\u00e7e ile ba\u015fvurucu \u00e7ocu\u011fun bebeklik d\u00f6nemi a\u015f\u0131lar\u0131n\u0131n anne ve babas\u0131 taraf\u0131ndan yapt\u0131r\u0131lmad\u0131\u011f\u0131ndan bahisle \u00e7ocuk hakk\u0131nda 3\/7\/2005 tarihli ve 5395 say\u0131l\u0131 \u00c7ocuk Koruma Kanunu\u2019nun 5. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendi uyar\u0131nca sa\u011fl\u0131k tedbiri uygulanmas\u0131na karar verilmesi talep edilmi\u015ftir.<\/p>\n<p>9. Sivasl\u0131 Asliye Hukuk Mahkemesinin 5\/11\/2012 tarihli ve E.2012\/319, K.2012\/235 say\u0131l\u0131 karar\u0131yla \u201cGeni\u015fletilmi\u015f Ba\u011f\u0131\u015f\u0131klama Program\u0131\u201dnda yer alan a\u015f\u0131lar\u0131n \u00f6nemiyle alakal\u0131 olarak yap\u0131lan a\u00e7\u0131klama ve e\u011fitime ra\u011fmen ebeveynleri taraf\u0131ndan a\u015f\u0131 uygulanmas\u0131na izin verilmeyen \u00e7ocuklar\u0131n 5395 say\u0131l\u0131 Kanun\u2019un 3. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendi uyar\u0131nca korunmaya muhta\u00e7 \u00e7ocuk olarak kabul\u00fc gerekti\u011finden bahisle \u00e7ocuk hakk\u0131nda, belirtilen Kanun\u2019un 5. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendi gere\u011fince sa\u011fl\u0131k tedbiri uygulanmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucu taraf\u0131ndan, verilen tedbir karar\u0131 aleyhine yap\u0131lan itiraz U\u015fak Aile Mahkemesinin 7\/1\/2013 tarihli ve E.2013\/15, K.2013\/5 say\u0131l\u0131 karar\u0131 ile reddedilmi\u015f; ret karar\u0131 30\/1\/2013 tarihinde ba\u015fvurucu temsilcisine tebli\u011f edilmi\u015ftir.<\/p>\n<p>11. 26\/2\/2013 tarihinde bireysel ba\u015fvuruda bulunulmu\u015ftur.<\/p>\n<p>12. Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 U\u015fak \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan Anayasa Mahkemesine hitaben g\u00f6nderilen 7\/7\/2015 tarihli yaz\u0131 ekinde yer alan ve ba\u015fvurucuya tatbikine karar verilen sa\u011fl\u0131k tedbirinin infaz\u0131 kapsam\u0131nda tutulan 24\/6\/2014 tarihli tutanakta, s\u00f6z konusu sa\u011fl\u0131k tedbirinin uygulanmas\u0131 kapsam\u0131nda ba\u015fvurucu temsilcisi ile yap\u0131lan g\u00f6r\u00fc\u015fme s\u0131ras\u0131nda, ilgili tedbir hakk\u0131nda bireysel ba\u015fvuruda bulunuldu\u011funun belirtildi\u011fi, bunun \u00fczerine durumun yetkili halk sa\u011fl\u0131\u011f\u0131 \u015fube m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirildi\u011fi, yap\u0131lan g\u00f6r\u00fc\u015fme sonras\u0131nda bireysel ba\u015fvuruya ili\u015fkin ba\u015fvuru evrak\u0131 ile birlikte tutulan tutana\u011f\u0131n g\u00f6nderilmesinin talep edilmesi \u00fczerine durumun tutana\u011fa ba\u011fland\u0131\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>13. Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 T\u00fcrkiye Halk Sa\u011fl\u0131\u011f\u0131 Kurumu (Halk Sa\u011fl\u0131\u011f\u0131 Kurumu ) taraf\u0131ndan Anayasa Mahkemesine hitaben g\u00f6nderilen 7\/7\/2015 tarihli yaz\u0131da -zorunlu a\u015f\u0131 uygulamas\u0131n\u0131n ve Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n 25\/2\/2008 tarihli ve 2008\/4 say\u0131l\u0131 Geni\u015fletilmi\u015f Ba\u011f\u0131\u015f\u0131klama Program\u0131 konulu Genelgesinin kanuni dayana\u011f\u0131 ba\u011flam\u0131nda- 24\/4\/1930 tarihli ve 1593 say\u0131l\u0131 Umumi H\u0131fz\u0131ss\u0131hha Kanunu\u2019nun 1., 2. ve 3. maddeleri \u00e7er\u00e7evesinde Bakanl\u0131\u011fa verilen yetkilerden bahsedilmi\u015f; s\u00f6z konusu Genelgenin uygulamaya konuldu\u011fu tarihte y\u00fcr\u00fcrl\u00fckte bulunan 13\/12\/1983 tarihli ve 181 say\u0131l\u0131 m\u00fclga Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname ile h\u00e2lihaz\u0131rda y\u00fcr\u00fcrl\u00fckte bulunan 11\/10\/2011 tarihli ve 663 say\u0131l\u0131 Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ve Ba\u011fl\u0131 Kurulu\u015flar\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname h\u00fck\u00fcmlerinden s\u00f6z edilerek halk sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve geli\u015ftirilmesi, hastal\u0131k risklerinin azalt\u0131lmas\u0131 ve \u00f6nlenmesi, sa\u011fl\u0131k i\u00e7in risk olu\u015fturan fakt\u00f6rlerle m\u00fccadele edilmesi, bula\u015f\u0131c\u0131 ve bula\u015f\u0131c\u0131 olmayan kronik hastal\u0131klar ve belirli hastal\u0131k ve risk gruplar\u0131 ile ilgili izleme, inceleme, ara\u015ft\u0131rma, ba\u011f\u0131\u015f\u0131klama ve kontrol \u00e7al\u0131\u015fmalar\u0131 yap\u0131lmas\u0131 g\u00f6revinin Halk Sa\u011fl\u0131\u011f\u0131 Kurumuna verildi\u011fi belirtilmi\u015ftir. S\u00f6z konusu yaz\u0131da ayr\u0131ca, 1593 say\u0131l\u0131 Kanun\u2019un 72. maddesinde yer alan \u201cHastalara veya hastal\u0131\u011fa maruz bulunanlara serum ve a\u015f\u0131 tatbiki\u201d ifadesini i\u00e7eren h\u00fck\u00fcmle zorunlu a\u015f\u0131 uygulamas\u0131n\u0131n 1593 say\u0131l\u0131 Kanun\u2019un 57. maddesinde belirtilen hastal\u0131klardan birinin zuhuru veya zuhurundan \u015f\u00fcphelenilmesi durumunda al\u0131nacak tedbirler aras\u0131nda say\u0131ld\u0131\u011f\u0131 ifade edilmi\u015ftir. Bunun yan\u0131 s\u0131ra, 1593 say\u0131l\u0131 Kanun\u2019un 64. maddesi uyar\u0131nca 57. maddede belirtilen hastal\u0131klardan ba\u015fka bir hastal\u0131\u011f\u0131n istilai \u015fekil almas\u0131 veya b\u00f6yle bir tehlikenin ba\u015f g\u00f6stermesi durumunda da ilgili hastal\u0131\u011fa kar\u015f\u0131 1593 say\u0131l\u0131 Kanun\u2019da yer alan tedbirlerin al\u0131nmas\u0131 vazifesinin de Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na verildi\u011fi, s\u00f6z konusu d\u00fczenleme kar\u015f\u0131s\u0131nda 57. maddede belirtilen hastal\u0131klar haricinde olmakla birlikte di\u011fer bula\u015f\u0131c\u0131 ve salg\u0131n hastal\u0131klar\u0131n da zorunlu a\u015f\u0131 uygulamas\u0131 kapsam\u0131nda de\u011ferlendirilebilmesi imk\u00e2n\u0131 bulundu\u011fu belirtilmi\u015ftir.<\/p>\n<p>B. \u0130lgili Hukuk<\/p>\n<p>14. 5395 say\u0131l\u0131 Kanun\u2019un \u201cTan\u0131mlar\u201d ba\u015fl\u0131kl\u0131 3. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendinin (1) numaral\u0131 alt bendi \u015f\u00f6yledir:<\/p>\n<p> \u201c(1) Bu Kanunun uygulanmas\u0131nda;<\/p>\n<p> a) \u00c7ocuk: Daha erken ya\u015fta ergin olsa bile, onsekiz ya\u015f\u0131n\u0131 doldurmam\u0131\u015f ki\u015fiyi; bu kapsamda, <\/p>\n<p> 1. Korunma ihtiyac\u0131 olan \u00e7ocuk: Bedensel, zihinsel, ahlaki, sosyal ve duygusal geli\u015fimi ile ki\u015fisel g\u00fcvenli\u011fi tehlikede olan, ihmal veya istismar edilen ya da su\u00e7 ma\u011fduru \u00e7ocu\u011fu,<\/p>\n<p> \u0130fade eder.\u201d<\/p>\n<p>15. 5395 say\u0131l\u0131 Kanun\u2019un \u201cKoruyucu ve destekleyici tedbirler\u201d ba\u015fl\u0131kl\u0131 5. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendi \u015f\u00f6yledir:<\/p>\n<p> \u201c(1) Koruyucu ve destekleyici tedbirler, \u00e7ocu\u011fun \u00f6ncelikle kendi aile ortam\u0131nda korunmas\u0131n\u0131 sa\u011flamaya y\u00f6nelik dan\u0131\u015fmanl\u0131k, e\u011fitim, bak\u0131m, sa\u011fl\u0131k ve bar\u0131nma konular\u0131nda al\u0131nacak tedbirlerdir. Bunlardan;<\/p>\n<p> \u2026<\/p>\n<p> d) Sa\u011fl\u0131k tedbiri, \u00e7ocu\u011fun fiziksel ve ruhsal sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve tedavisi i\u00e7in gerekli ge\u00e7ici veya s\u00fcrekli t\u0131bb\u00ee bak\u0131m ve rehabilitasyonuna, ba\u011f\u0131ml\u0131l\u0131k yapan maddeleri kullananlar\u0131n tedavilerinin yap\u0131lmas\u0131na,<\/p>\n<p> Y\u00f6nelik tedbirdir.\u201d<\/p>\n<p>16. 11\/4\/1928 tarihli ve 1219 say\u0131l\u0131 Tababet ve \u015euabat\u0131 Sanatlar\u0131n\u0131n Tarz\u0131 \u0130cras\u0131na Dair Kanun\u2019un 70. maddesinin ilk c\u00fcmlesi \u015f\u00f6yledir:<\/p>\n<p> \u201cTabipler, di\u015f tabipleri ve di\u015f\u00e7iler yapacaklar\u0131 her nevi ameliye i\u00e7in hastan\u0131n, hasta k\u00fc\u00e7\u00fck veya taht\u0131 hacirde ise veli veya vasisinin evvelemirde muvafakat\u0131n\u0131 al\u0131rlar.\u201d<\/p>\n<p>17. 1593 say\u0131l\u0131 Kanun\u2019un 57. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cKolera, veba (B\u00fcbon veya zat\u00fcrree \u015fekli), lekeli humma, karahumma (hummayi tiroidi) daimi surette basil \u00e7\u0131karan mikrop hamilleri dahi &#8211; paratifoit hummas\u0131 veya her nevi g\u0131da maddeleri tesemm\u00fcmat\u0131, \u00e7i\u00e7ek, difteri (Ku\u015fpalaz\u0131) &#8211; b\u00fct\u00fcn tevkiat\u0131 dahi sari beyin hummas\u0131 (\u0130ltihab\u0131 sahayai dima\u011fii \u015fevkii m\u00fcstevli), uyku hastal\u0131\u011f\u0131 (\u0130ltihab\u0131 dima\u011fii sari), dizanteri (Basilli ve amipli), lohusa hummas\u0131 (Hummai nifas\u0131) ruam, k\u0131z\u0131l, \u015farbon, felci t\u0131fli (\u0130ltihab\u0131 nuhai kuddamii sincabii hadd\u0131 tifli), k\u0131zam\u0131k, c\u00fczam (Miskin), hummai racia ve malta hummas\u0131 hastal\u0131klar\u0131ndan biri zuhur eder veya bunlar\u0131n birinden \u015f\u00fcphe edilir veyahut bu hastal\u0131klardan vefiyat vuku bulur veya mevtin bu hastal\u0131klardan biri sebebiyle husule geldi\u011finden \u015f\u00fcphe olunursa a\u015fa\u011f\u0131daki maddelerde zikredilen kimseler vak&#8217;ay\u0131 haber verme\u011fe mecburdurlar. Kudurmu\u015f veya kuduz \u015f\u00fcpheli bir hayvan taraf\u0131ndan \u0131s\u0131r\u0131lmalar\u0131, kuduza m\u00fcptela hastalar\u0131n veya kuduzdan \u00f6lenlerin ihbar\u0131 da mecburidir.\u201d<\/p>\n<p>18. 1593 say\u0131l\u0131 Kanun\u2019un 64. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201c57 nci maddede zikredilenlerden ba\u015fka her hangi bir hastal\u0131k istilai \u015fekil ald\u0131\u011f\u0131 veya b\u00f6yle bir tehlike ba\u015f g\u00f6sterdi\u011fi takdirde o hastal\u0131\u011f\u0131n veya her hangi bir hastal\u0131k \u015feklinin memleketin her taraf\u0131nda veya bir k\u0131sm\u0131nda ihbar\u0131 mecburi oldu\u011funu ne\u015fr\u00fc il\u00e2na ve o hastal\u0131\u011fa kar\u015f\u0131 bu kanunda mezk\u00fcr tedabirin kaffesini veya bir k\u0131sm\u0131n\u0131 tatbika S\u0131hhat ve \u0130\u00e7timai Muavenet Vekaleti salahiyettard\u0131r.\u201d<\/p>\n<p>19. 1593 say\u0131l\u0131 Kanun\u2019un 72. maddesinin birinci f\u0131kras\u0131n\u0131n (2) numaral\u0131 bendi \u015f\u00f6yledir:<\/p>\n<p> \u201c57 nci maddede zikredilen hastal\u0131klardan biri zuhur etti\u011fi veya zuhurundan \u015f\u00fcphelenildi\u011fi takdirde a\u015fa\u011f\u0131da g\u00f6sterilen tedbirler tatbik olunur:<\/p>\n<p> \u2026<\/p>\n<p> 2 &#8211; Hastalara veya hastal\u0131\u011fa maruz bulunanlara serum veya a\u015f\u0131 tatbik\u0131.\u201d<\/p>\n<p>20. 1593 say\u0131l\u0131 Kanun\u2019un 88-94. maddeleri.<\/p>\n<p>21. 1\/8\/1998 tarihli ve 23420 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan Hasta Haklar\u0131 Y\u00f6netmeli\u011fi\u2019nin \u201c\u0130lkeler\u201d kenar ba\u015fl\u0131kl\u0131 5. maddesinin birinci f\u0131krans\u0131n (d) bendi \u015f\u00f6yledir:<\/p>\n<p> \u201cSa\u011fl\u0131k hizmetlerinin sunulmas\u0131nda a\u015fa\u011f\u0131daki ilkelere uyulmas\u0131 \u015fartt\u0131r:<\/p>\n<p> \u2026<\/p>\n<p> d) T\u0131bbi zorunluluklar ve kanunlarda yaz\u0131l\u0131 haller d\u0131\u015f\u0131nda, r\u0131zas\u0131 olmaks\u0131z\u0131n ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne ve di\u011fer ki\u015filik haklar\u0131na dokunulamaz.\u201d<\/p>\n<p>22. Hasta Haklar\u0131 Y\u00f6netmeli\u011fi\u2019nin \u201cR\u0131zas\u0131 olmaks\u0131z\u0131n t\u0131bbi ameliyeye tabi tutulmama\u201d kenar ba\u015fl\u0131kl\u0131 22. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p> \u201cKanunda g\u00f6sterilen istisnalar hari\u00e7 olmak \u00fczere, kimse, r\u0131zas\u0131 olmaks\u0131z\u0131n ve verdi\u011fi r\u0131zaya uygun olmayan bir \u015fekilde t\u0131bbi ameliyeye tabi tutulamaz.\u201d<\/p>\n<p>23. Hasta Haklar\u0131 Y\u00f6netmeli\u011fi\u2019nin \u201cHastan\u0131n r\u0131zas\u0131 ve izin\u201d kenar ba\u015fl\u0131kl\u0131 24. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cT\u0131bbi m\u00fcdahalelerde hastan\u0131n r\u0131zas\u0131 gerekir. Hasta k\u00fc\u00e7\u00fck veya mahcur ise velisinden veya vasisinden izin al\u0131n\u0131r. Hastan\u0131n, velisinin veya vasisinin olmad\u0131\u011f\u0131 veya haz\u0131r bulunamad\u0131\u011f\u0131 veya hastan\u0131n ifade g\u00fcc\u00fcn\u00fcn olmad\u0131\u011f\u0131 hallerde, bu \u015fart aranmaz.<\/p>\n<p> Kanuni temsilcinin r\u0131zas\u0131n\u0131n yeterli oldu\u011fu hallerde dahi, anlat\u0131lanlar\u0131 anlayabilecekleri \u00f6l\u00e7\u00fcde, k\u00fc\u00e7\u00fck veya k\u0131s\u0131tl\u0131 olan hastan\u0131n dinlenmesi suretiyle m\u00fcmk\u00fcn oldu\u011fu kadar bilgilendirme s\u00fcrecine ve tedavisi ile ilgili al\u0131nacak kararlara kat\u0131l\u0131m\u0131 sa\u011flan\u0131r.<\/p>\n<p> Sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131 taraf\u0131ndan engellilerin durumuna uygun bilgilendirme yap\u0131lmas\u0131na ve r\u0131za al\u0131nmas\u0131na y\u00f6nelik gerekli tedbirler al\u0131n\u0131r.<\/p>\n<p> Kanuni temsilci taraf\u0131ndan r\u0131za verilmeyen hallerde, m\u00fcdahalede bulunmak t\u0131bben gerekli ise, velayet ve vesayet alt\u0131ndaki hastaya t\u0131bbi m\u00fcdahalede bulunulabilmesi; T\u00fcrk Medeni Kanununun 346 nc\u0131 ve 487 inci maddeleri uyar\u0131nca mahkeme karar\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n<p> T\u0131bbi m\u00fcdahale s\u0131ras\u0131nda iste\u011fini a\u00e7\u0131klayabilecek durumda bulunmayan bir hastan\u0131n, t\u0131bb\u00ee m\u00fcdahale ile ilgili olarak \u00f6nceden a\u00e7\u0131klam\u0131\u015f oldu\u011fu istekleri g\u00f6z \u00f6n\u00fcne al\u0131n\u0131r.<\/p>\n<p> Yeterli\u011fin zaman zaman kaybedildi\u011fi tekrarlay\u0131c\u0131 hastal\u0131klarda, hastadan yeterli\u011fi oldu\u011fu d\u00f6nemde onu kaybetti\u011fi d\u00f6nemlere ili\u015fkin yap\u0131lacak t\u0131bbi m\u00fcdahale i\u00e7in r\u0131za vermesi istenebilir.<\/p>\n<p> Hastan\u0131n r\u0131zas\u0131n\u0131n al\u0131namad\u0131\u011f\u0131 hayati tehlikesinin bulundu\u011fu ve bilincinin kapal\u0131 oldu\u011fu acil durumlar ile hastan\u0131n bir organ\u0131n\u0131n kayb\u0131na veya fonksiyonunu ifa edemez hale gelmesine yol a\u00e7acak durumun varl\u0131\u011f\u0131 halinde, hastaya t\u0131bbi m\u00fcdahalede bulunmak r\u0131zaya ba\u011fl\u0131 de\u011fildir. Bu durumda hastaya gerekli t\u0131bbi m\u00fcdahale yap\u0131larak durum kay\u0131t alt\u0131na al\u0131n\u0131r. Ancak bu durumda, m\u00fcmk\u00fcnse hastan\u0131n orada bulunan yak\u0131n\u0131 veya kanuni temsilcisi; m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde de t\u0131bbi m\u00fcdahale sonras\u0131nda hastan\u0131n yak\u0131n\u0131 veya kanuni temsilcisi bilgilendirilir. Ancak hastan\u0131n bilinci a\u00e7\u0131ld\u0131ktan sonraki t\u0131bbi m\u00fcdahaleler i\u00e7in hastan\u0131n yeterli\u011fi ve ifade edebilme g\u00fcc\u00fcne ba\u011fl\u0131 olarak r\u0131za i\u015flemlerine ba\u015fvurulur.\u201d<\/p>\n<p>24. Hasta Haklar\u0131 Y\u00f6netmeli\u011fi\u2019nin \u201cTedaviyi reddetme ve durdurma\u201d kenar ba\u015fl\u0131kl\u0131 25. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201c Kanunen zorunlu olan haller d\u0131\u015f\u0131nda ve do\u011fabilecek olumsuz sonu\u00e7lar\u0131n sorumlulu\u011fu hastaya ait olmak \u00fczere; hasta kendisine uygulanmas\u0131 planlanan veya uygulanmakta olan tedaviyi reddetmek veya durdurulmas\u0131n\u0131 istemek hakk\u0131na sahiptir. Biyot\u0131p S\u00f6zle\u015fmesi\u2019nin \u201cMuvafakat verme yetene\u011fi olmayan ki\u015filerin korunmas\u0131\u201d kenar ba\u015fl\u0131kl\u0131 6. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201c1) Muvafakat verme yetene\u011fine sahip olmayan bir kimse \u00fczerinde t\u0131bb\u00ee m\u00fcdahale, a\u015fa\u011f\u0131daki 17 ve 20\u2019nci maddelere uygun olarak, sadece onun do\u011frudan yarar\u0131 i\u00e7in yap\u0131labilir.<\/p>\n<p> 2) Yasal olarak bir m\u00fcdahaleye muvafakat verme yetene\u011fi bulunmayan bir k\u00fc\u00e7\u00fc\u011fe, sadece temsilcisinin veya kanun taraf\u0131ndan belirlenen yetkili makam, ki\u015fi veya kurumun izni ile m\u00fcdahalede bulunulabilir.<\/p>\n<p> K\u00fc\u00e7\u00fc\u011f\u00fcn fikri, ya\u015f\u0131 ve olgunluk derecesiyle orant\u0131l\u0131 bir \u015fekilde artan belirleyici bir etken olarak dikkate al\u0131nmal\u0131d\u0131r.<\/p>\n<p> 3) Bir yeti\u015fkin, yasal olarak ak\u0131l hastal\u0131\u011f\u0131, bir hastal\u0131k veya benzer nedenlerden dolay\u0131 m\u00fcdahaleye muvafakat etme yetene\u011fine sahip de\u011filse, ancak temsilcisinin veya kanun taraf\u0131ndan belirlenen yetkili makam, ki\u015fi veya kurumun izni ile m\u00fcdahalede bulunulabilir.<\/p>\n<p> \u0130lgili ki\u015fi, m\u00fcmk\u00fcn oldu\u011fu kadar izin verme s\u00fcrecine kat\u0131lmal\u0131d\u0131r.<\/p>\n<p> 4) Madde 5&#8217;de belirtilen bilgiler, benzer ko\u015fullarda yukar\u0131da 2\u2019nci ve 3\u2019\u00fcnc\u00fc paragraflarda belirtilen temsilci, yetkili makam, ki\u015fi veya kuruma da verilmelidir.<\/p>\n<p> 5) Yukar\u0131da 2\u2019nci ve 3\u2019\u00fcnc\u00fc paragraflarda belirtilen izin, ilgili ki\u015finin menfaatine daha uygun olacaksa her zaman geri \u00e7ekilebilir.\u201d<\/p>\n<p>31. Biyot\u0131p S\u00f6zle\u015fmesi\u2019nin \u201cAcil durum\u201d kenar ba\u015fl\u0131kl\u0131 8. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cAcil bir durum nedeniyle uygun muvafakat al\u0131namad\u0131\u011f\u0131nda, ilgili ki\u015finin sa\u011fl\u0131\u011f\u0131 i\u00e7in gerekli olan herhangi bir t\u0131bb\u00ee m\u00fcdahale derhal yap\u0131labilir.\u201d<\/p>\n<p>32. Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n 25\/2\/2008 tarihli ve 2008\/4 say\u0131l\u0131 Geni\u015fletilmi\u015f Ba\u011f\u0131\u015f\u0131klama Program\u0131 konulu Genelgesi.<\/p>\n<p>IV. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>33. Mahkemenin 11\/11\/2015 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da, ba\u015fvurucunun 26\/2\/2013 tarihli ve 2013\/1789 numaral\u0131 bireysel ba\u015fvurusu incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131<\/p>\n<p>34. De\u011ferlendirme<\/p>\n<p>1. Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 U\u015fak \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan Anayasa Mahkemesine hitaben g\u00f6nderilen 7\/7\/2015 tarihli yaz\u0131 ekinde yer alan ve ba\u015fvurucuya tatbikine karar verilen sa\u011fl\u0131k tedbirinin infaz\u0131 kapsam\u0131nda tutulan 24\/6\/2014 tarihli tutanakta, s\u00f6z konusu sa\u011fl\u0131k tedbirinin uygulanmas\u0131 kapsam\u0131nda ba\u015fvurucu temsilcisi ile yap\u0131lan g\u00f6r\u00fc\u015fme s\u0131ras\u0131nda, ilgili tedbir hakk\u0131nda bireysel ba\u015fvuruda bulunuldu\u011funun belirtildi\u011fi, bunun \u00fczerine durumun yetkili halk sa\u011fl\u0131\u011f\u0131 \u015fube m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirildi\u011fi, yap\u0131lan g\u00f6r\u00fc\u015fme sonras\u0131nda bireysel ba\u015fvuruya ili\u015fkin ba\u015fvuru evrak\u0131 ile tutulan tutana\u011f\u0131n birlikte g\u00f6nderilmesinin talep edilmesi \u00fczerine durumun tutana\u011fa ba\u011fland\u0131\u011f\u0131n\u0131n belirtildi\u011fi ve bu kapsamda ba\u015fvurucunun v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne y\u00f6nelik m\u00fcdahalenin fiilen ger\u00e7ekle\u015fmemi\u015f oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131ndan sa\u011fl\u0131k tedbiri uygulamas\u0131na ili\u015fkin kesinle\u015fen karar ile birlikte ba\u015fvurucunun v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne y\u00f6nelik s\u00f6z konusu m\u00fcdahaleden do\u011frudan etkilenme tehdit veya tehlikesiyle kar\u015f\u0131 kar\u015f\u0131ya oldu\u011fu ve devam eden s\u00fcre\u00e7te kar\u015f\u0131la\u015f\u0131lacak i\u015flemin karar\u0131n icras\u0131ndan ibaret olaca\u011f\u0131 g\u00f6r\u00fcld\u00fc\u011f\u00fcnden ba\u015fvurucunun, s\u00f6z konusu kamusal i\u015flem nedeniyle g\u00fcncel ve ki\u015fisel bir hakk\u0131n\u0131n do\u011frudan etkilendi\u011fi, dolay\u0131s\u0131yla ba\u015fvuruya konu ihlal iddias\u0131n\u0131n Anayasa Mahkemesinin ki\u015fi bak\u0131m\u0131ndan yetkisi kapsam\u0131nda oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>38. Ba\u015fvurunun incelenmesi neticesinde a\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan ba\u015fvurunun kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>39. Ba\u015fvurucu temsilcisi, velayeti alt\u0131nda bulunan ba\u015fvurucu \u00e7ocu\u011fa r\u0131zas\u0131 olmaks\u0131z\u0131n a\u015f\u0131 uygulanmas\u0131na ili\u015fkin karar nedeniyle Anayasa\u2019n\u0131n 17. maddesinin ihlal edildi\u011fini iddia etmi\u015ftir.<\/p>\n<p>40. Bakanl\u0131k g\u00f6r\u00fc\u015f yaz\u0131s\u0131nda ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne kar\u015f\u0131 yap\u0131lan t\u0131bbi m\u00fcdahalelerin de \u00f6zel hayat kapsam\u0131nda de\u011ferlendirilmesi gerekti\u011fi belirtilerek benzer konularda A\u0130HM taraf\u0131ndan incelenen dava ve karar \u00f6rneklerine yer verilmi\u015f, ba\u015fvuruya konu uygulaman\u0131n 5395 say\u0131l\u0131 Kanun\u2019un 3. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendi ve 5. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendi kapsam\u0131nda, benimsenen sa\u011fl\u0131k politikas\u0131 \u00e7er\u00e7evesinde k\u00fc\u00e7\u00fck ya\u015ftaki \u00e7ocuklar\u0131n ve dolay\u0131s\u0131yla toplumun sa\u011fl\u0131\u011f\u0131n\u0131 koruma \u015feklindeki me\u015fru amaca dayanarak ger\u00e7ekle\u015ftirildi\u011fi, s\u00f6z konusu a\u015f\u0131lar\u0131n do\u011fan her \u00e7ocu\u011fa yap\u0131ld\u0131\u011f\u0131, \u00e7ocuklar\u0131n geli\u015fme \u00e7a\u011f\u0131nda kar\u015f\u0131la\u015fabilecekleri muhtemel hastal\u0131klara kar\u015f\u0131 bir \u00f6nlem niteli\u011finde olan m\u00fcdahalenin bu y\u00f6n\u00fcyle gerekli oldu\u011fu ifade edilmi\u015ftir.<\/p>\n<p>41. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 sundu\u011fu beyan dilek\u00e7esinde, \u00f6zellikle ba\u015fvuruya konu uygulaman\u0131n kanuni dayana\u011f\u0131 oldu\u011fu noktas\u0131ndaki tespitlere kar\u015f\u0131 \u00e7\u0131km\u0131\u015f; ne 5395 say\u0131l\u0131 Kanun\u2019un korunmaya muhta\u00e7 \u00e7ocuklara sa\u011fl\u0131k tedbiri uygulanmas\u0131 konusunda genel nitelikteki d\u00fczenlemesinin ne de 1593 say\u0131l\u0131 Kanun\u2019un ilgili h\u00fck\u00fcmlerinin zorunlu a\u015f\u0131 uygulamas\u0131na mesnet olaca\u011f\u0131n\u0131 belirtmi\u015f ve dilek\u00e7e ekinde ayn\u0131 y\u00f6nde tespitler i\u00e7eren uzman g\u00f6r\u00fc\u015f\u00fc ile a\u015f\u0131 uygulamas\u0131 kapsam\u0131nda 5395 say\u0131l\u0131 Kanun uyar\u0131nca sa\u011fl\u0131k tedbiri uygulanmas\u0131 y\u00f6n\u00fcndeki taleplerin, zorunlu a\u015f\u0131 uygulamas\u0131n\u0131n kanuni dayana\u011f\u0131 bulunmad\u0131\u011f\u0131ndan bahisle reddine dair derece mahkemesi karar \u00f6rnekleri ibraz etmi\u015ftir.<\/p>\n<p>42. Anayasa\u2019n\u0131n 148. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 ile 6216 say\u0131l\u0131 Kanun\u2019un 45. maddesinin (1) numaral\u0131 f\u0131kras\u0131 h\u00fck\u00fcmlerine g\u00f6re Anayasa Mahkemesine yap\u0131lan bir bireysel ba\u015fvurunun esas\u0131n\u0131n incelenebilmesi i\u00e7in kamu g\u00fcc\u00fc taraf\u0131ndan m\u00fcdahale edildi\u011fi iddia edilen hakk\u0131n Anayasa\u2019da g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f olmas\u0131n\u0131n yan\u0131 s\u0131ra Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi (S\u00f6zle\u015fme) ve T\u00fcrkiye\u2019nin taraf oldu\u011fu ek protokollerin kapsam\u0131na girmesi gerekir. Bir ba\u015fka ifadeyle Anayasa ve S\u00f6zle\u015fme\u2019nin ortak koruma alan\u0131 d\u0131\u015f\u0131nda kalan bir hak ihlali iddias\u0131n\u0131 i\u00e7eren ba\u015fvurunun kabul edilebilir oldu\u011funa karar verilmesi m\u00fcmk\u00fcn de\u011fildir (Onurhan Solmaz, B. No: 2012\/1049, 26\/3\/2013, \u00a7 18). <\/p>\n<p>43. Anayasa\u2019n\u0131n \u201cKi\u015finin dokunulmazl\u0131\u011f\u0131, maddi ve manevi varl\u0131\u011f\u0131\u201d kenar ba\u015fl\u0131kl\u0131 17. maddesinin birinci ve f\u0131kralar\u0131 \u015f\u00f6yledir:<\/p>\n<p> \u201cHerkes, ya\u015fama, madd\u00ee ve manev\u00ee varl\u0131\u011f\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131na sahiptir.<\/p>\n<p> T\u0131bb\u00ee zorunluluklar ve kanunda yaz\u0131l\u0131 haller d\u0131\u015f\u0131nda, ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamaz; r\u0131zas\u0131 olmadan bilimsel ve t\u0131bb\u00ee deneylere tabi tutulamaz.\u201d <\/p>\n<p>44. S\u00f6zle\u015fme\u2019nin \u201c\u00d6zel ve aile hayat\u0131na sayg\u0131 hakk\u0131\u201d kenar ba\u015fl\u0131kl\u0131 8. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201c(1) Herkes \u00f6zel ve aile hayat\u0131na, konutuna ve yaz\u0131\u015fmas\u0131na sayg\u0131 g\u00f6sterilmesi hakk\u0131na sahiptir.<\/p>\n<p> (2) Bu hakk\u0131n kullan\u0131lmas\u0131na bir kamu makam\u0131n\u0131n m\u00fcdahalesi, ancak m\u00fcdahalenin yasayla \u00f6ng\u00f6r\u00fclm\u00fc\u015f ve demokratik bir toplumda ulusal g\u00fcvenlik, kamu g\u00fcvenli\u011fi, \u00fclkenin ekonomik refah\u0131, d\u00fczenin korunmas\u0131, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, sa\u011fl\u0131\u011f\u0131n veya ahlak\u0131n veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 i\u00e7in gerekli bir tedbir olmas\u0131 durumunda s\u00f6z konusu olabilir.\u201d<\/p>\n<p>45. \u00d6zel hayat kavram\u0131 eksiksiz bir tan\u0131m\u0131 bulunmayan geni\u015f bir kavram olup \u00f6zel ya\u015fama sayg\u0131 hakk\u0131 kapsam\u0131nda korunan hukuksal \u00e7\u0131karlardan biri de bireyin fiziksel ve ruhsal b\u00fct\u00fcnl\u00fck hakk\u0131d\u0131r. Bu hak kapsam\u0131nda devlet i\u00e7in s\u00f6z konusu olan y\u00fck\u00fcml\u00fcl\u00fck, sadece belirtilen hakka keyf\u00ee surette m\u00fcdahaleden ka\u00e7\u0131nmakla s\u0131n\u0131rl\u0131 olmay\u0131p \u00f6ncelikli olan bu negatif y\u00fck\u00fcml\u00fcl\u00fc\u011fe ek olarak \u00f6zel hayata etkili bir bi\u00e7imde sayg\u0131n\u0131n sa\u011flanmas\u0131 ba\u011flam\u0131nda pozitif y\u00fck\u00fcml\u00fcl\u00fckleri de i\u00e7ermektedir. S\u00f6z konusu pozitif y\u00fck\u00fcml\u00fcl\u00fckler, bireyler aras\u0131 ili\u015fkiler alan\u0131nda olsa da \u00f6zel hayata sayg\u0131y\u0131 sa\u011flamaya y\u00f6nelik tedbirlerin al\u0131nmas\u0131n\u0131 zorunlu k\u0131lar (Sevim Akat E\u015fki, B. No: 2013\/2187, 19\/12\/2013, \u00a7 26; Ercan Kanar, B. No: 2013\/533, 9\/1\/2014, \u00a7 52; Serap Tortuk, B. No: 2013\/9660, 21\/1\/2015, \u00a7 31; benzer y\u00f6ndeki A\u0130HM karar\u0131 i\u00e7in bkz. X ve Y\/Hollanda, B. No: 8978\/80, 26\/3\/1985, \u00a7\u00a7 23, 24, 27). <\/p>\n<p>46. \u00d6zel ya\u015fama sayg\u0131 hakk\u0131 alt kategorisinde ge\u00e7en \u201c\u00f6zel ya\u015fam\u201d kavram\u0131 A\u0130HM taraf\u0131ndan da olduk\u00e7a geni\u015f yorumlanmakta ve bu kavrama ili\u015fkin t\u00fcketici bir tan\u0131m yapmaktan \u00f6zellikle ka\u00e7\u0131n\u0131lmaktad\u0131r (Koch\/Almanya, B. No: 497\/09, 19\/7\/2012, \u00a7 51). Bununla birlikte S\u00f6zle\u015fme\u2019nin denetim organlar\u0131n\u0131n i\u00e7tihatlar\u0131nda, \u201cbireyin ki\u015fili\u011fini geli\u015ftirmesi ve ger\u00e7ekle\u015ftirmesi\u201d kavram\u0131n\u0131n, \u00f6zel ya\u015fama sayg\u0131 hakk\u0131n\u0131n kapsam\u0131n\u0131n belirlenmesinde temel al\u0131nd\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. \u00d6zel ya\u015fam\u0131n korunmas\u0131 hakk\u0131n\u0131n sadece mahremiyet hakk\u0131na indirgenemeyece\u011fi ger\u00e7e\u011fi kar\u015f\u0131s\u0131nda, ki\u015fili\u011fin serbest\u00e7e geli\u015ftirilmesiyle uyumlu bir\u00e7ok hukuksal \u00e7\u0131kar bu hakk\u0131n kapsam\u0131na d\u00e2hil edilmi\u015ftir. Bu ba\u011flamda ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne ili\u015fkin hukuksal \u00e7\u0131kar\u0131 da \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda g\u00fcvence alt\u0131na al\u0131nmaktad\u0131r. <\/p>\n<p>47. \u00d6zel hayat alan\u0131na d\u00e2hil olan t\u00fcm hukuksal \u00e7\u0131karlar S\u00f6zle\u015fme\u2019nin 8. maddesi kapsam\u0131nda g\u00fcvence alt\u0131na al\u0131nmakla birlikte s\u00f6z konusu hukuksal \u00e7\u0131karlar\u0131n Anayasa\u2019n\u0131n farkl\u0131 maddelerinin koruma alan\u0131na girdi\u011fi g\u00f6r\u00fclmektedir. Bu ba\u011flamda Anayasa\u2019n\u0131n 17. maddesinin birinci f\u0131kras\u0131nda, herkesin maddi ve manevi varl\u0131\u011f\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131na sahip oldu\u011fu belirtilmekte olup bu d\u00fczenlemede yer verilen maddi ve manevi varl\u0131\u011f\u0131 koruma ve geli\u015ftirme hakk\u0131, S\u00f6zle\u015fme\u2019nin 8. maddesi \u00e7er\u00e7evesinde \u00f6zel ya\u015fama sayg\u0131 hakk\u0131 kapsam\u0131nda g\u00fcvence alt\u0131na al\u0131nan fiziksel ve ruhsal b\u00fct\u00fcnl\u00fck hakk\u0131 ile bireyin kendisini ger\u00e7ekle\u015ftirme ve kendisine ili\u015fkin kararlar alabilme hakk\u0131na kar\u015f\u0131l\u0131k gelmektedir. Bunun yan\u0131 s\u0131ra Anayasa\u2019n\u0131n 17. maddesinin ikinci f\u0131kras\u0131nda t\u0131bbi zorunluluklar ve kanunda yaz\u0131l\u0131 h\u00e2ller d\u0131\u015f\u0131nda ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamayaca\u011f\u0131 ve r\u0131zas\u0131 olmadan bilimsel ve t\u0131bbi deneylere tabi tutulamayaca\u011f\u0131 belirtilmek suretiyle fiziksel ve ruhsal b\u00fct\u00fcnl\u00fck hakk\u0131 a\u00e7\u0131s\u0131ndan \u00f6zel bir g\u00fcvence h\u00fckm\u00fcne yer verilmi\u015ftir. <\/p>\n<p>48. \u00d6zel ya\u015fam fiziksel ve ruhsal \u00f6zerkli\u011fi de kapsamakta, bu hak bireyleri gerek kamusal makamlar\u0131n gerek \u00f6zel hukuk ki\u015filerinin fiziksel ve ruhsal b\u00fct\u00fcnl\u00fc\u011fe y\u00f6nelik sald\u0131r\u0131lar\u0131na kar\u015f\u0131 korumakta ve s\u00f6z konusu hukuksal \u00e7\u0131kar, t\u0131bbi m\u00fcdahaleyi ret hakk\u0131n\u0131 da i\u00e7ermektedir.<\/p>\n<p>49. T\u0131bbi m\u00fcdahaleyi ret hakk\u0131 kapsam\u0131nda fiziksel ve ruhsal b\u00fct\u00fcnl\u00fc\u011fe y\u00f6nelik m\u00fcdahaleler S\u00f6zle\u015fme organlar\u0131n\u0131n i\u00e7tihad\u0131na da s\u0131kl\u0131kla konu olmu\u015f, bu kapsamda ki\u015finin alkoll\u00fc olup olmad\u0131\u011f\u0131na y\u00f6nelik kan ve nefes testleri, babal\u0131\u011f\u0131n tespitine y\u00f6nelik tahliller, su\u00e7 faillerinin tespitine y\u00f6nelik kan ve t\u00fck\u00fcr\u00fck \u00f6rne\u011fi temini, bula\u015f\u0131c\u0131 hastal\u0131k riskine kar\u015f\u0131 yap\u0131lan kan testleri ve al\u0131nan r\u00f6ntgenler, jinekolojik muayene, psikiyatrik muayene ve tedavi, fiziksel tedavi ve ila\u00e7 tedavisi gibi ki\u015fiye r\u0131zas\u0131 olmaks\u0131z\u0131n uygulanan t\u0131bbi muameleler, fiziksel ve ruhsal \u00f6zerkli\u011fe bir m\u00fcdahale olarak de\u011ferlendirilmi\u015ftir (Schmidt\/Almanya, B. No. 32352\/02, 5\/1\/2006; X.\/Avusturya, B. No: 8278\/78, 13\/12\/1979, \u00a7 4; Glass\/Birle\u015fik Krall\u0131k, B. No: 61827\/00, 9\/3\/2004, \u00a7 70; Y.F.\/T\u00fcrkiye, B. No: 24209\/94, 22\/7\/2003, \u00a7 34).<\/p>\n<p>50. S\u00f6z konusu de\u011ferlendirmelerde A\u0130HM\u2019in, fiziksel ve ruhsal b\u00fct\u00fcnl\u00fc\u011f\u00fcn \u00f6zel ya\u015fam\u0131n en mahrem ve s\u0131k\u0131 koruma gerektiren y\u00f6n\u00fcn\u00fc olu\u015fturdu\u011funu ve zorunlu t\u0131bbi m\u00fcdahalelerin -s\u00f6z konusu m\u00fcdahalenin boyutu ne kadar k\u00fc\u00e7\u00fck olursa olsun- belirtilen hakka m\u00fcdahale te\u015fkil edece\u011fini belirtti\u011fi g\u00f6r\u00fclmektedir (Solomakhin\/Ukrayna, B. No: 24429\/03, 15\/3\/2012, \u00a7 33; Y.F.\/T\u00fcrkiye, \u00a7 33). <\/p>\n<p>51. Anayasa\u2019n\u0131n 17. maddesi h\u00fckm\u00fc genel olarak fiziksel ve ruhsal b\u00fct\u00fcnl\u00fc\u011f\u00fc g\u00fcvence alt\u0131na almakla birlikte, ikinci f\u0131kra d\u00fczenlemesi t\u0131bbi zorunluluklar veya kanunda yaz\u0131l\u0131 h\u00e2ller d\u0131\u015f\u0131nda ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamayaca\u011f\u0131n\u0131 ve r\u0131zas\u0131 olmadan bilimsel ve t\u0131bbi deneylere tabi tutulamayaca\u011f\u0131n\u0131 belirtmek suretiyle t\u0131bbi m\u00fcdahaleyi ret hakk\u0131na ve ki\u015filerin kendi bedenleri \u00fczerinde karar verme yetkisi oldu\u011funa, istisna tan\u0131mak suretiyle a\u00e7\u0131k\u00e7a i\u015faret etmektedir.<\/p>\n<p>52. T\u0131bbi m\u00fcdahale; hastal\u0131klar\u0131n te\u015fhisi, tedavisi veya \u00f6nlenmesi ama\u00e7lar\u0131na y\u00f6nelik olarak t\u0131p mesle\u011fini icraya yetkili ki\u015filer taraf\u0131ndan ger\u00e7ekle\u015ftirilen faaliyetlerdir. Bu kapsamda, birtak\u0131m hastal\u0131klara kar\u015f\u0131 ba\u011f\u0131\u015f\u0131kl\u0131k sa\u011flamak i\u00e7in o hastal\u0131\u011f\u0131n mikrobuyla haz\u0131rlanm\u0131\u015f eriyik olarak tan\u0131mlanan maddelerin v\u00fccuda verilmesi \u015feklindeki a\u015f\u0131 uygulamas\u0131n\u0131n da m\u00fcdahalenin boyutundan ba\u011f\u0131ms\u0131z olarak v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne bir m\u00fcdahale olu\u015fturdu\u011fu a\u00e7\u0131kt\u0131r. <\/p>\n<p>53. Somut ba\u015fvuru a\u00e7\u0131s\u0131ndan, ebeveyni taraf\u0131ndan bebeklik d\u00f6nemi a\u015f\u0131lar\u0131n\u0131n uygulanmas\u0131na muvafakat edilmeyen ba\u015fvurucu hakk\u0131nda, bebeklik d\u00f6nemi a\u015f\u0131lar\u0131n\u0131n yap\u0131lmas\u0131 hususunda zorunlu sa\u011fl\u0131k tedbiri uygulanmas\u0131n\u0131n, ba\u015fvurucunun maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131na bir m\u00fcdahale olu\u015fturdu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>54. Zorunlu a\u015f\u0131 uygulamalar\u0131n\u0131n S\u00f6zle\u015fme\u2019nin 8. maddesi kapsam\u0131nda A\u0130HM i\u00e7tihad\u0131na da konu edildi\u011fi ve Mahkemece, uygulanan t\u0131bbi m\u00fcdahalenin boyutuna bak\u0131lmaks\u0131z\u0131n s\u00f6z konusu m\u00fcdahalenin fiziksel b\u00fct\u00fcnl\u00fck hakk\u0131na bir m\u00fcdahale te\u015fkil etti\u011fi tespitine yer verildi\u011fi g\u00f6r\u00fclmektedir. Mahkemece ele al\u0131nan ve kanunilik \u015fart\u0131n\u0131 sa\u011flad\u0131\u011f\u0131 tespit edilen m\u00fcdahaleler a\u00e7\u0131s\u0131ndan genel olarak, s\u00f6z konusu uygulaman\u0131n bireyin ve toplumun sa\u011fl\u0131\u011f\u0131n\u0131 korumaya ili\u015fkin me\u015fru ama\u00e7 nazara al\u0131narak yap\u0131lan dengelemede, bireyin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131na ili\u015fkin menfaat kar\u015f\u0131s\u0131nda kamu sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 \u015feklindeki menfaate \u00fcst\u00fcnl\u00fck tan\u0131nd\u0131\u011f\u0131 ve s\u00f6z konusu m\u00fcdahalelerin \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131 ihlal etmedi\u011fine h\u00fckmedildi\u011fi g\u00f6r\u00fclmektedir (Boffa ve di\u011ferleri\/San Marino, B. No: 26536\/95, 15\/1\/1998, \u00a7 4; Solomakhin\/Ukrayna, B. No: 24429\/03, 15\/3\/2012, \u00a7\u00a7 33-38). <\/p>\n<p>55. T\u0131bbi m\u00fcdahalelere ili\u015fkin gerek ulusal gerek uluslararas\u0131 alandaki mevzuat h\u00fck\u00fcmleri r\u0131za unsurunu temel \u015fart olarak \u00f6ng\u00f6rmekte, velayet veya vesayet alt\u0131ndaki k\u00fc\u00e7\u00fck ya\u015ftaki \u00e7ocuklara veya k\u0131s\u0131tl\u0131lara uygulanacak m\u00fcdahaleler a\u00e7\u0131s\u0131ndan da kanuni temsilcilerin r\u0131zas\u0131 s\u00f6z konusu t\u0131bbi muamele sujesinin r\u0131zas\u0131 yerine ikame edilmekte ve r\u0131za \u015fart\u0131na istisna getirilebilecek h\u00e2ller genel olarak acil durumlar ba\u011flam\u0131nda t\u0131bbi zorunluluk h\u00e2lleri ile kanunda belirtilen durumlarla s\u0131n\u0131rland\u0131r\u0131lmaktad\u0131r (\u00a7\u00a7 15, 20-26).<\/p>\n<p>56. Hastan\u0131n r\u0131zas\u0131 olmaks\u0131z\u0131n yap\u0131lan t\u0131bbi m\u00fcdahalelerin hukuka uygunlu\u011funu sa\u011flayan h\u00e2llerden biri olarak kabul edilen t\u0131bbi zorunluluk kavram\u0131n\u0131n ise genel olarak hastan\u0131n r\u0131zas\u0131n\u0131n al\u0131nmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131, ancak m\u00fcdahalede bulunulmamas\u0131 durumunda telafisi g\u00fc\u00e7 zararlar\u0131n do\u011faca\u011f\u0131 ve \u00e7o\u011fu zaman hastan\u0131n ya\u015fam\u0131n\u0131 yitirmesinin s\u00f6z konusu olaca\u011f\u0131 durumlar\u0131 ifade etmek \u00fczere kullan\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>57. Anayasa\u2019n\u0131n 17. maddesinde de t\u0131bbi zorunluluklar ve kanunda yaz\u0131l\u0131 h\u00e2ller d\u0131\u015f\u0131nda ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamayaca\u011f\u0131 belirtilmi\u015ftir. S\u00f6z konusu d\u00fczenlemede \u00f6zel s\u0131n\u0131rlama sebepleri \u00f6ng\u00f6r\u00fclmemi\u015f olmakla birlikte kanun ile d\u00fczenleme h\u00fckm\u00fcne yer verilmi\u015f olup bu kapsamda yap\u0131lan m\u00fcdahalelerin me\u015frulu\u011funun denetlenmesinde, Anayasan\u0131n 13. maddesinde yer alan g\u00fcvence \u00f6l\u00e7\u00fctlerinin dikkate al\u0131nmas\u0131 zorunludur. <\/p>\n<p>58. Anayasa\u2019n\u0131n \u201cTemel hak ve h\u00fcrriyetlerin s\u0131n\u0131rlanmas\u0131\u201d kenar ba\u015fl\u0131kl\u0131 13. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cTemel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.\u201d <\/p>\n<p>59. Belirtilen Anayasa h\u00fckm\u00fc, hak ve \u00f6zg\u00fcrl\u00fckleri s\u0131n\u0131rlama ve g\u00fcvence rejimi bak\u0131m\u0131ndan temel \u00f6neme sahip olup Anayasada yer alan b\u00fct\u00fcn hak ve \u00f6zg\u00fcrl\u00fcklerin yasa koyucu taraf\u0131ndan hangi \u00f6l\u00e7\u00fctler g\u00f6z \u00f6n\u00fcnde bulundurularak s\u0131n\u0131rland\u0131r\u0131labilece\u011fini ortaya koymaktad\u0131r. Anayasan\u0131n b\u00fct\u00fcnselli\u011fi ilkesi \u00e7er\u00e7evesinde, Anayasa kurallar\u0131n\u0131n bir arada ve hukukun genel kurallar\u0131 g\u00f6z \u00f6n\u00fcnde tutularak uygulanmas\u0131 zorunlu oldu\u011fundan belirtilen d\u00fczenlemede yer alan ba\u015fta kanun ile s\u0131n\u0131rlama kayd\u0131 olmak \u00fczere t\u00fcm g\u00fcvence \u00f6l\u00e7\u00fctlerinin, Anayasa\u2019n\u0131n 17. maddesinde yer verilen hakk\u0131n kapsam\u0131n\u0131n belirlenmesinde de g\u00f6zetilmesi gerekti\u011fi a\u00e7\u0131kt\u0131r (Sevim Akat E\u015fki, \u00a7 35). <\/p>\n<p>60. Hak ve \u00f6zg\u00fcrl\u00fcklerin kanunla s\u0131n\u0131rlanmas\u0131 \u00f6l\u00e7\u00fct\u00fc anayasa yarg\u0131s\u0131nda \u00f6nemli bir yere sahiptir. Hak ya da \u00f6zg\u00fcrl\u00fc\u011fe bir m\u00fcdahale s\u00f6z konusu oldu\u011funda \u00f6ncelikle tespiti gereken husus, m\u00fcdahaleye yetki veren bir kanun h\u00fckm\u00fcn\u00fcn yani m\u00fcdahalenin hukuki bir temelinin mevcut olup olmad\u0131\u011f\u0131d\u0131r (Sevim Akat E\u015fki, \u00a7 36).<\/p>\n<p>61. S\u00f6zle\u015fme\u2019nin lafz\u0131 ve A\u0130HM i\u00e7tihad\u0131 uyar\u0131nca da S\u00f6zle\u015fme\u2019nin 8. maddesi kapsam\u0131nda yap\u0131lacak bir m\u00fcdahalenin me\u015frulu\u011fu, \u00f6ncelikle s\u00f6z konusu m\u00fcdahalenin yasa uyar\u0131nca ger\u00e7ekle\u015ftirilmesine ba\u011fl\u0131 tutulmu\u015f olup m\u00fcdahalenin hukukilik unsurunu ta\u015f\u0131mad\u0131\u011f\u0131n\u0131n tespiti h\u00e2linde S\u00f6zle\u015fmenin 8. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda yer alan di\u011fer g\u00fcvence \u00f6l\u00e7\u00fctleri tetkik edilmeksizin m\u00fcdahalenin ilgili maddeye ayk\u0131r\u0131 oldu\u011fu sonucuna ula\u015f\u0131lmaktad\u0131r (Y.F.\/T\u00fcrkiye, \u00a7 44).<\/p>\n<p>62. Anayasa\u2019n\u0131n 17. maddesi kapsam\u0131nda yap\u0131lan bir m\u00fcdahalenin kanunilik \u015fart\u0131n\u0131 sa\u011flad\u0131\u011f\u0131n\u0131n kabul\u00fc i\u00e7in de m\u00fcdahalenin kanuni bir dayana\u011f\u0131n\u0131n bulunmas\u0131 zaruridir. Bununla birlikte temel hak ve h\u00fcrriyetlerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ili\u015fkin kanunlar\u0131n \u015feklen var olmas\u0131 yeterli de\u011fildir. Kanunilik \u00f6l\u00e7\u00fct\u00fc ayn\u0131 zamanda maddi bir i\u00e7eri\u011fi de gerektirmekte olup bu noktada kanunun niteli\u011fi \u00f6nem kazanmaktad\u0131r. Kanunla s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fc, s\u0131n\u0131rlaman\u0131n eri\u015filebilirli\u011fini, \u00f6ng\u00f6r\u00fclebilirli\u011fini ve kesinli\u011fini ifade etmekte; b\u00f6ylece uygulay\u0131c\u0131n\u0131n keyf\u00ee davran\u0131\u015flar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ti\u011fi gibi ki\u015finin hukuku bilmesine de yard\u0131mc\u0131 olmakta, bu y\u00f6n\u00fcyle hukuk g\u00fcvenli\u011fi teminat\u0131 sa\u011flamaktad\u0131r.<\/p>\n<p>63. Kanunun, bu gerekliliklere uygun oldu\u011funun s\u00f6ylenebilmesi i\u00e7in yeterince ula\u015f\u0131labilir olmas\u0131 yani vatanda\u015flar\u0131n belirli bir olaya uygulanabilir nitelikteki hukuk kurallar\u0131n\u0131n varl\u0131\u011f\u0131 hakk\u0131nda yeterli bilgiye sahip olabilmesi, ayr\u0131ca ilgili normun keyf\u00eeli\u011fe kar\u015f\u0131 uygun bir koruma sa\u011flamas\u0131, yetkili makamlara verilen yetkinin geni\u015fli\u011fini ve icra edilme bi\u00e7imlerini yeterli bir netlikte tan\u0131mlamas\u0131 gerekmektedir (Benzer y\u00f6ndeki A\u0130HM kararlar\u0131 i\u00e7in bkz. Silver ve di\u011ferleri\/Birle\u015fik Krall\u0131k, B. No: 5947\/72, 25\/3\/1983, \u00a7\u00a7 86-88; Malone\/Birle\u015fik Krall\u0131k, B. No: 8691\/79, 2\/8\/1984, \u00a7\u00a7 66-68; Rotaru\/Romanya [BD], B. No: 28341\/95, 4\/5\/2000, \u00a7 55). <\/p>\n<p>64. Hukukun kendisi, beraberinde getirece\u011fi idari prati\u011fin d\u0131\u015f\u0131nda, s\u00f6z konusu i\u015flemin me\u015fru amac\u0131n\u0131 da g\u00f6z \u00f6n\u00fcnde tutarak keyf\u00ee m\u00fcdahalelere kar\u015f\u0131 bireyi korumak i\u00e7in yetkili makamlara b\u0131rak\u0131lan takdir yetkisinin kapsam\u0131n\u0131 yeterince a\u00e7\u0131k bir \u015fekilde g\u00f6stermelidir. Hukuk sistemi vatanda\u015flara, kamu makamlar\u0131na hangi ko\u015fullarda ve hangi s\u0131n\u0131rlar i\u00e7inde v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne y\u00f6nelik olan ve potansiyel olarak \u00f6zel ya\u015fama kar\u015f\u0131 tehlike olu\u015fturabilecek m\u00fcdahalelerde bulunma yetkisi verdi\u011fini, yeterince a\u00e7\u0131k ifadelerle g\u00f6sterecek nitelikte olmal\u0131 ve bu ba\u011flamda ilgili m\u00fcdahalenin muhataplar\u0131n\u0131n m\u00fcdahaleye zemin haz\u0131rlayan ko\u015fullar ile m\u00fcdahalenin sonu\u00e7lar\u0131 a\u00e7\u0131s\u0131ndan bir \u00f6ng\u00f6r\u00fcde bulunabilmeleri imk\u00e2n\u0131 tan\u0131mal\u0131d\u0131r.<\/p>\n<p>65. Bununla birlikte her ihtimale \u00e7\u00f6z\u00fcm getiremeyecek olan yasal mevzuat\u0131n sa\u011flad\u0131\u011f\u0131 koruma seviyesi b\u00fcy\u00fck \u00f6l\u00e7\u00fcde ilgili metnin d\u00fczenledi\u011fi alan ve i\u00e7eri\u011fiyle birlikte muhataplar\u0131n\u0131n niteli\u011fi ve say\u0131s\u0131yla yak\u0131ndan ba\u011flant\u0131l\u0131d\u0131r. Bu nedenle kural\u0131n karma\u015f\u0131k olmas\u0131 ya da belirli \u00f6l\u00e7\u00fclerde soyutluk i\u00e7ermesi ve buna ba\u011fl\u0131 olarak hukuki yard\u0131m ile tam olarak anla\u015f\u0131labilir h\u00e2le gelmesi tek ba\u015f\u0131na hukuken \u00f6ng\u00f6r\u00fclebilirlik ilkesine ayk\u0131r\u0131 g\u00f6r\u00fclemez. Bu kapsamda hak ya da \u00f6zg\u00fcrl\u00fc\u011fe m\u00fcdahale eden kural belirli \u00f6l\u00e7\u00fclerdeki takdir alan\u0131n\u0131 elbette uygulay\u0131c\u0131ya b\u0131rakabilir. Fakat bu takdir alan\u0131n\u0131n s\u0131n\u0131rlar\u0131n\u0131n da yeterli a\u00e7\u0131kl\u0131kta belirlenmesi ve kural\u0131n asgari bir kesinlik i\u00e7ermesi zaruridir.<\/p>\n<p>66. Bu kapsamda ilgili kanuni d\u00fczenlemenin, s\u00f6z konusu s\u0131n\u0131rlamaya ili\u015fkin temel \u00e7er\u00e7eveyi ortaya koymakla birlikte \u00f6zellikle uygulama ko\u015fullar\u0131 ve usule ili\u015fkin ayr\u0131nt\u0131lar\u0131 d\u00fczenleyici i\u015flemlere b\u0131rakmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ancak bu ihtimalde de s\u00f6z konusu d\u00fczenleyici i\u015flemin, yine muhataplar\u0131nca ula\u015f\u0131labilir olmas\u0131 ve i\u00e7eri\u011fi hakk\u0131nda ilgilileri yeterince ayd\u0131nlatacak nitelik ve a\u00e7\u0131kl\u0131kta olmas\u0131 gerekmektedir.<\/p>\n<p>67. Ba\u015fvuruya konu idari ve yarg\u0131sal s\u00fcre\u00e7te, ba\u015fvurucuya a\u015f\u0131 uygulamas\u0131 yap\u0131lmas\u0131 hususundaki talep ve kararlar\u0131n, 5395 say\u0131l\u0131 Kanun\u2019un 3. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendinin (1) numaral\u0131 alt bendi ve 5. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendi temelinde olu\u015fturuldu\u011fu g\u00f6r\u00fclmektedir. S\u00f6z konusu d\u00fczenlemelerde bedensel, zihinsel, ahlaki, sosyal ve duygusal geli\u015fimi ile ki\u015fisel g\u00fcvenli\u011fi tehlikede olan, ihmal veya istismar edilen ya da su\u00e7 ma\u011fduru \u00e7ocuklar korunmaya muhta\u00e7 \u00e7ocuk olarak tan\u0131mlanmakta ve \u00e7ocu\u011fun fiziksel ve ruhsal sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve tedavisi i\u00e7in gerekli ge\u00e7ici veya s\u00fcrekli t\u0131bbi bak\u0131m ve rehabilitasyonuna, ba\u011f\u0131ml\u0131l\u0131k yapan maddeleri kullananlar\u0131n tedavilerinin yap\u0131lmas\u0131na y\u00f6nelik olarak sa\u011fl\u0131k tedbiri uygulanabilece\u011fi belirtilmektedir. Somut ba\u015fvuru a\u00e7\u0131s\u0131ndan da ba\u015fvurucuya bebeklik d\u00f6nemi a\u015f\u0131lar\u0131n\u0131n uygulanmas\u0131n\u0131n ebeveyn taraf\u0131ndan reddi \u00fczerine, Aile ve Sosyal Politikalar Bakanl\u0131\u011f\u0131 U\u015fak \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan ebeveynlerince a\u015f\u0131 uygulamas\u0131na izin verilmeyen \u00e7ocuklar\u0131n korunmaya muhta\u00e7 \u00e7ocuk olarak kabul\u00fc gerekti\u011fi belirtilerek 5395 say\u0131l\u0131 Kanun kapsam\u0131nda sa\u011fl\u0131k tedbiri uygulanmas\u0131 talebinde bulunuldu\u011fu, ilgili \u0130lk Derece Mahkemesi taraf\u0131ndan da ayn\u0131 gerek\u00e7eyle sa\u011fl\u0131k tedbiri uygulanmas\u0131na h\u00fckmedilerek karar\u0131n itiraz kanun yolundan ge\u00e7erek kesinle\u015fti\u011fi, bu ba\u011flamda ba\u015fvurucunun, s\u00f6z konusu uygulaman\u0131n yasal temeli olmad\u0131\u011f\u0131 ve idari d\u00fczenlemelerle bir s\u0131n\u0131rlama \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc noktas\u0131ndaki itirazlar\u0131n\u0131n da yarg\u0131 mercilerince dikkate al\u0131nmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>68. Zorunlu a\u015f\u0131 uygulamas\u0131 ebeveyn taraf\u0131ndan reddedilen \u00e7ocuklar\u0131n, 5395 say\u0131l\u0131 Kanun kapsam\u0131nda korunmaya muhta\u00e7 \u00e7ocuk olarak de\u011ferlendirilmesi noktas\u0131nda da kamu makamlar\u0131 ve ba\u015fvurucu aras\u0131nda g\u00f6r\u00fc\u015f birli\u011fi bulunmamakla birlikte, esasen uygulanacak t\u0131bbi m\u00fcdahalenin t\u00fcr\u00fc ve kapsam\u0131 hakk\u0131nda bir a\u00e7\u0131klamada bulunulmaks\u0131z\u0131n \u00e7ocu\u011fun fiziksel ve ruhsal sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve tedavisi i\u00e7in gerekli ge\u00e7ici veya s\u00fcrekli t\u0131bbi bak\u0131m ve rehabilitasyonunu i\u00e7erecek \u015fekilde, genel olarak sa\u011fl\u0131k tedbirine h\u00fckmedilece\u011fine i\u015faret eden s\u00f6z konusu d\u00fczenlemenin, somut ba\u015fvuruda oldu\u011fu gibi do\u011fan her \u00e7ocu\u011fa belirli bir ya\u015f periyoduna ba\u011fl\u0131 olarak ve ebeveynin r\u0131zas\u0131 hilaf\u0131na, ilgili idarece belirlenecek olan her t\u00fcrl\u00fc a\u015f\u0131n\u0131n tatbiki yetkisi verildi\u011fi \u015feklinde anla\u015f\u0131lmas\u0131 olanakl\u0131 de\u011fildir. Aksinin kabul\u00fc h\u00e2linde uygulanacak t\u0131bbi m\u00fcdahalenin t\u00fcr ve kapsam\u0131 belirsiz olacak \u015fekilde, r\u0131za verilmeyen m\u00fcdahale t\u00fcrlerinin g\u00fcndeme gelmesi muhtemeldir.<\/p>\n<p>69. Bu kapsamda somut ba\u015fvuru a\u00e7\u0131s\u0131ndan 5395 say\u0131l\u0131 Kanun\u2019un ilgili h\u00fck\u00fcmlerinin, ba\u015fvuruya konu m\u00fcdahalenin kanuni temelinin ihtiva etmesi gereken unsurlardan olan \u00f6ng\u00f6r\u00fclebilirlik niteli\u011fini ta\u015f\u0131mad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan Anayasa\u2019n\u0131n 17. maddesi anlam\u0131nda m\u00fcdahalenin me\u015fruiyet unsurlar\u0131ndan biri olan kanunilik \u015fart\u0131n\u0131 sa\u011flamad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. <\/p>\n<p>70. Zorunlu a\u015f\u0131 uygulamas\u0131n\u0131n kanuni temeli ba\u011flam\u0131nda Halk Sa\u011fl\u0131\u011f\u0131 Kurumu taraf\u0131ndan g\u00f6nderilen yaz\u0131 i\u00e7eri\u011finde belirtilen ve ba\u015fvurucu taraf\u0131ndan da tart\u0131\u015fma konusu yap\u0131lan 1593 say\u0131l\u0131 Kanun\u2019un 57. ve 72. maddeleri ile Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n 25\/2\/2008 tarihli ve 2008\/4 say\u0131l\u0131 Genelgesinin ayr\u0131ca de\u011ferlendirilmesi gerekmektedir.<\/p>\n<p>71. 1593 say\u0131l\u0131 Kanun\u2019un 57. maddesinde belirli hastal\u0131k t\u00fcrleri say\u0131lm\u0131\u015f, 72. maddede ise 57. maddede zikredilen hastal\u0131klardan birinin ortaya \u00e7\u0131kmas\u0131 veya ortaya \u00e7\u0131kmas\u0131ndan \u015f\u00fcphe edilmesi durumunda bir k\u0131s\u0131m tedbirlere ba\u015fvurulaca\u011f\u0131 belirtilmi\u015f ve s\u00f6z konusu tedbirler aras\u0131nda hastalara veya hastal\u0131\u011fa maruz bulunanlara serum veya a\u015f\u0131 uygulanmas\u0131 \u015feklindeki tedbire de yer verilmi\u015ftir. \u0130lgili Genelgede ise genel ba\u011f\u0131\u015f\u0131klama program\u0131na ili\u015fkin ilke ve usuller belirlenerek bebeklik d\u00f6nemini de kapsayacak \u015fekilde belirli ya\u015f gruplar\u0131 i\u00e7in \u00e7e\u015fitli periyotlar d\u00e2hilinde baz\u0131 a\u015f\u0131lar\u0131n uygulanmas\u0131na ili\u015fkin esas ve usuller d\u00fczenlenmi\u015ftir. S\u00f6z konusu Genelge kapsam\u0131nda yer verilen a\u015f\u0131 t\u00fcrlerine bak\u0131ld\u0131\u011f\u0131nda 1593 say\u0131l\u0131 Kanun\u2019un 57. maddesinde tahdidi olarak say\u0131lan hastal\u0131klar i\u00e7in tatbiki \u00f6ng\u00f6r\u00fclenlerle s\u0131n\u0131rl\u0131 bir d\u00fczenleme olmad\u0131\u011f\u0131 anla\u015f\u0131lmakta, ba\u015fvurucuya tatbikine h\u00fckmedilen HepB, DaBT, \u0130PA, Hib ve KPA t\u00fcr\u00fcndeki a\u015f\u0131lar\u0131n da 1593 say\u0131l\u0131 Kanun\u2019un 57. maddesinde tahdidi olarak say\u0131lan hastal\u0131klar\u0131 tam olarak kar\u015f\u0131lamad\u0131\u011f\u0131, bu kapsamda 57. maddede zikredilen hastal\u0131klardan birinin ortaya \u00e7\u0131kmas\u0131 veya ortaya \u00e7\u0131kmas\u0131ndan \u015f\u00fcphe edilmesi durumunda hastalara veya hastal\u0131\u011fa maruz bulunanlara serum veya a\u015f\u0131 uygulanmas\u0131 hususunu d\u00fczenleyen 72. madde h\u00fckm\u00fcn\u00fcn, ba\u015fvuruya konu uygulaman\u0131n kanuni dayana\u011f\u0131 olarak kabul edilmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>72. Bunun yan\u0131 s\u0131ra 1593 say\u0131l\u0131 Kanun\u2019da m\u00fcnferiden \u00e7i\u00e7ek a\u015f\u0131s\u0131n\u0131n mecburi bir a\u015f\u0131 olarak \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc ve s\u00f6z konusu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn zaman ve ki\u015fi gruplar\u0131 nazara al\u0131narak Kanun\u2019un 88-94. maddelerinde ayr\u0131nt\u0131l\u0131 olarak d\u00fczenlendi\u011fi g\u00f6r\u00fclmektedir. Bunun d\u0131\u015f\u0131ndaki a\u015f\u0131 uygulamas\u0131n\u0131n Bakanl\u0131\u011f\u0131n ilgili Genelgesi kapsam\u0131nda ve belirlenen program \u00e7er\u00e7evesinde yap\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmekle birlikte genel ve zorunlu a\u015f\u0131 uygulamas\u0131na dayanak olu\u015fturacak bir kanun h\u00fckm\u00fcn\u00fcn mevcut olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>73. Halk Sa\u011fl\u0131\u011f\u0131 Kurumu taraf\u0131ndan g\u00f6nderilen yaz\u0131 i\u00e7eri\u011finde belirtilen ve a\u015f\u0131 uygulamas\u0131n\u0131n kanuni dayana\u011f\u0131 ba\u011flam\u0131nda yer verilerek halk sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve geli\u015ftirilmesi, hastal\u0131k risklerinin azalt\u0131lmas\u0131 ve \u00f6nlenmesi, sa\u011fl\u0131k i\u00e7in risk olu\u015fturan fakt\u00f6rlerle m\u00fccadele edilmesi; bula\u015f\u0131c\u0131 ve bula\u015f\u0131c\u0131 olmayan kronik hastal\u0131klar ve belirli hastal\u0131k ve risk gruplar\u0131 ile ilgili izleme, inceleme, ara\u015ft\u0131rma, ba\u011f\u0131\u015f\u0131klama ve kontrol \u00e7al\u0131\u015fmalar\u0131 yap\u0131lmas\u0131 g\u00f6revini Halk Sa\u011fl\u0131\u011f\u0131 Kurumuna verdi\u011fi belirtilen Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 ve Ba\u011fl\u0131 Kurulu\u015flar\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin de Anayasa\u2019n\u0131n ikinci k\u0131sm\u0131n\u0131n ikinci b\u00f6l\u00fcm\u00fcnde yer alan bir temel hakka y\u00f6nelik s\u0131n\u0131rland\u0131rma ve m\u00fcdahale a\u00e7\u0131s\u0131ndan dayanak olamayaca\u011f\u0131 a\u00e7\u0131kt\u0131r. <\/p>\n<p>74. Yukar\u0131da yer verilen tespitler uyar\u0131nca ba\u015fvuruya konu m\u00fcdahalenin kanunilik \u015fart\u0131n\u0131 sa\u011flamad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan s\u00f6z konusu m\u00fcdahale a\u00e7\u0131s\u0131ndan di\u011fer g\u00fcvence \u00f6l\u00e7\u00fctlerine riayet edilip edilmedi\u011finin ayr\u0131ca de\u011ferlendirilmesine gerek g\u00f6r\u00fclmemi\u015ftir. <\/p>\n<p>75. A\u00e7\u0131klanan nedenlerle ba\u015fvurucunun Anayasa\u2019n\u0131n 17. maddesinde g\u00fcvence alt\u0131na al\u0131nan maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>Serdar \u00d6ZG\u00dcLD\u00dcR bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>3. 6216 Say\u0131l\u0131 Kanun\u2019un 50. Maddesi Y\u00f6n\u00fcnden<\/p>\n<p>76. Ba\u015fvurucu, ihlalin tespiti ile uyu\u015fmazl\u0131k hakk\u0131nda yeniden yarg\u0131lama yap\u0131lmas\u0131na karar verilmesini talep etmi\u015ftir.<\/p>\n<p>77. 6216 say\u0131l\u0131 Kanun\u2019un \u201cKararlar\u201d kenar ba\u015fl\u0131kl\u0131 50. maddesinin (2) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p> \u201cTespit edilen ihlal bir mahkeme karar\u0131ndan kaynaklanm\u0131\u015fsa, ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131rmak i\u00e7in yeniden yarg\u0131lama yapmak \u00fczere dosya ilgili mahkemeye g\u00f6nderilir. Yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmayan h\u00e2llerde ba\u015fvurucu lehine tazminata h\u00fckmedilebilir veya genel mahkemelerde dava a\u00e7\u0131lmas\u0131 yolu g\u00f6sterilebilir. Yeniden yarg\u0131lama yapmakla y\u00fck\u00fcml\u00fc mahkeme, Anayasa Mahkemesinin ihlal karar\u0131nda a\u00e7\u0131klad\u0131\u011f\u0131 ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131racak \u015fekilde m\u00fcmk\u00fcnse dosya \u00fczerinden karar verir.\u201d<\/p>\n<p>78. Mevcut ba\u015fvuruda Anayasa\u2019n\u0131n 17. maddesinin ihlal edildi\u011fi tespit edildi\u011finden ihlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmak \u00fczere karar\u0131n Sivasl\u0131 Asliye Hukuk Mahkemesine g\u00f6nderilmesine karar verilmesi gerekir.<\/p>\n<p>79. Dosyadaki belgelerden tespit edilen 198,35 TL har\u00e7tan olu\u015fan yarg\u0131lama giderinin ba\u015fvurucuya \u00f6denmesine karar verilmesi gerekir.<\/p>\n<p>V. Anayasa\u2019n\u0131n 17. maddesinde g\u00fcvence alt\u0131na al\u0131nan maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131n\u0131n \u0130HLAL ED\u0130LD\u0130\u011e\u0130NE Serdar \u00d6ZG\u00dcLD\u00dcR\u2019\u00fcn kar\u015f\u0131oyu ve OY\u00c7OKLU\u011eUYLA, <\/p>\n<p>C. \u0130hlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmak \u00fczere karar\u0131n Sivasl\u0131 Asliye Hukuk Mahkemesine G\u00d6NDER\u0130LMES\u0130NE OYB\u0130RL\u0130\u011e\u0130YLE,<\/p>\n<p>D. 198,35 TL har\u00e7tan olu\u015fan yarg\u0131lama giderinin BA\u015eVURUCUYA \u00d6DENMES\u0130NE OYB\u0130RL\u0130\u011e\u0130YLE,<\/p>\n<p>E. \u00d6demenin, karar\u0131n tebli\u011fini takiben ba\u015fvurucunun Maliye Bakanl\u0131\u011f\u0131na ba\u015fvuru tarihinden itibaren d\u00f6rt ay i\u00e7inde yap\u0131lmas\u0131na, \u00f6demede gecikme olmas\u0131 h\u00e2linde bu s\u00fcrenin sona erdi\u011fi tarihten \u00f6deme tarihine kadar ge\u00e7en s\u00fcre i\u00e7in yasal faiz uygulanmas\u0131na OYB\u0130RL\u0130\u011e\u0130YLE<\/p>\n<p>11\/11\/2015 tarihinde karar verildi. <\/p>\n<p>KAR\u015eI OY GEREK\u00c7ES\u0130<\/p>\n<p> Anayasa\u2019n\u0131n 17. maddesinin ikinci f\u0131kras\u0131 \u201cT\u0131bbi zorunluluklar ve kanunda yaz\u0131l\u0131 haller d\u0131\u015f\u0131nda, ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamaz; r\u0131zas\u0131 olmadan bilimsel ve t\u0131bbi deneylere t\u00e2bi tutulamaz.\u201d h\u00fckm\u00fcn\u00fc ta\u015f\u0131maktad\u0131r. Bu d\u00fczenlemenin gerek\u00e7esinde ise \u201cMaddenin ikinci f\u0131kras\u0131 i\u015fkence, eziyet yahut insan h\u00fcrriyetiyle ba\u011fda\u015fmayan ceza ve muamele yasa\u011f\u0131 koymaktad\u0131r. Uzun a\u00e7\u0131klamalara gerek yoktur ki i\u015fkence, eziyet yahut insan h\u00fcrriyetiyle ba\u011fda\u015fmayan ceza veya muamele, bug\u00fcn ula\u015fm\u0131\u015f bulundu\u011fumuz uygarl\u0131k d\u00fczeyinde, hem insani duygular\u0131 rencide eder niteliktedir; hem de ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne bir tecav\u00fczd\u00fcr.\u201d denilmektedir. Anayasa\u2019n\u0131n 56. maddesinde de \u201cDevlet, herkesin hayat\u0131n\u0131, beden ve ruh sa\u011fl\u0131\u011f\u0131 i\u00e7inde s\u00fcrd\u00fcrmesini sa\u011flamak; insan ve madde g\u00fcc\u00fcnde tasarruf ve verimi art\u0131rarak, i\u015fbirli\u011fini ger\u00e7ekle\u015ftirmek amac\u0131yla sa\u011fl\u0131k kurulu\u015flar\u0131n\u0131 tek elden pl\u00e2nlay\u0131p hizmet vermesini d\u00fczenler\u2026\u201d h\u00fckm\u00fc yer almakta; maddenin gerek\u00e7esinde ise \u201cVatanda\u015f\u0131n korunmu\u015f \u00e7evre \u015fartlar\u0131nda beden ve ruh sa\u011fl\u0131\u011f\u0131 i\u00e7inde ya\u015fam\u0131n\u0131 s\u00fcrd\u00fcrmesini sa\u011flamak Devletin \u00f6devidir.\u201d denilmektedir.<\/p>\n<p> Anayasayla Devlete verilen, herkesin hayat\u0131n\u0131, beden ve ruh sa\u011fl\u0131\u011f\u0131 i\u00e7inde s\u00fcrd\u00fcrmeyi sa\u011flamak g\u00f6revinin yasal bazda yans\u0131mas\u0131 1593 say\u0131l\u0131 Umumi H\u0131fz\u0131ss\u0131hha Kanununda ana hatlar\u0131yla yer almaktad\u0131r. Nitekim, an\u0131lan Kanun\u2019un 1. maddesinde \u201cMemleketin s\u0131hhi \u015fartlar\u0131n\u0131 \u0131slah ve milletin s\u0131hhatine zarar veren b\u00fct\u00fcn hastal\u0131klar veya sair muz\u0131r amillerle m\u00fccadele etmek ve m\u00fcstakbel neslin s\u0131hhatli olarak yeti\u015fmesini temin ve halk\u0131 t\u0131bbi ve i\u00e7timai muavenete mazhar eylemek umumi Devlet hizmetlerindendir.\u201d denilmek suretiyle, halk\u0131n sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve gelecek nesillerin sa\u011fl\u0131kl\u0131 bi\u00e7imde yeti\u015fmesi i\u00e7in gerekenlerin yap\u0131lmas\u0131 Devlete bir g\u00f6rev olarak verilmi\u015f bulunmaktad\u0131r. Ayn\u0131 Kanun\u2019un 2-4. maddelerinde de Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019n\u0131n bu konudaki g\u00f6revleri detayl\u0131 bi\u00e7imde say\u0131lm\u0131\u015f, bu meyanda \u00fclkedeki her t\u00fcr ate\u015fli, bula\u015f\u0131c\u0131 ve salg\u0131n hastal\u0131klarla m\u00fccadelenin bu Bakanl\u0131\u011f\u0131n g\u00f6revleri aras\u0131nda oldu\u011funa i\u015faret edilmi\u015ftir. Kanun\u2019un 57. maddesinde kolera, veba, lekeli humma vb. hastal\u0131klar tek tek say\u0131lmak suretiyle belirtilmi\u015f ve Kanun\u2019un 72. maddesinde bu bula\u015f\u0131c\u0131 ve salg\u0131n hastal\u0131klardan biri zuhur etti\u011fi veya zuhurundan \u015f\u00fcphelenildi\u011fi takdirde al\u0131nacak tedbirler aras\u0131nda \u201cHastalara veya hastal\u0131\u011fa maruz bulunanlara serum veya a\u015f\u0131 tatbiki de\u201d say\u0131lm\u0131\u015ft\u0131r. Ne var ki yine Kanun\u2019un 64. maddesinde \u201c57nci madde de zikredilenlerden ba\u015fka her hangi bir hastal\u0131k istilai \u015fekil ald\u0131\u011f\u0131 veya b\u00f6yle bir tehlike ba\u015f g\u00f6sterdi\u011fi takdirde, o hastal\u0131\u011f\u0131n veya her hangi bir hastal\u0131k \u015feklinin memleketin her taraf\u0131nda veya bir k\u0131sm\u0131nda ihbar\u0131 mecburi oldu\u011funu ne\u015fr\u00fc ilana ve o hastal\u0131\u011fa kar\u015f\u0131 bu kanunda mezk\u00fbr tedabirin kaffesini veya bir k\u0131sm\u0131na tatbika S\u0131hhat ve \u0130\u00e7timai muavenet Vekaleti Salahiyettard\u0131r.\u201d denilmek suretiyle, 57. maddede say\u0131lanlar\u0131n d\u0131\u015f\u0131ndaki hastal\u0131klar y\u00f6n\u00fcnden de 72. madde de say\u0131lan tedbirleri almaya (bu meyanda a\u015f\u0131 tatbikine) Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019n\u0131n yetkili oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Dolay\u0131siyle, \u00f6nleyici mahiyetteki genel ve zorunlu a\u015f\u0131 uygulamas\u0131n\u0131n yasal dayana\u011f\u0131n\u0131n bulunmad\u0131\u011f\u0131, belirlilik ilkesinin yoklu\u011fu nedeniyle kanunilik \u015fart\u0131n\u0131n ger\u00e7ekle\u015fmedi\u011fi yolundaki de\u011ferlendirmeye kat\u0131lmaya imk\u00e2n yoktur. Anayasa\u2019n\u0131n belirtilen h\u00fck\u00fcmleri ve gerek\u00e7eleri ile 1593 say\u0131l\u0131 Kanun\u2019un i\u015faret edilen d\u00fczenlemelerin a\u00e7\u0131kl\u0131\u011f\u0131 kar\u015f\u0131s\u0131nda, Devletin sa\u011fl\u0131kl\u0131 bir nesil yeti\u015ftirme ve toplum sa\u011fl\u0131\u011f\u0131n\u0131 koruma g\u00f6revinin bir par\u00e7as\u0131 olarak, genel ve zorunlu a\u015f\u0131 program\u0131 uygulamas\u0131nda herhangi bir hukuka ayk\u0131r\u0131l\u0131k bulunmamaktad\u0131r. <\/p>\n<p> Konunun, 5395 say\u0131l\u0131 \u00c7ocuk Koruma Kanunu \u00e7er\u00e7evesinde de\u011ferlendirilmesinde ise 18 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f, bedensel, zihinsel, ahl\u00e2ki, sosyal ve duygusal geli\u015fimi ile ki\u015fisel g\u00fcvenli\u011fi tehlikede olan, ihmal veya istismar edilen \u00e7ocuklar\u0131n (bu meyanda bebeklik \u00e7a\u011f\u0131ndakilerin) \u201ckorunma ihtiyac\u0131 olan \u00e7ocuk\u201d olarak de\u011ferlendirildi\u011fi, bu gruba girenlerin \u00fcst\u00fcn yararlar\u0131 g\u00f6zetilerek, Kanunda bir tak\u0131m \u201ckoruyucu ve destekleyici tedbirler\u201d \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, bu meyanda \u201csa\u011fl\u0131k tedbiri\u201dnin de say\u0131ld\u0131\u011f\u0131, bu tedbirlerin al\u0131nmas\u0131 i\u00e7in yetkili mahkemelere (\u00c7ocuk H\u00e2kimi, Aile Mahkemesi) ba\u015fvuru usul\u00fc ve \u015fartlar\u0131n\u0131n ve ba\u015fvurmaya yetkili ki\u015filerin Kanunda ayr\u0131nt\u0131l\u0131 bi\u00e7imde d\u00fczenlendi\u011fi, yetkili kurum olarak g\u00f6revlendirilen Aile Sosyal ve Politikalar Bakanl\u0131\u011f\u0131 \u0130l M\u00fcd\u00fcrl\u00fckleri\u2019nin \u201cgeni\u015fletilmi\u015f ba\u011f\u0131\u015f\u0131klama program\u0131\u201dnda yer alan zorunlu a\u015f\u0131lar\u0131n uygulanmas\u0131 esnas\u0131nda ebeveynlerce buna izin verilmemesi halinde, a\u015f\u0131 uygulanacak \u00e7ocu\u011fu (bebe\u011fin) \u201ckorunmaya muhta\u00e7 \u00e7ocuk\u201d olarak nitelendirilerek, mahkemelere ba\u015fvuruldu\u011fu ve \u201csa\u011fl\u0131k tedbiri\u201d talebinde bulunuldu\u011fu g\u00f6r\u00fclmektedir. Ba\u015fvurunun somutunda da, bu yoldaki sa\u011fl\u0131k tedbiri talebi mahkemece kabul edilmi\u015f; bu karara kar\u015f\u0131 vaki itiraz da \u0130tiraz Mahkemesince reddedilmi\u015ftir. Uygulamada derece mahkemelerinin, ebeveynlerin r\u0131zas\u0131n\u0131n \u015fart oldu\u011funa dair verdi\u011fi baz\u0131 kararlar oldu\u011fu gibi; bu ba\u015fvuruda oldu\u011fu gibi, \u00e7ocu\u011fun \u00fcst\u00fcn yarar\u0131 g\u00f6zetildi\u011finde sa\u011fl\u0131\u011f\u0131n korunmas\u0131nda bu r\u0131zan\u0131n gerekmedi\u011fi yolunda verilen kararlar\u0131nda bulundu\u011fu anla\u015f\u0131lmaktad\u0131r.
